Here we present their final arguments in full — practically the length of a sizable novel — because of their great importance (the conventional literature on the subject today hardly even excerpts them) and also because of their general unavailability. Several courageous scholars collaborated recently to scan and use Optical Character Recognition (OCR) software to put the arguments into digital form on archive.org, but not until the Mercury joined the fray have they been presented on a popular Web site in correctly formatted, easy-to-read type with OCR errors removed. Today we will present the arguments of Frank Hooper for the State of Georgia and Reuben Arnold and Luther Rosser for Leo Frank. In our next article we will have the concluding arguments of Solicitor Hugh Dorsey for the state.

TODAY we continue the new audio book version of the American Mercury’s centenary series on the 1913 trial and conviction of Jewish sex killer Leo Frank, recorded by Vanessa Neubauer. Many have described this as the trial of the century: Not only did it forever alter Jewish-Gentile relations in the United States, but some say it profoundly changed the attitude of Jews toward their hosts from one of relatively benign interaction to one of active suspicion if not hostility. What is certain is that the founding of the powerful Jewish pressure group, the Anti-Defamation League (ADL), was closely tied to the case. Now it was the defense’s turn — and the defense team was a formidable one, the best that money could buy in 1913 Atlanta, led by Reuben Arnold and Luther Rosser. And many would argue that the city’s well-known promoter and attorney Thomas B. Felder was also secretly working for Frank and his friends, along with the two biggest detective agencies in the United States, the Burns agency — sub rosa, under the direction of Felder — and the Pinkertons — openly, cooperating with the police, and under the direction of the National Pencil Company.

Leo Frank Case Watson's Magazine, September 1915, Part 6 of 13
In part 6 of the 13 part series, Trial Lawyer Tom Watson shows how Leo Frank was cross-examined and he got caught in his own set of lies due to contradictory evidence from various eye witnesses. Monteen Stover's testimony exposed Leo Frank as being a liar. Detective Harry Scott interrogates Leo Frank who states that he was in his office when Monteen Stover went there to pick up her pay. Tom Watson is indignant that Governor John M. Slaton, a business partner of Leo Frank, could try and avert the court of justice by prostituting his office by the "stroke of a pen". The rich Jews couldn't buy poor Americans or even the courts (including judges, lawyers, and jury) but they could certainly buy crooked politicians in order to pardon a fellow Jewish sex criminal. The Jewish-owned mass media made it look like a short, weak man at 5'6" in height and 130 pounds that couldn't possibly overpower Mary Phagan whereas in reality he was 5'8" and 155 pounds at least. This misrepresentation of Leo Frank's physical measurements was done in order to deflect the suspicion of the crime unto the African-American sweeper in the factory by the name of Jim Conley. No one would expect a well-educated and physically agile athlete individual like Leo Frank would try and seduce a girl repeatedly for over a year. She resisted him all the time and he finally couldn't overcome his infatuation so he decided to knock her unconscious with the iron handle of a bench lathe, rape her while she was unconscious, and then kill her by hanging because he didn't want to get castrated and killed as a rapist. Mel Stanford testified that he saw blood and hair samples near the dressing room. Stanford swept the floor on Friday without seeing any blood or hair sample. He noticed this on Monday when he returned to sweep again. Mrs George W Jefferson who worked at the pencil factory testified that she saw blood stains near the girl's dressing room. EF Holloway, the day watchman at the factory who was sympathetic to Leo Frank, stated Leo returned back before Corinthia Hall and Emma Clark would enter the factory to pick up their pay. R.P. Barrett is the factory worker who was the individual that discovered the blood and hair in the workshop. Leo Frank bribed the Forman N.V. Darley, another sexual pervert harassing under-age girls like Opie Dickerson, to be an alibi against him in planting evidence implicating Newt Lee in the murder. However N.V. Darley gave the game away by saying Leo Frank was acting nervous when he went to see Leo Frank the following Monday morning. He also mentioned R.P. Barrett as having found the pay envelopes, white powder to clean evidence, and blood stains. Leo Frank's body language gave him away as being involved in the murder when he was interrogated by the police.

The American Mercury On The Leo Frank Trial Closing Arguments Of Solicitor Dorsey Part Three Trial of Leo Frank
The Third Part of the Closing Arguments of the Trial of Leo Frank in Atlanta, Georgia sometime around late 1913 by Solicitor Dorsey Continues With Frank being accused of trying to bribe Jim Conley to burn the body of thirteen year old Mary Phagan (June 1, 1889 - April 26, 1913) and cover up for him. Jim cautiously rejects his offer saying that the risks and troubles are not worth it if he gets caught in the act. This was very likely since smoke would eject from the chimney and into the sky thereby implicating him directly in the crime. Frank even tries to deflect suspicion off him and cast it upon Gantt when he sends the telegram to his uncle laying the blame on Gantt. Earlier Frank had claimed that he didn't know Mary Phagan but the other employees saw him calling her Mary and his accounting books showing that he had been paying her weekly salary for a year uncle proved otherwise.
He was seen by other eyewitnesses like Willie Turner approaching her a few months ago in March of 1913 with untoward and inappropriate behavior while she resisted him. Frank had also been seen touching factory workers in uncomfortable ways like putting his hands on their shoulders and getting a little bit too close for comfort with the child laborers at the factory. Frank setup a forged card to implicate Newt Lee in the murder, but when this racist diversionary tactic failed, he also tried to direct suspicion toward James Milton Grantt, the former payroll director at the factory that knew Mary Phagan; it was plausible framing given that Gantt had been a friend of the Phagan family for years. Frank obviously knew her since he did the payroll for her every week. At first he tried to blame the night watchman Newt Lee but when the timings in the punch card seemed off, he laid the immediate blame on Gantt who he claimed knew the girl. The prosecutors also claimed that Leo Frank made Jim Conley write sloppy notes that he put on her body to deflect blame from himself, and direct blame to the Negro night watchman Newt Lee. The contradictions in Frank's testimonies and the mismatch of the evidence at hand made Leo lose all credibility every time he made any further statements.

The American Mercury On The Leo Frank Trial Closing Arguments Of Solicitor Dorsey Part Two Trial of Leo Frank
In this part of the Trial, where Solicitor Dorsey continues on with the closing arguments, he points out that there is perjury in the case as Leo Frank exposes himself as the main culprit by "betraying nervousness". That is because Leo Frank is being shown by the prosecutor as a mentally fit and very capable young man that is able to execute everyday tasks with ease. Dorsey exposes the holes in Leo Frank's narrative and apparent contradiction when it is shown that Leo Frank wired a telegram to a fellow Jew by the name of Adolph Montag informing him ahead of time that the body of the factory girl would be found in the cellar of the pencil factory rather than the main premises of the building as had been suggested in the newspapers. He shows foreknowledge of where the body was placed ahead of time thereby exposing his guilty-ridden conscience.
He further shows his anticipation that police will solve it and makes his guilt transparent when he displays foreknowledge of what will happen to him. He states "I am all right, in case my uncle asks" indicating that he will be the prime suspect in the incident since all evidence pointed towards him. Furthermore, the Solicitor points out that the legal team that was handling the case would be bribing or keeping pressure on the police not to reveal the gory details that would point to Leo Max Frank as being the perpetrator of the crime. He mentions Pinkerton detective Harry Scott who was connected to other police officers like John R. Black and Atlanta police Sargeant Starnes. Frank's lawyer Rosser suppress evidence that would implicate his client. Not only that, Frank is accused of planting fake evidence that would distract potential investigators and prosecutors from focusing on him and investigate Newt Lee and Jim Conley instead.
Frank's lawyers may argue that perjury occurred and the evidence was circumstantial against Frank but Dorsey claimed that if the evidence is solid and it matches the timing and events whereas against the other accused individuals like Newt Lee, Jim Conley, and Gantt, it was extremely weak.

Hugh Dorsey, the Solicitor General for the State of Georgia presents his case in regards to the rape and murder of Mary Phagan by Leo Frank. He summarizes everything succinctly with various evidences exposing the details of what had transpired in the incident thereby causing the jury to convict Leo Frank in the immediate trial.
Jewish-American press juggernaut, Adolph Ochs (March 12, 1858 - April 8, 1935) owner of
the New York Times, and Albert D. Lasker (May 1, 1880 - May 30, 1952) were both involved in artificially maintaining consensus in the National Press that Leo Frank was innocent through their network of media bosses. Their crusade was cynical because behind closed doors Albert Davis Lasker (May 1, 1880 - May 30, 1952) expressed the belief that Leo Frank was a pervert and likely guilty.
The atmosphere surrounding the trial was heavily charged even many years after the event. All the blame fell on the people of Atlanta as being unhinged bigots and anti-Semites that decided to frame and arrest Leo Frank based on false charges for no particular reason other than sheer hate; that is according to the rich, powerful, and well-connected Jews that ran the National media, newspapers, and public press in general. The entire recording of the case proved that to not be the case.
The Solicitor General praises the Jewish people as having been civilized before his own before proceeding with the details of the case. Leo Max Frank is then exposed for what he truly is: a liar and pervert. Despite having come from an intelligent, rich, and successful background, Leo Frank made mistakes that men (both Jewish and Christians/gentile/non-Jewish) greater than him had made before he raped and murdered Mary Phagan. Various examples are cited that show great human beings have made tragic mistakes in their lives. The list includes people like King David and Judas Iscariot from the Bible, Abe Hummell, Abe Reuff, Schwartz, Henry Clay Bettie, amongst others. They go on to argue that circumstantial evidence is good as any other when it comes towards executing a successful conviction.

Leo Frank Case Judge Leonard Roan's Instructions To The Jury At Leo Frank's Rape Murder Trial
In this Audiobook, the bill of indictment which includes the charges is read out aloud by Judge Leonard Roan who begins by giving a short brief of the crime Leo Max Frank committed against Mary Phagan and the means and methods of executing his plans to violently rape and murder her. Leo Frank is then assumed to be innocent until proven guilty until evidence is provided to corroborate the accusations against the defendant. The judge goes through the motions and explains minute details of the differences in the type of conviction - whether it be reasonable doubt or beyond any doubt as well as the standard textual definitions of the crimes he is accused of committing.
These include terms such as doubt, beyond any doubt, beyond a reasonable doubt, murder, express malice, and implied malice. The Judge further stated that he encourages direct evidence as better proof of an accusation instead of circumstantial ones. The Judge further continues by saying that the Solicitor General of the state had been allowed to cross examine the eye witnesses for the defense. Any accusations coming forth from the prosecution will also need to bring in witnesses to enhance the validity of such claims. The defense in turn has the right to cross-examine the witnesses brought forth by the prosecution. If the jury believes the defendant is guilty without a reasonable doubt, the bar to convict the accused is set high especially when circumstantial evidence is taken into account.
Thereby simply accusing the defendant of having a bad character is not a good enough reason to have him convicted without taking any other factors into consideration.

Leo Frank Case, Watson's Magazine Sept 1915, Part 5 of 13, read by John De Nugent
Harry Scott further continues his testimony by stating the fact that Leo Frank admitted that he was inside his office every single minute between midday and 12:30 PM on April 26th, 1913 - the day Mary Phagan was suspected of having been murdered and Harry also claimed that he found nothing of importance when he conducted a thorough search. Rosser, the lawyer for Leo Frank was doing his best to try and ensure that Frank would answer "No" instead of "I don't know" to the question posed by Mary about whether the metal for the pencils had arrived or not because his client's response would indicate that neither one of them ever had a reason to venture into the metal room in order to find out whether the materials had been delivered. The presence of the metal being delivered was a prerequisite for Mary to return to work the following Monday morning. The reason for the importance of the response to Mary's question would indicate whether she possibly went to the metal room to check for the presence of the metal if there wasn't a certainty about it being there. Frank's lawyer was trying to place Mary as far away from Frank as possible since a tress of hair was on the projecting crank of a bench-lathe and blood stains had been found in the metal room. This discovery would implicate Leo in the crime of raping and murdering Mary Phagan as the main evidence implicating Leo Frank laid in that one room.
Another witness that had appeared on the stand was a young girl by the name of Monteen Stover belonging to the same age demographic as Mary Phagan who claimed to be in Leo Frank's office at around the same time that the pencil factory manager was supposed to be there. She claimed to have been there at around 12:05 PM but didn't see Leo Frank at that particular time he was supposed to have been there. She also to his secondary (inner) office besides the outer one but didn't see or hear anybody in the building. She also claimed that the door to the metal room had been locked. Another one of Leo Frank's lawyers John M. Slaton claimed that the pencil factory manager was not in his main office room at around 12:07 PM when Mary Phagan had arrived to collect her pay. Rather, John Slaton, claimed based on falsified records that Leo Frank was inside the inner office room at that time when Monteen Stover waited for his client to come out and pay her salary. He provided a gubernatorial proclamation contradicting Monteen's personal and persistant account of Leo Frank not being in either his inner or outer office when she went to look for him at exactly that same time Leo testified towards being inside his office. Monteen's testimony was never faltered or buckled under pressure from Leo's corrupt governor cum lawyer John M. Slaton.
