Washington Gun Law President, William Kirk, discusses the recent agreed motion and order to grant review, vacate the previous ruling and remand the matter for new consideration in the matter of Mitchell v. Atkins. This case was one of the earlier challenges to Initiative 1639, and challenged the new laws on two separate grounds. At the time that Mitchell was decided, the Court was quite proud of the intermediate scrutiny analysis applied and how it led to the easily conclusion to dismiss the suit. Now both sides recognize that the rule of law has changed significantly and that this case was decided on the wrong grounds. Therefore, it's time for a do-over. What does this all mean to you? Washington Gun Law President, William Kirk, discusses the recent holdings of State v. Flannery, a case out of our Court of Appeals, Division II, which found that Washington state's pre-trial orders for Defendant's accused of certain crimes. Under Washington law, a person charged with a felony or domestic violence offense is almost always ordered to surrender all firearms and concealed pistol licenses. However, the order prohibiting possession takes effect immediately, but then the individual is ordered to surrender their firearms. Or put another way, ordered to turn over evidence that they are in violation of the law. This is just one of the three successful Constitutional attacks made to this statutory scheme. Under the very plain language of this new legislation, any magazine which hold more than 10 round OR any magazine which can be converted to hold more than 10 rounds will be illegal contraband. So any notion of just plugging your magazines is now legally impossible by the definition the drafters of this legislation chose. Washington Gun Law President, William Kirk, discusses a very little known rule, and one that often times is inadvertently violated, which is that we must obtain ATF permission BEFORE we transport most NFA items across state lines. Even for a temporary relocation like taking a firearm to another state for target practice will required ATF approval IF the firearm is a NFA regulated item such as a short barrel rifle or short barrel shotgun. However, and this is very important, the rule DOES NOT require prior approval to take a suppressor/silencer across state lines. Today we break this all down for you including ATF Form 5320.20 which is the form that must be completed and approved each time before an NFA item can be transported across state lines.
