Today we discuss the case of Britto v. ATF, filed in the U.S. District Court for the N. Dist. of Texas - Amarillo Division. This case, brought by the three named plaintiffs challenges this new rule making order on several grounds including multiple attacks via the Administrative Procedure Act but finally uses the holdings of West Virginia v.
