SCOTUS Colorado website designer/gay wedding ruling clarified

“‘If there is a fixed star in our constitutional constellation,’ it is the principle that the government may not interfere with ‘an uninhibited marketplace of ideas.’”

You can think the SCOTUS has been hijacked by “right-wing extremists” but really, this ruling goes both ways to protect First Amendment rights. It’s not a win for Christians or religious freedom so much as it’s a win for all Americans and the First Amendment. There’s also legal precedent for this ruling, including the BARNETT case, in which the Court decided that a West Virginia school couldn’t compel students to recite the Pledge of Allegiance under pain of penalty, as it violated their (Jehovah’s Witness) religious convictions. Many folks taking issue with the ruling in 303 CREATIVE would no doubt take no issue with the ruling in BARNETT. Because again, this goes both ways, folks.

But the left doesn’t care about equality under the law or the Constitution, because, in fact, they believe the State should be able to compel speech they deem to be “enlightened,” and likewise, be able to censor speech they deem to be “dangerous” or counterproductive to the “enlightened” narrative. But that’s not how it works.

As Gorsuch pointed out in the Court’s opinion: based on Colorado’s logic, “the government could require ‘an unwilling Muslim movie director to make a film with a [certain] message,’ or ‘an atheist muralist to accept a commission celebrating evangelical zeal,’ so long as they would make films or murals for other members of the public with different messages.” MOST Americans would disagree with that type of government interference in art—as they well should.
