Justice Marshall in Marbury v Madison should have recused himself as well. John Marshall's the one that didn't deliver those documents as Secretary of State. Hence a bad ruling. Judicial review was not sought in this case and is NOT in the Constitution. The similar function in England was designated to Parliament. That's generally classified as common law isn't it? Hence preceding that bad decision and should have been overturned long ago (probably by Congress.) He was not well thought of by his contemporaries who knew the situation better than we do. No judicial review, no Dred Scott, no Roe v. Wade, etc., etc.
