Listing agents often mistakenly think that the only way they can work with a direct buyer is by acting as a dual agent. Some might even think that the only way for them to earn both sides of the listing commission is to convince the buyer and the seller to agree to dual agency.
In fact, nothing could be further from the truth as we’ll explain in the following video. Commission has nothing to do with the type of agency relationship the listing agent has with a direct buyer, and everything to do with whether there is an outside, “buyer’s agent” or not.
Furthermore, we’ll explain in this video that it’s dramatically easier and more sensible for the listing agent to remain as the seller’s agent, and to not complicate matters by trying to enforce dual agency on walk-in buyers.

Can I Charge Tenants Less Than 15 Percent in Commission?

I would like to offer my client 1 month commission of rental income vs them paying 15% of annual income. However, what if the apartment they secure through me requires a 7.5% co broke? How do agents navigate this discrepancy?

As you can see, it depends on the commission structure of the listing. In the New York City market where this agent is based, if it's a CYOF (Collect Your Own Fee) listing then you are indeed free to charge less in commission to your tenant client, or whatever you want.
However, many listings are marked as "Exclusive" and have a set co-broke, typically 50% of a typical 15% commission, or 7.5% to you as the tenant's agent. In this case, there is no way out of the tenant paying the 15% in commission if it's a regular (vs no fee) listing.
Keep in mind in other markets such as South Florida, the landlord customarily pays the broker commission (which can vary, and can often be 8% or 10% of one year's rent).

In Florida, a serious offer is typically submitted via a signed copy (by the buyer) of the standard Florida Realtor purchase contract.
If the seller "accepts" the offer, he/she simply counter-signs the contract and the terms of the contract automatically come into force.
Because the standard Realtor contract is more of a fill-in-the-blank form that isn't customarily edited, often times buyers will simply fill it out with their help of their buyer's agent.
Remember that it's not customary in Florida for the buyer and the seller to each have their own attorneys like in New York, where contracts are custom and heavily negotiated.
We will go over in this video a sample form, and explain what most real estate agents in the industry will understand the various parts to mean, and what is customarily done in transactions.

How Is a Broker's Commission Impacted if a Co-op Board Requires a Higher Purchase Price?

A co-op board generally has the authority to reject a buyer if the board thinks the price is too low. The co-op board wants to protect preserve the values in the building, and sometimes this means that a deal comes across their desk and they just don't like the sound of the sale price. We recently had a transaction where the agreed-upon sale price was $495k. The buyer agent commission was 2.5%, which came out to $12,375. However, the co-op board stipulated that the deal would only be approved at a price of $525k. The commission on $525k is $13,125, which is $750 more than the amount based on the original sale price.
The buyer and seller still wanted to move forward, so the lawyers drafted an amendment to the contract to show the new sale price. There are some implications for doing this as outlined in the Hauseit article above. The primary drawback is that the higher contract price results in higher closing costs, such as the Mansion Tax, NYC and NYS Transfer Taxes and the co-op flip tax. The buyer and seller agree on responsibility for these overages, and the seller typically credits the buyer in the amount of the increase in the purchase price.
When the co-op board requires the purchase price to be increased, the broker commission is still calculated based on the original price agreed upon between buyer and seller.
When you send your commission invoice to the lawyers prior to closing, please make sure that it's on the originally negotiated purchase price as shown in the original unamended contract.

A Realtor Letter of Good Standing is a reference letter from your primary Realtor association that you'll need to provide in order to join as a "Secondary Realtor" for another MLS / Realtor association.
For example, you primarily work in New York and your primary Realtor association is the Long Island Board of Realtors. However, you wish to also work in Florida during the winter months and you want access to the Miami MLS. Well, you would need to apply as a Secondary Realtor to the Miami Association of Realtors, which operates the Miami MLS.
A Secondary Realtor membership enables you to pay vastly reduced membership fees, since you already pay dues to your primary Realtor association. However, in order to qualify for this status, the Miami Association of Realtors will obviously need to verify that you are in good standing and paying your dues with the Long Island Board of Realtors.
Hence, a Letter of Good Standing from the Long Island Board of Realtors in this example would be needed to show proof that you've been paying your dues, and as a result are eligible for a reduced membership fee with the Miami Association of Realtors per our example.
We'll show you sample letters of good standing in this video, as well as what an example request for such a letter from a MLS might look like.
