Washington Gun Law President, William Kirk, discusses the huge ruling from the United States District Court for the Southern District of California, where the Honorable Roger T. Benitez has found California's mandatory background check for ammunition laws, as well as their ban on importation of ammunition from out of state to have not one, but three Constitutional problems. But today we focus on the order denying the State of California's motoin for a stay so that they could appeal this ruling. Not only has His Honor denied that motion, but he took a chance to add a few extra thoughts, so learn what all of this means and arm yourself with education.

The Obama-Appointed Judge Who Just Overturned a Federal Gun Law
Washington Gun Law President, William Kirk, dicusses the matter of United States v. Cherry, a challenge to 18 U.S.C. Sec. 922(g)(1) which prohibits possession of firearms by anyone who has been previously convicted of a felony. Here, we see what happens when a judge, who politically is not likely to side with the plaintiff's arguments, actually follow the clear directives of the Supreme Court in Bruen and come to a just result. This is a fantastic piece of work from a Judge who simply followed the law. So learn what all of this means and arm yourself with education today.

When New York's Red Flag Laws Meet the Bruen Opinion
Washington Gun Law President, William Kirk, discusses the recent ruling from the the Supreme Court of Dutchess County New York, where the Court has denied a challenge to the States' Red Flag law. This ruling, sort of a first of its kind, is the first real opinion to examine Red Flag laws under the Bruen analysis. One would think that the answer is quite obvious, but you might be surpised how the Court got to where it wanted to go. You might even be more surpised how they ruled on the prodecurial deficiencies found in nearly all Red Flag Laws. So learn what all of this means and arm yourself with education today.

Maine's Yellow Flag Laws and Why They Didn't Work
Washington Gun Law President, William Kirk, discusses the recent tragic and horrible events which took place in Lewiston, Maine but today we focus on the laws which were designed to prevent something like this and why they didn't work. We focus on Maine's Yellow Flag laws, which are a compromise between Red Flag laws and something far more resembling due process. But there are very important lessons to learn from this, namely it does not matter how many laws you pass, you actually need to use them. New York City Gets a Second Amendment Beatdown
Washington Gun Law President, William Kirk, discusses the huge ass-kicking that New York City took recently in the matter of Srour v. New York City. This case, which started as a challenge to NYC's "good moral character" requirements in order to obtain a concealed carry license. But during the course of this litigation, the Supreme Court handed down its Bruen decision so that resolved the matter, right? Wrong, instead New York City just passed the same unconstitutional laws but used different words. So what did Srour do? Amend the complaint and then get an injunction granted by the US District Court in Southern District of New York. Learn what this means to all of you in the Big Apple and arm yourself with education today.

What Really Just Happened at the Supreme Court on the Frame and Receiver Rule?

The Real Evil Behind This Amicus Brief
Washington Gun Law President, William Kirk, discusses a very troubling amicus brief, filed by 17 State Attorneys General, who have completely distorted the holdings of Bruen in an attempt to yet again, inject a two-part balancing test into Second Amendment litigation. What is more troubling is that they have filed this in the 9th Circuit in the matter of Teter v. Lopez, a challenge to Hawaii's butterfly knife ban, but do not be surprised when this exact line of reasoning ends up in the 9th Circuit's ruling in the matter of Duncan v. Bonta as well. So learn what all of this means, and arm yourself with education today.

The Truth About the Rahimi Case
Washington Gun Law President, William Kirk, discusses some universal truths about United States v. Rahimi which is set to be argued before the Supreme Court next month. This case, on appeal from the Fifth Circuit, will determine if it is Constitutional to strip an individual of their Second Amendment rights based upon a mere allegation supported by preponderance of evidence. But many in the main stream media and some in the 2A community have seriously misrepresented what this case is about and what's at stake. So today, let's give you some universal truths about this case so that you can arm yourself with education today.

How DOJ is About to Open Pandora's Box on Gun Control
Washington Gun Law President, William Kirk, discusses the DOJ's request on two separate cases for review by the United State Supreme Court which could significantly alter the Second Amendment landscape. We have long since been advocating for review, especially in light of Bruen, of the laws which forbid non-violent felons and cannabis users from exercising what is suppose to be inalienable rights. So today we talk about two cases, one from the Third Circuit the other from the Fifth Circuit, which involve those exact issues. The US really had no choice but to appeal these having lost at both Circuit Courts. Learn the amazing opportunity that this presents and arm yourself with education today.
