A distraught husband who killed his father-in-law and then was shot by his estranged wife will keep serving a life prison sentence after a state appeals court panel rejected his claims that his lawyer failed him.

The Superior Court sank Shaun Fairman’s hope for freedom by rejecting his argument that prosecutors shouldn’t have been allowed to use a confession he gave to police while he was wounded, drunk and under the influence of drugs.

Fairman, now 40, was in that condition because of what happened after his wife Jessica secured a Protection From Abuse order against him in May 2012.

Fairman went to his family’s Indiana County home carrying a pistol and a rifle despite being barred from doing so by the PFA, Senior Judge John L. Musmanno noted in the state court’s opinion. Jessica was there with two of the couple’s four children and her parents, Richard and Candice Shotts, who were there to help protect their daughter and grandchildren if Fairman violated the PFA.

Police said Fairman fired a shot from the pistol when Richard Shotts refused to let him into the house. When Richard Schotts returned fire with his own pistol, Fairman fired through a door and killed the 55-year-old Schotts with a shot to the neck.

Fairman then went into the house, walked by his father-in-law’s corpse, and went looking for Jessica. She was hiding in an upstairs bedroom with her children and mother and was armed with a .22 caliber pistol. When her husband walked into the room, Jessica shot him twice, then held him at gunpoint until the police arrived.

Police said that after his arrest Fairman told officers he didn’t mean to kill his father-in-law, and that he only planned to scare his wife and commit suicide in front of her.
