A few weeks ago the scenario seemed very unlikely. "The moral of this story is you have to be proactive with your health," attorney Ralph Lorigo said. Late December, Smemthiewicz took an ambulance to the hospital with a severe case of COVID-19 and by January 2 was on a ventilator. Lorigo said the family was told she had a 20 percent chance of survival. "A son does all this research and the family gets together and the son convinces the ICU doctor to give her ivermectin," he said. On the experimental treatment, Lorigo said the patient improved enough in 48 hours to move to a regular COVID-19 floor. However, the doctors there would not give her the follow up doses of ivermectin and Smemthiewicz's condition deteriorated again. She's sent to the cardiac ward. The family, desperate, asks the attorney for help. "I tell them the only thing I can do is bring a lawsuit," Lorigo said. By January 8, the family has obtained a court order from state Supreme Court Judge Henry Nowak who ultimately said if the patient's doctor prescribes the treatment the hospital must administer it. Back on ivermectin, Smemthiewicz started to improve again, leaving Lorigo to question why they had to get the order in to the first place. "When there are no alternatives and when there's very little downside and when it's demonstrated this kind of effectiveness, people should know about it," Lorigo said. Ivermectin is an FDA-approved drug used to treat and prevent parasitic diseases. But UBMD Physicians Group Executive Director Dr. Kevin Gibbons said it's not clear yet how effective it is in treating COVID-19. "I don't know that we have a really true double blind placebo controlled trial," Gibbons said. "The things that we really need to prove something works or doesn't work. This is a drug that has a better safety profile for example than hydroxychloroquine." Lorigo said people want to try it and he's received calls about this case from all over the country, and even different parts of the world. "I've sent our paperwork to different lawyers and we've got people who are asking for help," he said. "It's a shame they have to go to that. It's a shame they have to hire a lawyer to do what should be their right under these circumstances." In a statement, Kaleida spokesperson Michael Hughes said: "Our board-certified physicians treat patients using evidenced based protocols to ensure the highest quality care to our patients. There are occasions when a treating physician might feel the benefits outweigh the risks of non-FDA approved therapies, such as ivermectin, but that is a decision left between the treating physician and their patient and the respective family." BREAKING - Dr. Mary Talley Bowden Reacts To FDA Settlement On Ivermectin Agency Capitulates By Removing False Claims On Ivermectin From Social Media And Internet Dr. Peter McCullough March 25, 2024 https://petermcculloughmd.substack.com/p/breaking-dr-mary-talley-bowden-reacts Thursday evening March 21, 2024, in an unprecedented court case, the US FDA led by Commissioner Robert Califf, MD, a previously respected Duke Cardiologist, has settled a court case and taken down all of its false and misleading claims on ivermectin. The drug has been part of community standard of care for the treatment of COVID-19 with an excellent safety profile and signals of benefit in 101 studies. During 2021, in what has been called “A War on Ivermectin” the US FDA engaged in false and misleading tweets and public messaging to dissuade doctors, pharmacists, and patients from using the drug in The McCullough Protocol and similar multi-drug regimens for acute COVID-19. Brenda Baletti, Ph.D. reporting for Childrens Health Defense stated: “In their lawsuit, Drs. Bowden, Marik and Apter alleged the FDA acted outside of its authority by directing the public, including health professionals and patients, not to use ivermectin -- even though the drug is fully approved by the FDA for human use. https://childrenshealthdefense.org/defender/fda-ivermectin-covid-treatment-lawsuit-social-media/ They alleged the FDA was carrying out a “crusade” against ivermectin as a treatment for COVID-19 that “unlawfully interfered” with the doctors’ ability to practice medicine. The suit, filed in the U.S. District Court for the Southern District of Texas, Galveston Division, also named the U.S. Department of Health and Human Services (HHS), HHS Secretary Xavier Becerra and Dr. Robert Califf, acting FDA commissioner. The complaint alleged the FDA cannot ban off-label use of particular drugs or advise whether patients should take approved drugs. Doing so, they said, is intervening in the doctor-patient relationship. The plaintiffs said their lawsuit wasn’t about whether ivermectin is an effective treatment for COVID-19. It was about who determines the appropriate treatment for each unique patient and whether the FDA can interfere with that process. U.S. District Judge Jeffrey Brown dismissed the case in 2022, ruling the FDA has “sovereign immunity” and granting it protection against most civil lawsuits. Brown also said the plaintiffs had not proven they were directly harmed by any FDA action. But the 5th U.S. Circuit Court of Appeals in New Orleans overturned the dismissal in September 2023, ruling the agency did exceed its authority under federal law. Australian billionaire Clive Palmer imported 37 million doses of Hydroxychloroquine (HCQ) only to have it destroyed because of deals with Pfizer. He spent another million dollars on HCQ research that was also wasted when the HCQ study it was funding was shut down. The Vigilant Fox Substack July 22, 2022 https://thevigilantfox.substack.com/p/dr-pierre-kory-takes-alex-berenson During a friendly debate on the efficacy of Ivermectin, Dr. Pierre Kory responded to a comment that Alex Berenson made, comparing advocates of ivermectin to advocates of the vaccine, essentially saying both have attached themselves to a drug based on feelings and not evidence. But there’s a critical difference. “Look what the agencies are advocating for,” said Dr. Kory. He asked Berenson, “Do you think we're in a state of regulatory capture of the health agencies?” Alex responded, “Oh ya! Absolutely!” Pierre built on that belief. “So that's exactly what I want to base my point on. Instead of saying the advocates for the vaccines and the advocates for your ivermectin are similar, I would say, what’s similar is what the agencies want.” Dr. Kory continued: “So look at what their arguments are: they want vaccines in every arm, and they want at all costs to prevent Ivermectin from reaching anyone. So I think that's the same side of the -- my opinion is everything you've seen, every piece of BS, and I think crimes and fraud have been committed in the championing of these vaccines, ignoring data, ignoring natural immunity, all the chicanery that these agencies have pulled … [and] when you look at what they did to Ivermectin, that's the spot, that's the part that I would be suspicious of. And so, that's what I think is -- two things that you should be skeptical of; you should be skeptical of what's coming from the top.” Most definitely. Dr. Kory also mentioned his personal experience with treating his own patients with ivermectin. “Not only [did] the early data show, like a signal, we hadn't seen around anything, but I was starting to treat patients. And I was like, 'Wow!' I would have patients super sick -- four, five, six days. Within 12 to 24 hours, they were turning around." Now, here's the big angle where Kory took aim at Berenson's skepticism: the belief that only esteemed, randomized control trials can be given any attention. There are three main falsehoods on this topic: One. The hegemony of RCTs (randomized control trials) is that randomized and observational studies lead to different conclusions. "Every time you have like a promising study that shows this or that, everyone says, 'Ah! We need to do a big RCT to prove it.' There are half a dozen reviews that have looked over decades of trials, and when you compare collections of observational and randomized, they reach the exact same conclusion on average throughout the history of evidence-based medicine. Yet, we're in a modern health system, where nothing is proven until a high-impact journal with a highly-funded study, which is supposedly high-quality -- that's the arbiter of truth. And I will tell you, that's false ... You're essentially looking to capture journals who now control that's what gets used." Two. High-quality trials lead to different conclusions than low-quality trials. "Again, not true. High-quality [and] low-quality are actually separated by grading scales, which academics have come up with bias and all this stuff -- concealment randomization, allocation, and when you actually look at high-quality, low-quality trials studying the same thing, if you look at collections of them, they reach the same conclusions, yet we dismiss all the low-quality." Three. It is better to pick one esteemed study than to look at meta-analyses. "The highest form of medical evidence is meta-analyses. It's when you group all the data together, and when you do that, you show statistically significant improvements in mortality, hospitalization, [and] time to viral clearance. Any individual trial will show one thing, but you want to look at the average of all the data, and when you do that, I'm going to tell you, Alex, in my study of therapeutics, I've never seen a more proven drug than ivermectin. Right now, we have 88 controlled trials involving 132,000 patients, and when you look at meta-analyses, no matter how you slice it and dice it, it's so profoundly positive [for ivermectin]. And yet I sit, I've listened to all of these kind of these narratives, and I just feel like it's this selective 'Look at a couple of trials,' and then you ignore a massive evidence base, and I think that's what leads people astray." Thank you so much, Dr. Kory, for this important breakdown. It is so easy to jump to a conclusion when you pick and choose the studies you want, but when all the data is combined, it's evident. So, it's something like 99.9% vaccination rate. And they were the first ones to line up for their vaccines. Well, as I started looking at the sudden deaths of Canadian doctors, I realized, yes, most of them are dying from cardiac issues, heart injuries, cardiac arrests, dying while jogging or swimming, dying in their sleep. And Dr. Peter McCullough has talked about this extensively, about the myocarditis and the damage to the heart, the scarring to the heart. And then some were dying from blood clots, pulmonary embolis, strokes. "But then there was quite a large subset of doctors who were developing extremely aggressive cancers and cancers at an age that they shouldn't be getting. So, for example, there was a doctor who developed gastric cancer in his 30s, presented at stage four. He was dead in less than a year. Very rare brain cancers in young individuals in their 20s and 30s, medical students, and medical residents. And these cancers would always present at stage four. And they would always kill them in a matter of a few months. And it was always less than a year. "And at first, I didn't know what the term for this was or what the phenomenon was. I just started really paying attention to it, tracking it. I then realized that this is being called “turbo cancer” by people on social media. Turbo cancer is not a medical term, but it's a term that people came up with to really describe the extremely aggressive nature of these cancers in the COVID-vaccinated. And these cancers behave completely differently, unlike anything I've seen before in my career. And I've diagnosed over 20,000 cancer patients in my career with cutting-edge PET, CT, positron emission tomography, imaging, CT, MRI, pathological correlation. "I've never seen anything like this. I've never seen stage four breast cancers presenting in women in their 20s. I've never seen stage four colon cancers presenting in men and women in their 20s and 30s. Leukemias that will kill you in a matter of days or even hours after diagnosis. Lymphomas that, again, kill you in a matter of months." ...................... Using Ivermectin To Treat Turbo Cancer Dr. William Makis: "Ivermectin is a wonderful, incredible drug. Discovered in Japan, it won the Nobel Prize [for medicine]. I have recently done a very extensive article. Ivermectin has been used to treat COVID-19. What's interesting is that -- and I've reviewed the research extensively on this -- there is now extensive research to support Ivermectin use in treating cancer, particularly the types of aggressive cancers we're seeing in COVID-19 vaccinated individuals -- the turbo cancers. "For example, the glioblastomas, which are the brain cancers that are really terminal. If you get diagnosed with that you may die within a few months. Ivermectin may actually help with those. The stage four breast cancers, the stage four colon cancers, pancreatic cancers, gall bladder cancers, renal cancers, melanomas. These are cancers that have actually been studied with Ivermectin -- very aggressive cancers. 'FDA is not a Physician': Federal Appeals Court Sides with Doctors on Ivermectin for COVID-19 By Emily Miller September 1, 2023 https://www.emilypostnews.com/p/fda-is-not-a-physician-federal-appeals A federal appeals court on Friday gave three doctors the green light to pursue their lawsuit against the Food and Drug Administration (FDA) over using ivermectin off-label to treat COVID-19. "It's been David v Goliath from the start of this pandemic, and it's finally a small win for David," Dr. Mary Talley Bowden, one of the plaintiffs, told me Friday. "But there's still a lot more work to do." Just weeks after hearing the case, the 5th Circuit reversed a district court's dismissal on the grounds that the FDA has sovereign immunity. (The decision is at the bottom for paid subscribers to read.) The ruling was written by U.S. Circuit Judge Don Willett, a Pres. Donald Trump appointee. He pointed to the FDA's social media posts (below) about ivermectin that made it seem the medication was for farm animals. The judge wrote: "FDA is not a physician. It has authority to inform, announce, and apprise—but not to endorse, denounce, or advise. The Doctors have plausibly alleged that FDA's Posts fell on the wrong side of the line between telling about and telling to. As such, the Doctors can use the APA to assert their ultra vires claims against the Agencies and the Officials. "Even tweet-sized doses of personalized medical advice are beyond FDA's statutory authority." Judge Willett also wrote that the social media messaging "traveled widely across legacy and online media." He wrote: "Left unmentioned in most of that messaging: ivermectin also comes in a human version. And while the human version of ivermectin is not FDA-approved to treat the coronavirus, some people were using it off-label for that purpose." Dr. Bowden said that she and her co-plaintiffs Dr. Paul E. Marik and Dr. Robert L. Apter are "thrilled with the decision which recognizes the FDA is not a doctor and does not have the authority to issue medical advice." During the hearing before the three-judge panel, Judge Jennifer Walker Elrod pressed the FDA's lawyer hard on whether the agency's social media posts were "commands." Finally, the FDA lawyer conceded, "FDA explicitly recognizes that doctors do have the authority to prescribe ivermectin to treat COVID." The doctors filed the suit in June 2022 for interfering with both their authority to prescribe an approved medication and the doctor-patient relationship. "The court rejected the government's attempt to assert sovereign immunity and avoid any accountability for its illegal actions, allowing our case to proceed," Bowden said. Joe Rogan, Ivermectin and the 'Politicization of Information' By Children's Health Defense Team https://childrenshealthdefense.org/defender/joe-rogan-ivermectin-russell-brand-rolling-stone/ When comedian Joe Rogan contracted COVID, the media seemed to take delight in his illness and wanted him to suffer as a result of it, Russell Brand said in a new video. The media's reporting on the treatments Rogan used -- which included ivermectin, vitamin C and monoclonal antibodies -- was "deeply cynical," said Brand. Brand said he has no opinion on how COVID should be treated and isn't qualified to offer advice -- but he does have an opinion on how the media reports on certain issues and what biases are at play. Brand questioned why information on ivermectin, an antiparasitic drug given to 4 billion people worldwide, is so politicized. He highlighted a clip from "The Joe Rogan Podcast" where Rogan addresses the media storm that ensued after he went public about using ivermectin. In his podcast, Rogan said: "They keep saying I took a horse dewormer. I literally got it from a doctor. It's an American company. They won the Nobel Prize in 2015 for use in human beings, and CNN is saying I'm taking horse dewormer. They must know that's a lie." Rogan said he's considering suing CNN for accusing him of putting out misinformation about ivermectin. Politicizing medical treatments To unpack the mainstream media's condemnation of Rogan's decision to take ivermectin, Brand points to an article by Matt Taibbi -- "Ivermectin: Can a Drug Be 'Right-Wing'?" The article notes the varying opinions on using ivermectin to treat COVID. Taibbi writes: "As is noted in nearly every mainstream story about the subject, the WHO has advised against its use pending further study, there have been randomized studies showing it to be ineffective in speeding recovery, and the drug's original manufacturer, Merck, has said there's no 'meaningful evidence' of efficacy for COVID-19 patients. "However, it's also patently untrue, as is frequently asserted, that there's no evidence that the drug might be effective. "This past week, for instance, Oxford University announced it was launching a large-scale clinical trial. The study has already recruited more than 5,000 volunteers, and its announcement says what little is known to be true: that 'small pilot studies show that early administration with ivermectin can reduce viral load and the duration of symptoms in some patients with mild COVID-19,' that it's 'a well-known medicine with a good safety profile,' and 'because of the early promising results in some studies, it is already being widely used to treat COVID-19 in several countries. "The Oxford text also says 'there is little evidence from large-scale randomized controlled trials to demonstrate that it can speed up recovery from the illness or reduce hospital admission.' But to a person who might have a family member suffering from the disease, just the information about 'early promising results' would probably be enough to inspire demands for a prescription, which might be the problem, of course. Unless someone was looking for that information, they likely wouldn't find it, as mainstream news even of the Oxford study has been effectively limited to a pair of Bloomberg and Forbes stories." Brand said what he found interesting about the article is the discussion about the "politicization of information." Mainstream media has "very little objectivity," Brand said, and uses everything as an "opportunity to score points for what's regarded as the 'left' and 'right.'" Rolling Stone article demonizing ivermectin is debunked On Sept. 5, Rolling Stone published a now-debunked report falsely claiming the use of ivermectin to treat COVID had emergency rooms in Oklahoma "so backed up that gunshot victims were having hard times getting" access to medical care. Rolling Stone didn't retract the piece, but instead issued a correction saying that a hospital denied Oklahoma doctor Jason McElyea's claim that ivermectin overdoses were causing delays in treating gunshot victims. The story also sparked controversy because of the image Rolling Stone used in the article, which, on social media, looked as if the people waiting in line were waiting for treatment at an emergency room in Oklahoma. Brand: 'You should be entitled to make your own decision' on vaccines When it comes to COVID vaccines, Brand is a firm believer in personal choice. Brand said: "If you want to be vaccinated, you should become vaccinated if you're comfortable with the information you've been given around that subject. If you're a person who doesn't want to be vaccinated, you should be entitled to make your decision." And when people say "not being vaccinated affects" others, Brand said that same attitude of considering how your personal actions affect others should be applied to a whole host of issues, including distribution of wealth, public speech and education. Brand said: "It's interesting that that's being applied strictly in one area of public and medical life and not others. Peter McCullough, MD, is a consultant cardiologist and Vice Chief of Medicine at Baylor University Medical Center in Dallas, Texas. He is a Principal Faculty in internal medicine for the Texas A & M University Health Sciences Center.
