The Burnet County deputies who managed this situation did an excellent job. Patricia Gerino appears to be orchestrating actions she wishes to keep concealed from the members with zero transparency. Similar to her tenure on the "WOWSC" water co-op board, legal expenditures were significantly increased, seemingly to shield her and her associates from any allegations. The millions spent during her time on the water co-op board culminated in a verdict of conspiracy and breach of fiduciary duties for her friend Dana Martin. That is all public record. Additionally, her 71% rate hike as a WOWSC director to cover the aforementioned legal fees was deemed 'unjust and unreasonable' by the PUC. The Incident: January 10th, 2023. William "Bill" Earnest struck a member in the face at a meeting causing pain. This can be seen in the video. The sheriffs office and county attorney strung this along for several months by phone and in person only to claim it was closed in February of 2023 with no charges. There is documentation to prove the string along. Eyewitness Accounts: Not one eyewitness was contacted. Sheriff's Office Actions: Presented are the actions and decisions made by the sheriff's office, raising questions about whether they have shown undue favoritism towards their friend. 11/3 The WOPOA board of directors filled the vacancy with the most polarizing person in our community and they did NOT properly notice the meeting. There was no way to know they were filling the vacancy. Texas Property Code Open Board Meetings Sec. 209.0051 Subsection (c) "Regular and special board meetings must be open to owners, subject to the right of the board to adjourn a board meeting and reconvene in closed executive session..." This was an open/public meeting as required by the property code. Open meetings in TX are not subject to privacy interests and can be recorded by the invited public attending said open meeting. Texas is a one party notice/consent state for recordings. The person doing the recording consents. If this were a true telephonic conf call they would have no claim. The fact this was a video conf call does not change the analysis. The HOA/POA board cannot simply declare an entire meeting as private/not open in direct violation of the Property Code. Such a declaration is void as a matter of law.
