Film director, Tyler Perry won a case that awarded him the trademark for ‘What Would Jesus Do,’ but Kimberly Kearney had it first…what happened?

According to Kearney, she had created the idea and title for a television show, ‘What Would Jesus Do,’ in 2007. Kearney shared her idea with representatives at Tyler Perry Studios, only to learn several months later that Perry had filed to register his own mark for ‘What Would Jesus Do’ and cancel hers.

How can someone cancel someone else’s trademark? Perry was able to show that Kearney had abandoned her mark by not utilizing it, and since Perry was filing with the intention to use the mark in a similar way, the case was justifiable to the court.

Andrei Mincov (the founder of Trademark Factory®) talks about how you can cancel or claim someone else’s trademark, and what simple mistakes Kearney could have avoided to help her keep her mark.
