Listen to our client, Dr. Richard Wilkinson share his testimony regarding his experience he had with covid policies regarding early treatment and the shot policy of Washington state. His case is Wilkinson v. Rodgers: SMF brought this suit on behalf of three doctors licensed in Washington State: Dr. Rick Wilkinson (Yakima), Dr. Richard Eggleston (Clarkston), and Dr. Ryan Cole (Boise, ID) who are being prosecuted by the Washington Medical Commission (WMC) for COVID-19 misinformation/disinformation and for prescribing Ivermectin under the WMC’s COVID-19 Position Statement. SMF has challenged the WMC’s punitive actions to STOP these actions, requesting a Temporary Restraining Order (TRO). Judge Rice’s decision to deny the TRO was based on his belief that the WMC’s Position Statement is not enforceable as it says that it “may” be enforced. Obviously, we disagree with that position. Judge Rice also stated that he could not decide on the merits of the case as each Dr.’s license is currently in the middle of an investigation from the WMC, so the federal court is required to abstain from deciding the merits UNTIL the WMC’s process is completed. We have an opportunity to submit an amended complaint in Federal Court as well as a complaint on state issues in Thurston County. Today’s video addresses our Attorney General’s overreach into our daily lives by including Consumer Protection Act (CPA) in legislation he supports, like last year’s gun legislation. Including the CPA allows the AG to directly go after vendors, like Federal Way Discount Guns, for selling magazines in violation of Revised Code of Washington 9.41.370 without addressing whether the law is constitutional. By including a violation of the Consumer Protection Act in several pieces of legislation, the AG has created a direct path to infringe on business owners’ rights.

Today, Judge Dimke issued a ruling denying our Motion for Preliminary Injunction on SB 5078 (10+ round magazine ban). Judge Dimke focused on the lack of evidence before the court. As a reminder, we included several expert declarations, including one from Ashley Hlebinsky (Second Amendment historian) and Mark Hanish (former firearms industry professional) with evidence on historical use of the magazines. Where do we go from here? We have three options: (1) continue in Yakima to trial, submitting more evidence, etc.; (2) seek reconsideration from Judge Dimke, essentially asking her to rethink what she just ordered; and (3) appeal this decision to the Ninth Circuit Court of Appeals based on this decision. We're working through these options, but we anticipate we'll have a decision on which option makes the most sense within the next two weeks. Stay tuned!
