The Murdaugh murder trial has been one of the strangest things I've seen in a Courtroom in over a decade of litigating cases. We're three weeks into a trial that was expected to take a total of 3 weeks, and it feels like the State has focused a great deal of time presenting evidence of financial crime. That said, it would appear the State made some progress in an exciting end to the week of testimony and evidence. The trial of former South Carolina attorney Alex Murdaugh is taking place in Colleton County, SC. The Manson Family Trial - a trial that lasted 9 1/2 months, including 22 weeks of testimony on behalf of the prosecution, strange outbursts and interruptions, every single attorney being threatened with contempt, a prosecution closing argument that included personal attacks of defense counsel, and a 7-day closing argument that was cut off when the court recognized it as a filibuster rather than a closing argument. At the end of the second week of the Murdaugh murder trial and it seems there are still questions outstanding. Murdaugh wasn't the only major legal news this week, with disgraced attorney Tom Girardi being indicted and Alec Baldwin charging instrument finally being released. The state is pushing hard to introduce abundant evidence of financial crimes to support a motive theory and the internet is ablaze with opinions in one direction or the other. Tom Girardi Indicted - disgraced former attorney, Tom Girardi (estranged spouse of Erika Jayne, from Real Housewives of Beverly Hills), has been federally indicted in California and Illinois on charges he stole more than $18 million from clients. Girardi is said to be suffering from dementia and both his and his law firm, Girardi Keese, are in active bankruptcy cases. Alec Baldwin Charges Finally Released - after announcing that charges would be filed against Alec Baldwin by the end of the month, the Santa Fe District Attorney formally filed charges on January 31st (technically by the end of the month, but come on...). It's been a busy week as we've seen the start of a trial several of us have long been interested in, the trial of disbarred attorney, Alex Murdaugh. Apparently, various attorneys, clients, and interested parties decided their New Year's resolution of becoming Public Relations specialists would start now! We've heard statements from the New Mexico District Attorney, Alec Baldwin, The Screen Actors Guild, Kohberger's Pennsylvania Public Defender (repeatedly), Sam Bankman-Fried, and the former Chief Compliance Officer for FTX, all in the same week! On the docket: FTX & SBF - there was a hearing today (1/20/2023) in the FTX bankruptcy case on the application of Sullivan & Cromwell, LLP to act as counsel to the various FTX debtors in the bankruptcy case. In the lead up to the hearing, Mr. Bankman-Fried took to social media to make a number of new statements, and the former Chief Compliance Officer to FTX actually filed a bombshell declaration on the eve of the hearing, making all sorts of accusations of improper conduct by Sullivan & Cromwell, LLP and others. Alec Baldwin Rust Charges - the New Mexico District Attorney announced that charges would be filed against Alec Baldwin and Hannah Gutierrez-Reed (armorer) in connection with the shooting of Halyna Hutchins on the set of "Rust". We've got an interview by the District Attorney, a statement by Alec Baldwin (via counsel), and a statement by the Screen Actors Guild, who decided to weigh in with their opinions. Brian Kohberger's Pennsylvania Attorney Interview - the court appointed counsel for Brian Kohberger, whose representation was limited to Kohberger's extradition to Idaho just keeps giving interviews, over and over again. On March 29, 1951, Julius Rosenberg and Ethel Rosenberg were convicted of espionage for providing classified information to the Soviet Union and were sentenced to death under Section 2 of the Espionage Act of 1917. The Rosenbergs were executed by the U.S. Federal government in 1953 at Sing Sing Correctional Facility in Ossining, New York, becoming the first American civilians to be executed for espionage charges and the first to receive that penalty during peacetime. It's the first Friday of 2023, and we've got some stuff to talk about... On the docket: The Washington Post published an article yesterday with the byline: "A group of online creators has skyrocketed to fame by covering every aspect of the meltdown, but some optimize for attention over accuracy". I'll give you three guesses as to the author of the piece, but I'm fairly certain you'll only need one. This "citizen journalist" (also a practicing bankruptcy lawyer) has some opinions on this traditional/corporate media narrative, specifically concerning the SBF & FTX coverage, so let's talk about it. Samuel Bankman-Fried Bond Modification & Asset Seizures - SBF plead "not guilty" on Tuesday in the Southern District of New York. The hearing was notable for two additional reasons: (1) the Court granted SBF's request to seal the names of the two additional sureties to his $250M bond (not his parents); and (2) the Court modified his bond conditions to prohibit him from accessing/transferring any FTX or Alameda assets (or anything purchased with FTX or Alameda assets), to the apparent chagrin of his attorneys. This leads us to our 3rd matter on the docket... FTX Bankruptcy Update - FTX Trading Ltd. (and 101 affiliated entities) filed for Ch. 11 bankruptcy protection on November 11, 2022. In under 2 months, there have been 387 docket entries in the bankruptcy matter, with some serious amounts of tension. For those of you who think bankruptcy is boring, it was a 2 min appearance at the bankruptcy hearing on Jan 4th where we learned that the DOJ had seized several additional accounts, including $450 million in Robinhood stock titled to Emergent (90% owned by SBF). What was the 387th docket entry??? I'm glad you asked. Dkt. 387 is SBF's first filing in the bankruptcy, asking the bankruptcy court to kindly allow him to have access to those Robinhood shares. It's that magical time of year for so many households, when families gather and exchange gifts. FTX Bankruptcy Update - the fight between FTX Global (consolidated cases of U.S. bankruptcy filings) and the Joint Provisional Liquidators (JPL - the Bahamian liquidators of FTX International) continues to escalate. Imagine a corporate darling of finance, one of the largest and most innovative companies in the world, an industry leader with capable management at the helm that showed nothing but promise, with financial statements and outlooks to support that feeling of optimism. Then imagine that market giant collapsing into a void of financial losses and scandal. When you imagine this financial giant, what company do you think of? FTX? Close, but think older... Theranos? Closer, but just a little bit further back... That's right, ENRON. At the turn of the century, Enron was the talk of the town; it was the largest seller of natural gas in North America, the fifth largest corporation in the U.S., and according to Fortune magazine, it was the nation's "most innovative" large company. Just a few months later in November of 2001, Enron's stock price crashed almost overnight and on December 2, 2001, the company filed for bankruptcy. After the fall of Enron, investigators uncovered evidence of corporate arrogance, greed, and fraud of an unprecedented level. IS ANY OF THIS SOUNDING FAMILIAR YET?!?! Ken Lay and Jeff Skilling served as Chief Executive Officer for Enron (at different times) and were indicted on charges including conspiracy to commit securities fraud, four counts of securities fraud and two counts of wire fraud, one count of bank fraud and three counts of making false statements to a bank facing charges of fraud, insider trading, and conspiracy. Today marks the 20-year anniversary of the day that five men, Antron McCray, Kevin Richardson, Korey Wise, Raymond Santana, and Yusef Salaam (known now as the "Central Park Five") were exonerated by DNA testing that corroborated a 2001 confession by a convicted serial rapist and murderer, Matias Reyes. These 5 men were wrongfully convicted of raping and assaulting a female jogger in Central Park on April 19, 1989, based, in part, on false and coerced confessions. In all of the reporting this week regarding the charging and arrest of Samuel Bankman-Fried, the media has missed some of the biggest details that were filed in the bankruptcy proceeding in Delaware. I'm not being hyperbolic when I say that I'm shocked we haven't seen front page coverage of the allegations being made (and, more importantly, the receipts attached). And then, as has been so typical with this show - of course, we've got a last-minute addition to the docket because a new brief was filed in the Depp v. Heard appeals. Buckle up, because here. we. go. On the docket (UPDATED): Depp v. Heard Appeal - Depp filed his reply brief in his appeal of the $2 million judgment that was entered in favor of Heard and against him. Recall that this is the appeal filed by Depp, so this is the 3rd and final brief of the issues raised in his appeal before oral arguments. Let's take a look. FTX Bankruptcy, Bahamian Securities Commission, and Samuel Bankman-Fried - a fight is underway in the FTX bankruptcy case between FTX Global (consolidated cases of U.S. bankruptcy filings) and the Joint Provisional Liquidators (JPL - the Bahamian liquidators of FTX International). Let me ask you this - what's the connection between SBF's constant reference to being unable to access his passwords/data have to do with the Bahamian Securities Commission, the fight between FTX Global and the JPLs, and SBF's renewed application for bail??? Samuel Bankman-Fried (SBF), Ex-CEO of FTX, was arrested in the Bahamas on December 12, 2022. A Federal Grand Jury Indictment filed in the U.S. District Court for the Southern District of New York was unsealed this morning, and complaints have been filed by the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC). All of this happened on the eve of a hearing before the U.S. House of Representatives Committee on Financial Services, at which John J. Ray III (replacement CEO) testified. It also appears that SBF's written testimony was provided to the Committee in advance of the hearing, and the remarks he intended to deliver are pretty unbelievable. Let's go through the relevant filings, highlights of testimony, and where things go from here!

A class action lawsuit was filed against Samuel Bankman-Fried and members of the FTX inner circle by Jay Edelson of Edelson PC (yes, the same Jay Edelson from the Tom Girardi case) on behalf of a class of plaintiff, defined as "All persons in the United States who had bitcoins, other cryptocurrency, assets or money stored with FTX on November 10, 2022 [the day FTX filed for bankruptcy relief]." Let's review the Complaint!

After a week off I'm thankfully back to firing on all cylinders, and it's a good thing because we have a lot to cover. Spoiler Alert - this is going to be a fun one... On the docket: Depp v. Heard - I feel like the last time I spoke with ya'll, we were reviewing the amicus briefs themselves. Well, how about this for timing? Ben Chew filed an omnibus ("for all" / addressing 2-or-more things) opposition to the motions by the Amici for those briefs to be considered, which is filled with the amount of snark we've come to expect. What's worse - the Amici filed a supplement to their briefs, essentially compounding their original mistake and admitting failings in their brief. This should be an interesting read! Jessup v. Sam Bankman-Fried, et al. - I'm sure we'll chat about SBF's monumental week of social media and interview tomfoolery (especially after he actually hired an attorney to insulate against such recklessness), oh - and of course congress doing the chest-thumping we've come to expect from our elected politicians, BUT I DIGRESS. On Monday, Jay Edelson (yep, the same Jay Edelson from the Girardi coverage) filed a class action lawsuit against SBF, Caroline Ellison, Nishad Singh, Gary Wang, and Sam Trabucco (inner circle at FTX and Alameda Research), and it's definitely worth discussing! Boston Police discovered the body of a 34-year-old bank manager on July 5, 1972 inside an apartment occupied by Robert Anderson (20 years old). After breaking a window, leaping from the apartment, and running from police before his eventual arrest just days later, Anderson pointed a motivated finger at Anthony Mazza (25 years old), whom he had met months earlier and had allowed to stay at the apartment for a few days. Mazza and Anderson were both charged with murder, but Anderson's charges were dropped after he testified before the grand jury. As you might imagine, Mazza's trial featured lengthy testimony from Robert Anderson, with additional testimony from Robert's younger brother, William Anderson. Anthony Mazza was convicted on April 3, 1973, and was sentenced to life without parole. Big happenings this week, so let's break them down. On the docket: FTX Crypto Exchange Bankruptcy - so as you may know, I practice in two fields: domestic relations & bankruptcy, so I've been following the FTX bankruptcy pretty carefully. Based on the filings to date, I'm going out on a limb and saying that this bankruptcy gives all indication of being more expansive, complex, and downright nasty than Girardi, Puerto Rico, Enron, Lehman Brothers, etc. Let's take a look at what was filed this week and discuss why. Open Letter Supporting Amber Heard & Possible Amicus Brief - an open letter was supporting Amber Heard was signed by more than 130 individuals, organizations, and "experts". I have thoughts. Dr. Samuel Holmes Sheppard was arrested on July 30, 1954, for the murder of his wife, Marilyn Reese Sheppard, who was found dead on July 4, 1954, in the marital home, just outside of Cleveland, OH. Sheppard claimed that a bushy-haired intruder had killed his wife, who he then chased to the beach where he was knocked unconscious. Sheppard maintained his innocence, but Cleveland newspapers demanded his arrest, alleging that the family was conspiring to shield him from authorities. After a 9-week jury trial (described as a "carnival atmosphere"), Sheppard was convicted of 2nd degree murder and sentenced to live in prison. He remained incarcerated until, ten years later, F. FTX is a cryptocurrency exchange based out of the Bahamas and founded in 2019 by Sam Bankman-Friend (SBF). FTX peaked with over 1,000,000 users and was the 3rd largest crypto exchange by volume. FTX faced liquidity issues and, despite the assurances of SBF, filed for bankruptcy relief under Chapter 11 of the U.S. Bankruptcy Code on November 11, 2022. In the days leading up to FTX's bankruptcy filing, it's founder and then-CEO took to Twitter to express his apologies for the current state of affairs and ensured the world that things would be just fine.
