CAN YOU COPYRIGHT A TWEET - AT ISSUE IN THIS EXCITING EPISODE!

Can you copyright a tweet is the subject of today's video by Attorney Steve®? The general rule would probably be NO and words, numbers, and short phrases do not normally meet the minimal level of creativity needed to register a copyright with the United States Copyright Office ("USCO"). These items, along with business and product names, stage names, pen names, slogans, and similar things, while they may qualify for federal trademark protection, the copyright office will likely be looking for more than just a short phrase.

However, if there is something beyond mere fact, opinion, idea, or short statements with 140 characters or less, it may be possible to register the tweet to prevent infringement (ex. someone posting your tweet on a t-shirt and selling it). Also, photos or videos used in your tweets may separately qualify for copyright registration but the office may exclude from protection any short phrases or words you may use to accompany the photo. This is general legal information only and not legal advice. You know where to find us for that.
