Feds Colluded With Big Banks to Spy on Americans’ Financial Transactions The federal government conducted "broad," "unjustified" surveillance of the private financial transactions of millions of Americans in the wake of events that took place on Jan. 6, 2021, at the U.S. Capitol, according to a report issued Wednesday by the U.S. House of Representatives Select Subcommittee on the Weaponization of the Federal Government. By Brenda Baletti, PhD The Defender March 7, 2024 https://childrenshealthdefense.org/defender/big-bank-feds-track-americans-financial-transactions-cbdc/ The federal government conducted "broad" surveillance of the private financial transactions of millions of Americans "without legal process" in the wake of events that took place on Jan. 6, 2021, at the U.S. Capitol, according to a report issued Wednesday by the U.S. House of Representatives Select Subcommittee on the Weaponization of the Federal Government. The report details how government officials asked major banks to search financial transactions for key terms, like "Trump" and "MAGA." It also suggested they identify transactions related to firearms or sporting goods stores, such as Cabela's, Bass Pro Shop and Dick's Sporting Goods. "Americans doing nothing other than shopping or exercising their Second Amendment rights were being tracked by financial institutions and federal law enforcement," according to the report. The "financial surveillance was not predicated on any specific evidence of particularized criminal conduct and, even worse, it keyed on terms and specific transactions that concerned core political and religious expression protected by the Constitution," the report said. Michael Rectenwald, Ph.D., author of "Google Archipelago: The Digital Gulag and the Simulation of Freedom," said the searches violated fundamental constitutional rights. Rectenwald told The Defender: "The willing cooperation of these financial institutions, without due legal process, demonstrates that these otherwise non-state actors are acting as what I have called 'governmentalities,' or apparatuses of the state. They are not merely private companies, per se. They are state assets colluding with the government in a system that can best be described as fascism." According to the report, the U.S. Department of the Treasury's Financial Crimes Enforcement Network (FinCEN) and the FBI held backchannel discussions with some of the largest financial institutions in the U.S. They asked them to voluntarily share people's private financial information, without a subpoena. The institutions included Barclays, U.S. Bank, Charles Schwab, HSBC, Bank of America, PayPal, Wells Fargo, Citibank, JPMorgan Chase and others. The report also detailed how law enforcement and approximately 650 high-grossing companies and financial institutions shared non-public intelligence documents through a web portal run by a public-private partnership called the Domestic Security Alliance Council. The FBI and the U.S. Department of Homeland Security ran the portal, which was accessible only to members of the private-public partnership. Through this portal, the government shared reports with financial institutions about people who allegedly fit the profile of "domestic violent extremists" and who may be "emboldened" in the wake of Jan. 6 -- focusing on people holding certain viewpoints. One report shared in the portal noted that "those Americans who expressed opposition to firearm regulations, open borders, COVID-19 lockdowns, vaccine mandates, and the 'deep state' may be potential domestic terrorists." "These illegal searches suggest that the criminal justice agencies have been turned into weapons for the persecution of political opposition," Rectenwald said. Labeling dissenters as domestic violent extremists is "the most egregious example of government overreach" highlighted in the report, said Tim Hinchliffe, editor of The Sociable. "It basically means that if you question anything the government says or does, you may be marked as a potential domestic terrorist, which opens the door for the government to pry even deeper into your life and violate your freedoms," he added. Hinchliffe told The Defender: "Today, they're going after Americans who oppose open borders, lockdowns, vaccine mandates, etc., but who will they go after tomorrow? Will they go after people who express opposition to U.S. funding in Ukraine? What about opposition to sending troops on the ground? Who will become the next domestic terrorist based on which side they support in the Middle East?" W. Scott McCollough, former Texas assistant attorney general, told The Defender it was important to realize this is not a partisan issue. "The story is that we -- the people -- are in an abusive relationship with our government because the government thinks that everybody is a threat or can be a threat at some point. Everybody," he said. "A particular subset of people who are thought to be right-wing, conservative or whatever have been deemed to be the enemy today," he said. "But that could change tomorrow," and the same thing could happen to "people who thought they were immune." Year-long investigation continues with hearing today In February 2023, retired FBI Supervisory Intelligence Analyst George Hill testified that following the events at the U.S. Capitol on Jan. 6, 2021, Bank of America voluntarily shared a list of the names of all people who used Bank of America credit or debit cards in the Washington, D.C., area between Jan. 5 and Jan. 7, 2021, with the FBI. The list also included anyone who had ever used one of Bank of America's cards to purchase a firearm. Two other FBI agents, former Special Agent-in-Charge of the Boston Field Office Joseph Bonavolonta and Steven Jensen, the then-section chief of the FBI's Domestic Terrorism Operations Section, corroborated Hill's testimony, according to the report. The committee requested documents from other national financial institutions about similar practices. In the process, they discovered that FinCEN and the FBI had discussions with multiple financial institutions, not only Bank of America. As part of the investigation, Ohio congressman and Judiciary Committee Chairman Jim Jordan in January sent a letter to Noah Bishoff, the former FinCEN director. The letter made public the congressional findings that FinCEN had distributed materials -- obtained by the committee -- to financial institutions outlining the "typologies" of various persons of interest and providing financial institutions with suggested search terms and "Merchant Category Codes" for identifying transactions on behalf of federal law enforcement. In addition to the document that recommended using search terms like "Trump" and "MAGA" to search Zelle payment messages, Jordan wrote, the FinCEN also warned institutions of "'extremism' indicators," such as transportation charges "for travel to areas with no apparent purchase" or "subscriptions to other media containing extremist views." The interim staff report issued Wednesday described the findings of the ongoing investigation. According to the report, the emergence of digital banking has resulted in "an unprecedented amount of private data entrusted to financial institutions, potentially revealing all sorts of sensitive information about a customer." That data is an important resource for law enforcement, the report stated, However, the availability of such information "must be weighed against the privacy interests of Americans." In this case, the report said, the investigation predicated on the events of Jan. 6, 2021, "devolved into a fishing expedition for Americans' financial data." McCollough said the legal questions about government access to financial data had to be placed into historical context. Following a 1976 Supreme Court decision, United States v. Miller, which held that customers of financial institutions have no reasonable expectation of privacy, Congress enacted the Right to Financial Privacy Act in 1978, which provided strong privacy protection. That protection included a requirement to notify people whose bank records were being sought and allow them to contest the search. However, McCollough said, the Patriot Act undid a lot of those protections. "What it has left is an expansive, backdoor information-sharing regime led by the nation's most powerful law enforcement agencies and their partners in the financial sector," the report said. Today's hearing examined how the federal government and major financial institutions conduct surveillance of Americans' private financial data. McCollough said the broader problem is the gathering and retention and availability of this information. "People need to understand that all of their data has already been seized. We are now just talking about on what terms does it get searched." Solari Report founder Catherine Austin Fitts told The Defender this surveillance fits into a broader strategy being rolled out to control how people spend their money. "The central bankers have explained that they are converting our money to digital currency that will give them complete control of our money -- where we can spend it and how we can spend it." "Like the Chinese social credit system, if we do not do what we are told, they will take or shut off our money. Federal enforcement working with the large banks to institute the systems necessary to do this is a form of control that will ultimately be used to tax without representation." Fitts said people have the power to resist these forms of control by using cash and working with local financial institutions rather than the big banks. "This is why it is essential that we use cash and work with our community bankers and credit union leadership as well as our state legislatures to prevent central control of our money and a land grab on Main Street supported from Washington and Wall Street," she said. .................. In the wide-ranging interview published Thursday titled “Truckers on the Frontlines of Freedom,” Lich joined Peterson and his wife Tammy to dissect the events “leading up to, during, and after the internationally recognized Canadian Freedom Convoy, which sought to publicize and end ridiculous COVID mandates as they heavily affected the multi-national trucking industry.” In the interview, Lich, born in Saskatchewan but now a resident of Alberta, explained to Peterson that she was largely apolitical until the industry in which she worked -- Alberta’s oil and gas sector -- began to be throttled by so-called “climate change” policies implemented by the federal government throughout the late 2010s. In particular, Lich outlined to Peterson that she became angered with two federal Liberal Party policies introduced in Parliament in 2017 and 2018, called Bill C-48, Oil Tanker Moratorium Act, and Bill C-69, Impact Assessment Act and Canadian Energy Regulator Act, respectively. As a result of these policies and others, Lich, taking inspiration from the “yellow vests” protest in France in 2018, started a Canadian version of the movement, which included forming a convoy of trucks to protest in a variety of locations in the western half of the nation. Lich also explained to Peterson that it was around this time that she became involved with “Wexit,” a play on words of the U.K.’s Brexit movement, which saw disgruntled Canadians in the natural resource heavy western provinces band together to form a political party in opposition to federal government policies. Later in the interview, Lich broke down how after the COVID-19 so-called pandemic had begun she started to do her own research about the virus and the associated vaccines, listening to experts such as Dr. Byram Bridle, Dr. Peter McCullough, Dr. Robert Malone and others, and began to doubt the credibility of the government’s approach to managing the virus, which in Canada included lockdowns, mask mandates and vaccine passports among other measures. Then, in January 2022, Lich recalls coming across Canadian truck driver Chris Barber, who was advocating on social media for a trucker-related protest after Prime Minister Justin Trudeau mandated that those driving across the U.S.-Canada border, including truckers, would have to be vaccinated against COVID or subject themselves to a 14-day quarantine every time they reentered the country. Lich said that her and the other organizers then started a GoFundMe page and a website for the Freedom Convoy, with the intent of encouraging truckers to drive to the nation’s capital of Ottawa and park their vehicles in protest of the various COVID-era mandates. Lich told Peterson that “miraculously” the movement took off on social media and word of mouth, and that despite the massive turnout, it only took “10 days” to organize. For the remainder of the interview, Lich told Peterson about the immense success of the Freedom Convoy, the Trudeau government’s heavy-handed response -- which included invoking the never-before-used Emergencies Act to freeze the bank accounts of the organizers and anyone who had financially contributed to the movement, in addition to arresting Lich and the other organizers -- and her experience being in jail for over 45 days on mischief charges stemming from her role in the movement. Despite the immense personal cost, Lich talked about the pride and joy she felt during the protest, and how her and her fellow organizer Barber, felt as though they had already “won” just based on the “beautiful show of humanity” that took place for those weeks in Ottawa. Richard Lindzen is a dynamical meteorologist. He has contributed to the development of theories for the Hadley Circulation, hydrodynamic instability theory, internal gravity waves, atmospheric tides, and the quasi-biennial oscillation of the stratosphere. His current research is focused on climate sensitivity, the role of cirrus clouds in climate, and the determination of the tropics-to-pole temperature difference. He has attained multiple degrees from Harvard University, and won multiple awards in his field of study such as the Jule Charney award for “highly significant research in the atmospheric sciences”. Between 1983 and 2013, he was the Alfred P. Sloan Professor of Atmospheric Sciences at MIT where he earned emeritus status in July of 2013. One of my accounts was shut down (because I had the effrontery to sign in from Alberta — an event too unexpected for the bank’s security systems). I was placed on hold interminably, subjected all the while to the corporate world’s idea of music (to soothe me). I was then offered a call-back, which I duly received, 45 minutes later. Then I was placed on hold again, and again, and again. This all occurred after my patience had already been exhausted in the aftermath of trying to fly in Canada. Like so many Canadians, I have been unable to see many of the people I love and who are tolerant enough to return the sentiment for nearly two years. Lockdowns. Restrictions. Limits on personal and social gatherings. Precautions. Precautions. Precautions. But everything had opened enough, in principle, so flights for such purposes were — in principle — once again possible. My wife and I therefore took the opportunity on the last day of 2021 to fly first to Comox, British Columbia, and then, several days later, to our joint hometown of Fairview, Alberta. However, the airline we had arranged our flights with cancelled/delayed all six flights we had scheduled. Furthermore, they had no staff available in one entire wing of Edmonton’s airport. This made rescheduling prohibitively difficult. We were delayed by one full day travelling to British Columbia, and then another day travelling to Alberta (and there were further delays on our way home to Toronto). This took quite a chunk out of an eight-day trip. All this from an airline that not so long ago was a model of efficiency. Like most people in Canada, and in the broader Western world, my wife and I are accustomed to systems that work. When we booked flights in the past, with rare exceptions, we arrived safely and on time. When we used our banking systems, online, we gained access to our accounts. When we had to phone security, because of a log-in problem, we were able to talk to someone who was able to help. And, because we were spoiled Westerners, we expected that such would always and consistently be the case. Why? Because, by and large, our systems worked. Miraculously well. The power (and the heat — it’s forty below here in northern Alberta, and has been for three weeks) always worked. Planes took off and landed on time. Banks were open and effective and honest. But there are empty shelves in the grocery stores here in Fairview. The supply chain that provides our food — just in time — are severely stressed. While I was here, I spoke with a local restaurateur who operates the pizza place I worked in forty years ago. She is barely hanging on. This is true of most local businesses. I was on the phone for three hours trying to sort out a minor banking issue, after being delayed for a full day while flying, after having been delayed in a similar way only four days before. And, because I am an entitled Westerner, accustomed to my privileges, I got whiny about it. I have a banker that takes care of my affairs, and I sent him and his associate a string of complaints about the service I was receiving. They wrote back, apologetically, and told me that they’re barely able to function with the COVID restrictions, the attendant staff shortages (also caused by illness) and their inability to attract new employees — a problem besetting many industries at the moment. I am not accustomed to feeling particularly sympathetic for the travails of large, successful enterprises: banks, airlines, utilities and the like. I expect a certain standard of service, so that I can conduct my own affairs effectively, and am impatient when delays unnecessary in the normal course of things emerge. The letter from the bank stopped me and made me think, however. It wasn’t just the bank. It was also the airline. It was the empty shelves in the grocery store in northern Alberta. It was the daughter of the man I once worked for as a cook, back when I was a teenager. It was the shopkeepers and small business-people I have spoken with on this trip. We are pushing the complex systems upon which we depend and which are miraculously effective and efficient in their often thankless operation to their breaking point. Can you think of anything more unlikely than the fact that we can get instant trouble-free access to our money online, using systems that are virtually graft- and corruption-free? Just imagine how much work, trust and efficiency was and is necessary to make that a reality. Can you think of anything more unlikely than fast, reliable and inexpensive jet air travel, nationally and internationally, in absolute safety? Or the constant provision of almost every consumer good imaginable, in the midst of plentiful, varied and inexpensive food? These systems are now shaking. We’re compromising them seriously with this unending and unpredictable stream of restrictions, lockdowns, regulations and curfews. We’re also undermining our entire monetary system, with the provision of unending largesse from government coffers, to ease the stress of the COVID response. We’re playing with fire. We’ve demolished two Christmas seasons in a row. Life is short. These are rare occasions. We’re stopping kids from attending school. We’re sowing mistrust in our institutions in a seriously dangerous manner. We’re frightening people to make them comply. We’re producing bureaucratic institutions that hypothetically hold public health in the highest regard, but subordinating all our properly political institutions to that end, because we lack leadership, and rely on ultimately unreliable opinion polls to govern broadscale political policy. I’ve never seen breakdown in institutional trust on this scale before in my lifetime. I was recently in Nashville, Tennessee. No lockdowns. No masks. No COVID regulations to speak of. People are going about their lives. Why can that be the case in Tennessee (and in other U.S. states, such as Florida) when there are curfews (curfews!) in Quebec, two years after the pandemic started, with a vaccination rate of nearly 80 per cent? When BC is still limiting social gatherings? When we are putting tremendous and unsustainable strain on all the complex systems that have served us so well, and made us so comfortable, in the midst of the troubles of our lives? The cure has become worse than the disease. I have spoken with senior advisors to provincial governments in Canada. There is no end game in sight. The idea that Canadian policy is or should be governed “by the science” is not only not true, it’s also not possible, as there is no simple pathway from the facts of science to the complexities of policy. We are deciding, by opinion poll, to live in fear, and to become increasingly authoritarian in response to that fear. That’s a danger, too, and it’s increasingly real. How long are we going to flail about, hiding behind our masks, afraid to send our children (who are in no danger more serious than risk of the flu) to school, charging university students full tuition for tenth-rate online “education,” pitting family member against family member over vaccine policy and, most seriously, compromising the great economic engine upon which our health also depends? Until we decide not to. There are no risk-free paths forward. There is only one risk, or another. Pick your poison: that’s the choice life often offers. I am weary of living under the increasingly authoritarian dictates of a polity hyper-concerned with one risk, and oblivious to all others. And things are shaking around us. Enough, Canadians. Enough, Canadian politicos. Enough masks. Enough social gathering limitations. Enough restaurant closures. Enough undermining of social trust. Make the bloody vaccines available to those who want them. Quit using force to ensure compliance on the part of those who don’t. Some of the latter might be crazy but, by and large, they are no crazier than the rest of us. Set a date. Open the damn country back up, before we wreck something we can’t fix. Time for some courage. One of my accounts was shut down (because I had the effrontery to sign in from Alberta — an event too unexpected for the bank’s security systems). I was placed on hold interminably, subjected all the while to the corporate world’s idea of music (to soothe me). I was then offered a call-back, which I duly received, 45 minutes later. Then I was placed on hold again, and again, and again. This all occurred after my patience had already been exhausted in the aftermath of trying to fly in Canada. Like so many Canadians, I have been unable to see many of the people I love and who are tolerant enough to return the sentiment for nearly two years. Lockdowns. Restrictions. Limits on personal and social gatherings. Precautions. Precautions. Precautions. But everything had opened enough, in principle, so flights for such purposes were — in principle — once again possible. My wife and I therefore took the opportunity on the last day of 2021 to fly first to Comox, British Columbia, and then, several days later, to our joint hometown of Fairview, Alberta. However, the airline we had arranged our flights with cancelled/delayed all six flights we had scheduled. Furthermore, they had no staff available in one entire wing of Edmonton’s airport. This made rescheduling prohibitively difficult. We were delayed by one full day travelling to British Columbia, and then another day travelling to Alberta (and there were further delays on our way home to Toronto). This took quite a chunk out of an eight-day trip. All this from an airline that not so long ago was a model of efficiency. Like most people in Canada, and in the broader Western world, my wife and I are accustomed to systems that work. When we booked flights in the past, with rare exceptions, we arrived safely and on time. When we used our banking systems, online, we gained access to our accounts. When we had to phone security, because of a log-in problem, we were able to talk to someone who was able to help. And, because we were spoiled Westerners, we expected that such would always and consistently be the case. Why? Because, by and large, our systems worked. Miraculously well. The power (and the heat — it’s forty below here in northern Alberta, and has been for three weeks) always worked. Planes took off and landed on time. Banks were open and effective and honest. But there are empty shelves in the grocery stores here in Fairview. The supply chain that provides our food — just in time — are severely stressed. While I was here, I spoke with a local restaurateur who operates the pizza place I worked in forty years ago. She is barely hanging on. This is true of most local businesses.
