On January 8, 2023, at approximately 10:48, Officers were dispatched to 1609 North Spring Street regarding a possible domestic in progress. Upon arrival I observed Mr. Emmanuel Newby standing behind a vehicle in the driveway of the residence. Mr. Newby proceeded to state that we were not needed at the residence and that we could leave. I advised Mr. Newby that we would not be leaving until our investigation was done. As i walked around the vehicle, I noticed Mr. Newby had his left hand in his pants pocket and his right hand down the front of his pants. I told Mr, Newby to slowly pull his hands out of his pockets and he refused. I then repeated my command to remove his hands from his pockets multiple times. Mr. Newby continued to disregard the order. I then drew my duty weapon and Mr. Newby pulled his hands out of his pocket and had what appeared to be a vape, pointing it in my direction. I then holstered my duty weapon and began to place Mr. Newby in handcuffs to detain him. Mr. Newby then began yelling and attempting to pull his arms away from me. After placing handcuffs on Mr. Newby, I advised that he was under arrest and walked him to Cpl. McKewen's patrol vehicle. I then conducted a search of Mr. Newby's person and placed him in the back seat of the patrol vehicle. I then made contact with Mr. Newby's father, Mr. Lorenzo Newby who stated Ms. Quintella Trimble had called after coming to the residence and being asked to leave by Mr. Newby Sr. Mr. Newby Sr. then stated that Ms. Trimble had left the residence before our arrival and that it had just been a verbal argument. Dispatch then advised that they had contacted Ms, Trimble and that she was at a friend's residence but would not disclose the address of her location. Mr. Newby was then transported to the Stuttgart Police Department where he was cited and released with a court date for his charges.
