Washington Gun Law President, William Kirk, discusses Oregon Ballot Measure 114, one of the worst pieces of gun legislation to come along in a long time. Worse yet, this legislative proposal is completely deaf to the clear holdings of New York Pistol & Rifle Assoc. v. Bruen. Its as if the "rule of law" only applies sometimes. This legislation would do much to restrict Oregon's lawful and responsible gun owners by limiting magazine capacity. However, what is most troubling about this proposed legislation is that all Oregon residents will need to obtain a permit, from the State of Oregon, to just purchase a firearm. Does that training just include a two hour class? Oh no, it includes much, much more, most of which will never be available to Oregon residents. Washington Gun Law President, William Kirk, discusses the recent denial of a Writ of Certiorari to the United States Supreme Courtr in the matter of GOA v, Garland. This suit, originating out of the 6th Circuit, aimed to overturn ATF's ban on bump stocks in December of 2018. As some of you may recall, ATF, which had previously approved such devices, did a 180 after President Trump asked ATF to consider banning them after the horrific mass shooting in Las Vegas in October of 2017. But this rejection of a petition for review tells us a lot more about where this Court is at when it comes to bump fire technology which is that they are more than happy to let ATF's determinations remain in place for now. Moreover, when we look at what the chances that Operation Reticent Recall will, at some point, be overturned by appellate fiat, we see the unwillingness of the Court to step into this arena. Today we discuss the notion that Operation Reticent Recall is a front for the creation of a national gun registry. We know that Federal law, prohibits the use of any government resources to compile any type of gun database. We also know that the ATF has recently classified certain triggers and solvent traps, standing alone, as NFA regulated firearms and have begun seizing these items. Prior to the seizure phase of this operation, ATF used government resources to forcefully extract data, of the sale of these items, which they now consider to be firearms, to then compile that data, in a searchable format, for enforcement of this operation. Washington Gun Law President, William Kirk, discusses some very recent developments as it relates to a Colorado based company, Firequest, and the recent legal issues they are having with the ATF in regards to their Hellfire Gen 2 and Hellfire Gen 2 AR trigger systems. This system, which is actually installed in the pistol grip itself, uses magnets to assist in increasing the rate of fire. However, the manufacturer was recently served with a cease and desist order from ATF and one of their distribution centers in Arkansas was raided and hundreds of items were confiscated. District of Columbia, where the Heller Foundation once again sued the District of Columbia, this time over their law which limited the number of rounds a person could carry with them to no more than 20 rounds at any one time. Rather than fighting the lawsuit, the District of Columbia instead chose to repeal this oppressive law and conceded defeat. However, D.C. also has a magazine ban which provides the exact same restrictions. So if the law banning the number of rounds one could carry was unconstitutional, how then is the same law, which does the same thing, by merely banning magazine capacity? Of course, once registered, this information will be ATF's to keep and use for whatever purpose they may desire later. Furthermore, with just one act of Congress, the United States government could generate somewhere between $4 and $8 billion in additional tax revenue.
