Supreme Court Hears Birthright Citizenship Case

The Supreme Court heard consolidated oral argument in Trump v. CASA, Trump v. Washington, and Trump v. New Jersey, a case about nationwide injunctions halting President Donald Trump's executive order on birthright citizenship. On his first day back in office, President Trump signed an executive order limiting birthright citizenship. Three federal district court judges in the states of Washington, Maryland, and Massachusetts blocked the order with nationwide injunctions, thereby stopping it from taking effect. Trump then appealed to the Supreme Court on its emergency docket to remove or limit the injunctions. The Citizenship Clause of the 14th Amendment was enacted after the U.S. Civil War, in response to the case of Dred Scott v. Sandford, which ruled that U.S. citizenship did not apply to African Americans. Since then, birthright citizenship has been official precedent

ByteDance, TikTok, and content creators argued the law violated the First Amendment, but the Justice Department maintained TikTok was a national security risk due to ultimate ownership under China. In December 2024, the U.S. Court of Appeals for the DC Circuit upheld the law, which takes effect Jan. 19, 2025. ByteDance and TikTok then filed an emergency appeal. The Supreme Court heard oral argument in Fischer v. United States, a case that could impact hundreds of January 6 defendants' cases as well as Special Counsel Jack Smith’s election interference case against former President Donald Trump. Joseph Fischer, the petitioner and a January 6 defendant is challenging a criminal statute used by the federal government to charge him with obstructing an official proceeding. The proceeding is the congressional certification of the electoral votes in the 2020 presidential election on January 6, 2021. His legal team argues the statute is only applicable when there is tampering with evidence, and they contend Mr. Fischer did nothing of a sort. They want the obstruction charge thrown out. The federal government disagrees with their legal interpretation. The Supreme Court has through June 2024 to issue a ruling.
