Washington Gun Law President, William Kirk, discusses one of the worst pieces of gun legislation currently kicking around the country, that being New Jersey Assembly No. 4769. This god-awful piece of legislation, if enacted into law, would required all New Jersey residents to obtain, first a license from the state, before they can exercise their Constitutional right. But this bill provides much, much more to New Jersey residents. New transfer rules, a whole new slew of places where individuals can no longer protect themselves, including all areas of private property, new training requirements are but a few hits in this new legislation. But wait, there's more. You see there is a whole new training requirement that will inevitably lead to no one being able to obtain a state license to exercise a right. Washington Gun Law President, William Kirk, discusses the matter of McHutchen v. United States, currently awaiting review of a petition for certiorari before the United States Supreme Court. This case, is yet another bump stock case, but unlike all the other previous challenges to the bump stock ban, this suit is not brought under the 2nd Amendment, claiming that ATF encroached upon our Second Amendment rights, rather it claims that when the bump stock ban went into effect, overnight, Americans had three choices: (1) surrender your property to the government; (2) destroy your property, or; (3) face criminal prosecution. This, by its very definition is an unconstitutional taking prohibited by the 5th Amendment. So the argument here is not that the Federal Government did not have the right to ban and take bump stocks, rather that the Constitution mandates just compensation to those who had not choice but to dispossess themselves of their property. But, if accepted by SCOTUS for review, this case has the chance to have the same far-reaching implications similar to Bruen. What does this all mean to you? Washington Gun Law President, William Kirk, discusses the recent ruling in Sullivan v. Ferguson, the suit to overturn RCW 9.41.375, Washington's magazine ban. Recently, the Court denied several motions by Defendant's King and Kitsap County to either have them removed as Defendant's for failure to state a claim against them, or to have the lawsuit dismissed outright for failing to either state a claim or establish standing to bring this challenge. Washington Gun Law President, William Kirk, discusses the Congressional letter sent to ATF which help place the Hellfire Trigger System on ATF's Most Wanted List, but more importantly, points out that Binary Triggers are mentioned on several occasions in the nasty little letter Congress sent ATF. Washington Gun Law President, William Kirk, discusses some rare, but rather encouraging news about the recent and massive increase in Concealed Pistol License Applications here in this state and what the means to all of us in the lawful and responsible gun owning community. In August of 2022, Washington state set an all-time record for CPL applications. In fact, the number of applicants shattered the previous record by nearly 33%. Washington Gun Law President, William Kirk, discusses the ongoing litigation in the matter of VanDerStok v. Garland which is a challenge, in the Northern District of Texas, to ATF's new rules on unfinished frames and receivers. This suit alleges that ATF has overstepped its boundaries by now regulated raw pieces of material where Congress has only authorized ATF to regulate firearms. "Firearms" is a specific term, defined by Congress, and that is the only area of firearms that ATF has jurisdiction over. Why then are they now allowed to regulate raw material? It was encouraging that the trial court had granted the preliminary injunction but recent developments shed an even more positive light on this lawsuit. A manufacturer of 80% lowers, a named plaintiff in this lawsuit, has asked for additional injunctive relief to allow them to continue to do business as if the rule was not even in effect.
