The Epoch Times reported that Justice Thomas questioned John Sauer, the attorney representing former President Donald Trump, about whether they had challenged Smith's authority to bring charges against Trump. Sauer clarified that they had not directly challenged Smith's authority in the current case before the Supreme Court but emphasized the significance of the issue due to Smith's exceptional prosecutorial power, despite never being nominated by the president or confirmed by the Senate. Sauer's response referred to an amicus brief filed by former Attorneys General Edwin Meese and Michael Mukasey on March 19, which raised doubts about Smith's legal authority.

During the hearing, Justice Thomas specifically asked John Sauer, Trump's attorney, whether they had challenged the appointment of special counsel Jack Smith, who was appointed to the case by Attorney General Merrick Garland. The amicus brief submitted by the former attorneys general argued that Smith lacked the proper authority to conduct the prosecution since he was not appropriately appointed as a federal officer. They claimed that Smith possessed significant power without any accountability and contended that his appointment was unlawful, therefore rendering any actions resulting from it, including the prosecution of Trump, also unlawful.
