Today, Judge Dimke issued a ruling denying our Motion for Preliminary Injunction on SB 5078 (10+ round magazine ban). Judge Dimke focused on the lack of evidence before the court. As a reminder, we included several expert declarations, including one from Ashley Hlebinsky (Second Amendment historian) and Mark Hanish (former firearms industry professional) with evidence on historical use of the magazines. Where do we go from here? We have three options: (1) continue in Yakima to trial, submitting more evidence, etc.; (2) seek reconsideration from Judge Dimke, essentially asking her to rethink what she just ordered; and (3) appeal this decision to the Ninth Circuit Court of Appeals based on this decision. We're working through these options, but we anticipate we'll have a decision on which option makes the most sense within the next two weeks.
Stay tuned!
