Do you remember my 8/24/22 post about that huge increase of our City manager cost and nowhere to find city council approval of his salary increase? Cost increasing from $191,227 (2020) to $236,240 (2021).
This meeting discussion was the follow up on their 8/16/22 executive session. City manager Harper has not attended the meeting, “he felt ill last couple days”.
▪️K. Kahlich said “an independent third party should be involved to find the correct resolution on those items we discussed”.
“On this budget I would like to see revision on the City manager office salary and wages … revise from $464,871 to reduce it by $36,823 to new number that’s $428,048.”
▪️A. Groff said “There was a request for independent investigation… I went ahead and began that investigation”. He also said three times within 2 minutes this is about cost of living adjustment.
◾️📌D. Cates said “I too could approve the budget with an amendment …. that City manager 2023 proposed based salary of $206,823 be reduced by $36,823 to reflect the contracted amount of $170,000 as agreed on the contract dated March 20, 2018 ….until a third party legal opinion is rendered and the issue between the contracted salary and actual paid salary is formally resolved.”
▪️D. Cates said “We had two conflicting sets of legal advice…. We have to get a third legal advice we can lean on.”
◾️A Groff said “we have requested third party investigation and the paperwork was turned over to the state.”
After exec session City Council approved 2023 budget as is, ie without lowering city manager salary. Knape made motion, Martin seconded, approved 5:2. Kahlich and Cates voted against

If you ever witnessed Mr. Jeff Roberts public speaking, you may understand why he did all what it takes to avoid Mayoral Forum prior last elections. Anything but to be with Mr. Kuykendall on same stage.
On 4/21/15 2:50 he stated “…I will not be able to attend due to a prior commitment scheduled months in advance”.
On 4/22/16 his wife Melisa stated a school was named after Jeff’s dad and “we did not find out until Tuesday he was a finalist… no, it [not attending Mayoral Forum] was not to attend the school board meeting”.
On 4/23/16 Jeff Roberts came up with the story about not attending Mayoral Forum due to “hosting our missionary friends from Russia in the evening” who are here only for FEW DAYS. However, the newspaper recorded Jeff Roberts “was in attendance at the district’s board of trustee meeting” the Mayoral Forum night.
The Facebook 4/13/16 initiative to move Mayoral Forum to Sunday felt on deaf ears. That is a water under the bridge now.
What you may not know is that on top of not attending, Jeff Robert's big supporter Tajana Mesic (council member at the time, Duke employee now), went to the Police station and filed alleged assault charges against Mr. Kuykendall’s wife related to “winking”. Mr. Kuykendall was informed about these assault charges only couple hours prior the Mayoral Forum. (If you ever wondered why he looked so beaten on that stage). When you read the Police report note how Mrs. Mesic story gets shorter under the Oath.
As to blaming Chamber of Commerce for the Mayoral Forum debacle, note that the wedge between the City and its Chamber started way before. See Mrs. Mesic attached e-mail dated 1/28/16.

Let’s look today on former mayor Kuykendall post dated 10/30/16:
“The havoc and chaos started in 2015 when then Council Members Jeff Roberts, Erin Tristan, Tajana Mesic and Ramona Ridge undertook a vigorous process to fire our economic development director. These are the individuals responsible for any loss in our economic development activity that may have occurred. It all became clear when then Council Member Tajana Mesic applied for the economic development director's job following the director's forced retirement from the City. They conspired for political motivation and subsequently derailed Fulshear's economic development plan for their gain.”
The timeline of the attached documentation will tell the story about Ms. Mesic and the Economic Director job:
7+8/2015: Legal charges related to termination of Economic Development Director Cheryl Stalinsky. See the names of councilmembers involved. I will leave it up to Mrs. Stalinsky if she wants to explain why she filed EEOC claim. During this time, Mrs. Mesic's friends were elected and got majority on council, Mrs. Mesic began actively promoting economic development on her Facebook page.
8/2015 Social media crusade against Mrs. Stalinsky. Not posting here that bloodbath even when I have those screen shots. Mostly involved CCR Mesic’s and Tristan’s friends, some of them (not all of them) now appointed by Mayor Roberts to Fulshear boards, committees and commissions.
From 5/2015 to 8/2015, Mesic heavily “campaigning” on her Facebook how involved she is in Fulshear Economic development.
8/28/15 City of Fulshear posting Economic Development Director job opening, Mesic sharing with social media Mrs. Stalinsky is retiring 9/30/15.
10/1/15, first legal charge related the councilmember employment. Note this is COUNCIL MEMBER Employment. That means that a council member wanted to be employed at city in addition to their elected position.
10/10/15 Mesic filing job application for Economic development director job. Remember this date 10/10/15. As shown below, Ms. Mesic was "not entirely truthful' later on in her FB posts.
11/03/15 Mayor Kuykendal e-mailing Mesic it would be a conflict of interest. She cannot report to City Administrator as Economic Development Director and to be his boss as Councilmember at the same time. Note at the text: “In the summer of 2015 as a City Council Member serving with a measure of authority over employees, you were vociferous in the removal of Cheryl Stalinsky, Fulshear's Economic Development Director, from her position at the City. Finally in October 2015, you submitted your application to fill the position which you were trained for by the City and for which you had a significant role in creating the vacancy with your position of authority as a Council Member.”
11/13/15 Mrs. Mesic withdrawing her application for positon of Economic Development Director.
3/23/16 I filed an open record asking which council member applied for the job.
3/30/16 I sent the follow up if my ORR received. Same day Mrs. Mesic posting on her political FB “after a FEW MONTHS of observing the city’s struggle with receiving viable applications. I considered it [EDD job] briefly, but I withheld my application to honor my two-year term on City council”. What a coincident to share this information with constituents the same day when she figured out what I am just about to expose this information to the public.

Fulshear property owner Jim Gibson, who died before lawsuit ended, accused Jamie Roberts of stealing two carports from his property. Case: The state of Texas versus James Warren Roberts.
Jamie Roberts has been under indictment for charges that included felony theft and abuse of office, since March 2007. Mayor Jamie Roberts asked his City council for the reimbursement of his attorney charges but it was denied by city council (2009). The plaintiff died, I guess his family did not wish to continue the lawsuit, therefore Jamie was exonerated.

Years later (7/31/15 and 9/22/15), Jeff Roberts’ dad Jamie and brother Troy sent a requests to City to get reimbursement of those legal fees again. Note the date: July 2015, ie 2 months after the elections where Jeff Roberts and his friends Mesic/Tristan/Ridge got the majority on the Fulshear council. Unfortunately, respectively fortunately for taxpayers, Roberts family could not expect that Mayor Kuykendall will turn down this request without presenting to his Council for voting. See the attached documentation. Thanks Tommy. That would be about $135 per family of 4.

This whole story is an ancient history, except the part of Troy and Jamie requesting payment from Council where their family member Jeff has finally the majority after 5 years sitting on council.

Fulshear City Council meeting 8/25/16, LAND DEAL VOTE
The land purchase approved tonight. 3 yes (Murdoch-motion, Ridge-second, Tristan), 2 no (Krenek, Gill).
Ms. Krenek stated she wants park but she feels the Council itself has not done their due diligence, Krenek has not seen the property. They were talking about another property for a long time and that is where Krenek did her due diligence. City has 1.35 mil park budget and we want to buy best park in the City and due diligence has not been done.
Mr. Gill stated he is all for park but he is not comfortable with a situation where until up Tuesday evening City was concentrated on one piece of land and yesterday morning he was told it is completely different deal and a completely different piece of property. He has not seen the land, it may be the best piece of land but at this time he does not have enough information to make a qualified decision on that land. He would like to spend 1.2 mil in the best interest of the City.
Mr. Murdoch stated this land is North of Primrose property and public would like this opportunity better than the other opportunity and that the contract is good. (Note Mr. Murdoch is a store planner with no legal experience).
Ms. Krenek, an experienced attorney, stated the contract is not perfect, there are things that are not appropriate at this contract as drafted and corrections and changes need to be made to that contract.
Mr. Tristan, a teacher with no legal experience, stated there is only one thing that is missing at the contract, to strike one point and that this contract is good and the value is under appraised value.
After the meeting Mr. Ridge shared with public the deal is for 15 acres for about $82,000.

Fulshear City Council Meeting 3/2/2016, HIGH LEGAL BILLS AGAIN
Interesting City Council tonight. Tajana Surlan Mesic attempted to introduce two months prior elections a topic that was not on the agenda and likely hold Mayor responsible for it: HIGH LEGAL BILLS for the City. What she forgot to mention is that Mesic herself was responsible for an additional $20K spent to delay Home Rule Charter, among other legal expenses, such as having problem with resident recording public meetings.
Her attorney fees analyses was sent to other council-members at last minute before the meeting so they did not have time to get familiar with her document.
What she forgot to mention was that the 6 months of legal work to create the proposed Home Rule Charter was at a cost of approximately $56K. The additional legal cost AFTER the Charter Commission’s work was done and after the Charter was finalized (December 16) was over $20K. WHO CREATED THE NEED FOR THESE ADDITIONAL CHARGES TO BE INCURRED when the independent law firm charges (just to review the Charter document itself per Mesic request and to provide a written opinion) was only $4K??? Mesic.
In order to understand the substance of those legal bills, to ascertain the reasons and to allow true transparency, the City and/or the specific City Council Members would l have to waive the attorney-client communications PRIVILEGE before the attorney is allowed the ability to FREELY DISCUSS the genesis, purpose, REASONS and basis for the legal cost, and to be in a position to explain those charges.
After attorney suggested to discuss the content of those bills in open forum, CRICKETS SINCE.
By waiving the privilege, the CITY ATTORNEY would also be PERMITTED TO EXPLAIN to the citizens us who actually was involved in creating the need for further legal work, particularly including the ENORMOUS amount of legal fees and costs incurred on the Home Rule Charter AFTER the Charter Commission actually finished their work on the Home Rule Charter process.

Fulshear City Council Meeting 10/10/2016, RED BIRD LANE FLOODING SOLUTIONS
Costello engineering firm presented multiple concepts ranging from 360K (an emergency access road) to 8 mil (bridge).
The issue is not the houses flooding but access to households being cut during flooding. The goal was to find the emergency access solution. This became an issue only a couple of years ago. This used to happen once every twenty years. The financing was the large part of the discussion.
Former mayor Kuykendall stated during his citizen speech he is the author of one of the preliminary permanent plans solutions presented by Costello, this solution helped to cut some of the cost.
He also suggested that once a possible funding mechanism could be through 4A and 4B EDCs. He proposed instituting of a municipal development district, that could help bring more sales tax revenue. He proposed to eliminate 4A Development Corporation and substituting it with the Municipal development district, that would have the flexibility with streets, infrastructure, phase 1 of parks. Voters would have to approve this. Each development corporation brings about 350K per year. He also recommended to maximize relationships with the County to get the funding.

Council member Tajana Surlan Mesic and her elected friends killed an approval of the streaming of Fulshear public meeting
The City of Fulshear has budgeted about $48K for external media audio and video streaming services. The City employees have obtained and evaluated multiple bids for these services, it came down to two companies to compare apples to apples (HD streaming, agenda indexing, 2 cameras, remote operation) and with similar cost within the approved budgeted amount. One time equipment cost is about 38K and streaming service about 10K per year. Other bidders were significantly higher. Mayor stated if City is going to do it he is in favor of doing that right (HD etc) or do not try it at all.
Councilwoman Mesic stated she allegedly heard from about 5 constituents concerned about such a high cost.
City council did not approve the investment, the motion died for lack of second. Councilwoman Mesic asked for more bids to see if there are less expensive bids.
5/2017 UPDATE: The streaming of public meetings never made it back on the agenda as long as of May 2017, when Tajana Surnal Mesic term was over.
However, just few weeks later on 12/1/2015 Councilwoman Mesic proposed that taxpayers should pay for meeting teleconferencing when she cannot be there, mayor stated constituents expect her to be there and serve the citizens who elected her. Contrary to the live streaming meeting broadcasting for the public, this time the cost did not appear to be her concern

Fulshear City Council Meeting 7/21/2015, FIREWORKS AGAIN
FIREWORKS ORDINANCE, CITY COUNCIL PUBLIC MEETING, JULY 2015:
The discussion was to make the existing ordinance stronger but to change the wording of proposal and to discuss the topic again next month.
The way the proposal is currently worded can be interpreted that when a citizen of city A purchases fireworks in city B and is stopped by Fulshear police for any reason while driving through Fulshear, they can be penalized up to $2,000 for having fireworks in his car. The same applies within CCR, if an old forgotten firework is found on your property; you can be penalized up to $2,000.

Fulshear City Council Meeting 8/15/2015, FIREWORKS
FIREWORK ORDINANCE, CITY COUNCIL PUBLIC MEETING, AUGUST 2015.
There was a long debate about firework ordinance. Councilwoman Tristan was pushing for $2,000 penalty, the state approved maximum, for possession. Councilwoman Krenek was opposing saying people cannot be criminalized unless they fired the firework. This ordinance will have to go back to The City Attorney for reworking again.
Actually this was not first time I heard during last 3 meetings I attended that some ordinance proposals were against the law, in one case even against our Constitution.

Fulshear City Council Meeting 8/18/2015, FULSHEAR EXCESSIVE ATTORNEY CHARGES
EXCESSIVE USE OF CITY ATTORNEY SERVICES BY CITY COUNCIL MEMBERS, CITY COUNCIL PUBLIC MEETING, JULY 2015:
Elected officials spending taxpayers money to ban citizen from recording public meetings, amongst other things.
Mayor addressed during the meeting city council members should run their question through city administrator initially, if 2 or 3 members have same question it can be combined to cut down legal charges. I have to admit I was astonished to hear how much we as taxpayers had to pay for attorney fees just for month of July. The total legal fees for the whole previous fiscal year were $127,201. The legal fees for July were $33,011. Through an open records request, I obtained July invoices and I analyzed 1 invoice for $17,545.
I found that 1 day after I posted my previous video of the pedicab discussion on youtube, one councilwomen Tristan made an inquiry about the legality of posting public meetings on web. We paid for total of 3 inquiries in total questioning public information being public.
One Councilmember had seven inquiries. Three of them were related to making video public, three related to employee termination, and one about AED.
Of the 111 requests made by Council members and City employees to the City attorney, councilwomen Mesic requested his assistance 21 times, even on July 4th. That is 19% of all inquiries for this invoice and same amount inquires that the remaining of all of the five council members made combined (also 19%).
