Affirmative Action Had To Go. And So Does The Radical Reactions from the Left
When former Supreme Court Justice Sandra Day O'Connor voted in favor of affirmative action, she stated, "The Court expects that 25 years from now, the use of racial preferences will no longer be necessary to further the interest approved today."
In a 6-3 and 6-2 decision, the Supreme Court found that the "race-conscious" admission policies of the University of North Carolina and Harvard violate the Constitution. With that, affirmative action came to an end.
What has not ended is the extreme reactions from the political Left, which range for hysteria to near total insanity. Cornell Law Professor William Jacobson explains the law and the decision, as well as the politics of the reaction and what many universities will do next.

Democrats Infuriated By Impeachment Inquiry. GOP Should Keep Going
Democrats from Rep. Ocasio-Cortez to Adam Schiff are infuriated with the impeachment inquiry into President joe Biden. And they should be; Hunter Biden's selling of influence has his dad - the leader of the Democrat party - in a bad, bad position.
To counter this, the Progressive Left exclaims that there is "no evidence!" Of course there isn't....if you refuse to look.
Also, a judge in Georgia has taken a unique axe to free speech. The courts usually avoid this one line, working hard not to cross it. Consider the line crossed, and consider the consequences for all of us.
William Jacobson, Cornell Law Professor and creator of Legalinsurrection.com joins Tony to discuss the issues.

On Trump Indictment: Where Is The Crime?
Cornell Law Professor William Jacobson is asking the key question on the latest indictment of President Donald Trump - What is the crime?
This isn't a conversation about whether you like what Trump did on January 6th, 2021. This isn't about whether you want to punish Trump for what happened on January 6th. This is about the law. Jacobson breaks down what the case the DOJ is making, and whether the indictment stands up to scrutiny...never mind whether a jury will buy the government's case.

Biden Corruption Is STILL The Biggest Story In America
This week has been a monster for news: An almost coup in Russia. The Trump audio leaked with him discussing classified documents. The Supreme Court is going to unleash a barrage of decisions.
But nothing compares to the clearer and clearer evidence that President Biden KNEW about his son Hunter's business dealings, and that AG Merrick Garland had the Department of Justice impede the investigation.
Don't get it twisted, these other stories do matter and deserve discussion. But, when ranked, the idea that the current President of the United States may have been involved in pay for play, and the current Attorney General helped thwart an investigation into him? That's the top story.
Period.

China's False Economy: How China's lies and failures affect the Midwest
Anyone who trust's China is out of their mind. As history has shown repeatedly, all Communists regimes lie. It's how they keep power, and how they keep control of their citizens.
China's economy is in awful shape. Their rabid Covid lockdowns, plus a global recession, has meant real hardship on every level. But, true to Communist form, they are lying to everyone to try and save face; including no longer reporting certain numbers in order avoid hard conversations with investors around the globe.
Then again, investors around the globe should know better than to trust the CCP.
But the global damage being done is very real, and very serious. Dr. Matt Will, economist at the University of Indianapolis, explains how the global recession - mixed with China's clear lying - is having impact on Midwest America and beyond.

NBC’s Alexander Grills KJP: Biden Says Border Walls Don’t Work, Now DHS Is Building Walls
ALEXANDER: “The president earlier today said that — he was asked, ‘Does the border wall work?’ He said, ‘No.’ But in the statement that was posted within the last 24 hours, the Department of Homeland Security Secretary says, ‘There is presently an acute and immediate need to construct physical barriers and roads in the vicinity of the border of the United States in order to prevent unlawful entries into the United States.’ So, who’s right: the statement from the DHS Secretary overnight or the President’s comments today saying they don’t work?”
Jean-Pierre: “So, a couple of things. Yes, it showed up on the register today. But the announcement — this is not new. This is from six months ago.”
ALEXANDER: “Well, it is new, because the waiving of the laws actually didn’t happen until overnight.”
Jean-Pierre: But it was — this is something that was out back — that the DHS was — put out back in — in — in — six months ago.”
ALEXANDER: “So, wait, wait. So, they waived the —“
Jean-Pierre: “So — and now — they announced — no —“
ALEXANDER: “Did they waive the laws six months ago?”
Jean-Pierre: “Well, what I’m saying is DHS announced this back in — in June, that the agency would do so. They actually said that they would do that back — in DHS –”
ALEXANDER: “But — so, they moved forward with it today — but the initial announcement was six months ago — by waiving the law. So, that’s what’s new today. Understood.”
Jean-Pierre: “Yes —“
ALEXANDER: “So, this statement, when he says ‘presently’ was filed —“
Jean-Pierre: “ — just want to make sure we’re clear on that.”
ALEXANDER: “— so, when he said there is ‘presently,’ are you saying, when he says there is ‘presently,’ he was referring to six months ago or referring to the date of which it was filed — 10/4?”
Jean-Pierre: “What I can tell you is DHS announced this back in June, that they were going to move forward with this. That’s what I can share with you. That’s what I — I know is to be true and is to be fact. Look, I can speak for the President. The President said — he was asked directly — he doesn’t believe a border wall is effective.”
ALEXANDER: “Does he have a disagreement with his Department of Homeland Security Secretary?”
Jean-Pierre: “I — I — what I can tell you is what the President — I — I’m going to tell you what the President said and what your colleague asked him. He said no, he doesn’t believe that the border wall —“
ALEXANDER: “I ask because he’s speaking —“
Jean-Pierre: “— is effective.”
ALEXANDER: “— in direct contradiction to what his own Homeland Security —“
Jean-Pierre: “No, I hear you.”
ALEXANDER: “ — Secretary says.”
Jean-Pierre: “I hear you. I’m speaking for the president. I’m saying that he has said that he does not believe a border wall is effective. That’s what he was asked. He has said that for some time now, and it still remains to be the case. He asked — right? — he asked Congress multiple times, his team has asked Congress to reappropriate the funds. They refuse to do that. We’re going to comply by law.”
ALEXANDER: “Will you ask the president on our behalf, then, in the absence of our ability to do that, whether he disagrees with the statement that there is ‘presently an acute and immediate need to construct physical barriers’?”
Jean-Pierre: “I’m happy to take that back.”
ALEXANDER: “Thank you.”
Jean-Pierre: “I’m happy to take that back."

Why Are Target and Kohl's So Woke? It's ESG! Just Follow The Money!
Target and Kohl's have continued to push gender ideology on children, offering kids clothes with slogans and iconography that are questionable. And, in the case of Target, offering swimsuits to children that allow for "tucking."
Boycotts are happening. But these companies do not seem bothered or worried. Why is that? The answer to most things is "follow the money." And it could be that ESG is making sure these companies make plenty of cash. If the investor is spending, maybe the customer doesn't matter anymore.
Tony Katz takes a look at why Target and Kohl's are acting this way.

Kennedy to Mayorkas: ‘You Are Not Qualified to Manage the Costco Food Court'
MAYORKAS: “Our administration has pursued a comprehensive strategy to manage this unprecedented migration. Our strategy includes expanded lawful pathways for migration, strengthened consequences for unlawful entry at the border, removing a record number of individuals found to be ineligible for protection under the law, and increased partnership across the region to curb irregular migration.”
HYDE-Smith: “So, the — the situation at the border, you’re saying, is not a disaster?”
MAYORKAS: “That is correct”
>> KENNEDY: Now, in 2023, this is senator hoven’s chart, how many — what percentage of the illegal immigrants who came across the southern border were not from Mexico? Do you know?
>> MAYORKAS: Senator I know third country nationals has been on the increase.
>> KENNEDY: What percentage — you don’t know, do you? It is 71%! Are people who are not from Mexico. So if we had a safe third country policy, that means that 71% of the 8.4 million people that you have allowed to come into our country illegally, let me be conservative and use 6.6 million, because they — the 8.4 includes got a ways. 71% of the 6.6 million people that you have allowed into our country illegally would not be hurt in a way. They could claim asylum from political, religious or racial persecution but they would have to do it in another country and more than likely Mexico. Is that not the case?
>> MAYORKAS: Senator that is inaccurate and incomplete.
>> KENNEDY: Did you not say when we last spoke and we propose that, is on it was a bad policy.
>> MAYORKAS: Senator let me share a prerequisite to a safe third country agreement and that is
>> KENNEDY: No, I am almost out of time and I’m not can I let you filibuster.
>> MAYORKAS: Senator I have to say.
>> KENNEDY: I am just not going to let you do it. It is my time madam chair and I will use it the way I want. Here is where you let others go on. I think you are a smart guy. Only one or two things going on here. Either you are not qualified to manage the Costco food court or you believe in open borders. And I think it's the latter.
>> Senator Kennedy, your time has expired.
>> Number one you are 0 for 2 on that. You are inaccurate in both respects number one and I would like to let the record reflect that 60 minutes is not 45 minutes because I can’t seem to answer a question without being interrupted.
>> KENNEDY: Well if you would answer a question —
>> Thank you very much, Madame chair. I appreciate the recognition.

Trump Takes New Hampshire, Yet Haley Remains
Former President Donald Trump is the first non-incumbent in GOP history to win both Iowa and New Hampshire. That's pretty amazing. What is also amazing is that Trump spent so much of his victory speech attacking former Amb. Nikki Haley.
Haley lost by double digits. But Haley also out-performed the polling. And beating expectations, in politics, is everything. A deep dive shows that there were crossovers; Democrats who registered as Republicans to vote for Haley in the primary. Trump supporters declare this proves her lack of GOP enthusiasm. But doesn't this also mean that Haley could have the crossover appeal in a general? And doesn't the GOP want to win the general?
Haley's path is tough...near impossible. But she doesn't show signs of leaving the trail yet.
PLUS: Joe Biden's lack of leadership has made the Middle East even more dangerous for the U.S. and the world. Noah Rothman of National Review has more on this remarkable failure in policy.
AND: Let's be clear....Dr. Anthony Fauci is guilty. He lied, he covered up and he believes that he knows best. And now his buddy from the WHO - Dr Tedros! - wants us all to have digital medical records that can determine our coming and going.

We Are At War With Iran, Because Iran Is At War With Us
The drone strike that killed three U.S. Service members was just another attack in the continued war with Iran. Yes, between Hamas, Hezbollah and the Houthi rebels in Yemen, Iran is at war with the United States.
Sadly, the Biden Administration doesn't understand this reality. Biden has promised a response, but who knows when that will happen...or how. On the Right, there are plenty who are demanding a swift and forceful response in Tehran. Then there is the Tucker Carlson, who see this as war mongering and feel no need to respond. That side asks, "What are we doing there to being with?"
ALSO, a border deal is in the offing, but the GOP is already balking. While the details are not yet out, they are not wrong to assume what they've heard is true: This bill doesn't go nearly far enough to deal with the border issues. And what is President Biden talking about? Pass the bill and I will shut down the border? He can do that right now!
PLUS, does anyone care about the Super Bow;, Hillary Clinton's hilarious warning and how we should respond to activists who destroy art.

Pence. Christie. Burgum? Why Are They Running for 2024?
For most Americans, the GOP field of presidential candidates will come down to President Trump or Gov. Ron DeSantis. For large swaths of the political right, everyone else running in 2024 is looking to be VP, or get a cabinet position.
But even with Trump/DeSantis looming, contenders are still joining the race. Most recently, former VP Mike Pence, former NJ Governor Chris Christie and current North Dakota Governor David Burgum.
Wait. Who?
Why are they running? Well, it's complicated....but not really.

Impeachment of Mayokas Moves Forward
The Biden Administration is talking tough about protecting the border. Of course, they're only talking tough because it's an election year. And they're only talking tough because the border is a disaster; politically, economically and on a humanitarian level.
For three years, the GOP - and America! - have been asking, talking, begging and screaming for something more to be done. In those years, Homeland Security Secretary Alejandro Mayorkas has failed to move on existing policies, toed the Biden Administration party line and has presided over the largest numbers of illegal immigration ever...if not near ever.
The GOP now moves to impeach the Secretary.
ALSO: The Biden Administration has yet to respond to the killing of three U.S. soldiers by Iran. Meanwhile, the administration tries to claim that they've been tough with Iran and getting results. However, the facts don't back up the claim. And "Don't" is not a policy.
PLUS: Taylor Swift is not a psy-op. Neither is Travis Kelce. The response to them - and their coverage- is a great example of how to ensure you lose the culture and future elections.

Gov. Grisham's Wrong, Evil and Ridiculous Assault on the Constitution
New Mexico Governor Michelle Lujan Grisham (D) has decided that the Constitution can be suspended if she simply feels like doing so.
In order to combat "gun violence" in her state, gov. Grisham decided that no one in New Mexico can open or conceal carry a firearm for 30 days.
Of course, this is a clear and flagrant violation of the US Constitution. Even leftists have said so. But she would have had to know that. So, why do it? Is this just a test balloon to see how Americans would react?

Interest Rates Up Again? Why Isn't Bidenomics Working?
the Federal Reserve just raised the target rate to 5.25-5.50%. This, while Americans are told that inflation has cooled to 3%, and while President Biden tells Americans that Bidenomics is working. Heck, the White House has fully embraced the term, "Bidenomics!"

Banks downgraded. Chinese Exports Fail. Welcome To The Global Recession!
President Joe Biden can scream that Bidenomics is working great, but reality is hitting Americans in the face daily. Europe is in recession, having had two negative quarters of GDP growth. China is losing markets with whom they can trade.
But those are world-wide concerns, not Americas. True. America only has to be concerned with a massive credit crunch, coupled with a Fitch downgrade of the US economy and mood's downgrading the banking sector.
The US is not in a recession. But these events don't show us that everything is far from good. Economist Dr. Matt Will explains the the global landscape, and how AI - and other tech opportunities - are keep the US looking good on paper.

Can Nikki Make It Out Alive? - Tony Katz Today
Amb. Nikki Haley needs a decent showing in New Hampshire to help her in her home state of South Carolina. That's just political fact.
The polling does not show evidence of that happening, with former President Trump ahead in N.H. by 18 points.
Does a path exist for Haley if she fails?

Why Is the White House So Proud of Bidenomics?
They named it Bidenomics. Or, at least, they embraced the term. The White House can't stop crowing about how great the economy is doing. They still claim they've created jobs...even though it's nothing more than people being allowed to go back to work post-Covid.
They claim that not beating jobs numbers is actually great growth. And with today's top line news about inflation being down, they are ecstatic.
But is inflation down? Will we see the Federal Reserve bring down interest rates? Are businesses feeling comfortable for the foreseeable future?
Economist Dr. Matt Will from the University of Indianapolis shares his take with Tony. As always, Wall Street is a long, long way away from Midwest Main Street.

Ending DEI Bigotry...One Lawsuit At A Time!
William Jacobson is taking on the state of New York. Through his project, EqualProtect.org, Jacobson is bringing suit against a long standing New York practice in education that allows schools to discriminate against students by only offering educational opportunities to students of a certain race or color.
In this case, Jacobson, a lawyer and law professor at Cornell University, is representing Asian parents who see their children being discriminated against.
DEI is bigotry, and it damage everything and everyone it touches. Prof. Jacobson talks to Tony about the lawsuit, as well as the state of antisemitism on college campuses.
PLUS: President Biden admits that the first retaliations agains the Houthi rebels have failed, so he's trying again. The New Hampshire primary is days away, and Amb. Nikki Haley is sounding her best (seriously...listen to how she's speaking!) But will it be enough to defeat former President Trump, who in national polls is getting 72% of the vote. 72!!!!

KJP is Wrong About America's Confidence in Biden
Jean-Pierre: “Inflation fell to the lowest level in three years. That’s important. Consumer confidence is at the highest level since July and the second-highest level in two years."
BURNS: “Who feels good about the economy right now? Who feels bad about the economy right now? Alright. Shelley, let me ask you first. What do you think is going on economically? What are the challenges you are facing economically?”
UNKNOWN: “I would think it would be groceries, gas, everything you have to buy every day is way more expensive than previous years.”
BURNS: “Let me — let me ask you this. Right now, when you look on paper, right, you’ve got low unemployment rates, wages are up, inflation is easing, stock market is doing well, but are you feeling any of that? How do you feel about the economy day to day?
UNKNOWN: “I’m not sure I agree with what you just said.”
UNKNOWN 2: “Not better off now than I was four years ago. I retired three years ago. I never planned on using some of the money that I saved to retire that I had to use because of the economy now. So, I don’t know if the stock market is up, I must be in the wrong place. Because I’m not making the same money that I was making before.”
Jean-Pierre: "And so we’re glad to see that Americans are feeling more confident about the economy.”

DeSantis Is Out. So the Race Is Over....Right?
Florida Gov. Ron DeSantis got out of the presidential race on Sunday, suspending his campaign and endorsing President Donald Trump.
Conventional wisdom says the race is over, and Trump gets the nomination. Honestly, does Former Amb. Nikki Haley really have a chance in New Hampshire and South Carolina to force a Super Tuesday battle? Come on....it's over!
Right?
Plus, two Navy SEALs are dead and America still doesn't understand that it's at war with Iran. An immigrant has an ominous warning for the US. And the elites in Davos are looking to get some action....late-night style!
