White residents wonder whether gang beating is hate crime
2013 - ST. PAUL, Minn. Many people are wondering whether the brutal beating in St. Paul's Dayton's Bluff neighborhood that left a St. Paul man in critical condition was a hate crime as the community questions police response.
Ray Widstrand, a white man, was brutally beaten by a group of mostly black young men, but the Ramsey County attorney says there is no evidence race was a motivating factor in the attack.
Yet, a lot of people have been asking the question -- and it's not just neighbors. FOX 9 News has fielded calls from St. Paul police officers who believe the department isn't being aggressive enough with the investigation. Yet, when it comes to the state's hate crime law, evidence is necessary.
The flowers at the corner of Minnehaha and Preble are a reminder that the community is still thinking of Widstrand -- as to the signs neighbors posted to say they believe facts are being covered up.
Many in the community wonder why it took five days for them to find out about the crime and why local politicians have been so quiet about the brawl that took place just a block away from the police station.
Widstrand was walking home when he came across a group of 30 to 40 of the East Side Boyz and their youth group of wannabes, the Ham Crazy Gang. He was knocked down, beaten and stomped on. The mob even took off his pants to rifle through them.
After eight days in the hospital, Widstrand is now coming out of his coma, but he will likely have serious brain injuries.
On Monday, the Ramsey County Attorney's Office responded to rumors that the beating was a hate crime, saying they have "no information from police investigators that racial bias was a motivating factor at this moment in time."
A spokesperson for the St. Paul Police Department also dismissed the idea that there was a delay in notifying the public about the crime, saying it is not responsible for what the media chooses to cover; however, the St. Paul police chief will meet with neighbors at 6:30 p.m. on Thursday at Arlington Lutheran to discuss the crime more.

White man beaten by racist Blacks, possible hate crime
2014 - Nathanial Szczerbinski is out of the hospital, but not out of the woods as far as his recovery goes. It may be a long road ahead physically and mentally.
He's mad and heartbroken over what happened to him Saturday afternoon in the city he loves, just six blocks from home in Grosse Pointe Park.
Szczerbinski accidentally drove the wrong way down a one-way street. He was T-boned by a man driving an older van. It was a devastating accident.
Szczerbinski got out of his vehicle to see if everyone was alright. The African American men in the van attacked him with slurs, spit, fists and kicks.
"The next thing I know he starts running his mouth and then he hits me. And then two other guys come out and they just start wailing on me, too. So I'm basically like in a corner. I tried to put my arms over my face so they don't, you know, kill me," he said.
Police are investigating the beating as a hate crime. What exactly did the men say to Szczerbinski?
"They called me a white b**** and then the driver was like, 'I don't care if I just got out of jail, I'm gonna keep hitting you, I don't care,'" said Szczerbinski.
Sore and sad, he doesn't want this to happen to anyone else and wans to ask the men who beat him why they did it.
"I just want to know why. I mean, it was a mistake. A simple mistake. I don't know if you guys hate me because I'm white. I really don't know. I just want to know why," he said. "I didn't deserve this."

White man attacked in possible hate crime in New York dies
A 62-year-old man has died after being attacked last week in Union Square, according to law enforcement sources.
Jeffrey Babbitt slipped into a coma and had been declared brain-dead at Bellevue Hospital after he was allegedly beaten by 31-year-old Lashawn Marten last week.
Babbitt died on Monday.
The retired train conductor was walking near the chess boards in Union Square at around 3 p.m. Wednesday when Marten allegedly said he would punch "the next white person" he saw, and began attacking people.
"He said 'the next white person who walks by I'm going to [expletive],'" one woman said. "His fist went in and the man's head bobbed and he hit the ground and you could hear his skull hitting the ground."
Witnesses said Marten then hit two more people before demanding to see police officers. He remained at the scene until police arrived.
Because of Marten's alleged comments about targeting white people, the incident could result in hate crime charges in addition to felony assault charges, according to Police Commissioner Ray Kelly.
Babbitt shared a Sheepshead Bay apartment with his 92-year-old mother. He was her primary caregiver.
Friends told CBS 2′s Hazel Sanchez that Babbitt's mother, Lucille, remained by his side until he died.
"She stood up in that hospital from the time Jeffrey was admitted. Wednesday, Thursday, Friday, Saturday, Sunday, Monday sleeping on the couch up there. I called her on the phone and said 'Lu come home,' and she said 'I'm not leaving my son,'" Robert Pizzimenti said.
Babbitt's death rocked his neighborhood, where residents described him as a good, helpful soul.
"He's very good guy. He's very helpful to all the people. He never say no if somebody ask him for the help," Vladmir Krasmov said.
A note on an elevator in Babbitt's apartment building announced his death. The note also said, "Jeffrey was a kind & gentle soul. May he rest in peace."

White guy beaten nearly to death by Blacks for dating a Black woman, no hate crime there
May 19, 2010
Both teens were denied youthful offender status and sentenced to 6 years in prison for the gang assault charge that landed another teen in the hospital.
19 year old Brian Milligan was kicked, punched, and hit with a rock last August at the corner of Genesee and Floss.
Milligan had just walked his girlfriend home and was returning to his grandmother's house when 18 year old Donte Lee, 16 year old Antoine Blackmon, and a 12 year old cousin attacked Milligan.
He suffered severe injuries to his head and jaw. His family originally wanted the attack investigated as a hate crime. They believe Milligan was beat up because he is white and his girlfriend is black.
Blackmon and Lee apologized to Milligan in court. An attorney for both teens placed the majority of blame on the 12 year old cousin. He is charged as a youthful offender in family court. Milligan says he's pleased with the sentence.

White guy beaten by racist Blacks for dating a Black woman in Savannah, Georgia
2012 - SAVANNAH, GA - A Savannah couple says they were attacked in Ellis Square because they are not the same race.
23 year old Andrew Quade's eye is swollen shut and his face is swollen after he says he was attacked in Ellis Square Friday night.
He was with his African American girlfriend walking through the square when he says three men shouted racial slurs at them.
The next thing the couple remembers, Quade was unconcios on the ground.
"He was basically left for dead. I don't want to go into all the gory details but they could have stopped, but they kept going," Quade's girlfriend Olufisayo Bakre said.
Bakre says three black men began yelling at them as they walked to a friend's birthday party.
"One of them was making racial comments at us and one of them was blowing kisses. It was very aggravating," Bakre said.
Quade says he tried to ignore the comments.
"I didn't want to freak out on them because I thought they were saying something about me and my girlfriend. I wanted to get more information and understand the situation. But before I could, I was knocked out," Quade said.
Quade says the next thing he remembers is waking up in an ambulance.
"I think of this as a hate crime. It's that simple," Bakre said
The couple says they've felt discrimination before, but never anything like this.
"The worst we've had is people staring or talking about us. But it has never gotten to the level of physical contact until now," Bakre said.
Police say they are reviewing surveillance video and talking to witnesses. The couple still can't understand why someone would do this.
"I can't wrap my mind around what logical reason they would have," Quade said.
The couple insists they did nothing to provoke the attack.
"I just hope they get caught. I really hope justice prevails. This should not happen in this day and age. I know we're in the South, but it is time for a change," Bakre said.
Police say there is no hate crime law in Georgia. Police say if there is enough evidence, there are federal laws that could apply and the case could be referred to the FBI.
Investigators say they do have surveillance video, but according to the couple the quality is not good.
The couple did not get a good description of the suspects and can only say they were three black males varying in height.

White Seattle teen whipped and burned with cigarettes just for being White
2010 - A West Seattle teen is still recovering after a savage hate filled attack. It happened near 14th Avenue Southwest and Southwest Holden Street as the boy was walking home. The victim told Police he was beaten and robbed because of his color.
The teen's father Tim McClellan spoke exclusively with Q13 Fox News.
"He went to hand him a light and they attacked him, knocked him down right there," said McClellan.
Looking at the pictures of his son in a hospital bed isn't easy for Tim.
"Beat him for 4 hours, beat him, whipped him, burned him with cigarettes," said McClellan.
In pain and still fearful Tim's son Shane wasn't up for talking to us. But, his dad told us his story. Shane was walking home from a friend's house in Highland Park around 2 AM Tuesday when he was tortured along a trail.
According to Tim his son was beaten for well over an hour on a staircase near the trail. He says the thugs put Shane's face into the steps and put a gun to the back of his head.
"You know cocked the weapon and told him as they were burning him, if he made any noise they were going to blow his head off," said McClellan.
All of it might have been because of the color of his skin. The Seattle Police Department's Bias Crimes Unit is investigating the case as a possible hate crime, because, of what the men said to Shane.
"When they kept whipping him with the belt, they kept talking about you know whipping him because he was a white kid," said McClellan.
Police believe the teens that did this are African American and Filipino and may have gang ties. Tim wants them caught before they hurt someone else.
"Doubt it was the first time and be a fool to think it was the last time you know. Just don't want to be responsible for it happening to someone else. I'd like to see these guys off the street," said McClellan.
Despite how bad his injuries look, Tim says Shane is expected to make a full recovery.
If you have any information about this attack, call Crime Stoppers at 1-800-222-TIPS.

White family demands Black man be charged with hate crime
2013 - CEDAR RAPIDS, Iowa -- Victims of an alleged attack at Outback Steakhouse say they are thankful to be alive.
"Everybody was running and screaming everywhere," said Hallie Hanson. "It was the scariest event I've ever been a part of. People had full plates of food and just left. It was a traumatic event."
Matthew Sanders, 29, is in jail where he faces assault charges after police say he injured three people. Court documents show the attack at the restaurant on First Avenue southeast was unprovoked. Witnesses reported that through it all Sanders yelled racially charged comments.
"It total chaos when this took place," Chuck Hanson said.
Chuck Hanson said his family just sat down for dinner when Sanders approached the table. They said a man they'd never seen before suddenly attacked for no reason.
"I was sitting there at the table and a young gentleman walked by me and asked me how I was doing," Chuck Hanson said.
"My dad replied 'terrible' because he'd been having a bad day, and all of the sudden the guy had like a gray trapper and he went and reached for something," Hallie Hanson said.
"The next thing I know, I was getting punched in the back of the head and then my daughter, Hallie, was protecting me," Chuck Hanson said.
"I just saw glass flying everywhere. At that point, he started punching him in the face and in the back of the head and I pulled my dad towards me because I thought he was trying to kill my father," Hallie Hanson said.
Court documents show the man was using a glove with glass shards. The pair counted up the stab wounds estimating Chuck was stabbed at least five times and punched several times. Hallie also got a piece of glass in her arm. The family said they have no idea why Sanders attacked, but Chuck does remember Sanders shouting something through it all.
"He said 'call me the "n" word again', as he proceeded to keep hitting me in the back of the head," Chuck Hanson said.
Chuck said he didn't know why he was screaming that.
One day after the scary ordeal, the family is hoping prosecutors will charge Sanders with more than assault. They call this a hate crime and said they'd like to see him charged with attempted murder
"He came with sharp glass and a work glove with the intentions of hurting somebody, and I was that somebody," Chuck Hanson said.
Hallie and Chuck said they would undergo surgery on Tuesday because of that glass. Hallie said after Sanders attacked her dad, he threw a chair hitting a waitress who happened to be pregnant. She's the third victim in this attack.

White family attacked for being in wrong neighborhood, not a hate crime
DA finds reason to weasel out of charging Black man with hate crime.
District Attorney Hillar Moore says his office will not pursue hate crime charges against a person accused of attacking a man and his family for "being in the wrong neighborhood."
Moore says his team will, instead, go after defendant Donald Dickerson, using Louisiana's habitual offender section of the law. If convicted of a hate crime, Dickerson would only face the possibility of an extra five years added to his sentence.
Instead, Moore says he prefers trying Dickerson as a habitual offender. Then, if convicted, Dickerson would automatically face life in prison without the possibility of probation or parole because of his criminal background.
Dickerson has previously been convicted of armed robbery, purse snatching and a sex crime. Those convictions, in combination with the latest offense, make Dickerson eligible to be tried as a habitual offender.
Moore says the victims are happy with his decision.
"Their wish is pretty much my command in this case, and although I may have wished to do something else, my senses tell me I can get a whole lot more time," Moore said, "I believe he deserves it should he be found guilty"
Dickerson was arrested and charged with second-degree battery. The other two suspects: Devin Bessye, 24, and Ashley Simmons, 22, were released on site after police wrote them each a summons for simple battery.
Baton Rouge Police Chief Carl Dabadie apologized for the way his officers handled the case in the beginning by not booking all three suspects in jail.
The victim suffered a broken eye socket, broken nose, and several lacerations to the face, and his wife was knocked unconscious.

Violent, racist African immigrants
2009 - Racial tensions at Owatonna High School have the police pulling extra security duty and some parents extremely worried.
A group of concerned parents met with the school superintendent Thursday, while many students stayed home, too afraid to go to school.
It was hard to miss the four police cars outside Owatonna High School Thursday, as well as a fifth car patrolling the neighborhood.
The precautions, a result of increased racial tensions between Somali students and white students.
"Certainly this is an issue that sprung from some racist comments that had been made," says Owatonna School Superintendent Dr. Tom Tapper.
Tapper, says educators met with the entire student body today to talk about the problems, but some students, citing recent fights and alleged threats, stayed home.
One student, who does not want to be identified, says she and her parents were afraid of what might happen.
"There's tons of kids and they've posted all over the internet saying they're not going to school and they're just scared to go to school.
Another student, who also did not want to be identified, stayed home as well.
She says things got pretty ugly at the school earlier this week.
"Monday, there was 20 Somalians who gang beat one senior and two of his friends jumped in with him. And the one that they jumped, he ended up in the hospital," she says.
That student's mother was one of the parents who met with the Superintendent and the Chief of Police for nearly two hours this afternoon.
The Superintendent says they talked about ideas on how to move forward, but he declined to give any specifics.
"Well, we're doing everything we can to make sure that everybody is safe within in our school," says Tapper.
And for the moment, that includes keeping an increased police presence at the high school until at least Thanksgiving break.
The superintendent does say whatever the solutions is, it will likely involve all the students as well as members of the community.

Racist teens expect sympathy for the hate crime they committed
2009 - Starting at 2:23 there is a report from another station. Black witnesses don't support Domineek's version.
Grand jury votes not to indict teens in July 4th assault
Two Valley Stream teenagers criticized police and prosecutors Wednesday after a grand jury voted not to indict them on charges they beat up a man in what police had said was a possible racial attack.
Domineek Washington and Jimmy Blaise, both 18, faced gang assault charges after police said they beat Joseph Frigenti, 30, a Long Island Rail Road worker, outside his home on Broadway during a Fourth of July party.
Prosecutors had looked at the case as a possible hate crime, which would have elevated the charges to a class B felony, punishable by up to 25 years in prison, said Washington's lawyer, Brian Griffin of Garden City.
"Instead of doing a full investigation, they threw us in jail," Blaise said at a news conference, where both he and Washington spoke.
Police and prosecutors said they did the only responsible thing by presenting the evidence to a grand jury.
"The district attorney chose to present the case to an impartial grand jury of the defendants' peers," said Eric Phillips, a spokesman for District Attorney Kathleen Rice. "That's the fairest thing a prosecutor can do in a situation where there are two sides to a story."
Washington and Blaise are black and Frigenti is white. Griffin said there was not enough evidence for police to look into the case as a hate crime. Police said witnesses had raised the possibility of a bias attack.
Griffin said Washington, Blaise and two friends were arguing with some other Valley Stream teens when three adult men, including Frigenti, came over, told them to leave and then attacked them.
"Everything my client did was in self-defense, and he did nothing exceeding his right to defend himself," Griffin said. He asserted that Washington and Blaise were not responsible for Frigenti's most serious injuries, which included fractures of his eye orbits and jaw, contusions and swelling on the brain
Frigenti's lawyer, Elizabeth Fitzpatrick of Melville, could not be reached for comment Wednesday.
A prosecutor had previously said that several witnesses identified Washington and Blaise, although police said about a dozen youths were involved.
Nassau Det. Sgt. Anthony Repalone said the witnesses told police that there may have been a racial motivation in the attack. Police were obligated to look into that, he said.

Racist bullies force White boy to quit school
2013 - RENO, NV - A kid had to leave his school because he said the bullying was so severe.
"I've been hit by a fishing pole, I've been kicked, I've been punched, I've been thrown into a bush," James Wilson said.
It's not the first time the 11-year-old has been the subject of ridicule. He said it started in kindergarten.
"I was smarter than everybody in there, and I didn't brag about it or anything, but they figured it out and they hated me for it," he said.
Now it's more of a hate crime. Most recently, a group of kids allegedly beat him outside school grounds at the bus stop on Robinhood and Lakeside.
"They're saying they're doing it because I'm white, because they think I'm gay," he said.
The Washoe County School District won't comment on this specific case, but says there's zero tolerance for bullying, with a matrix of disciplinary actions before law enforcement can get involved.
"There can be suspension days that are involved, there can be assignments, a variety of different things that all fit in that consistent matrix," Katherine Loudon, counseling, equity and diversity director, said.
After filing a report with the school and Reno police, his parents pulled him out of the school system, saying it's not enough.
"They get a slap on the wrist and get told don't do it again, and that's it, so why does that stop them? It just seems like it's being brushed off for someone else to handle," Richard Wilson, James' father, said.
Louden encourages bystanders to intervene when they see bullying.
"You can make them feel so much better by standing by them, by telling them, 'It's OK, you don't have to listen to them,'" she said. "Reporting is the only way to help to ensure that the behavior will stop, and it is the only way to ensure that it won't happen to someone else."
For James, the only place he feels safe now is at home. "I don't know what I could say to them without them getting mad and trying to beat me up," he said.
Those who suspect their children are being bullied should look for a change in behavior.
If the children complain of bullying, validate them and make sure they feel like they are being heard and supported, then take action.

Racist Black man brutally beat up White man on New York bus
2013 - He is laughing about it now, but not much is funny about what happened to "Ken", an aspiring actor from Astoria.
"My nose was broken in two places - I have two stiches, my eye was closed," said Ken.
Last Saturday, Ken crossed paths with a man on a Westbound M-60 bus on 125th Street.
"A gentleman asked me for directions, 'does the bus stop at 116?', so I went to ask the driver," Ken says, "I was passing through the bus and there was a gentleman staring at me."
Ken says the man used an anti-white slur, and asked why he was in his face.
"I told him I wasn't in his face, and it was a crowded bus, and he just attacked me," adds Ken.
First, the man sucker punched Ken between the eyes, then landed 7 or 8 more blows with a closed fist before he ran off the bus.
"I'm just like, 'wow, this really hurts', I could feel my nose break, and there was blood gushing all over," Ken says.
The onboard camera system captured images of the suspect, who vanished before police could find him. Police are now investigating this as a possible hate crime, and Ken is hoping that someone comes forward to get the suspect off of the street.
"He seemed like he was out of his mind to be honest, he seemed a little deranged," says Ken, "I don't know if he was in prison before, or a mental patient, but he seemed very angry like he wanted to hurt somebody."

Racist Black gangs targeted Whites for hate crimes in Denver
2009 - Police believe a series of violent attacks in downtown Denver between July 17 and September 20 of this year were motivated by racial hatred of white people by the black suspects.
Explosive new information revealed today, in the arrest warrants issueed to nearly three dozen gang members accused in a series of attacks in the LoDo area. Police say the attacks have occured over the last four months, involving numerous victims, some of whom were beaten severely and seriously injured.
Arrest affidavits released by the Denver Police Department show a pattern of racially charged statements by the attackers preceding most of the attacks.
According to the documents, the suspects told police they specifically targeted white men, they called "crackers". They would approach a victim saying things like "it smells like white people" and "i hate (expletive) white people." The suspects told police they felt two black gangs "owned" sections of LoDo near The Bash nightclub and wanted to beat up white men in that area to teach them not to come downtown unless they "brought their friends for protection.'
Many of the suspects were blunt in their motivations when they were interviewed by detectives.
The suspects told police the beatings were part of gang initiations and that gang members could gain status by "beating up white dudes." Other motives were money and robbery. The suspects allegedly stole cash, credit cards and cell phones. And told police they robbed the white people because the victims had a lot of money.
Many of the attacks were caught on downtown surveillance cameras. In some cases, it appears the suspects knew the cameras were there but did not seem to care.
Police made the arrests following a lenghty undercover operation.

Possible Black on White hate crime in Cleveland, Ohio caught on tape
2014 - Cleveland Police are investigating an attack on a 10-year-old girl as a hate crime, and the attack was captured on video and posted on-line.
It happened on Leeila Avenue off Bellaire Road on the west side.
A video posted on YouTube shows a white girl on a scooter ambushed and beaten by a black girl. The beating went on for about 12 seconds until you hear voices in the background calling for it to stop.
A Cleveland Police report shows the attacker is 13 years old. The victim, Danielle Fair, says she felt bullied.
A neighbor says she saw it all, and she heard the attacker use a racial slur.
"Cracker. She called her a cracker," said Jessica Jaworski.
The attack looked planned, with the camera rolling even before the beating even started.
We went to the home of the teen throwing punches.

Racially motivated attack on White man in Vancouver, Washington, hate crime
2014 - VANCOUVER, WA Two men face charges in connection with an attack in Vancouver early Sunday morning that investigators believe was racially-motivated, according to court documents.
Matthew Boorujuy, 30, was walking his dog in the 1800 block of East 32nd Street near Washington Elementary School at around 4 a.m. Sunday when several men attacked him, investigators said.
Zachary Hotchkins, 22, allegedly pointed a gun at Boorujuy's face and pulled the trigger, according to court documents. But when the gun didn't go off, Hotchkins allegedly used the butt of the gun to beat Boorujuy in the face and head. Police said Robert Mitchell, 18, held Boorujuy down while he was being hit.
According to court documents, one of the suspects called Boorujuy a racial slur several times during the attack.
"In this time... It's 2014. Nobody should be picking on anybody that's different than them. It doesn't seem fair anymore," said Jennifer Travis, who heard the commotion from her home nearby.
Hotchkins was arrested near a strip mall along Fourth Plain Boulevard several days later. Police said he and Mitchell admitted to participating in the attack.
Both suspects appeared in Clark County Superior Court on Friday on suspicion of first degree assault. Hotchkins faces an additional charge of malicious harassment, which is a hate crime. Both men are scheduled to be arraigned on April 24.
Police said Boorujuy had to get staples and stitches on his face and head. His vision is now blurry in his left eye, according to court documents. He's already been released from the hospital.

Little girl attacked on a playground
An 11-year-old Jewish girl was attacked at a Crown Heights playground by a band of black youths who slammed her into a metal slide, kicked her repeatedly - and pelted her with anti-Semitic invective, the girl's mom said Wednesday.
Dumb Jew! B----! Why are you here? Why are you in this world? the boys screamed as they pummeled Nechama Benjamin at a Montgomery St. playground early Tuesday evening.
The shocking attack by at least three boys is being investigated by police. The beating caused Nechama to black out and left her with a bloody nose - and a terrible fear of leaving home, her mom said.
My daughter told me she is afraid to go out, to go to the park - to go anywhere, said Elka Benjamin, 31.
Nechama went to the local park with her 6-year-old brother around 6 p.m. Although Crown Heights has long been plagued by racial and religious tension, Nechama's mother thought it was okay for her kids to go to the playground alone because the family lives on the same block.
Trouble started when one of a group of boys playing soccer tossed the ball at Nechama, hitting her in the leg, her mother said.
She tossed it back - and an argument ensued. The boys surrounded Nechama, taunting her mercilessly, her mother said.
Then the boys grabbed her by the hair and dragged her from the bench to a playground slide.
Nechama spoke to cops Tuesday at the NYPD's 71st Precinct stationhouse, where a boy who witnessed the incident was also questioned.
No arrests have been made, a police source said Wednesday night.
