Yes The United States Is A Constitutional Republic So We Often Hear Talk about the “Original Intent” of the Writers of the Constitution, but the Founding Fathers did not plan to create the political system we have today a democratic republic based on two national and permanent political parties. Indeed, “democracy” and “political parties” were dirty words to them. They did realize, however, that the world was likely to change, which is one reason they included an amendment process in the Constitution that has allowed this document to survive as our frame of government for so long.Show more

So I came out of High School in American back in [1984] with a reasonable understanding of this and the process and context which produced the constitution. It was required class for a year and I had a great teacher. Civics classes seem to have disappeared from school. I talk to people all the time who never got any schooling about civics and government. The fabric that holds society together has been forgotten by most. The lack of understanding leaves room for con men and scoundrels of all kinds to prey on peoples mis-fortune and take advantage. I think the results are clear. My generation has a lot to answer for in today world.

So At A College in New England about 30 years ago, some of the students decided to do a survey. They took a copy of the Bill of Rights(the first 10 amendments to the constitution) around to people. They pretended that they were circulating a petition to have them added to the constitution. Most people after reading them refused saying they these were to radical. I would have loved to seen some of those idiots reactions when they told them that it was already part of the constitution.

You got it right. The 1% doesn’t want us to know our rights. Our education system has defunded and dissolved the parts that help us be knowledgeable, allows us to enjoy life, that helps us see, and be aware of the importance of these rights. The arts, and as you stated civics and government, even home economics, and most importantly, the real history of America and the world.

The term original intent refers to the notion that the judiciary should interpret the Constitution (including its amendments) in accordance with the understanding of its framers. The courts’ commitment to original intent is somewhat tested, however, by the reality that the framers’ intentions are not always easy to identify.

Madison believed constitutional interpretation should rest on the intentions of the people who ratified the Constitution

Another factor is that it has never been clear to what extent the framers’ intentions are relevant to the task of establishing constitutional norms. Some even disagreed on this point. James Madison, one of the drafters of the Constitution, felt strongly that future interpretation of the document should not rest primarily on the intentions of the framers, but on the intentions of the people who, through their state representatives, ratified the Constitution. In part, this reasoning explains Madison’s decision not to make public for many years the notes he took at the Constitutional Convention.

Hamilton believed the Constitution’s text should control the interpretation

Alexander Hamilton, who signed the Constitution on behalf of New York, looked to the Constitution itself, believing that the text should control its interpretation. In his view, the Constitution spoke for itself; there was no need to go behind it to ascertain the intent of the framers. However, in what it says, the Constitution is liberal in granting powers to the national government.

Jefferson advocated for strict constructionism

Thomas Jefferson advocated still another method of constitutional interpretation: the rule of strict constructionism. Jefferson strongly asserted that the Constitution and Bill of Rights were grounded in the principle embodied in the Tenth Amendment: that all undelegated powers are reserved “to the states respectively, or to the people.” Yet even Jefferson violated his interpretive theory when, after originally concluding that the Louisiana Purchase required a constitutional amendment, he authorized the transaction without one.

Original intent of the Bill of Rights

It can be unclear what the framers were thinking when they drafted the Bill of Rights. The Bill of Rights was not a part of the document drafted at the Constitutional Convention in 1787. Almost all the delegates believed a bill of rights would be superfluous. The new federal government possessed only limited powers delegated to it by the states; no power had been granted to legislate on any of the subjects that might be included in a bill of rights. Therefore, an enumeration of rights was not necessary.

From late 1787 until 1789, the proposed Constitution was considered by the various state ratifying conventions. Meanwhile, a strong Anti-Federalist element developed quickly. The Anti-Federalists opposed ratification, fearing that the centralizing tendencies of the new document would crush the rights of states and individuals. For many of the states, the only solution to this problem was to mandate inclusion of a bill of rights. Indeed, six of the 13 states Massachusetts, New Hampshire, North Carolina, New York, Rhode Island, and Virginia accompanied their instruments of ratification with a list of recommended amendments that would secure various personal liberties, such as “rights of conscience,” “liberty of the press,” and “rights of trial by jury.” However, the records of the debates of the state ratifying conventions are of little help in ascertaining the precise meanings that such liberties were to assume.

Separationist and accommodationist ways of interpreting religion clauses of the First Amendment

The first rights enumerated in the First Amendment pertain to religion: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof.” Of the six states that recommended amendments to secure personal liberties, all but Massachusetts submitted proposals about religious freedom. Apparently, Massachusetts legislators did not feel that the Massachusetts religious establishments were in any way threatened by the proposed Constitution; they believed that the new federal government was to be impotent in matters of religion.

For the religion clauses, two basic interpretations of what the constitutional framers intended have emerged the separationist and the accommodationist. The separationist interpretation suggests a strict separation between civil authority and religion. Although governmental authority should protect the private “free exercise” of religion, no church or religious group should receive any form of governmental aid. The accommodationist view holds that the framers intended for the establishment clause to prevent governmental establishment of a single sect or denomination of religion over others. The framers, they contend, intended only to keep the government from abridging religious liberty by discriminatory practices generally or by favoring one denomination or sect over others. Neither view, however, was well articulated, nor can either claim to have represented the clearly understood meaning of the religion clauses in 1789.

Framers’ thinking is unclear in First Amendment rights

As for the remaining rights enumerated in the First Amendment, it is equally unclear exactly what the framers were thinking. Most scholars believe they were thinking rather broadly, with few restrictions on the rights enumerated. Virtually everyone agrees that First Amendment rights were fundamentally limitations on federal and not state power. Thus there was little reason to interpret the various rights. In fact, from the time the Bill of Rights was ratified in 1791 until World War I, Congress passed only one law restricting speech the Sedition Act of 1798. It was not until the Espionage Act of 1917 and the Sedition Act of 1918 that an intense debate over the meaning of the free speech clause began. That debate, like the meaning of all of the First Amendment rights, has largely played out in the courts.

As for freedom of the press, if there was anything close to a consensus in the founding era it was likely the common law view expressed by English jurist William Blackstone: “The liberty of the press is indeed essential to the nature of a free state; but this consists in laying no previous restraints upon publications, and not in freedom from censure for criminal matter when published” (Blackstone 1872: 4:151).

Few suggest that there should be no limits on speech, press, assembly, and redress rights. Rather, the debate is over where to draw the line between protected and nonprotected expression. In some areas, such as pornography and flag burning, it is exceedingly difficult to know where to draw the line. Individual interests are pitted against society’s larger interests, and the courts do the line drawing. Whether the courts’ decisions conform to the framers’ original intent will always be a matter of considerable debate.

The United States is a constitutional republic, not a democracy. The Founding Fathers ratified the U.S. Constitution to form a more perfect union, protect individual rights, and prevent the tyranny of democracy. The word "democracy" is not found in the Declaration of Independence nor in the Constitution. The Constitution was meant to foster a complex form of majority rule, not enable minority rule. The goal of government by the people, including both a democracy and a republic, was understood when the Constitution was drafted and ratified. Power is not found in mere majorities, but in carefully balanced power. The goal is freedom, prosperity, and human flourishing.

The United States is a Federal Constitutional Republic, where the people hold power but elect representatives to exercise that power. The Constitution provides the framework for how the federal and state governments are structured and places significant limits on their powers. The federal entity created by the U.S. Constitution is the dominant feature of the American governmental system, but most residents are also subject to a state government and various units of local government. A constitutional republic means that the people select some of their members to temporarily serve in political office, and both the citizens and their governing officials are bound to follow the rules established in that Constitution. A federal republic is one in which the federal government is given only limited powers for limited purposes, while state governments retain most powers of government.

A federal republic is a federation of states with a republican form of government. At its core, the literal meaning of the word republic when used to reference a form of government means: "a country that is governed by elected representatives and by an elected leader (such as a president) rather than by a monarch".

In a federal republic, a division of powers exists between the federal government and the government of the individual subdivisions. While each federal republic manages this division of powers differently, common matters relating to security and defense, and monetary policy are usually handled at the federal level, while matters such as infrastructure maintenance and education policy are usually handled at the regional or local level. However, views differ on what issues should be a federal competence, and subdivisions usually have sovereignty in some matters where the federal government does not have jurisdiction. A federal republic is thus best defined in contrast to a unitary republic, whereby the central government has complete sovereignty over all aspects of political life. This more decentralized structure helps to explain the tendency for more populous countries to operate as federal republics. Most federal republics codify the division of powers between orders of government in a written constitutional document.

The political differences between a federal republic and other federal states, especially federal monarchies under a parliamentary system of government, are largely a matter of legal form rather than political substance, as most federal states are democratic in structure if not practice with checks and balances. However, some federal monarchies, such as the United Arab Emirates are based upon principles other than democracy.

Otherwise, federal states primarily contrast with unitary states, where the central government retains many of the powers that are delegated to the subdivisions in federal republics. While there are exceptions, the overall tendency is for federal republics to be larger, more populous, and more internally heterogeneous than unitary states, with such larger size and internal heterogeneity being more manageable in a federal system than in a unitary one.

A Federal Constitutional Republic - Is Not To Be Confused With Federated State.

A federated state (also state, province, region, canton, land, governorate, oblast, emirate, or country) is a territorial and constitutional community forming part of a federation. A federated state does not have sovereignty since powers are divided between the other federated states and the federal government. Federated states are different from sovereign states.

Importantly, federated states do not have standing as entities of international law. Instead, the federal union as a single entity is the sovereign state for purposes of international law. Depending on the constitutional structure of a particular federation, a federated state can hold various degrees of legislative, judicial, and administrative jurisdiction over a defined geographic territory and is a form of regional government.

In some cases, a federation is created from the union of political entities that are either independent or dependent territories of another sovereign entity (most commonly a colonial power). In other cases, federated states have been created out of the administrative divisions of previously unitary states. Once a federal constitution is formed, the rules governing the relationship between federal and regional powers become part of the country's constitutional law and not international law.

In countries with federal constitutions, there is a division of power between the central government and the component states. These entities – states, provinces, counties, cantons, Länder, etc. – are partially self-governing and are afforded a degree of constitutionally guaranteed autonomy that varies substantially from one federation to another. Depending on the form the decentralization of powers takes, a federated state's legislative powers may or may not be overruled or vetoed by the federal government. Laws governing the relationship between federal and regional powers can be amended through the national or federal constitution, and, if they exist, state constitutions as well.

In terms of internal politics, federated states can have republican or monarchical forms of government. Those of republican form (federated republics) are usually called states (like states of the US) or republics (like republics in the former USSR).

What is a Gold Fringe Flag?
Have you ever walked into a court room and notice a gold fringe flag hanging in the room?

The gold fringe flag is not the same flag that is approved for our Constitutional Republic in USA code Title 4 Ch 1 & Ch 2. The fourth color (yellow) is not approved in the code. So, wait a minute? Our flags that hang in our government buildings and court rooms are actually representative of war-time in the law of the sea/admiralty law?? Yes. We are in fact, functioning in maritime admiralty law, and our court system is actually upholding a corporation that goes by the name of UNITED STATES. In other words, we are not in a republic, and we are not dealing with the constitutional United States of America. So, now it is up to us to figure out how to navigate our way through the law of the sea, in order to find our remedies. The possibilities for this are endless. But it basically boils down to either mastering the current system and learning how to navigate your way through it, without incurring personal liability for anything.
