Since the end of 2023, nearly 382 Wall Street firms have moved their headquarters out of New York City, taking nearly $12+ trillion in assets under management with them. This has resulted in the loss of tens thousands of high-paying jobs, straining city and state finances by sapping tax revenue. New York, California Lose Firms Managing an Estimated $12 Trillion in Assets More Than 370 US Companies Have Moved Headquarters Since 2020, Report Finds. The recent departures of some major investment firms from New York have resulted in nearly $1 trillion in combined assets under management that are no longer based in the largest U.S. city, according to a new report.

And New York isn’t alone. California investment firms decamping to other states over the past several years, with Texas as the top destination, also managed nearly $1 trillion in combined assets.

Around 158 companies managing $993 billion in assets, including Alliance Bernstein and Elliott Management, moved their headquarters out of New York to states including Florida and Tennessee from the first quarter of 2020 to early 2023, according to a Bloomberg study of corporate filings from more than 17,000 firms since the end of 2019. New York alone accounted for 56 of the 104 financial services firms that moved to Florida in that time, the study found.

In total, since the start of 2020 through the end of March 2023, more than 370 investment companies, or about 2.5% of the U.S. total with $2.7 trillion in assets under management, moved their headquarters to a new state, the study found. Most of the moves were from areas with high costs of living in the Northeast and on the West Coast to Sun Belt states including Florida and Texas.

The investment firms and their relocating employees can have big ripple effects on the commercial property market beyond office buildings to retail and residences. Finances of the new markets also are affected, especially since asset managers are often high-wage earners, not to mention top executives or founders who are often millionaires or billionaires.

The net number of taxpayers moving out of New York based on the preliminary 2021 tax-year data at the time was over 10,000 higher than the annual net average of 28,700 personal income taxpayers between 2015 and 2019, according to a separate study by New York State Comptroller Thomas DiNapoli’s office. The net number of millionaires leaving in 2021 was almost three times that in 2019, according to the comptroller’s office, adding that a continuation of the trend would hurt New York state’s personal income tax collections, the single-largest source of revenue.

Moving Out
The migration trend followed a net total of 112,400 taxpayers moving out in 2020, nearly four times as many as in 2019, according to the comptroller’s study.

On the commercial property front, while AllianceBernstein still has a New York footprint, CoStar data shows the size has declined to about 166,000 square feet with the firm's expected move to 66 Hudson Blvd. after it exited about 733,000 square feet in 2021 at 1345 Avenue of the Americas.

Alliance Bernstein said in its original 2018 announcement that its planned move to Nashville, Tennessee, would involve relocating over 1,000 jobs in the New York metropolitan area. The firm officially debuted its downtown Nashville headquarters spanning more than 221,000 square feet last year.

The effect is deep for cities that have welcomed new firms. For example, the headquarters relocation of Citadel from Chicago to Miami has spurred demand for new top-quality office projects. Manhattan developer L&L Holding is planning a 1 million-square-foot, mixed-use apartment, office and retail project in the Wynwood neighborhood, its first major development in Miami.

The migration trend also has retail tenants following suit as they seek to capitalize on newcomers with spending power. New York-based Major Food Group opened restaurants in Miami during the pandemic, including Carbone, Sadelle’s, HaSalon, Dirty French Steakhouse and ZZ’s Club. Local real estate brokers have said many of the retail and restaurant names flocking to the market often are better known for their outposts in the Big Apple.

Icahn Capital Management — headed by billionaire corporate raider Carl Icahn — is among the most prominent firms to decamp to the Sunshine State. In August 2020, the firm ditched its posh Manhattan digs atop Fifth Avenue’s General Motors Building in favor of a 14-story office complex in a Miami suburb.

Icahn’s firm, which manages $22.2 billion in assets, now conducts business less than a mile away from his mansion in Indian Creek Village.

The people participating are mostly aware of that. There are participants who are legitimately enraged by police brutality and feel that this public display is the only way to bring any attention to their situation, but the reality is that all riots serve to do is make the rioters look like uneducated savages who do not know how to conduct themselves in the public forum, regardless of how legitimate the original cause was.

The vast majority of those involved, particularly young rioters- at least in my belief, based on their recorded actions- are not trying to affect any form of political change. They are they because they want to break some windows for fun. It’s out of the ordinary, a chance to act a bit crazy, and basically quite exciting. Not that I’m approving of it, or saying I would be joining in, but you’re lying to yourself if you think that there isn’t a sort of abandoned fun in going around and mindlessly destroying things. According to the FBI, 15,498 people were murdered in the US in 2018, down from 16,499 in 2017. Racial data is available on only 14,123 (91.1%) of those murdered in 2018.

Of the 14,123 victims, 9,066 cases are listed as Not Hispanic or Latino; 2,173 are listed as Latino or Hispanic; 6,088 are listed as White; 7,407 as Black; 395 as other race; and 1,840 are listed as unknown race. This is problematic because it is impossible to discern how many of the victims listed as “white” are actually Hispanic/Latino. Hispanic/Latino is an ethnic group not a racial group according to the government’s definition.

Ongoing reductions achieved in shootings, homicides, vehicle thefts, other major crimes

Continued declines across most major crime categories prevailed during January
2024, compared to the first month of last year, and included substantial drops in murder, rape, burglary, and felony assault. And for the second month in a row, the number of vehicles stolen in New York City was reduced by at least 3.8% (1,178 vs. 1,224).

Overall index crime dipped 2.9% citywide in January compared to the same month in 2023, more than reversing the slight increase experienced in December. In January, the category of murder decreased by 25% (27 vs. 36); rape by 24.4% (102 vs. 135); burglary by 19.8% (1,065 vs. 1,328); grand larceny auto by 3.8% (1,178 vs. 1,224); and felony assault by 1.5% (2,068 vs. 2,100). Arrests for all major index crimes citywide increased 5.7% (4,676 vs. 4,422) in January compared to the same time period a year ago.

Shooting incidents in January were reduced by 10.8% (66 vs. 74), which equated to an 11.5% (77 vs. 87) decrease in the number of shooting victims. Also in January, NYPD officers arrested 330 people for possession of an illegal firearm and seized 508 guns. Police have now taken more than 14,115 guns off New York City streets since the start of the administration two years ago.

“It is evident that the tremendous work being done by the men and women of the NYPD to confront gun violence head-on continues to drive significant reductions in violence and disorder across many categories,” said Police Commissioner Edward A. Caban. “These intensive efforts are having ripple effects citywide, and are enhancing quality of life and increasing public safety on a large scale.”

In January 2024 compared to the previous January, overall crime in public housing developments decreased by 11 major crimes (486 vs. 497). The total number of bias incidents investigated by the NYPD’s Hate Crime Task Force across the five boroughs increased by 12 incidents (45 v. 33) in January, led by a month-over-month increase in anti-Jewish incidents.

Citywide in January, the category of robbery increased 5.4% (1,417 vs. 1,345) while grand larceny saw a 0.4% (4,056 vs. 4,041) uptick, fueled by organized pickpocket teams and individual “lush workers” – so named because they often target inebriated or sleeping victims in the subway system. The nation’s largest and most-travelled transit network, which accounts for just 2% of all major crime committed in New York City, saw an increase of 70 index crimes (222 vs. 152) in January. In demonstrating the NYPD’s ability to develop timely, intelligence-driven deployment plans, uniformed presence in the subway system was expanded in hot-spot areas and will be supported further over the coming weeks using a combination of
Transit Bureau personnel and officers usually assigned to administrative duties department-wide. In addition to violent crime, officers will continue to focus on quality-of-life offenses, including fare evasion.

THE FACTS ON BAIL REFORM In 2019, New York lawmakers passed legislation that eliminated the use of cash bail for most misdemeanors and some nonviolent felony charges, in an overdue recognition that a person’s wealth should not determine their liberty.

But in 2020, prosecutors and police departments led a misinformation campaign that resulted in roll backs of the 2019 reforms. Now opponents of the bail law are determined to spread more misinformation and fear, threatening to undermine due process and push New York even further backward.

Bail reform is essential to improving public safety, upholding due process, advancing racial justice, and protecting public health during the COVID-19 pandemic. It is also working. People released on bail are returning to court at high rates. Here are the facts.

What the Bail Law Does
New York’s bail law currently eliminates money bail for most misdemeanors and nonviolent felonies. Those accused of these crimes are either freed without restrictions while their case plays out, or released under certain conditions like electronic monitoring. The law also requires police to issue appearance tickets to people charged with some low-level minor offenses, rather than taking them to jail.

Under the new law, judges are much more likely to look at alternatives to pretrial incarceration as conditions of release, such as drug treatment programing and other services that help people succeed in their community.

Prior to bail reform, these New Yorkers would have had to sit in jail, in often dangerous or even deadly conditions, even though they hadn’t been convicted of any crime. Given what we know about how rapidly COVID spreads in jails, it is no exaggeration to say that bail reform has saved lives. People held in jails are highly vulnerable to outbreaks of contagious illnesses like COVID. They are packed together in close quarters with little control over their daily interactions with others, and are often in poor health. Fewer people in jails means fewer people at risk of getting sick and dying.

Racial Justice Impacts
Everyone benefits in a society where people are presumed innocent until proven guilty and when people are not incarcerated without due process. But any attempt to roll back bail reform will have disproportionate impacts on Black people and other people of color.

A NYCLU report based on data that pre-dates bail reform found that in eight upstate counties, white New Yorkers were twice as likely to be released on bail as Black New Yorkers. Black New Yorkers were also twice as likely as white New Yorkers to spend the night in jail, and face a host of collateral consequences – including loss of employment, housing, childcare, and more – after bail was set.

The Dangers of “Dangerousness”
One idea from opponents of bail reform is punishing people preemptively, before they’ve even been accused, let alone convicted of any crime. Advocates for a so-called “dangerousness standard” want judges to be able to hold people in jail whom they think could commit crimes if they are released. In our racially unjust society, “dangerousness” inevitably becomes a proxy for what race a person is.

Efforts to Destroy Bail Reform are Not About Safety
There is no evidence that bail reform has contributed to an increase in crime. For the prosecutors and law enforcement officials fear-mongering about bail, the real issue has never been about safety. It’s about power. Prosecutors want the power to coerce people – even those who have not done anything wrong – into taking plea deals. Police departments want to avoid any scrutiny of their failures and use bail reform as a scapegoat.

New Yorkers cannot allow our state to be pulled backwards. We need robust funding for mental health care, housing, and education and for proven public safety solutions like restorative justice and violence interruption programs. The facts don’t support a retreat from justice, neither should state leaders.

There is no clear connection between recent crime increases and the bail reform law enacted in 2019. In 2019 New York State adopted a law ending the assessment of cash bail in most cases involving misdemeanors and nonviolent felonies. The law aimed to reduce the risk that someone would be jailed because they could not afford to pay for release and the unnecessary use of incarceration, both of which can have a profoundly disruptive effect on peoples’ lives.

Many police leaders and some politicians have been against these reforms from the start, arguing that they contributed to rising crime early in the Covid-19 pandemic. Those concerns, among others, drove three rounds of revisions to the bill between 2020 and 2023. Here, we review what we know so far about bail reform and its impact on public safety. Critically, there is no evidence that bail reform drove recent increases in violence.

Bail eligibility depends on several factors.
New York’s bail reform legislation went into effect at the start of 2020 and changed where and how judges may impose monetary bail pending the outcome of a criminal case. Broadly speaking, the law separates cases into two categories based on the alleged crime involved.

According to the law, judges have the option to set bail in almost any case involving a violent felony. In these “bail eligible” cases, a defendant must pay any assessed bail or face detention. In most other cases, which include most misdemeanors and nonviolent felonies, judges must release people on their own recognizance or impose some other set of conditions to ensure their return to court. Such conditions include restrictions on travel or supervision by a pretrial supervision agency.

When deciding whether to release a person or set bail, the law requires judges to focus solely on the conditions that will ensure that the person returns to court. That means, unlike most other states, New York judges cannot consider their subjective view of a person’s “dangerousness” when deciding what release conditions to set. New York’s approach, which dates back to the 1970s, reflects an attempt to preserve the presumption of innocence and reduce racial biases against defendants. State legislators carefully considered revisiting this rule in 2020 but ultimately decided against it.

Notably, judges also retain the ability to set bail in some “high risk” cases, even ones that would otherwise be ineligible for bail. Judges may set bail for defendants who have been released and are rearrested for another offense, provided both charges are felonies or Class A misdemeanors and involve “harm to an identifiable person or property.” This provision was expanded in 2022, to make clear that the definition of “harm” includes theft. As a result, a judge may set bail for a person who was charged with punching someone in a bar fight, released, and then arrested for injuring someone in another fight. The same likely holds true for repeat shoplifters. Other circumstances can make a case bail eligible as well, such as when someone is charged with a felony offense while on probation.

Research shows bail reform did not drive the 2020–21 crime increases.
Many have argued that bail reform was responsible for rising crime in New York State, both in and out of New York City. But no direct evidence has emerged to support those claims.

It is true that New York City saw a sudden increase in crime from 2019 to 2020, with an especially stark increase in murders, which rose from the 319 in 2019 to more than 450 in 2020. Shooting incidents in the city roughly doubled during the same period. Statewide, the murder rate also rose from 2.9 to 4.2 killings per 100,000 people. According to one analysis, those spikes were “concentrated in areas characterized by poverty and racial segregation.” Pretrial rearrest rates also climbed, though slightly, between 2019 and 2022.

The best available information, however, suggests that bail reform is not the primary driver of any of these increases. In one recent paper, a team of criminologists studied how bail reform affected New York State crime rates through late 2021 — the period when crime spiked most dramatically. They concluded that murder, larceny, and motor vehicle theft did increase in New York State, but found no evidence that bail reform caused those increases. Essentially, they determined, crime was poised to rise for other reasons in New York, notwithstanding bail reform.

Two studies by the Data Collaborative for Justice reached similar conclusions after a close look at trends in New York City. The first found that eliminating bail for misdemeanors and nonviolent felony offenses reduced rearrest rates. In a follow-up study, and using a different strategy, the Data Collaborative for Justice found that bail reform had no impact on rearrest rates in either direction.

That said, there is evidence that reform led to an increase in pretrial rearrests in some limited circumstances. When focusing on “high risk” cases — for example, people with a pending case or recent violent felony arrest — the Data Collaborative for Justice found that rearrest rates rose after reform. Those findings align with data from the nonprofit New York City Criminal Justice Agency, which contracts with the city on pretrial supervision work. According to the group’s data dashboard, rearrest rates are higher, and have risen moderately, in cases involving people with a more substantial criminal history. But the data also underscores that these are the vast minority of cases.

Taken together, the best available research undercuts any sweeping claims that bail reform could explain the spikes in crime the city and state saw during the pandemic. But it may point to the need for creative thinking to solve implementation issues, such as more funding to support pretrial supervision.

Crime rose in jurisdictions both with and without bail reform — and is now falling.
The increases in violence we saw in 2020 and 2021 were undeniably tragic developments but must still be considered in context. Murder rates in New York City and New York State both remain below the national average. City and state crime increases during the Covid-19 pandemic were also far from unique. Between 2019 and 2020 the national murder rate rose by roughly 30 percent, and assaults jumped by around 10 percent. These increases were felt in communities of all sizes, political alignments, and geographies — and in places with and without recent bail reform policies. In Florida, for example, murders rose by roughly 15 percent between 2019 and 2020.

Further, as of January 2024, crime has been declining in New York City, with murder and nonfatal shootings falling precipitously. That too parallels a national trend: violence declined nationally in 2022 and likely also dropped in 2023. (Officials have not yet shared data on national crime trends in 2023.)

Crime is complex, and policymakers should be wary of simplistic answers.
It may be years before we have a complete understanding of what caused crime to rise in New York during the Covid-19 pandemic, but researchers have begun to point to some potential national factors.

Gun violence appears to have significantly contributed to the increase in murders. Guns were sold, carried, and recovered at crime scenes at much higher rates than previous years. The pandemic also caused a sudden, sharp, and highly unequal recession — thrusting many people and communities into deep uncertainty. Social distancing and disruptive lockdowns severely hindered the reach of institutions that help preserve neighborhood safety. As the criminologist John Roman recently testified in a congressional hearing, “The pandemic can be simply described as an ‘everything, everywhere, all-at-once’ experience for most Americans.”

Of course, researchers and policymakers can and should continue to study the effects of bail reform on public safety, as more data and methods of analysis emerge. Many factors can influence a pretrial release decision too, making it important to look beyond the words in the statute and consider how prosecutors, judges, and other stakeholders are applying the law in practice.

Critically though, so far there is no evidence that bail reform has driven the increase in crime. That makes the case for further major revisions to the bail statute significantly weaker. Indeed, other policy interventions that support communities have the potential to build enduring public safety in the city and state.

For example, better funding for pretrial services, which lawmakers and Gov. Kathy Hochul have supported in the past, could ensure that people awaiting trial in their communities receive help they may need. Further, expanded mental health treatment services could identify and help people in crisis, as could addiction and substance abuse treatment. Other interventions, like after-school programming and summer youth employment, may provide safe places for young people and reduce opportunities for conflict. Programs to expand affordable housing could reduce strain on the city’s overburdened shelters for unhoused people, and improve quality of life, health, and safety at a stroke. Funding and support for community violence interrupters, a promising strategy that the Biden administration has embraced at the federal level, could also lead to safer neighborhoods. These approaches grab fewer headlines than bail reform, but legislators should focus on investments, like these, that are proven to address crime.

The phrase not guilt by "beyond a reasonable doubt" means that the evidence presented and the arguments put forward by the prosecution establish the defendant's guilt so clearly that they must be accepted as fact by any rational person. 3) Ticketed recipients are not adequately notified Most governments using ticket cameras send out tickets via first class mail. There is no guarantee that the accused motorist will even receive the ticket, let alone understand it and know how to respond. However, the government makes the assumption that the ticket was received. If motorists fail to pay, it is assumed that they did so on purpose, and a warrant may be issued for their arrest.

4) The driver of the vehicle is not positively identified Typically, the photos taken by these cameras do not identify the driver of the offending vehicle. The owner of the vehicle is mailed the ticket, even if the owner was not driving the vehicle and may not know who was driving at the time. The owner of the vehicle is then forced to prove his or her innocence, often by identifying the actual driver who may be a family member, friend, or employee.

5) Ticket recipients are not notified quickly People may not receive citations until days or sometimes weeks after the alleged violation. This makes it very difficult to defend oneself because it would be hard to remember the circumstances surrounding the supposed violation. There may have been a reason that someone would be speeding or in an intersection after the light turned red. Even if the photo was taken in error, it may be very hard to recall the day in question.

6) These devices discourage the synchronization of traffic lights When red-light cameras are used to make money for local governments, those governments are unlikely to jeopardize this income source. This includes traffic light synchronization, which is the elimination of unneeded lights and partial deactivation of other traffic lights during periods of low traffic. When properly done, traffic light synchronization decreases congestion, pollution, and fuel consumption.

7) Cameras do not prevent most intersection accidents Intersection accidents are just that, accidents. Motorists do not casually drive through red lights. From the motorist’s perspective, government funds should be used on improving intersections, not on ticket cameras. Even in instances where cameras were shown to decrease certain types of accidents, they increased other accidents. Simple intersection and signal improvements can have lasting positive effects, without negative consequences. Cities can choose to make intersections safer with sound traffic engineering or make money with ticket cameras. Unfortunately, many pick money over safety.

9) Ticket camera systems are designed to inconvenience motorists Under the guise of protecting motorist privacy, the court or private contractor that sends out the tickets often refuses to include a copy of the photo to the accused vehicle owner. This is really because many of the photos do not clearly depict the driver or the driver is obviously not the vehicle owner. Typically, the vehicle owner is forced to travel to a courthouse or municipal building to even see the photograph, an obvious and deliberate inconvenience meant to discourage ticket challenges.

10) Taking dangerous drivers’ pictures doesn’t stop them Ticket cameras do not apprehend seriously impaired, reckless, or otherwise dangerous drivers, or get them off of the road.

In the US, the spousal privilege precludes one spouse from testifying against the other spouse in criminal or related proceedings, and either spouse can invoke the privilege to prevent the testimony. This privilege does not survive the dissolution of the marital relationship. Spousal immunity is a long-standing rule that says an individual cannot be forced to testify against their spouse in a criminal case.
