It was a declaration, required by law, to commence cordon sanitaire protocols, to include shelter in place orders and prohibitions against nonessential gatherings, and also nonmedical grade facial coverings mandates, but in the Commonwealth of Virginia, only one litigation, now on petition for certiorari, raised the objection that the declaration for a communicable disease of public health threat had been issued, despite the fact that no reports of COVID-19 infection would appear until exactly one month later, a violation of law celebrated as decisive action by the Richmond Free Press.
The Wall Street Journal, which had been issuing opinion editorials since July 2020, just recently published an opinion editorial promoting a study in Denmark and Sweden that had concluded that the lockdowns advocated by Dr. Anthony Fauci, had had absolutely no effect on the mortality rates in the current public health crisis, the reason that large social gatherings, like in person worship, were prohibited--a constitutional right to free exercise guaranteed under the First Amendment, only in the Constitution because men of faith, like Rev. Jeremiah Moore, had advocated for its inclusion in the Bill of Rights, but very few places of worship brought that matter to court in Virginia, resolved to wait until after the pandemic. Yet, in his first month in office, judicial activist progressives filed four suits against the Republican governor over his first day executive order regarding nonmedical grade facial coverings mandates that he decided to make optional, retreating from the scientific argument that there is not even one study that has overruled the 2010 study by NIOSH that had definitively determined that nonmedical grade substitutes in a respiratory tract infection pandemic would be wholly ineffective--the case we raised all the way to the Supreme Court.
Under DHS v. Board of Regents for the University of California, the "DACA Case", judicial review of government action is limited to what the agency knew at the time, and in February 2020 the WHO, which had declared the pandemic, had specifically instructed other nations not to resort to massive lockdowns, and even the Chinese had limited lockdowns to Wuhan and a few surrounding areas, and was reopening in February 2020, after only one month, but perhaps Americans love to have their freedom surrendered more than communists in China.
