Brittany Watts, a 33-year-old woman, was charged with felony abuse of a corpse after she miscarried a non-viable fetus in her bathroom. The charges were filed in Trumbull County, Ohio, and she faces a fifth-degree felony, which carries a maximum sentence of up to a year in prison and a fine of $2,500.

The fact that this woman's personal health issues have been exposed to the public is a violation of HIPPA. The nurse and the risk management violated HIPAA. They were trying to protect the hospital, that's all they were concerned about, what would happen to the hospital!

She used the medically correct term - inducing after a miscarriage is indeed an abortion - but because politicians have demonized that term, the hospital treated her as a criminal. Outrageous, like the rest of this horrible horrible story. And that nurse deserves to be arrested for a false report.

§ 2927.01. Abuse of a corpse.

(A) No person, except as authorized by law, shall treat a human corpse in a way that the person knows would outrage reasonable family sensibilities.

(B) No person, except as authorized by law, shall treat a human corpse in a way that would outrage reasonable community sensibilities.

(C) Whoever violates division (A) of this section is guilty of abuse of a corpse, a misdemeanor of the second degree. Whoever violates division (B) of this section is guilty of gross abuse of a corpse, a felony of the fifth degree.

This section prohibits treating a human corpse in a way the offender knows would produce righteous and reasonable outrage among members of the family. It covers conduct formerly prohibited by specific prohibitions against grave robbing and unlawful dissection of a corpse. It also includes other kinds of conduct, such as copulating with or otherwise mistreating a corpse. The section does not include conduct authorized by law, such as a mandatory autopsy or the exhumation of a dead body on court order.

Abuse of a corpse is a misdemeanor of the second degree.

The International Olympic Committee’s decision to allow what we now term a “previously male” weightlifter to compete against women is puzzling many people. And so it should, as this simple statistic demonstrates better than all the nonsense articles to the contrary: the world record for men’s deadlift is 1,104 pounds; the women’s record is 694 pounds. Explain that difference without reference to biology if you can.

It really is strange how quickly, and with so little resistance, people yield to the strange new lingo of what we may call the “woke movement.” People who are fervently woke seem to have gifted themselves with the very curious right to change the names of things.

I added “fervently” there because I cannot believe that even in the climate of new wokeism, all are so presumptuous and vain as to think they have such a right. But there’s no doubt that it is from this dim and grim movement that cancel culture springs. (Grim, because if you stir a woke hive, you will get stung. Dim? Well, let me continue.)

In the newly fashioned and explosively present trans movement, you may find perfect illustrations of this. The basic names of things, such as “man” and “woman,” are being hauled from their very ancient roots. I am no linguist, but I’m willing to speculate that the very first words ever uttered — from that one instant, in the vast reaches of time when human beings discovered, were given or stumbled upon the faculty of speech — were mutterings to denote, and to name, mother and father.

The faculty of manipulating sounds to register and declare the objects around us and, over time, of applying sounds to denote emotions and thoughts, was the absolute central accomplishment of the human race. Thought emerges from speech. No speech, no thought. Without thought, we would have stayed in the caves forever.

Very close to those primal designations, I would also guess our ancestors had words (or sounds) for boy and girl, male and female. Language likely grew outward from such basic, infallible terms. Without seed words — such as mother, father; male, female; water, food — language could not have grown into the highly accurate tool to describe our reality that we are all accustomed to.

Sunday was Mother’s Day, probably the only secular holiday that has universal appeal and charm. For however little we know of the person standing next to us waiting in the queue, we do know that he or she, like you or I, had a mother. We know that, out of the darkness of the 13.8 billion years that preceded our brief burst into being, it was a woman, a female, a mother, who corralled us into life. It doesn’t matter who we are — butcher, baker, candlestick-maker — it was a mother that got us here.

Or perhaps you would prefer “parent-unit one.” Or the latest odd, tormenting and (to my mind insulting) mock euphemism to come out of the “making up words” faction of the woke establishment: “birthing parent.” This, it is the suggestion of the terminally woke, is the more “inclusive” term. Well, in the words of the immortal linguist Yogi Berra, “inclusive me out.”

I can see now in my mind’s eye the sweet smiling face of a six-year-old girl looking with immeasurable affection towards her mother yesterday and wishing that dear woman, “Happy birthing-person day, it. You are the best birthing-person in the whole wide world.”

Birthing-person will never replace mother, regardless of how much people here in the cocoon of the West’s prosperity claw away at every rule and truth of our nature. It is a precarious twilight in which “man” and “woman,” to use the academic vernacular, are contested, problematic — hold for a laugh — “cisgender-heteronormative” terms.

They are none of these things. Like mother and father, sister and brother, man and woman, these words are the heart of language itself. The attempt to usurp any of these life-defining words with the ugly and forced argot of academic ideologues is an insulting travesty. And the effort to brand anyone who uses words that have worked since our ancestors came down from the trees is the consummate marriage of arrogance with ignorance.

Combine birthing-person with chest-feeding (for breastfeeding) in this new vocabulary, and you see how hollow and ridiculous this business is. Sensible people should never accommodate the attempt to force people to use words that are forged in an ideological furnace. To control language is to control thought; to control thought is a sin — a sin against human nature and the idea of the individual.

Why we make it so easy is a perplexity I cannot resolve. In any event, a couple days late perhaps, but a delayed Happy Mother’s day, all you birthing-persons. And a wave to all your little person-units.

Black woman charged after miscarrying in bathroom shares feelings about arrest and Brittany Watts shared shocking details surrounding her miscarriage last September.

A Black Ohio woman who was charged after having a miscarriage in her bathroom toilet last year said she does not “want any other woman to go through what I had to go through.”

Brittany Watts, 34, spoke with CBS Mornings in her first interview following her September arrest. Authorities got involved after a hospital nurse who consoled Watts when she sought medical help called the police, Watts said. Earlier this month, an Ohio grand jury decided to dismiss the charges.

On Sept. 19, Watts was 21 weeks and five days pregnant when she noticed an “uncomfortable” fluid leaking from her, she said. Her OB-GYN told Watts that her pregnancy was nonviable, according to a report by the Trumbull County Coroner’s Office. Watts was then transported by ambulance to Mercy Health St. Joseph Warren Hospital in Warren, Ohio, where she waited hours “for the doctor to come in or call,” she said during the interview.

“I kept asking whoever would come in to check my vitals — I said, ‘Have you heard anything?’ and they were like, ‘Oh, well, we’re still waiting. We’re still waiting.’”

Watts waited at least eight hours before deciding to leave the hospital “against medical advice,” according to medical records. The hospital report also states that Watts understood her risk of complications, including hemorrhage, sepsis or death.

Watts returned to the hospital the next day to get a labor induction; she waited for 11 hours, she said, but was never induced and opted to go home.

“I felt frustrated,” Watts said. “I felt ignored.”

Watts’ case was referred to Mercy Health’s ethics committee that day, after staff reported concerns with Watts using the word “abortion” when discussing the next steps to her care, according to medical records shown by CBS News. In Ohio, abortions after 22 weeks into a pregnancy are banned with exceptions to life-saving care, according to the state’s law.

In a statement to NBC News, Mercy Health declined to give specifics about Watts’ care, citing patient privacy.

“It is with the deepest empathy during difficult times that we care for those who have suffered a great loss,” the statement said.

While waiting on a decision about an induction on Sept. 20, Watts said she was worried about her own health. She miscarried two days after leaving the hospital for a second time.

Upon arriving at the hospital a third time in the middle of her miscarriage, Watts said a nurse reassured her that “everything’s going to be OK.” Meanwhile, that nurse, whom the hospital has not identified, called the police, Watts said. In a call with a 911 dispatcher shared by CBS News, the nurse said Watts “didn’t want to look” at the fetus. She also alleged Watts “didn’t want the baby and she didn’t look,” according to the 911 audio. Watts said, however, this was not true.

“I said I did not want to look,” Watts said Friday. “I have never said I didn’t want my baby. I would have never said something like that. It just makes me angry that somebody would put those type of words in my mouth to make me seem so callous and so — so hateful.”

Police arrested her days later on charges of abusing a corpse, under a state law that punishes those who treat a human corpse in a “way that the person knows would outrage reasonable family sensibilities” or “community sensibilities.” The fifth-degree felony charge is punishable by up to one year in prison and a fine of up to $2,500.

Warren Police did not immediately respond to a request for comment.

An Ohio grand jury decided on Jan. 11 that Watts would not be indicted. In a statement, Trumbull County Prosecutor Dennis Watkins said that “Watts did not violate the Ohio criminal statute.”

Traci Timko, Watts’ attorney, said his client was painted as a “young, unmarried Black woman that did not comply with their orders to keep waiting.” The hospital, she added, “weaponized the police.”

Watts said she believes her race played a role in why she was charged. She also said there are no regulations explaining what women like herself should do in the situation she experienced. Today, Watts said she is “motivated” that the charges have been dropped and is advocating for changes in laws for women who experience miscarriages. “As the old saying goes, ‘History repeats itself,’” Watts said. “I don’t want it to happen in this case.”

A woman who had a miscarriage is now charged with abusing a corpse as stricter abortion laws play out nationwide. An Ohio woman who had sought treatment at a hospital before suffering a miscarriage and passing her nonviable fetus in her bathroom now faces a criminal charge, her attorney told CNN.

Brittany Watts, 33, of Warren, has been charged with felony abuse of a corpse, Trumbull County court records show.

“Ms. Watts suffered a tragic and dangerous miscarriage that jeopardized her own life. Rather than focusing on healing physically and emotionally, she was arrested and charged with a felony,” her attorney, Traci Timko, told CNN in an email.

“Ms. Watts’ case is pending before the Trumbull County Grand Jury. I have advised her not to speak publicly until the criminal matter has resolved.”

Though a coroner’s office report said the fetus was not viable and had died in the womb, Watts’ case highlights the extent to which prosecutors can charge a woman whose pregnancy has ended – whether by abortion or miscarriage.

After last year’s Supreme Court decision overturning Roe v. Wade and the federal right to an abortion, a host of state trigger laws went into effect across the country that placed new restrictions or bans on abortion.

In turn, some women carrying fetuses with fatal abnormalities have been barred from having an abortion in their home states. Other women with potentially life-threatening pregnancies have also been unable to get an abortion, as medical exemption clauses can be vague and medical providers fear severe legal consequences.

When asked whether the charge against Watts may have been influenced by the repeal of Roe v. Wade, her attorney said ignorance is the main factor.

“I believe that this charge stems from the lack of knowledge and/or insight that men have regarding the realities of miscarriage and women’s health in general,” Timko told CNN.

“I don’t believe the fetal personhood issue was something they considered or found relevant. I believe this case demonstrates the need for education and showcases the sweep that the fetal personhood debate has even outside the context of abortion.”

A prosecutor said Watts’ actions after passing the fetus are at the center of the case.

“The issue isn’t how the child died, when the child died. It’s the fact that the baby was put into a toilet, large enough to clog up the toilet, left in that toilet, and she went on her day,” prosecutor Lewis Guarnieri said at preliminary hearing last month, according to footage from WKBN.

Trumbull County Prosecutor’s Office spokesperson Guy M. Vogrin declined to comment on the case, telling CNN all cases at the grand jury level are secret proceedings under Ohio law. CNN has also reached out to the Warren Police Department for comment.

Days of bleeding and a critical timeline
Watts went to a hospital three times in four days due to vaginal bleeding, a report from the Trumbull County Coroner’s Office says.

When she was first admitted to the Labor and Delivery Department at St. Joseph’s Hospital on September 19, “She was diagnosed with premature rupture of membranes and severe oligohydramnios,” the report states. In other words, her water had broken prematurely, and she had exceptionally low – if any – amniotic fluid.

“Although a fetal heartbeat was found, it was recommended by medical staff that an induction occur of the nonviable fetus,” the coroner’s office report states.

At the time, Watts’ pregnancy “was 21 weeks, 5 days gestation,” the report says. In Ohio, abortions are legal until fetal viability – which is generally considered to be around 22 to 24 weeks of pregnancy. After viability, the state can legally restrict abortion access unless the patient’s life or health are at risk.

However, “Brittany Watts signed herself out of the hospital against medical advice on 9/19/2023,” the coroner’s office report states. CNN has asked her attorney about why Watts may have left the hospital without having the nonviable fetus induced, as recommended by the medical staff.

The next day, September 20, Watts returned “for the same issue and left against medical advice again,” the coroner’s office report states.

Watts returned on September 20 expecting to be induced to deliver her preterm pregnancy, according to The Washington Post. But for hours doctors and officials mulled the ethics of inducing labor for a woman who had been diagnosed with preterm premature rupture of membranes (PPROM), had no detectable amniotic fluid, was bleeding vaginally and had advanced cervical dilation, the Post reported. Watts eventually left.

Then on September 22, Watts returned to the hospital “for vaginal bleeding with retained placenta after a home delivery,” the coroner’s office report states. “According to medical records, Brittany Watts stated that at approximately 5:58am … she delivered the fetus into the toilet of her residence.”

Police and coroner’s staff respond to home
The hospital staff notified the Warren Police Department, which responded to Watts’ home, the coroner’s office report says.

CNN reached out to the hospital for comment about why staff notified police. Maureen Richmond, vice president of integrated communications at Mercy Health – a Catholic health care system that includes St. Joseph Warren Hospital – sent the following statement to CNN:

“The safety and security of every patient who comes to us for care is our highest priority. Out of respect for patient privacy, we will not discuss individual specifics of care.

According to the coroner’s office report, “Brittany stated to police that she had taken the fetus out of the toilet and placed in it a black bucket. She then told police that she put the remains near the garage in the back yard.”

An investigator from the coroner’s office also responded to the scene. “Near the side of the garage, next to a large trash can, there was a pile of tissue, blood and what appeared to be paper towels in the weeds,” the coroner’s office investigator, Alaina Jamison, wrote in the report.

When Warren police detectives were called out to investigate the scene, they discovered “the downstairs toilet was filled with blood,” the coroner’s office report says. “Looking into the toilet, it was filled to the brim with water, blood, blood clots and tissue.”

The coroner’s investigator checked inside the toilet bowl and “felt what appeared to be a small foot with toes,” the investigator’s report says. The toilet was later broken apart by Warren police detectives, “and the fetus was retrieved,” the report states.

An autopsy revealed the fetus’ cause of death was intrauterine fetal demise – meaning the fetus died inside the womb – due to severely low amniotic fluid from the premature rupture of membranes.

Miscarriage is most common early in the first trimester, often before a woman knows she’s pregnant. It’s less common to naturally lose a fetus more than halfway through gestation – often known as stillbirth. About 21,000 stillbirths happen each year in the US – about 1 in 175 pregnancies, according to the US Centers for Disease Control and Prevention.

Symptoms & Signs of Miscarriage
A pregnancy that ends on its own within the first 20 weeks of gestation is called a miscarriage. Miscarriage symptoms that occur before, or during, can be different for everyone. It is the most common type of pregnancy loss. Studies reveal that anywhere from 10-25% of all clinically recognized pregnancies will end in miscarriage. Chemical pregnancies may account for 50-75% of all miscarriages. This occurs when a pregnancy is lost shortly after implantation, resulting in bleeding that occurs around the time of her expected period. The woman may not realize that she conceived when she experiences a chemical pregnancy.

Warning Signs of Miscarriage
If you experience any or all of these miscarriage symptoms, it is important to contact your health care provider or a medical facility to evaluate if you could be having a miscarriage:

Bleeding may start as light spotting, or it could be heavier and appear as a gush of blood. As the cervix dilates to empty, the bleeding becomes heavier.

The heaviest bleeding is generally over within three to five hours from the time heavy bleeding begins. Lighter bleeding may stop and start over one to two weeks before it completely ends.

The color of the blood can range from pink to red to brown. Red blood is fresh blood that leaves the body quickly. Brown blood, on the other hand, is blood that’s been in the uterus a while. You may see discharge the color of coffee grounds, or near black, during a miscarriage.

Exactly how much bleeding you’ll experience depends on a variety of circumstances, including how far along you are and whether or not your miscarriage is progressing naturally. Let your doctor know if you fill more than two sanitary pads an hour for two or more hours in a row.

Other miscarriage symptoms may include:

Mild to severe back pain (often worse than normal menstrual cramps)
Weight loss
White-pink mucus coming from the vagina
True contractions (very painful happening every 5-20 minutes)
Tissue with clot like material passing from the vagina
A sudden decrease in signs of pregnancy
Most miscarriages occur during the first 13 weeks of pregnancy. Pregnancy can be such an exciting time, but with the great number of miscarriages that occur, it is beneficial to be informed about all potential miscarriage symptoms.

What Causes Miscarriage?
During the first trimester, the most common cause of miscarriage is chromosomal abnormality – meaning that something is not correct with the baby’s chromosomes. Most chromosomal abnormalities are the cause of a damaged egg or sperm cell or are due to a problem at the time that the zygote went through the division process. Chromosomes are tiny structures inside the cells of the body that carry many genes, the basic units of heredity. The reasons for miscarriage are varied, and most often cannot be identified.

Types of Miscarriage
Miscarriage is often a process and not a single event. There are several types of miscarriages and they all may have different miscarriage symptoms. You may hear your health care provider mention types of miscarriages:

Threatened Miscarriage: Some degree of early pregnancy uterine bleeding accompanied by cramping or lower backache. The cervix remains closed. This bleeding is often the result of implantation.
Inevitable or Incomplete Miscarriage: Abdominal or back pain accompanied by bleeding with an open cervix. Miscarriage is inevitable when there is a dilation or effacement of the cervix and/or there is a rupture of the membranes. Bleeding and cramps may persist if the miscarriage is not complete.
Complete Miscarriage: A completed miscarriage is when the embryo or products of conception have emptied out of the uterus. Bleeding should subside quickly, as should any pain or cramping. A completed miscarriage can be confirmed by an ultrasound or by having a surgical curettage (D&C) performed.
Missed Miscarriage: Women can experience a miscarriage without knowing it. A missed miscarriage is when embryonic death has occurred but there is not any expulsion of the embryo. It is not known why this occurs. Signs of this would be a loss of pregnancy symptoms and the absence of fetal heart tones found on an ultrasound.
Recurrent Miscarriage (RM): Defined as 3 or more consecutive first trimester miscarriages. This can affect 1% of couples trying to conceive.
Related Issues
Blighted Ovum: Also called an embryonic pregnancy. A fertilized egg implants into the uterine wall, but fetal development never begins. Often there is a gestational sac with or without a yolk sac, but there is an absence of fetal growth.
Ectopic Pregnancy: A fertilized egg implants itself in places other than the uterus, most commonly the fallopian tube. Treatment is needed immediately to stop the development of the implanted egg. If not treated rapidly, this could end in serious maternal complications.
Molar Pregnancy: The result of a genetic error during the fertilization process that leads to the growth of abnormal tissue within the uterus. Molar pregnancies rarely involve a developing embryo, but often entail the most common symptoms of pregnancy including a missed period, positive pregnancy test and severe nausea.
Understanding early fetal development and first-trimester development can give you a good idea of what is going on with your pregnancy, and help you know what your health care provider is looking for when there is a possible miscarriage occurring.

Physicians say the prosecution is ‘ludicrous’
Ohio Physicians for Reproductive Rights slammed the criminal charge against Watts, saying it would deter other women who suffer miscarriages from seeking medical help.

“As citizens, we are outraged that the criminal justice system is being used to punish Ms. Watts who, like thousands of women each year, spontaneously miscarried a non-viable fetus into a toilet and then flushed,” the group said in an open letter to the Trumbull County prosecutor.

“By seeking to indict her, you are clearly implying that anyone who miscarries at any point in pregnancy in our state must retrieve the fetal tissue whether they are at home, at work, at school, at a restaurant or other public place and preserve it until the tissue can be disposed of properly even though Ohio law does not define what a proper disposal method would be. … That fact alone renders your prosecution both unjust and ludicrous,” the letter says.

“As physicians we are deeply concerned that your actions will deter women who miscarry from obtaining the medical attention they need and deserve.”
