OPINION - Smartmatic's Non-Denial Denials: "It Depends on what the meaning of 'is' is" After the Arizona hearing last Monday, I went to look, again, for that Smartmatic manual they say has instructions for how to weight and skew votes, and flip votes from one candidate to another. I have only put in a cursory effort in trying to find that. (If there is one, by now Smartmatic has likely already taken it down from their website, given all of the negative publicity surrounding it.) However, what I did stumble across is pretty intriguing. They posted a "Smartmatic Fact-Checked" webpage at their website, where they attempt to refute many of Sydney Powell's allegations. Strangely missing however, as I see it, is a specific or explicit denial that their software is designed to weight votes more heavily for one candidate versus another. Nor is there an explicit denial that their machines can flip votes from one candidate to another. They allude to it, but they don't expressly deny it (in my opinion). What I found especially intriguing is that several of their attempts at "denial" or refutation of what Sydney Powell had to say about them (and Dominion) sounds strikingly similar to that famous Bill Clinton line: "It depends on what the meaning of 'is' is." We all remember that line. Bill Clinton was asked about his relationship with Monica Lewinsky in an interview with Bill Lehrer. Lehrer asked him, "The news of this day is that Kenneth Starr, the independent counsel, is investigating allegations that you suborned perjury, by encouraging a 24 year old woman, a former White House intern, to lie under oath, in a civil deposition, about her having had an affair with you. Mr. President, is that true?" And, Bill Clinton responded, "That is not true. That is not true. I did not tell anyone to tell anything other than the truth. There IS no improper relationship. And, I intend to cooperate with this inquiry." But, former President Clinton was technically correct. He was not lying in either statement. "Is" is present tense. "There 'IS' no improper relationship." He could have ended it five minutes before he walked into that interview and that statement would have still been true. He never said there WAS no improper relationship, because there was. And, in the second statement, he didn't technically lie either. Most people would consider oral sex to be "sex." However, technically, by definition, what he and Lewinsky were reported to have engaged in, is Sodomy, not sex. Nevertheless, while technically not lies, it appears he did intend to deceive. Ergo, Smartmatic and their, what I call, Non-Denial denials, in very Clinton-esque fashion. Let's take a look: #1. "Smartmatic’s software was developed by our own engineers ..."The founders of Smartmatic were born in Venezuela." "The company, however, was founded in Boca Raton, Florida in 2000 and still maintains its US base there." ... "Many other American companies were founded by people born outside the US. A US company is still a US company, regardless of where its founders or shareholders happened to be born." Contrast the above to the following Wikipedia Bio about their founder, "Antonio Mugica (born May 1974) is the founder and CEO of Smartmatic, a multinational electronic voting company. ... "He graduated from the Universidad Simón Bolívar in Caracas, Venezuela, where he earned an Electrical Engineering degree. ... "In the late 1990s, Mugica along with two other Venezuelan colleagues, Alfredo José Anzola and Roger Pinate, created a system ..."after the 2000 United States presidential election, they decided instead to dedicate the system toward electoral functions" ... "Smartmatic formed out of the SBC organization that was owned 51% by Smartmatic, 47% Venezuelan state telecommunications organization CANTV ... "Bizta, also owned by the owners of Smartmatic, with a board member from the Bolivarian government during the time an industry-fostering loan from a government institution was in force. In 2004 Smartmatic was granted a contract worth $128 million with the CNE, the government's elections agency, to acquire its products (an automated voting system, voting machines and support services)" ... "But then, after collecting the required number of citizens' signatures, the 2004 Venezuelan recall referendum was activated to remove Hugo Chávez from the presidency, and Smartmatic had to hastily tailor the Voting System to the changed requirements" ... "On January 8, 2007, President Hugo Chávez announced that Venezuela would re-nationalize CANTV, a move aimed at returning the company's control to the state. On April 8, 2007, the Venezuelan Government launched a tender offer to acquire Cantv’s shares in Venezuela (Class D) and in the United States (ADS). One month later on expiring the offer, the Government acquired 79.6% of the outstanding shares of the Company, in addition to the 6.6% which it previously owned, obtaining control of the Company with a total of 86.2% of its total shares." Remember, CANTV OWNED 47% of Smartmatic at their inception, according to the above. "Controversy Public surveillance "In an El Nuevo Herald, former SEBIN officials and security experts state that the Venezuelan government has allegedly spent millions of dollars to spy on Venezuelans; using Italian and Russian technology to monitor emails, keywords and telephone conversations of its citizens; especially Venezuelans who use CANTV for telecommunications. Acquired information is used to create a "person of interest" for Venezuelan authorities, where only selected individuals could have been fully spied on and where a database had been created to monitor those who publicly disagreed with the Bolivarian Revolution." #2. "There are no ties between Dominion Voting Systems and Smartmatic." Notice the Present tense "ARE." "There IS no improper relationship." There ARE no ties. "There are no ties between Dominion Voting Systems and Smartmatic – plain and simple. No ownership ties, no software leasing, no business at all between them." But right after that, in the very next breath they admit there WAS a relationship: "In 2009, (that’s more than a decade ago) Smartmatic licensed scanning machines from Dominion for use in The Philippines for a Smartmatic election project. Our one contract with Dominion was short-lived and ended in a lawsuit. That was the first and last time that Smartmatic and Dominion tried to do business together." "Ended in a law suit" - See the attached lawsuit where Smartmatic and Dominion fight it out over their non-compete clause in regard to one of them using the other's technologies ... #3. "Smartmatic does not have any operations in Venezuela." Once again, this denial is very Clintonesque. There IS no improper relationship. Smartmatic DOES NOT HAVE ... Oh but there WAS ONE. DOES NOT currently have operations in Venezuela, BUT they did for 13 or 14 years ... Check out what they say next: "We did election projects in Venezuela from 2004 to 2017, and Smartmatic’s equipment, software and people all performed successfully every time." 13 or 14 years? That is no small amount of time. Hugo Chavez was President of Venezuela from 1999 to 2013. That's quite A LOT of overlap. #4. "There are no ties between Dominion Voting Systems and Smartmatic" ... Once again There "ARE" no ties, ie. present tense. "Smartmatic has only owned one election company in the US, Sequoia Voting systems. Smartmatic sold the company in 2007 to Sequoia’s management team. More than three years later Sequoia was bought by Dominion Voting Systems." That sounds like a "tie" to me. So does their lawsuit over non-compete agreements over shared technology between Smartmatic and Dominion. (Please see attached law suit.) Sydney Powell also said A LOT of web pages were disappearing from the Internet. I came across the same thing while researching the above. However, I was able to access them by clicking on "cache" which led me to several former Smartmatic web pages that had been removed. #5. "George Soros is not one of those angel investors mentioned above. Mr. Soros has no ownership interest in Smartmatic. He’s not on the Board, nor is he employed by Smartmatic. He never has been." In other words, There IS no improper relationship with that man, George Soros. However, I did stumble across this from the Washington Examiner: "Litigation over Smartmatic “glitches” alleges they impacted the 2010 and 2013 mid-term elections in the Philippines, raising questions of cheating and fraud. An independent review of the source codes used in the machines found multiple problems, which concluded, “The software inventory provided by Smartmatic is inadequate, … which brings into question the software credibility,” ABS-CBN reported. "Smartmatic’s chairman is a member of the British House of Lords, Mark Malloch Brown, a former vice-chairman of George Soros’ Investment Funds, former vice-president at the World Bank, lead international partner at Sawyer Miller, a political consulting firm, and former vice-chair of the World Economic Forum who “remains deeply involved in international affairs.” The company’s reported globalist ties have caused members of the media and government officials to raise questions about its involvement in the U.S. electoral process. Waldron: “This is a multifaceted issue, but yes, the forensics data, if you have access to the software code that was driving the algorithms in these machines. Waldron: “So, if you’re tabulating votes, you vote, my vote, Representative Johnson’s votes, well, that’s THREE VOTES. This data is reported in three digit fractions. Col. Waldron: “So, how is that possible in an additive function? So, the software and the code is what we would need. Or, a forensics, a qualified forensics team of your choice would need to look at, to determine what algorithms were in the USB drives that drive the machines. And, the number pattern that we is that they would pick three to four precincts. They would run the algorithm X amount of time until they got close to the precinct threshold, so it wouldn’t kick off the over-vote situation. And then they would move it to another precinct. Col. Waldron: “So, this is a complex issue with injection. In Pennsylvania, we heard a gentleman who again, signed an affidavit, he’s a truck driver, that he delivered a truckload of ballots, to a vacant lot in Pennsylvania, from New York. And, his assumption was, that ballots were just left there. There was no one there. No one there to sign his bill of lading, to get the bill of lading. So the hypothesis, the assumption is that that was used as a staging area for people to go pick up pre-printed ballots, to move into the system. Um, for example, we saw in some of the late absentee numbers in Michigan.”

Waldron: “They do have licensure agreements between Smartmatic and Dominion; between Smartmatic and ES&S, which is another major voting machine. And, really the core of these voting systems are rife with vulnerabilities. Col. Waldron: “I was an Information Warfare Officer, so I looked at ways to penetrate, defeat, and corrupt other systems – whether it was through Electronic Warfare, through other means. And, these systems are highly vulnerable to penetrations at multiple levels throughout the system. Col. Waldron: “Um, the easiest way, and the most discreet way, is USB drives. Col. Waldron: “Um, in classified systems in the military, I worked with both secret and top secret, and other special access programs. All those machines, uh, had the USB drives deactivated. You could not use them, just because of the critical vulnerability. Col. Waldron: “These machines All work off of USB drives. And so, there’s really, we’ve found, in dealing with Pennsylvania, and in Arizona, there is no control. There is no chain of custody in the USB drives. Workers can stick a USB drive in, we can stick a USB drive into ANY of our laptops. You don’t know what’s on there. And, you can change software. You can change operating systems with USB drives. Col. Waldron: And, the core of these systems is manipulability. Col. Waldron: “Um, this is the Operators Manual. And, the implementation statement for 5.1. One of the myths that has been propagated, even by the Director of CISA at Homeland Security, which is the Cyber Security infrastructure, uh Security Agency, is that, ‘Well, these machines are not connected to the Internet.’ Col. Waldron: “In the Operator’s Manual, there’s a whole page of references that show you how, and when, to connect, and what selectors to connect, to servers and to routers, so it is connected to the Internet. Col. Waldron: “That’s how you get election night reporting. Um, that’s through another company called Clarity Elections. They provide early reporting to the news media. Col. Waldron: “Matter of fact, as I was looking at one of your, one of the counties where I saw the spike, I believe it was Oakland County. Um, I was going to the Oakland County, the 2020 elections results. And, I clicked on the elections results and a warning flag pops up to the right side, and it says, ‘You are leaving this domain. As a matter of fact, there is testimony on the House floor, as late as July of 2019, that decries that we’re actually still using this equipment that is full of holes. My team is doing analysis all over the country right now. We can’t meet the demand because there is so much. Waldron: “So, if you’re tabulating votes, you vote, my vote, Representative Johnson’s votes, well, that’s THREE VOTES. This data is reported in three digit fractions. Col. Waldron: “So, how is that possible in an additive function? So, the software and the code is what we would need. Or, a forensics, a qualified forensics team of your choice would need to look at, to determine what algorithms were in the USB drives that drive the machines. And, the number pattern that we is that they would pick three to four precincts. They would run the algorithm X amount of time until they got close to the precinct threshold, so it wouldn’t kick off the over-vote situation. And then they would move it to another precinct. Col. Waldron: “So, this is a complex issue with injection. In Pennsylvania, we heard a gentleman who again, signed an affidavit, he’s a truck driver, that he delivered a truckload of ballots, to a vacant lot in Pennsylvania, from New York. And, his assumption was, that ballots were just left there. There was no one there. No one there to sign his bill of lading, to get the bill of lading. So the hypothesis, the assumption is that that was used as a staging area for people to go pick up pre-printed ballots, to move into the system. In addition, he served as a "Poll Challenger" on the AV Counting Board in Detroit (AV stands for Absentee Vote) on election day from 5:00 pm until into the evening on the following day on November 4th. (He also trained poll challengers.) He is also a Microsoft certified small business specialist. And, he said he did "cabling design for the International Space Station." According to his bio at Ballotpedia, he has a B.S. and M.S. in aerospace engineering from the University of Michigan. He also studied at the International Space University in Strasbourg, France. He has worked in the aerospace, defense, Page 6 of 24 pharmaceutical, healthcare, telecommunications, automotive, information technology and financial services fields. (Michigan has the 4th ranked graduate Engineering program in the country according to U.S. News & World Report, just behind MIT, Stanford, and Cal Berkeley.) He used statistical and graphical analysis. One graph he referred to is titled "The BIG SWITCH," which is enclosed. If you take a quick, close look at it, you will see exactly the point. To preface it, think of this example. Everyone is familiar with a typical ink jet printer. Each of them has a particular printing speed. One might print at a speed of 5 color ppm, or 5 pages per minute. However, if someone came up to you, knowing that speed or print capacity, and told you they just printed 600 color pages a minute on that same printer, you would be incredulous. You wouldn't believe them because you know it is impossible. That printer can only print 5 color pages per minute. No way it could do 600. Now, take a closer look at that slide titled The BIG SWITCH (enclosed). It shows a HUGE SPIKE in the number of votes counted during a two hour and thirty-eight minute period of time in FOUR COUNTIES in MICHIGAN (that include the City of Detroit). It shows that during that 2 hour and 38 minute period of time, 384,733 ballots were counted. However, that is impossible. The problem is, the machines being used only had a CAPACITY to count 94,867 votes during that same period of time. Which means, 289,866 votes were created OUT OF THIN AIR! They had to be. That's like saying a printer that can only print 5 color pages per minute, suddenly had the capacity to print 600 pages per minute. It is a PHYSICAL IMPOSSIBILITY. Criminals are so stupid/arrogant. Hubris. That's how they get caught. There is always something they didn't think of. Something their hubris blinded them to. Plus, no one has ever checked before. They likely were complacent. Page 7 of 24 Apparently, these machines keep track of everything they do. During that spike in votes (which was detected using a statistical technique called "Bedford's Law," which graphically revealed the HUGE spike in votes counted). Please see the enclosure labeled "Vote Tally Anomalies Identified" to view this spike graphically. One other major discovery: See the enclosure labeled Non-Integer Reports. On that report you will see six lines of data, each timestamped a few minutes apart from 6:54 to 7:03. And, on each line you will see the number of votes. Did you know that votes are counted in fractions of votes nowadays?(Facetiousness intended.) Recall Sydney Powell's contention that the Dominion voting machines can be programmed to count votes in fractions, say 1.25 for each Biden vote to only 0.75 for each Trump vote. Well, if you take a close look at the enclosure labeled Non-Integer Reports, you will see that the votes are counted with two digits past the decimal point. Like 1.23 or 5.67. However we only count votes 1,2,3,4,5 .... Not by fractions of votes. So where are these partial decimal votes coming from? Priebus is also an attorney and the former RNC Chair when President Trump was elected in 2016. Page 16 of 24 Reuters (Dec. 21, 2020): “In a statement issued by the campaign, Trump lawyer Rudy Giuliani said the campaign had filed a petition asking the high court to reverse three rulings by a Pennsylvania state court interpreting the state's rules for mail-in ballots. “The Campaign’s petition seeks to reverse three decisions which eviscerated the Pennsylvania Legislature’s protections against mail ballot fraud," Giuliani said in a statement. Giuliani said the filing sought all "appropriate remedies," including an order allowing Pennsylvania's Republican-controlled legislature to award the state's 20 electoral votes to Trump. Biden won the state by more than 80,000 votes. "The petition is "frivolous" and is not going to stop Biden from becoming president on Jan. 20, said Joshua Douglas, an election law professor at the University of Kentucky." The Professor apparently hasn't seen Justice Alito's statement (joined by Justices Gorsuch and Thomas) about the Pennsylvania Supreme Court Ruling regarding Election Law. OPINION Supreme Ct: Don't be confused - there are TWO Pennsylvania Cases The Supreme Court case just dismissed (The Kelly case) has nothing to do with the other. The other case, REPUBLICAN PARTY OF PENNSYLVANIA v. KATHY BOOCKVAR, SECRETARY OF PENNSYLVANIA is about ballots turned in after the 8:00 pm election day deadline, required by statute in Pennsylvania. In the Kelly case, they're asking the Supreme Court to strike down a law PASSED by the Pennsylvania legislature (2019 Act 77) because, they allege, it violates the Pennsylvania constitution. The Kelly case was doomed from its inception. The Kelly case is the EXACT OPPOSITE of what Rudy Giuliani has been arguing all over the country, while speaking before the various state legislatures. Giuliani has been telling state legislatures, that Under Article II, section 1, Page 17 of 24 clause 2, state legislatures have PLENARY power when it comes to choosing electors for their respective states. What is Plenary Power? Plenary power is defined as "A plenary power or plenary authority is a complete and absolute power to take action on a particular issue, with no limitations. It is derived from the Latin term plenus ("full")." In tossing the Kelly case, the Court is, essentially, agreeing with Giuliani. The Kelly case incorrectly argued that the PA legislature's plenary power is subordinate to the Pennsylvania Constitution. However, the Supremacy Clause of the United States Constitution means that when any state law, constitution, etc. conflicts with the United States Constitution, the U.S. Constitution reigns supreme. It trumps any state law (or state Constitution) to the contrary. For example, suppose a state amended its constitution to prohibit freedom of speech and freedom of religion. Could they get away with that? No, of course not. The U.S Constitution reigns supreme. The Bill of Rights, if you will, trumps a state constitution that contradicts it. That's the flaw in the Kelly case. The state legislatures, under Article II, section 1, cause 2 provides "Each State SHALL appoint, IN SUCH MANNER as the LEGISLATURE THEREOF MAY DIRECT, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress". The Kelly case, in effect, is ass-backwards. They claimed the Supreme Court should overrule 2019 Act 77, passed, on October 31, 2019, by the Pennsylvania state legislature, because they claimed it violated the Pennsylvania state Constitution. However, the Kelly case was a no-brainer. it was an quick and easy toss by a unanimous U.S. Supreme Court (for the same reasons that Rudy Giuliani is arguing that the various swing states in question, violated the plenary power granted to the various state legislatures, when election officials and the various secretary of states, made up their own rules, in effect, overriding the plenary power granted to their legislatures by the U.S. Constitution - to Direct the Manner in which the electors are chosen by their respective states. The hearts of the petitioner's attorneys in the Kelly case were in the right place. They just made the wrong legal argument. Page 18 of 24 Ordinarily, the Kelly case might have been a pretty good argument. However, not, in this case, when a specific U.S. Constitutional provision (Article II, section 1, clause 2) overrides it, or as Rudy Giuliani characterized it, the state legislators have PLENARY power: "Each State shall appoint, IN SUCH MANNER as the LEGISLATURE THEREOF MAY DIRECT, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress". That's where the REPUBLICAN PARTY OF PENNSYLVANIA v. KATHY BOOCKVAR, SECRETARY OF PENNSYLVANIA case is the EXACT OPPOSITE of the Kelly case. (Giuliani and the Texas AG case, joined by 17 other state attorney's general, essentially agree with Justice Alito's statement, below.) In the 2019 Act 77 passed by the Pennsylvania Legislature, it specifically amended Pennsylvania law to say this (requiring all absentee and mail-in ballots be received BY 8:00 p.m. on ELECTION DAY): "An absentee ballot cast by any absentee elector as defined in section 1301(i), (j), (k), (l), (m) and (n), an absentee ballot under section 1302(a.3) or a mail-in ballot cast by a mail-in elector SHALL BE canvassed in accordance with this subsection IF the ABSENTE BALLOT or MAIL-IN ballot is RECEIVED in the office of the county board of elections NO LATER THAN eight o'clock p.m. ON THE DAY of THE primary or ELECTION." The voters have relied on the unlawful misinformation put out by election officials. The problem with that notion is that would be true every time they unlawfully (and unconstitutionally) amended the voting/election regulations. Thereby, rendering ALL election laws obsolete. The election officials announce illegal changes to their legislature’s voting regulations right before an election. The voters rely on them. The courts say too late. No election laws would ever need to be adhered to. The answer was YES, there is a potential, and we ought to fix that. Now, amazingly, after this election, all kinds of issues have come up and said there are potentials for problems, and everyone seems to be saying, “MOVE ON.” The only reason I can think that would be different, was because the election outcome seemed to be different. And, one side is now saying, let’s just move on and ignore this. In my state on election night, like 27 other states in the country, by that evening, we were counting votes and all absentee ballots had been received. There was much less opportunity for accusations of fraud because all of our ballots were in. Amazingly enough, a week after the election was completed, this November, Oklahomans were listening to other states, that were saying things like, “We don’t know how many more ballots there are left to count.” … "The obvious answer is, if you mail a ballot to everyone in the state, even if they didn’t ask for it, does it provide an opportunity for fraud? Especially when the state did not first purge or verify those addresses? And, they sent THOUSANDS of ballots to people that no longer lived there. I’ve talked to Nevada residents that received MULTIPLE BALLOTS at their home, for people that no longer lived there. That’s a problem. And, we should at least admit that’s a problem. And, for some reason the other side was very focused on, We’ve gotta fix the potential for problem from 2016, but in 2020, when there’s potential for problem, and things that have been shown, everyone seems to say, move along. And, 4,000 people voted in Nevada that are non-citizens. In Oklahoma, we did state bill 210, and state bill 1779, because we saw with the pandemic, there were going to be problems. So, our legislature came into session, made a change to be able to adjust for how we were going to do early ballots, and early voting. Because we knew that was the law that needed to be followed.
