Generally, a foreign entity is under no obligation to obtain a U.S. EIN, nor is it obligated to file a U.S. tax return.

Under certain circumstances, however, the foreign company may need to apply for an EIN if it has to file a U.S. federal tax return.

In this video, I discuss some examples where a foreign entity will need to apply for an EIN because of U.S. tax filing obligations.
