And, as an extra precaution, only two of the auditors are selected to be entrusted with the information after about eight thousand Members of the Academy cast their votes, and the votes are tallied, and those selected individuals are required to memorize the names of the winners in at least 27 individual categories, prepare two envelopes in which to place the names of the winners of the Oscars, to be placed in a vault at an undisclosed location, apparently far more precautions than members of the executive branch take with secret compartmented information (SCI). Yet, if you believe that that is impressive, imagine the security required to keep it under wraps that the emcee selected by the Academy was not only the lead defendant in a suit brought under the federal racketeering statute but had also managed to evade disclosure of the fact since May 2022, a case that can only be brought with at least two allegations regarding commission of the vilest felonies in the U.S. criminal code, from murder to conspiracy to commit transnational terror.
Perhaps it helps when the defendant is joined by American Broadcasting Company, which hasn’t even broadcasted a story on Good Morning America, but you would think with the robust fact-checking operation demonstrated so well during a once-in-a-lifetime global public health crisis, certainly, reporters like Mary Kekatos or even George Stephanopoulos could make mince meat of any false information; so, why did ABC News elect a right to remain silent, joined by WUSA9, DC’s News Channel 8? As Marty Johnson used to say on Laugh In: Very interesting.
But, fresh from a rap video debut, the ever-interesting Major Mike Webb has prepared an entertaining and informative video regarding some Oscar “winners” in advance, and maybe on March 23rd, with the airing of the 95th Annual Oscar Awards, the publicists at the Academy of Motion Pictures and other Hollywood elites will not have to grab another Best Actor Award winner to pretend an open hand slap was an actual event, and not just some silly publicity stunt.

And he notes that, while during a pandemic he could easily establish standing in courts to address a global public health crisis and the disjointed government response to a novel coronavirus, especially having been girded by experience as essentially a former biological warfare planner in strategic counterintelligence, in the escalating opioid crisis, despite experience both in counter terror, the new putsch, and counternarcotics operations, the human choices that even Dr. Rochelle Walensky had conceded had not served the majority of the opiated masses well in a pandemic involving a virus that isn’t stupid, have again already raised their preferences, louder than kids for personal pronouns, and, at the present anticipates no engagement opportunities to enjoy his retired life of leisure as a litigation hobbyist.

Reporting live from the world’s newest banana republic, Congressman Don Beyer, Jr., who, at least according to the Washington Post had scored “almost perfect SATs”, certainly impressed the over 75% of voters in one of the most educated, by credentials, congressional districts in the nation, with the highest concentration of government scientists, when he told reporters that he spent time doing multivariate equations homework for his precalculus course at George Mason University, and most probably didn’t know that he already had the worst roll call voting record in the entire Congress. But, apparently “Donny Come Lately” is one helluva salesman, because he actually sold his district on leading the congress in proxy votes during a once in a lifetime pandemic crisis, and even got faith leaders to endorse his pride in four kids who had rejected God, church and religion. And, as the nation ponders how the Intelligence Community and fully vaccinated defense establishment missed spy balloons from China, apparently on multiple occasions letting them, you know, escape, wait until they discover that had they read the reports from the Proceedings for the National Academies of Science (PNAS), they may have been a bit hesitant in 95% vaccinated Arlington to sign up for a COVID-19 countermeasure that had been developed without the prerequisite knowledge of infectious dose to ascertain the proper correlates of protection to develop an effective, and not just efficacious vaccine, without requiring a large sample size phase three clinical trial.
Remember the surprised look in the Project Veritas Gotcha video? Imagine when those following the science hear this about the clinical trial in which they volunteered apparently fully informed, assuming as high as a 36% risk for serious adverse events associated with the Pfizer product alone, translating into around 18% of the American population at risk for a clear and present danger from the “safe and effective vaccines”, are able to process that they did all of this, closed businesses, churches and schools, and postponed vacations and fine dining for not only a disease with only a 1.1% case fatality rate, but also, at least according to PNAS, a disease in which there is only a 0.37% chance of finding even one COVID-19 virion in a droplet measuring 10 microns or below, trailing off exponentially the smaller the droplet is.
“If you’re ever invited to a soccer game and can’t see the ball, don’t volunteer to play goalie, I always say. And this pandemic takes double blind studies to a whole new level,” remarked Major Mike Webb, a former biological warfare planner, still apparently tickled by the thought of a blind goalie in pandemic socker, before falling on the floor in uproarious laughter saying what sounded like “Cookies!”
This Wednesday Webb takes on Alexandria Prosecutor Bryan Porter to bring a case to compel a grand jury investigation into the infections of the former pastor of the First Baptist Church of Alexandria, and one well-known family in that congregation, who had been featured in the Washington Post, asking what were the odds, while a case brought against five historic Black Churches from Harlem to Atlanta for a vaccines only worship policy continues to work its way through the federal court in Alexandria. And in his free time, the former childhood protege of a legendary civil rights and criminal defense attorney is awaiting watching the Academy Awards to hear the jokes about his racketeering case against late-night talk show host James “Christian” Kimmel, who had begun promoting vaccine absolutism in March 2015, around the same time that Chapel Hill-UNC had collaborated with the Wuhan Institute of Virology, a class of government scientists for which the Intelligence Community had assigned a low to moderate risk of permitting lethal and contagious biohazards to escape, to cultivate a virus in vitro, for the very first time, and, ironically a SARS-like, chimeric coronavirus, for which they immediately applied for a patent on methodology. Intelligence sources are still awaiting reports regarding the balloons the size of six commercial busses that may have been missed flying over North Carolina, while folks were looking for UFOs—we mean unexplained aerial phenomena.

Alexandria Prosecutor to Argue Why He Is Not Compelled to Investigate Murder Cases

Reporting live from the world’s newest banana republic, he attended night law school, and he had run unopposed in his last election, capturing 97% of the vote in Alexandria, Virginia, a suburb of the nation’s capital, and, perhaps, when it comes to the pinnacle of jurisprudential scholarship, Bryan Porter, who has even written a book about one of his murder trials, the Charles Severance murders, has decided to argue pro se, without retaining legal assistance, the proposition that the state law prescribing duties of a Commonwealth Attorney, codified at Va. Code § 15.2-1627(B), which expressly states that “[t]he attorney for the Commonwealth and assistant attorney for the Commonwealth shall be a part of the department of law enforcement of the county or city in which he is elected or appointed, and shall have the duties and powers imposed upon him by general law, including the duty of prosecuting all warrants, indictments or informations charging a felony,” in no way, shape or form compels him to investigate or prosecute a felony., while carefully shaping his arguments to convince members of the First Baptist Church of Alexandria that his decision not to investigate has anything to do with their Southern Baptist Churches, evangelical Christian religion.
Although students in the public schools of Northern Virginia may not have learned their Black History, certainly they should have become familiar with one of the most famous cases, Marbury v. Madison, which involved a petition for writ of mandamus, a legal cause of action that Porter, a former contestant on Jeopardy, who claims he has even taught a few courses in constitutional law, had claimed last year did not even exist, describing the plaintiff’s allegations as “inscrutable”, or perhaps the founding days of the republic were not a part of the curriculum at T.C. Williams High School.
“It is always a delight to argue against Bryan in court because you never know what he is going to do. And, obviously, if he has yet to bring this case himself, without my filing a case to apprise him of the science that at least a former biological warfare planner knows, we must assume that he is not favorably inclined to take up this case for consideration. So, we will be going back to basic science, the way that Robert Koch, the father of the modern understanding of infectious disease, and proceeding through Koch’s Postulates, as he had done in 1870, to use this methodology to explain the infections of Pastor Don Davidson, his wife and the Graveson family, which even Washington Post had suggested had defied the odds. I hate to have to be the Jesus freak who has to explain basic science in the congressional district with the most government scientists, but we have 95% of the residents in the most educated, by credentials, municipality who volunteered to be administered a COVID-19 countermeasures product, developed without the prerequisite knowledge of infectious dose, and taking that chance of what a damning peer reviewed report in August assessed as a 36% risk for serious adverse events from the Pfizer product, just to avert an infection from a disease with a 1.1% case fatality rate, most lethal to those over the age of 65, with at least four comorbidity factors, or at least that is what the science reports say, and I never heard that on NPR,” smiled Major Mike Webb, a graduate of the most competitive private college in the Commonwealth, and he ain’t really Black; so don’t look for his name on the Washington & Lee University Black History Timeline.
Next month, Webb will be taking on Stacey Davenport, the first woman to be elected Commonwealth Attorney in Chesterfield, arguing a similar case arising from the death of Bishop Gerald Glenn, the former Senior Pastor of the New Deliverance Evangelistic Church, who had, along with 30 other Black Pentecostal faith leaders, died in a Valentine’s Day Massacre, attributed to a novel coronavirus before the celebration of the first Easter in pandemic. Not even his “good friend”, Senator Tim Kaine, the poster child Christian Democrat, and former prosecutor and criminal defense attorney, took up this case on his behalf.

One “hypocritical Christian” brought a case of first impression, bringing a case under the provisions of the Freedom of Access to Clinic Entrances (FACE) Act providing a civil remedy for the unlawful blocking of access to a place of worship. One “hypocritical Christian” sued the Governor when he had encouraged gay men to celebrate La Vie Boehme during Pride Month in a pandemic that found over a thousand breakthrough infections one month later in Provincetown amongst gay men, reveling and celebrating under the false perception of security and immunity. And now one “hypocritical Christian” who grew up in Black Church, but, apparently, today, “ain’t really Black”, has a case in federal court against Black Churches from Harlem to Atlanta, which have closed their doors to the unvaccinated, but in his last correspondence one man from Tarsus said that when he began no man stood with him, and as he wrote, “only Luke is with me now.”
According to the oft-quoted Rev. King, himself quoting the theologian Reinhold Niebur, had said that “groups tend to be less moral than individuals,” and, sitting alone in a Birmingham jail had confessed that he “wept over the laxity of the church”, that he “meeting young people every day whose disappointment with the church has risen to outright disgust”, and that “[s]ome have been kicked out of their churches, and lost support of their bishops and fellow ministers”. Rev. King had expressed a “hope the church as a whole will meet the challenge of this decisive hour”, and quoted T.S. Elliot, stating that “there is no greater treason than to do the right deed for the wrong reason.”
Rev. King had observed that, even in his day and age, “so often the arch supporter of the status quo”, and that “[f]ar from being disturbed by the presence of the church, the power structure of the average community is consoled by the church's silent and often vocal sanction of things as they are”, and spoke of an earlier church, albeit “small in number but big in commitment”, who “were too God-intoxicated to be ‘astronomically intimidated’”, and Rev. King said that “[w]henever the early Christians entered a town the power structure got disturbed and immediately sought to convict them for being ‘disturbers of the peace’ and ‘outside agitators.’” And while when Senator Corey Booker looks at Justice Ketanji Brown Jackson, he sees himself, one case currently before the federal courts asks, when you look at that description, as a Christian, does that honestly look like you?

Swimming with the Sharks: A Day in Court
THE CIVIL RIGHTS THE NAACP AND THE ACLU WON'T TELL YOU ABOUT
Ask any progressive law professor on constitutional law, like Rutger's Professor Ann Freeman, and they will tell you that Frederick Douglas was an "aspirational" leader, and who doesn't immediately think "dream" when referencing "Dr. King", removing any suggestion of religion from the preacher and son of a preacher? But at least Langston Hughes had asked the question about what happens to a dream deferred, providing the basis for the raisin in the sun that became the title of the Lorraine Hansberry play that bore that name, and that had starred on Broadway Ralph Carter, who would later become Michael Evans on Good Times.
And, once again, I am heading to the U.S. Supreme Court, marking my seventh potential chance to have a case docketed for certiorari, one of less than 7,000 cases each year that enjoy that distinction, and a formidable task for even an attorney, and, so, far much more daunting for an unrepresented litigant.
One thing to remember about the Supreme Court is that, for the most part, it is not what an attorney would describe as a court of original jurisdiction, where you would commence litigation, but, rather it is generally an appeals court, requiring someone first to identify an objection that is preserved in the record to raise as an assignment of error, a process with which most unrepresented litigants are wholly unfamiliar.
And, just like if it isn't in the contract you can't do it, a court cannot read your mind, nor try to do so; and what you bring to the court is just about all that will be considered, and if you forgot to raise a point, that's on you.
Accordingly, it is not quite surprising that this is not an argument that is often raised, because unrepresented litigants don't know about appeals, may get tripped up trying to file the appeal, trying to sort through the rules that apply just to begin, and would probably not be familiar with the law or even precedents that have been developed in this particular area of law regarding pro se litigants, or people who have decided, for whatever reason, to represent themselves in court.
Well, if you can't afford an attorney, and will not be appointed one by the court in civil litigation, you probably will have a struggle coming up with the fees required to pay for your statutory right to a day in court, which actually are far more substantial than registering your firearm or obtaining a carry permit, but notice that nobody ever raises this argument, not even the NAACP or the ACLU?
Of record, over 74% of the cases involving unrepresented litigants bringing civil litigation are those who are "mass incarcerated", to use the ACLU term, and over 33% of the cases being brought are for civil rights, the area of expertise for the "oldest and boldest civil rights organization", the NAACP Legal Defense Fund, who apparently believe that the most important right for you is the franchise, if you use it to vote for Democrats who donate to keep them in business. A little conflict of interest?
Think of the application to proceed without payment of fees, or to proceed in forma pauperis, the Latin term, as an application for credit, which, even for folks in prison sitting maybe on a fortune of cigarettes can be denied. However, since 1950, it has been determined that you can file for an appeal of that "credit denial", but you have to submit another "credit application", or have to pay the fee to get a decision for that appeal, which is about a hundred dollars more than the original fee you claimed you could not afford, effectively saying you have no right to appeal if you are poor, and you need to just suck it up, pay the original filing fee after your application is denied, and hope you don't have to submit an appeal when you lose at the court that denied your credit application.
Intriguingly, on this issue, it has been the conservatives, like Thomas, O'Connor and Scalia who have dissented when this has come before the courts, arguing that a person has a right to a day in court and a trial on the merits, and not any progressives. And, now, without the support of the ACLU or the NAACP, it is a conservative bringing this case to a conservative Supreme Court, while the NAACP is submitting an amicus brief, or friend of the court memo, just to say they agree with the position somebody else took, and not filing a case themselves, on voting rights that are supposed to be their priority.
Of course they will not tell you that side of the story when they beg for your money, but let's just say I am keeping it real, and speaking truth to power, and I ain't really Black.

Reporting live from the world’s newest banana republic, one of the chief criticisms of organizations like the NAACP is that in public schools they are never taught their history, a raging battle in education currently capturing national news in Florida, but one pesky independent finds that even his current events, which have included a half dozen cases docketed for certiorari at the U.S. Supreme Court don’t even find a morning note mention in the daily press, but such is the life of the “ever-interesting Mike Webb”, and, of course, he “ain’t really Black.”
One reason, perhaps for the cone of silence, is that there are “security reasons” to censor the comments of a man who had served as the most junior commissioned officer to have ever served as the operations officer for all U.S. Army strategic counterintelligence, but, stolen valor blogs seem to suggest that he had lied about his military record. However, were you an incumbent legislator, who could only claim generally that you had been a “lifetime environmentalist”, with no specifics, a graduate of Tulane University Law School, with no significant cases to mention, and, seeking to appeal to voters in a house district with at least 26% Latino voters, to state that your father was an illegal immigrant from Venezuela, only first mentioning the fact in 2017, at a candidate forum, after having served two terms in Richmond, and framing that admission within a context of feeling ashamed, you would not, by credential match a godson of the first Negro Chairman of the House Budget Committee and first Negro House Majority Whip.
Imagine running against the former childhood protege to a legendary civil rights and criminal defense attorney, who had represented high profile clients, to include Angelo Errichetti in ABSCAM and Reuben “Hurricane” Carter. If you added to that graduation from the most selective private college in the Commonwealth, assignment in the elite 75th Ranger Regiment, former army top spy, third generation college graduate, third generation military officer, and third generation of Negroes born free after the Emancipation Proclamation, apparently the document that abolished slavery when it was read to slaves in Galveston, and a maternal great grandson of a Jewish immigrant from Germany who had come to America through Ellis Island, you would probably want a little censorship. It’s just common sense.
And, now, with the focus on voting rights being preached in the pulpit of America’s Freedom Church, by a sitting President, the “passionate” son of a preacher man, Major Mike Webb, decided to produce a video about his never discussed grandfather, an actual franchise martyr, while he battles with the progressive Arlington Democrats and the Board of Elections, once more, just to have his name placed on a ballot. But at least the NAACP can celebrate a right to vote, as long as they vote Democrat, and for the candidates they are told to support, which is nothing like being a slave, apparently.
And, remember to get your booster, when it is your turn.

The Lord Will Make a Way Somehow: We've Come This Far by Faith
A DRUM MAJOR FOR JUST US?
In Black Church, where the President says he used to go when he was younger, a common saying is that "Church folks is a mess." But, at least if you grow up in Black Church, and happen to be that son who has been pretty much selected to be the son who continues the family tradition, you are probably going to hear quite a few sermons about Jesus.
And, you may happen to notice a pretty consistent pattern developing in every sermon in which Jesus is having some discussion with His disciples, which tend to take on the character of those pesky emails of a man named Saul from Tarsus, who decided to stop persecuting Christians and begin spamming a few churches.
And, by today's standards, one might get the conclusion that Jesus was hating on His disciples, and Paul was hating on churches. But one rather famous speech, about which most, like the I Have a Dream, and Mountaintop Speeches, most only remember only one line, Rev. King had discussed a Drum Major Instinct, and had noted that he had wanted to be a drum major for justice. But he actually begins this homily in the synoptic gospel of Mark, in a particular exchange with his top disciples, in which the problematic accounts amongst even the sons of Zebedee during the Transfiguration are pretty glaring even before Jesus decides to get essential and provide some instructions.
And, while going into the observance of the birthday of the Drum Major for Justice, perhaps a good reading of that sermon might be a good idea for making good use of the holiday, for those interested in "extra credit", with the President delivering the sermon in the pulpit of Rev. King's church on his birthday, one might recall Rev. King's last speech, where he did specifically state that when he was in a hospital, after being stabbed with a letter opener, by what he had described twice as "a deranged black woman", he said he had received a letter from the President and the Vice President, as well as a telegram from the Governor, but did not remember what they said.
But the biblical story that had immediately come to mind when I learned that the President had suddenly decided to go down to Atlanta to preach in Rev. King's pulpit, during what he had described, like Dr. Benjamin E. Mays before him, as "the most segregated hour in America", and during not the in-person, vaccinated only, no exceptions earlier service, but at the online virtual service (a little public relations gaffe), was the background reference material in 2 Chronicles, Chapter 26, on that footnoted king in the verses in Isaiah 6, about that greater prophet's calling, and the year in which he had also seen the Lord, but high and lifted up.

First Contact: No Plan Survives
R&R IN PANDEMIC?
During a two-year public health crisis, during which period schools decided to close their doors, without hundreds of students rising in protest, probably lacking the sense of urgency found in existentially imperative issues, like preference in personal pronouns, and being able to pee wherever you want, reading scores hit 30-year lows, and mathematics scores dipped below where they were when the nation began tracking this basic education metric.
Is reading important in a public health crisis?
The WHO report in China in February 2020, appeared to suggest it was, noting that, after only a month, schools in China, specifically the Huanan Province, the only region affected by the draconian lockdowns, were beginning to reopen, providing an advantage vis a vis nations that decided to close schools for two years, and expressly stating that fully educating the public would be of the greatest benefit in prevention and mitigation, but, if you never read that report, you wouldn't know that, and the concept of replicability of results, one of the two R&Rs that are the basis of the scientific method, would impair your ability to gain a complete picture of a global phenomenon. All things being equal, a disease should, by results and outcomes, look generally the same in science reports, and if you assume that COVID-19 acted like that, you didn't read the world reports.
And, while Bible sales were breaking records for articles of religious faith that found actual Bible reading dip to historic lows, the author of that robust study, completed after 1,800 teams of epidemiologists had examined 55,924 laboratory-confirmed cases in China--19 times more cases examined than had yet been reported in the entire U.S. by mid-March 2020, and their trace contacts, a process hailed by the CDC during the ebola crisis in Zaire as the key to disrupting the spread, that had been almost entirely blown off worldwide, had lamented in an interview in early March 2020, that nobody appeared to have read his 40-page report, which, in case you missed it, stated expressly: "it is not clear whether this correlates with the presence of an infectious virus", and, empirically, based upon the vaccinations, we may fairly conclude, empirically, over 80% of Americans, who had heard "immunity", and were deafened to the sound of "defense" in Defense Production Act, used during the development of countermeasures products designed to address a significant threat to uniformed members of the active-duty military, and citizens residing abroad, according to the Emergency Use Authorization Declaration, on March 27, 2020, did not get that memo.
Is math important in a public health crisis? There were certainly a lot of percentages tossed around, which tends to involve some understanding of math, and if you were convinced about 90% efficacious, distinct from effective, "vaccines", but oblivious to a 1.1% case fatality rate, in the U.S, or a less than five percent secondary attack rate found in China, for purposes of reproducibility you had received low marks as a "global citizen", and also failed on the notion of replicability, often described as computational replicability, which is the global language with which scientists communicate in laissez-faire debates, without censorship, politics and ad hominems, to advance science.
And, by coincidence, a correlation that does not necessarily mean causation, at least the National Academies of Science had considered the terms "reproducibility" and "replicability" so important in 2015, when down at UNC-Chapel Hill they were teaming up with WIV to cultivate the first ever virus in vitro, which happened to be a SARS-like coronavirus, and obtaining a patent for a spike protein for their chimeric creation, which, by vocabulary definition would imply some animal genomes not usually found might have been included, explaining that aberrant from nature ophidian codon usage bias discussed in the report by Wei Ji, et al. in March 2020, that they dedicated over 250 pages to the topic, obviously of no great concern even to voters who voted for the science, and decided to be administered products about which the developers admit they did not yet understand the correlates of protection or even the mechanisms that could have made their product effective, in addition to whatever collateral processes were occurring in the body, or why we use the term "efficacious", and not "effective".
And, if you volunteered to have an experimental substance injected into your body about which the developers did not yet know the effects, face it, pal: you actually are a guinea pig, by the science.

Why Does Rice Play Texas?
Seasonal Greetings!I believe it was Jim Garrison who in 1969 in New Orleans had quoted Tennyson, stating that authority forgets a dying king." And, although in the past my success in simply receiving a response under the FOIA provisions, first signed into law under President Lyndon Johnson, have been disappointing, even given the statutorily codified right to injunctive relief, and the priority of action for matters presented to the courts under this provision of law, as stated in 28 U.S.C. Section 1657, the President has himself recently acknowledged that I am "passionate", and like with COVID-19 countermeasures developed with no knowledge of infectious dose, in evolving science, if at first you don't succeed, try, try again.
According to the National Archives, approximately 515 documents remain withheld in full and an additional 2,545 have been withheld in part, many belonging to the CIA, an executive branch agency.
Apparently, the CIA has held back documents pertaining to whether it had an operational interest in Oswald at the time of the assassination, an interest apparently that missed the fact that, at least according to the Warren Commission, their possible person of interest was about to assassinate the President, a significant failure of intelligence if true.
However, as you are aware, Aljazeera has reported that "a newly released September 1964 memo to the presidential commission investigating the assassination said 'the Central Intelligence Agency has no indication that Ruby and Lee Harvey Oswald ever knew each other, were associated, or might have been connected in any manner'".
Moreover, as the Washington Post had reported, "A December 1963 document described how CIA officials in Mexico City 'intercepted a telephone call' Oswald made in October from that city to the Soviet Embassy there 'using his own name' and speaking 'broken Russian,'" which suggests some level of interest.
A CIA spokesperson has said that t "CIA believes all of its information known to be directly related to the assassination of President John F. Kennedy in 1963 has already been released."
Furthermore, they have at least proffered as pretext the justification that "the continued redaction of some documents, saying they contain information that details CIA intelligence sources and methods — some from as late as the late 1990s, given to help provide context about the CIA’s methods and terminology."
Yet, under Executive Order 12,958, National Security Information, April 17, 1995, Section 1.1, the President is the ultimate original classification authority and all other agencies have delegated derivative authority. Accordingly, in the public interest, as a candidate for Delegate in Virginia's 49th District, and hence entitled to a fee waiver, I am requesting the immediate release for the American people, subject to judicial review in camera, as authorized under U.S. v. Nixon, 418 U.S. 683 (1974), regarding the President's recent assertion of executive privilege, of the remaining documents pertaining to the assassination of President John F. Kennedy on November 22, 1963 in Dallas, Texas. And "it is emphatically the province and duty of the judicial department to say what the law is." Marbury v. Madison, 1 Cranch 683 (1803). As all are aware, or should be aware, under Executive Order 12,333, United States Intelligence Activities, December 4, 1981, Section 2.11, "No person employed by or acting on behalf of the United States Government shall engage in, or conspire to engage in, assassination."
However, as a matter of public policy, this is not codified as a misdemeanor nor felony under the provisions of the criminal code and has been recognized exclusively in the case of conventional military operations, counterinsurgency operations, and peacetime counterterrorist operations.
Moreover, there is granted recognized exceptions in the case of any clandestine, low visibility or overt use of military force against legitimate targets in war, or against similar targets in time of peace where such individuals or groups pose an immediate threat to the United States citizens or the national security of the United States, as determined by competent authority.
Still , "no power can be exerted to that end by the United States unless, apart from the Preamble, it be found in some express delegation of power or in some power to be properly implied therefrom." Jacobson v. Massachusetts, 197 U.S. 1 (1905) (1 Story's Const. § 462).
As all are aware, under Executive Order 12,958, Section 1.8(a), "In no case shall information be classified in order to: (1) conceal violations of law, inefficiency, or administrative error;(2) prevent embarrassment to a person, organization, or agency; (3) restrain competition; or (4) prevent or delay the release of information that does not require protection in the interest of national security."
However, "[i] is said that this power in the President is dangerous to liberty, and may be abused", and "[a]ll power may be abused if placed in unworthy hands", Luther v. Borden, 48 U.S. 1 (1849), but "“[t]he courts cannot prevent abuse of power, but can sometimes correct it.”U.S. v. Chalk, 441 F.2d 1277 (4th Cir. 1971).
The President has suggested, "Temporary continued postponement is necessary to protect against identifiable harm to the military defense, intelligence operations, law enforcement, or the conduct of foreign relations that is of such gravity that it outweighs the public interest in immediate disclosure."
Under Executive Order 12,958, Section 1.4(b)(2), "'Top Secret' original classification authority may be delegated only by the President or by an agency head or official designated pursuant to paragraph (a)(2), above." And this appears to encompass the concerns expressed by the President.
The President has stated that the National Archives and relevant agencies “shall jointly review the remaining redactions in the records that had not been publicly disclosed”, until May 1, 2023, and that "any information withheld from public disclosure that agencies do not recommend for continued postponement” will be released by June 30, 2023.
As you are aware, under Nixon, "[a]bsent a claim of need to protect military, diplomatic, or sensitive national security secrets, we find it difficult to accept the argument that even the very important interest in confidentiality of Presidential communications is significantly diminished by production of such material for in camera inspection with all the protection that a district court will be obliged to provide." And certainly the federal district court would be more readily able to provide a far more expeditious resolution than the current proposed schedule on a matter long overdue and of great concern to the Kennedy family and the American people. Reporting live from the world’s newest banana republic, it was George Washington Carver, in the Atlanta Compromise that had suggested the thought, “Cast down your buckets where you are”, but, at least according to medical experts at Healthline, “there is very limited research to show that drinking more than your hydration requirements benefits your health”, and “drinking a gallon (3.8 liters) of water per day is likely arbitrary and unnecessary — unless your body requires that much water for proper hydration”, but one recently re-elected pastor in Atlanta who had encouraged the congregation at America’s Freedom Church, the Ebenezer Baptist Church and former pulpit of the slain civil rights leader Rev. Martin Luther King, Jr., has arbitrarily and capriciously decided to make a new year's resolution for his congregation to enjoy the full benefits of baptism by immersion, resolving to drink a gallon of water per day, raising concerns at least for one pesky candidate known well from coast to coast from Blue Virginia to progressives in chic coffee houses in Seattle as having been opposed to the government response to the current public health crisis, a pandemic the President had declared over shortly after a damning peer reviewed study demonstrating a risk as high as 36% for the popular Pfizer product in what business reporters at Bloomberg had described as the biggest vaccine campaign in history, administering as many as the latest vaccination rate is 261,820 doses per day, on average, by October 6th, but on all evidence not a popular choice for DoD civilians and contractors, where, according to the DoD product dashboard only 41% of civilian employees have decided to follow orders to “get the shot”, compared with 94% of uniformed members of the military.
Empirical evidence suggests that Black clergy, who, despite a common title, regardless of educational credentials, commonly refer to themselves as “doctor”, and within a demographic where the achievement gap in math and science is historically significant, are not the go to guys on health advice. And who can forget the alarm after Bishop Gerald Glenn decided to oppose social distancing, which at least science experts suggest was the cause of his tragic death, a debatable proposition currently before the judiciary in Virginia.
“Perhaps once the U.S. Marshals get a hold of my racketeering defendant Jimmy Kimmel, he can get some of his doctor friends to make another comical video like they did for vaccine absolutism, one right after the folks at UNC Chapel Hill had applied for a patent on the methodology to develop a SARS-like chimeric coronavirus spike protein, and another during our current pandemic. I’d be happy to deliver a few zingers about how, according to medical experts drinking an extreme amount of water in a short time can be dangerous and how even in water board practice we try to warn counterintelligence interrogators that imbibing too much of that life sustaining fluid too quickly can prompt a reduction in sodium levels below recommended levels and induce a condition of potentially life threatening hyponatremia, but if the good reverend says the church should blow off the science, at least we may never learn exactly how dangerous the one shot adenovirus regimen was, right?” quipped Major Mike Webb, the former biological warfare planner who had filed an injunction against the mRNA COVID-19 countermeasures at the beginning of December to compel the FDA that had blown off inspections of clinical trial sites to follow the science in a peer reviewed study published in August.
According to medical experts at VCU and VDH, the Black clergy, the last to return to in person worship, and practically the only places of worship that require proof of vaccination status, had begun meeting early in the public health crisis and quickly exhausted the topic that continues to baffle the scientists, moving on to other topics, during a year in which they began razing century old statues, marching in demonstrations and going door to door in a pandemic to pimp the one shot regimen from Janssen, early known to be associated with myocarditis.
Perhaps the new game plan is to dilute the damage caused by consuming what amounts to poison, but even after a night of intense alcohol consumption hydration tends not to reduce the damage, or cleanse a sin sick soul, washing sin’s stains white as winter snow.
One of the highlights of pandemic for one pesky litigation hobbyist was an interview with Rev. Mike Jones, by WRIC, a councilman who had taken up the cause of removing Confederate monuments, and who explained exactly what he didn't know about respiratory tract infections, infectious dose and a less than five percent secondary attack rate, positing that a person might turn their head 180 degrees like an owl to observe someone exhibiting an asymptomatic sign of infection, like sneezing. And at least one Alexandria pastor, Rev. One reporter at Essence had expressed her woeful frustration in not being able to locate disaggregated data on racial impacts from COVID-19 that had been diligently compiled by Boston University and The Atlantic until just before the first anniversary of the pandemic and announcement of the American Rescue Plan that was to end the pandemic by Independence Day after the first celebration of a new imaginary holiday, by which time, apparently, over 73,000 Negroes had perished to a novel coronavirus. And while Blacks accounted for over 60% of the fatalities in Richmond, Mayor Levar Stoney was securing contracts for his donors to remove a statue of Robert E. Lee.
And in other Ebony News, Jennifer McClellan, the delegate who had vied to defeat Terry McCauliff for the gubernatorial nomination was elected as the nominee to succeed former Congressman Donald McEachin, who tragically died just weeks after winning reelection in November.
Like Rev. Calvin Butts, the former pastor of the historic Abyssinian Baptist Church in Harlem, who had organized Black clergy to vaccinate his people, and 80s star of Fame who had celebrated her birthday by getting the vaccine, posting her joy on Twitter, McEachin shall be sorely missed. McClellan had famously cried out in helpless despair after former Governor Ralph Northam had been infected, seeking his medical care from a fellow pediatrician to stave off a lethal and highly contagious disease, but proudly and apparently convincing voters his infection was proof his mask worked.
Northam, a medical doctor had suggested you could find protection with only a bandana, and even a piece of cloth secured in your face with a couple of rubber bands, but found some confusion attempting to explain aerosol transmission during his Labor Day COVID-19 update just before his infection.
Who managed to infect the former governor remains unknown, but he refused an invitation from one recipient of a letter from the Congregation for the Causes of Saints who had offered to lay healing hands on him, and hug and kiss him like apparently they do in the former Governor's church.

DOUBLE ZOONOTIC EVOLUTION? WHAT ARE THE ODDS?
On January 31, 2020, Dr. Kristian Andersen, after examining the genome for a novel coronavirus, had claimed to Dr. Anthony Fauci that it looked like it had been created in a laboratory, a thought he shared with his colleagues, but in June 2021, after he had written his zoonotic evolution report in March 2020, which was exclusively a "theoretical" piece in a three page note in a medical journal, not a full blown report, he told the New York Times that, based upon a codon usage that had appeared to have been adapted to human physiology that he had apparently later discovered to appear in some other viruses, he had originally thought the virus came from a laboratory, but his application of the scientific method had refuted his earlier hypothesis that ignored the ophidian, or snake codon usage bias, the predominant indicator, which was aberrant from nature, because there are no reptile or snake coronaviruses.
At that time, Dr. Andersen claimed to be leaning towards a zoonotic and natural evolution, but, like Dr. Fauci, keeping an open mind. However, by September he had joined 121 other scientists to theorize that not just a fluke zoonosis had occurred, but a double zoonotic evolution involving two separate strains that just happened to arise in close proximity and collide at the Huanan Seafood Wholesale Market. Consider the odds of that double rare event, and, again, he based his conclusions wholly on theory, but added at the end that the failure to ever locate the zoonotic source would essentially lead to more pandemics because a walking, breathing and free biohazard laboratory was still in business, but, somehow that never occurred, and now not even the Intelligence Community or the President appears any more alarmed than with a possible invasion by aliens that most believe exist in the vast universe, and they can't all come in peace, one, except the most naive and ignorant, would think.
So, while Dr. Andersen, Dr. Lindsey C. Marr and Dr. John Lednicky are considering this argument, this is a chance for some amatuer sleuths to revisit the origins of a novel coronavirus.

Reporting live from the world’s newest banana republic, officially, according to the federal court record, the government can neither confirm nor deny that it owns the novel coronavirus that has resulted, to date, in 99,705,095 cases of infection, according to the CDC COVID Data Tracker, as many as 12% of which have been reinfections, according to a peer reviewed study by Washington University in Saint Louis, reviewing a rather complete record of veterans in that “universal healthcare” system, and that has been attributed to 1,083,279 American fatalities, more deaths than every American war, the conflicts in Korea, Southeast Asia, Iraq and Afghanistan and the terror attacks on 9/11, and more fatalities than the Holocaust worldwide, in half the time, but most elected legislators in Washington are far more concerned about the 928 persons charged during a protest demonstration alleged to have threatened democracy on January 6, 2021.
But at least one pesky, not a serious option, fringe independent who has floated around the periphery of Northern Virginia politics is taking that road less traveled, and not just promoting the sale of a new book, especially after a damning report first published in August that had found a 16% combined risk for serious adverse events—as high as 36% for the popular Pfizer product alone, representing an existential threat to as many as 21% of the American population, over 80% of whom have been administered at least one shot—assigned with the mRNA COVID-19 countermeasures products that the President had confidently assured Americans would have ended the pandemic on Independence Day a year ago, but has yet to fulfill his promise to acknowledge failure of the American Rescue Plan if it failed at any part. And, recognizing a clinical state of insanity, the former army top spy, often mocked as “bat shit crazy” has resorted to the mental health toolbox utilized by credentialed public health professionals to address the problem with cognitive behavioral therapy: Catch it; check it; and change it.
“Back in my days growing up in Black Church, I can recall the great controversy stirred when Dad opened the church to an Alcoholics Anonymous group, when church folks got upset because he had relaxed the smoking prohibition. We know that church folks are a mess or they wouldn't need Jesus, and, to be honest, I am certain that some of the angst arose from claims of discrimination. The why can he smoke in church and not me? Well, he, if you would, has taken that first step in repentance and recognized that he has a problem you still deny. You can drive around for a long time on a flat tire, and cause irreparable damage to your car until you admit that you have a damn problem. And as Daddy used to say, when you have a flat tire, only a fool believes he can only fix the flat part, trying to put a fancy bow on a tire that is broke. Heal the body and make whole the soul, and at least some clergy may know the sermon but now it’s time for the practical exercise, faith in the praxis as my social justice seminarians say,” explained Major Mike Webb, the plaintiff and advocate in a civil action seeking injunctive relief in federal court that had been filed at the beginning of December.
Taking a comprehensive approach, Webb has brought his concerns as a former biological warfare planner to the Arlington Public School Board, which suddenly decided to restore health benefits to seasonal staff, and has brought his concerns to the local faith community, especially historically Black churches where unvaccinated persons are refused a right to worship, while Rev. Raphael Warnock, Senior Pastor at the Ebenezer Baptist Church in Atlanta, the former pulpit of Rev. Martin Luther King, Jr., is still wailing about voter suppression even after his reelection victory, subordinating the lives of his own church members.
“We plan to head down to Atlanta for MLK Day weekend to integrate that place of worship, in patent violation of the FACE Act provisions against blocking the entrance of a place of worship. And we are going to keep on integrating until justice flows like waters and righteousness like a mighty stream. The gates of Hell shall not prevail against Christ's church,” stated the internationally notorious preacher’s kid who had shared a spiritual mentor with Rev. Martin Luther King, Jr., a friend of his father.
Progressives especially in Northern Virginia may well be feeling a tinge or envy, lacking any Negro leaders with Webb’s bona fide pedigree in the Civil Rights Movement, boasting a franchise martyr grandfather and two family churches on the National Historic Registry, which may account in part for his silent treatment in the press.
“Henry O. Flipper, the first graduate of the U.S. Military Academy endured the sane silent treatment that my Daddy did when he integrated the New Jersey National Guard and God never gives us any more than we can bear,” stated Webb, the leading challenger against Delegate Alphonso Lopez in Virginia's 49th District.
The White House has adopted a “Stonewall It” approach that historically led to the impeachment of former President Richard Nixon, even going to the extent to misuse intelligence assets after Webb had submitted a FOIA request to settle the still unresolved question regarding the virus origins, just as Dr. Ashish Jha continued today to reecho the final message from Dr. Fauci at his last White House briefing, encouraging Americans to be administered products known to present a serious danger, as confirmed by a peer reviewed science study.
Webb has intimated that after the holiday and the new year celebration, in addition to beginning to solicit signatures to qualify for the ballot, he intends to press for a hearing on summary judgments in the first pandemic incident homicide grand jury investigation, a matter brought on petition for writ of mandamus in Chesterfield arising from the death of Bishop Gerald Glenn, the former Senior Pastor of the New Deliverance Evangelistic Church, as well as for a similar action recently filed in the Alexandria Circuit Court.
Webb had, as a child, served as a protege to the legendary civil rights and criminal defense attorney, Raymond A. Brown, who had represented various high-profile defendants, including Reuben “Hurricane” Carter, ABSCAM’s Angelo Errichetti, and the accused communist spy Ivan Butenko. Much to the chagrin of his father, the son of a preacher man had completed his very first “attorney work product” while still in grammar school, assisting Brown in his representation of Resorts Casino, bringing gambling to Atlantic City.
Webb had served as the Legal Specialist for the 2nd Ranger Battalion at Fort Lewis, Washington, before being ordered to attend OCS, for a follow on assignment as the Aide-de-Camp to the Commander for all U.S. Army strategic counterintelligence in CONUS, followed by an assignment completing his service on active duty as the most junior commissioned officer to have ever served as the Operations Officer for all U.S. Army strategic counterintelligence, where he served a key staff role in standing up the Armed Forces Medical Center (AFMIC), the precursor to the National Medical Intelligence Center (AFMIC), which Good Morning America’s George Stephanopoulos had claimed to have alerted the former President about an emerging public health crisis in China as early as November 2019.

Professor Shrad had hoped, “When all is said and done, perhaps we will recognize their sacrifice as true patriotism, saluting our doctors and nurses, genuflecting and saying, ‘Thank you for your service,’ as we now do for military veterans.” And, after even Dr. Sanjay Gupta, Senior Health Reporter at CNN apparently forgot that a novel coronavirus that may have found origins in a Chinese krait or king cobra would be quite an aberration from nature, the theme of “fake it until you make it” has become the mantra at the White House where the President had, on the first anniversary of the pandemic promised he would acknowledge failure of the American Rescue Plan if it failed at any part, finding Dr. Zha stating, “We’re being very clear about this — if you’ve not gotten a vaccine in the last six months, it is essential to go out and get the new, updated bivalent,” turning a blind eye to a damning report regarding the 16% combined risk for serious adverse events assigned with the mRNA COVID-19 countermeasures products that had been developed with no knowledge of the infectious dose, prerequisite knowledge to determine the proper correlates of protection in quantifiable serological titers to enable the development of an effective vaccine.
As Brad Dress, not Duress, reporting for The Hill, states, “Jha’s remarks come as health officials have recorded a more than 40 percent increase in COVID-19 cases and hospitalizations since Thanksgiving”, a disease that even The Atlantic had acknowledged last month a person would find a better chance of winning a coin toss than being infected by a roommate with the omicron variant, raising serious questions exactly what kind of activity had been occurring in Provincetown in July 2021, shortly before the FDA rushed approval of the Pfizer products on the basis of a mere preprint of an efficacy study, not even satisfying the threshold for a release under an emergency use authorization.
“We saw this same rosying up of intelligence under General Lloyd Austin when he had commanded CENTCOM, and we saw the same failures in leadership at Forward Operating Base Markez eight years ago, during the Obama Administration in Mosul, where there were commanders who first confused a suicide bombing with a mortar attack, which left 22 dead and over 70 wounded in the worst insurgent attack since the end of the invasion. And on the anniversary of this national tragedy we expect fully to be back in federal court after DoD refuses to respond to a FOIA to determine the exact number of excess deaths of uniformed members of the military after General Austin issued the order to get the shot and Lieutenant General Jody Daniels decided to take an always out front photo opportunity getting the shot without first performing the required intelligence preparation of the battlefield,” stated Major Mike Webb, a “pesky” but “passionate” “litigator hobbyist” known to the Progressive Voters Guide as far away as Seattle for being against the government response to the current public health crisis.

In 2015, after the ISIS attack at San Bernardino, killing 14 and wounding dozens others, Lopez joined Congressman Don Beyer and Congresswoman Eleanor Holmes Norton at the Dar Al-Hijrah Mosque, which was once formerly led by Anwar al-Awlaki, the deceased chief recruiter for Al Qaeda, and which has close ties to terrorists who had been recruited for the attacks on Fort Hood, as well as the 9/11 attack on the Pentagon, which is in Lopez’s district.
Yet, at least Professor Shad, an academic at Villanova, believed that the pandemic would foster a new era when “we will finally start to understand patriotism more as cultivating the health and life of your community, rather than blowing up someone else’s community”, stating “Maybe the de-militarization of American patriotism and love of community will be one of the benefits to come out of this whole awful mess.” And Webb says: “Just say ‘no’ to drugs.”
Arlington GOP has not yet recruited anyone to run against Webb and Lopez, but at least Republican Governor Glenn Youngkin, a businessman, has taken the position that the choice to accept as high as a 36% risk for serious adverse events associated with the Pfizer product is an individual choice, even this far surpasses the threshold for a massive recall.

Evidence of flight is strong circumstantial evidence of culpability, just as false exculpatory statements are circumstantial evidence to establish participation in a conspiracy, and that’s just the law,” stated Major Mike Webb, the leading challenger against Arlington attorney and Democratic Caucus House Majority Whip Delegate Alphonso Lopez in Virginia’s 49th District.

Just like the elusive zoonotic origins, the infectious dose, according to the CDC, remains unknown, prerequisite knowledge to determine the proper correlates of protection to develop an effective vaccine without a large sample size phase three clinical trial, establishing that over 80% of Americans were fraudulently induced to become participants for a product with a patent defect, as alleged in the complaint, and a defendant can only disavow participation in a conspiracy through affirmative action's reasonably calculated to communicate disavowal to other conspirators. Mere silence or acquiescence is insufficient.

You know you are saying something interesting if your Facebook account is permanently disabled expressly for “security reasons”, you have been denied general amnesty on Twitter, and you are suspended on Truth Social, and, as of today, banned on YouTube, but, on January 16, 2023, the MLK Day Holiday Weekend, I will be returning to a church in Atlanta, Georgia, a church that had been copastored by Rev. Martin Luther King, Jr., with his father Daddy King, friends of my father, but where, today, “whosoever will let him come” notwithstanding, you are refused entry for the 9:30 am service, if you are unvaccinated, even though on August 17, 2022, a peer-reviewed study by Joseph Fraiman, et al. had determined that there is a 16% combined risk for serious adverse events associated with the mRNA products being produced and distributed by Pfizer and Moderna.
There is no 11:00 am service at “America’s Freedom Church”, Ebenezer Baptist Church, because of a pandemic biological agent, for which, as of March 7, 2021, in Webb v. Fauci, Record No. 21-6868 (U.S. 2022), the government can neither confirm nor deny that the infectious dose and/or secondary attack rate, standard risk assessment metrics in epidemiology, and easy to determine, are classified information. Under Executive Order 12,958, these metrics could only be classified if the government owns the biological causative agent for COVID-19, and, under Molecular Pathology Associates v. Myriad Genetics, Inc., 569 U.S. 576 (2013), the government could only own the biological agent if it had been the product of a laboratory, which several features on the novel coronavirus had confirmed from early on, to include an ophidian codon usage bias, despite the fact that, even though there are over three thousand coronaviruses that infect mammals, and over three thousand that infect birds, there are no coronaviruses that infect snakes or reptiles.
So, rather than trying to create a surprise, the Pastor Raphael Warnock, the Georgia Governor, the State Health Commissioner, the Mayor of Atlanta and even Jimmy Carter have been advised that I intend to worship at Ebenezer Baptist Church in January, just like Miss Jane Pitman went to take a drink from the Whites Only fountain at the end of that Cicely Tyson movie, and we shall see what happens.

On the first anniversary of the pandemic, the President assured the American people, telling them the truth, that, if we all did our part, and got vaccinated when it was our turn, then, by Independence Day, America would return to normal. Did that occur?
In that same speech, the President said that if the plan did not work, he would acknowledge that, which did not occur during the breakthrough infections outbreak at Provincetown, did not happen when it was discovered that FDA had failed to inspect the Pfizer trials, apparently not something new for that agency, according to BMJ, did not happen when the elderly were 90% of the fatalities or when 58% of the fatalities were vaccinated, and did not occur when a peer reviewed study found a 16% combined risk for the mRNA COVID-19 countermeasures, as high as 36% for the Pfizer product, but today, the President said that Hitler was a bad guy, and silence is complicity.

And, in pandemic, with an invisible enemy for whom some they even had to tell that "novel" meant "new", they got your attention, knew you were interested in an "extra layer of protection", in this protection racket pandemic, and had only to pass over the pen gently with a smile to get you to sign on the line that is dotted for action. You got suckered, bamboozled and sold, and now, according to a peer-reviewed report that was first published online in mid-August, but about which not even one press headline has appeared, the extra layer of protection, a "COVID-19 countermeasure", according to the Emergency Use Authorization Declaration, as well as the PREP Act that had provided the pharmaceutical companies immunity for your "as is" vaccine, has some problems, at least a latent defect: a combined risk of 16% for serious adverse events associated with the mRNA vaccines being distributed by Moderna, which came into existence to market mRNA vaccines simultaneously with your made to order pandemic, and Pfizer, whose product has a 36% risk, to address a disease in which the elderly were known from the beginning to be at highest risk in the science reports that nobody apparently read, and that has only a 1.1% case fatality rate if you are lucky enough to come in close contact with someone "with" the virus, a virus that began with a less than five percent secondary attack rate, prompting the conclusion by the WHO that "it is not clear whether this correlates with the presence of an infectious virus", in late February 2020, even if it was highly contagious in your mind.

And Wall Street Journal, the leading business daily, comes now to the rescue, as Fret Stanford Alumna Allison Finley proposed recently that since the market appears to have lost confidence in the boosters, the President needs a better salesman to keep the bottom from falling out of the market, and warns that some schmuck consumer like you might get the idea to sue for false advertising, which actually is a nonstarter, and why would you be concerned about false advertising if you happened to have had a stroke or died because of this COVID-19 countermeasure.
Well, under the PREP Act, the pharmaceutical companies were not provided blanket immunity from civil liability, just like, as the court observed in the Eichmann case, not even the Third Reich gave the SS carte blanche to obey an unlawful order, and if there is willful misconduct that you can prove in court, at least for those who lost loved ones and family, you have an entitlement to compensation for the lost of your aggrieved ones, and, as a preacher's kid, who has attended a lot of funerals, I know that there are a lot of people who show up only to see what the decedent left them in financial rewards, and the holiday season may be a good time for you to get close with those lost family members you may not have known had died to see if you can show your love and get paid for their loss, and maybe win an Academy Award in court for your performance as a grieving family member. Remember, "I promised myself I would not cry", and, lights, camera, civil action!

Catching COVID-19: True Crime Stories (It's Wholly Conceivable. . .)
THE QUESTION NOT ASKED IN THE FAUCI DEPOSITION
National headlines indicate that the once amazing Dr. Fauci, apparently even once gifted with soothsaying abilities to prophesy, may have suffered some signs of long covid, exhibiting an inability to recall some details during his deposition in the “free speech” case brought by the Attorney Generals for the States of Missouri and Louisiana, but what was very apparent was that one question has even been dodged by the plaintiffs in the action, a question raised by an intervenor who was refused leave of court to enter, and denied an opportunity to re-enter the matter after the depositions were announced.
The plaintiffs requested a string of high-level government officials in their motion for depositions, including the NIAID Director, who had officially announced his decision to retire last August, but apparently sped up his timeline before Thanksgiving, indicating that he was giving his last White House update briefing. However, one intervenor, described by the court as a “litigation hobbyist”, and expelled by the Court with a group of investigative journalists who had also sought to intervene, happened to be essentially a former biological warfare planner, who had had a half dozen cases docketed for certiorari at the Supreme Court in less than a year during the pandemic, quite an accomplishment for an unrepresented litigant, while one matter, Webb v. Fauci, filed in the Eastern District of Virginia on July 7, 2021, remains unresolved, hinging on a technicality and procedural question since the new term began on October 1, 2022, when the Supreme Court attempted to quash the matter that had been docketed on June 28, 2022.
The only relevant question, with regard to establishing a claim that Dr. Fauci had lied, for a legal cause of action in fraud, forming the basis of what the court in U.S. v. Elliott had described as a “wheel conspiracy”, with a “hub” personality, with several “spokes”, is whether or not the government owns the causative biological agent for COVID-19, the aim of the FOIA that had been submitted to the White House on March 23, 2021, months before the White House had tasked the Intelligence Committee, and before several news organizations had begun submitting FOIA requests to obtain copies of emails.
The FOIA sought, in Sesame Street Simplicity, the answer to a procedural question about standard epidemiological metrics that, quixotically, remained unknown, i.e., infectious dose and secondary attack rate. Under Executive Order 12,958, these metrics could only be classified if the government owned or controlled the causative biological agent for COVID-19, and, under Molecular Pathology Associates v. Myriad Genetics, Inc., the government could only classify the metrics for a novel coronavirus if it had been cultivated or manipulated in a laboratory.
As of March 7, 2022, in a matter brought for prejudgment decision on the shadow docket, Webb v. Fauci, Record No. 21-6868, a presumptive assertion of executive privilege, reserved under U.S. v. Nixon, for matters of national security, was transformed into a Glomar Statement: the government can neither confirm nor deny that the infectious dose and/or secondary attack rate for COVID-19 are classified information.

WHEN YOU WISH UPON A STAR
Captain Brett Crozier was what one might describe as a rising star, career tracked to admiral, until as series of claims that he was willing to sacrifice his career to save the lives of sailors who were not at war and facing an outbreak that, even according to the science report upon which he had relied, described those at greatest risk as being elderly and with comorbidities, which does not conform to the profile of anyone on the crew of a nuclear powered, Nimitz class aircraft carrier.
Rising stars are not hard to spot in the military, and those with ambitions may often try to catch a rising star to be in the entourage, enjoying the spoils of victory, but at least “Let Your Conscience Be Your Guide” Jiminy Cricket appeared to pin his hopes upon wishing upon falling stars, and if Captain Crozier didn’t care what happened to his career, after doing everything he could to get to be on deck for elevation to that threshold that only less than one percent of commissioned officers pass, already at that mark that only 12% attain, he certainly achieved that goal, quietly retiring after having his command, with no specific name references, reprimanded in an inspector general’s report for partial responsibility in the over 1,400 infections aboard the U.S.S. Theodore Roosevelt early in the current public health crisis, a big news story for a while, during an election, that just faded away.
And, totally forgotten was the fact that within that outbreak of infections, early in the pandemic, one sailor died, the very first uniformed service member on active duty, which is significant in itself, in addition to his age, just 41, and in sufficient fitness to serve in the military, and a commander is responsible for the health and welfare of his crew.
The infection, quarantine, hospitalization and death of Chief Thacker is not a clean nor pretty story, and suggests significant, felonious conduct attributed to senior level officials, for which there is little political will to pursue, or even just ask questions that need to be answered.
