LAL — Jonathan Taylor, the Biden Brand & DA Fani Willis (August 1, 2023)
Let's all give Norm a round of applause for absolutely crushing his first solo livestream yesterday! Flawless execution. Who needs Mike anyway?
.
In all seriousness, thank you to all of you who dropped by at the later hour and stayed engaged as Norm unpacked a heavy, heavy topic regarding our federal Department of Justice, the looming indictment of President Donald J. Trump in connection with the events of January 6, 2021, and the nature of transhumanism and the burgeoning threat of artificial intelligence as a mechanism by which the human mind might be disembodied and 'live forever'. If you haven't, please go back and listen to Norm's pontification that Donald J. Trump might be the felt necessity of the times; a symbol of the defiant man who refuses to be governed by the threat of the ultimate algorithm.
.
Today, we get back to the brand:
.
› Indianapolis Colts star running back Jonathan Taylor is making headlines for his now very public discontent with the franchise, its owner Jim Irsay, and the NFL's contractual systems as collectively bargained that afford the Colts major leverage against Taylor in his fight for better positional compensation.
.
› Devon Archer, former business partner to Hunter Hit-Them-Stones Biden, has testified in closed session before House Oversight Committee that President Joe Biden was a part of multiple video calls between Archer and Hunter during the course of then Vice President Biden's term. According to Archer, Hunter included his father the Vice President in an effort to wield "the Biden brand" and to instruct DC to intervene to remove Ukrainian prosecutor, Viktor Shokin, in an effort to stall the ongoing investigation into Burisma. Whew boy. Cue the coordinated MSM damage control.
.
› Fulton County District Attorney Fani Willis is playing the game. DA Willis is expected to ask a grand jury to hand down indictments stemming from allegations of a conspiracy to overturn Georgia's 2020 presidential election results. With Jack Smith having just issued a superseding indictment in the classified documents case, and with Trump's lawyers indicating that charges in connection with J6 are imminent, the reporting around DA Willis' handling of this case makes for a great season of House of Cards. What are the claims of personnel safety risks about? And why is DA Willis on record speaking to the lack of coordination between her office and special prosecutor Jack Smith?

LAL — Jim Harbaugh, Donald Trump, & More A.I. Case Citations (July 28, 2023)
Good Morning #LALiens and Happy Friday!
.
Norm and Mike convene for a little sports, a little politics, and a little candor-toward-the-tribunal-is-apparently-hard-nowadays:
.
› University of Michigan Football's Head Coach, Jim Harbaugh, has been suspended by the NCAA for four (4) games to start the 2023 season.
.
› Former President and Candidate for President Donald J. Trump has been met with additional charges in the matter of the Mar-a-Lago classified documents case, and another one of his employees has been charged as well.
.
› In Ex Parte Lee, the Tenth District Texas Court of Appeals identified within the argument section of the petitioner's brief five (5) case citations, all of which made reference to nonexistent precedent. The court acknowledges that the brief was likely prepared with the assistance of artificial intelligence, but stopped short of issuing any sort of show cause order to the attorneys responsible for submitting the brief.
.
› With time, Kevin Spacey has been acquitted. Where does he go to get his reputation back?

LAL — Hunter Biden, Kevin Spacey, McConnell, UFOs & Infinity (July 27, 2023)
It's Thursday. You're thirsty. We get it. Top off your mug and settle in.
.
› Hunter Biden is almost certain to go to prison. How do we know? Relevant offense conduct.
.
› Kevin Spacey has been acquitted of the numerous sexual assault charges. Maybe we can enlist his help to turn House of Cards here in American back into fiction.
.
› Senate Minority Leader 'Cocaine' Mitch McConnell had himself a moment on camera during a press conference Wednesday, but what can we the voters do about it?
.
› President Trump created Space Force. And here we are, watching with levels of incredulity previously unimaginable as congressional testimony is offered regarding the presence of alien life on planet earth. It is almost like a mega-famous celebrity-athlete's 18 year-old son went into cardiac arrest, or the body of a live-in chef was found at the bottom of a pond at a former president's estate at Martha's Vineyard or something.

LAL — NFL Contracts, Diversity Paradox, Advice to New Law Students (July 26, 2023)
Good Morning #LALiens and Happy Hump Day! Yesterday's stream and attendance were incredible. If you are a new arrival, welcome! For our regulars, hold it down in the chat!
.
Today, Norm and Mike attempt to satisfy the platform tag police (yeah, we see you):
.
› NFL contracts are in the news. Los Angeles Chargers' franchise quarterback, Justin Herbert, and the team have agreed to a 5-year extension that makes Herbert the highest paid at the position by annual salary. By contrast, the running back position across the NFL continues to cheapen, highlighted by New York Giants star, Saquon Barkley, signing a one-year deal just to avoid a prolonged holdout a la Leveon Bell. What is to blame for the disparity?
.
› As teased at the end of yesterday's stream, the Wall Street Journal published a piece entitled, "The Rise and Fall of the Chief Diversity Officer." The Journal also published a piece entitled "The Hidden Cost of Being Overweight," which tracks the new legal pressures being applied in New York, New Jersey, and Massachusetts to join Michigan in listing weight as a characteristic protected from discrimination. There is a saying in the south that goes something like, "that's like going around one's butt to get to one's elbow," that seems appropriate here.
.
› Advice to New Law Students: Ilya Somin writes for the Volokh Conspiracy and lists four (4) pieces of advice to law students beginning their law school journeys this fall. Norm and Mike review this list and each offer a piece of advice of their own.

LAL — Vikings' Addison, Protected Speech, Beer by Mail, Collapse of the CDO (July 25, 2023)
We appreciate your pardon for yesterday's last-minute notice. Norm and Mike are back in full swing for today's stream:
.
› With the 23rd overall pick in the 2023 NFL Draft, the Minnesota Vikings selected the wide receiver from the University of Southern California, Jordan Addison. Shortly after Friday's stream, it was reported that Addison had been stopped by the Minnesota State Highway Patrol for going 140 mph in a 55 mph zone. Addison was not arrested. Later on Friday, Addison released a statement apologizing for the incident, curiously without citing an emergency with his dog.
.
› Jonathan Turley published an article analyzing the troubling view many modern American journalists that "misinformation" is somehow not speech protected by the first amendment to the United States constitution.
.
› "Just Let Breweries Mail Beer Already, Congress" is an article published in VinePair, in which Dave Infante lays out the case for allowing breweries to utilize the United States Postal Service to mail beer directly to customers in any of the 50 states. Mike knows a bit about this topic and sees it in perhaps a different way. Has the beer industry earned this sort of congressional call to action?
.
› The Wall Street Journal published "The Rise and Fall of the Chief Diversity Officer" late last week, detailing the shrinking demand of the executive leadership role which was largely invisible until the summer of 2020. What does the retraction in the market for chiefing a company's diversity, equity, and inclusion efforts signal?

LAL — NIL NCAA Bill, Stanford & Michigan Law, NYPD & #AMA (July 21, 2023)
It's Friday. Let's have a little fun. After a couple of quickies, Norm and Mike shift into #AMA mode and take questions from the live chat.
.
Quickies:
.
› USA Today reports a draft bill that would create an entity known as the College Athletics Corporation which would oversee a broad set of new regulations attendant to college athletics, including the hotly debated topic of NIL.
.
› Remember Tirien Steinbach, the Stanford Law DEI administrator who sympathized with the toddlers shouting down Fifth Circuit Court of Appeals Judge, Kyle Duncan? Yeah, she gone.
.
› NYPD announced a $13M settlement for 1,300 plaintiffs in a class action lawsuit over police treatment of BLM protestors during the George Floyd riots in 2020. What's more? Norm and Mike just realized that New York Attorney General Letitia James sued the NYPD in January of 2021 seeking the implementation of an 'external monitor' to oversee changes in riot response protocol.
.
› #AMA: Type your questions into the live chat for Norm and/or Mike to answer.

LAL — Jason Aldean & CMT, Bud Light, 'Hawai'i Six-O' (July 20, 2023)
Be contrarian. Be correct. Must one choose between the two? Vivek Ramaswamy does not believe so. Nor does Law and Legitimacy. After all, we are for the contrarians, the free-thinkers, and the unafraid. Welcome to our new subscribers, followers, and viewers. Welcome back to the crew we look forward to seeing in the livestream chats every morning.
.
Today, Norm and Mike handle some unfinished business:
.
› Jason Aldean is the subject of immense scrutiny and censorship after the debut of the official music video to his song, "Try That in a Small Town". Has Trump found his new campaign song?
.
› AB InBev survived a complaint filed with the Beer Institute which claimed its Bud Light social media campaign with Dylan Mulvaney violated prohibitions on soliciting underage drinking.
.
› Michigan AG Dana Nessel announced charges against 16 Michigan electors from the 2020 presidential election. How does American history inform our understanding about the role of electors, expectations of how they behave, and is the AG's move a stunt to facilitate adoption of National Popular Vote Interstate Compact Act?

LAL — Locke, RFK Jr., Netherlands & Tinted Windows (July 18, 2023)
How incredible is @LawPodDaily on Twitter? We're having a blast. Law and Legitimacy returns this beautiful Tuesday morning with a view for chasing the dark arts. What do we mean?
.
› RFK Jr.'s sister has now publicly condemned comments RFK did not make. To what sort of spellcasting do we owe the privilege of watching mainstream media arbitrage the most powerful brand of American outrage? Could it be that one of Gavin Newsom or Michelle Obama intends an imminent announcement of presidential significance?
.
› John Locke's Second Treatise is required reading for every 1L. It is in the Law and Legitimacy syllabus. We continue today with an analysis of Locke's view of the right of the individual to resist.
.
› Mark Rutte, the former Netherlands Prime Minister, has resigned, after the Dutch government failed to reach an agreement that would have tightened immigration policy in a country that has seen a dramatic rise in migrant arrivals over the last several years. Is the Netherlands the canary in the metaphorical coal mine for the whole of the West?
.
› The United States District Court for the District of Connecticut has ruled that a law enforcement officer's use of an iPhone to see through a vehicles tinted windows does not violate the fourth amendment's guard against unreasonable searches and seizures. Norm and Mike unpack the Order from Judge Jeffrey Meyer in United States v. Christopher Poller.

LAL — Wimbledon, Locke, Vivek & RFK Jr. (July 17, 2023)
It's a new week! Law and Legitimacy welcomes the many new subscribers and invites each of you to engage in the chat and get to know your fellow #LALiens. Last week ended with a bang, as Norm and Mike interviewed Jimmy Vallee about the SDNY's ruling in SEC v. Ripple Labs, Inc. If you haven't done yourself the favor, double back for that extended daily episode. Give it a like, a retweet, a share, and a comment.
.
Norm and Mike begin the week with a strong front of strivers in the world of legitimacy:
.
› The 20 year-old Spaniard, Carlos Alcaraz, put on a decisive performance in his 2023 Wimbledon Championship win. Mike shares his intrigue with the 4th set of the 3rd game.
.
› Norm is re-reading John Locke's Second Treatise on Government with a particular emphasis on the distinction between consent and acquiescence. Calling all law students!
.
› Republican candidate for president, Vivek Ramaswamy, is surging big time. Norm and Mike have been talking about Vivek for months. There is no doubt the millennial capitalist is way talented and extraordinarily charismatic. How do we get him to drop by Law and Legitimacy?
.
› RFK Jr. made headlines over the weekend with his remarks concerning the studies showing COVID's varying impact on ethnicities from around the world. Is the media treating his words fairly?

› Several new developments in the Department of Justice's prosecutions in connection with the events of January 6, 2021: (i) Ray Epps has filed a civil complaint alleging defamation against Fox, claiming that the DOJ has imminent plans to prosecute him criminally for his activity at the Capitol; (ii) the DOJ has also moved to appeal the sentences of Oath Keepers convicted of Seditious Conspiracy, including the sentence of Stewart Rhodes, indicating a clear dissatisfaction with the lengths of the convicted defendants' respective and forthcoming incarceration; and (iii) an Orlando, Florida, based actor, James Beeks, has been acquitted of the charges filed against him in connection with J6—and Beeks was a pro se litigant.
.
› Having had an opportunity to watch and listen to Ep. 9 of Tucker on Twitter, Norm joins Mike in analyzing the essence of the interview.
.
› Elon Musk announced via Twitter yesterday the launch of xAI with a tweet reading, "Announcing formation of @xAI to understand reality." Elon then hosted a Twitter Space in the evening and was joined by Ro Khanna and Mike Gallagher to discuss the premise of xAI, the challenges facing humanity related to the emergence of artificial intelligence, China's influence and role in that emergence, and the need for useful regulations attendant to A.I.'s development. We are fortunate to have Norm to offer a historical and philosophical perspective on the nature of what we conceive as our shared reality.

@LawPodDaily — Norm's Petition to SCOTUS, Tucker & Tate Lift Consciousness (July 12, 2023)
It is Wednesday, July 12th, 2023. NATO curved Ukraine. Blackrock's CEO has Bitcoin in his mouth. And you're here with us on Law and Legitimacy. Welcome back to the initiated #LALiens among you. Welcome to the first-timers. Norm Pattis and Michael Boyer convene every weekday morning at 8:00am eastern to volley the essence of law and its intersection with our common conceptions of right in an increasingly stressed and frenetic western society. That is, what is law without a foundational sense of legitimacy?
.
Today's Agenda:
.
› Edward Lang v. the United States of America has been petitioned to the Supreme Court of the United States. Mike referenced Norm's involvement in an additional case with an additional defendant in cases arising out of the events of January 6, 2021, on the solo stream. On petition for certiorari, Norm joins Steve Metcalf in asking the Court to overturn an appellate court's breathtaking misapplication of a federal criminal statute against one Edward Lang. This is decidedly a case with major implications on the protections afforded every American citizen by and through the first amendment to the United States Constitution. Will the Court grant cert?
.
› Tucker on Twitter Ep. 9 debuted yesterday evening. Tucker Carlson's roughly 2 and-a-half hour interview with Andrew Tate is, as Mike describes, a meditation on the human essence. If one only makes it halfway through, one is still blessed with unvarnished analysis of due process and systems of justice, the "matrix" and the marriage between MSM and global influences, masculine essence and programmed depression, the male tendency to bond through suffering, tiers of government corruption, extreme ownership and accountability for self, racism and the division of lower classes along cosmetic lines, western malaise and unbridled immigration, and more. As of this stream, the interview has 37 million views in roughly 14 hours. Epic.
.
› The Prime Minister of the Netherlands, Mark Rutte, resigned after the Dutch government failed to reach an agreement that would have tightened immigration policy in a country that has seen a dramatic rise in migrant arrivals over the last several years. Is the Netherlands the canary in the metaphorical coal mine for the whole of the West?

LAL — Norm on DC Confinement, Dutch PM Resigns, Mixed Signals at NC State (July 11, 2023)
Good Morning, #LALiens! Thank you for joining, giving this stream a thumbs-up, subscribing to Law and Legitimacy. Yesterday was a lot of fun. Mike felt the love on his first solo LAL flight. Norm rejoins Mike in the cockpit this morning and the two navigate the turbulence of a western culture in crisis.
.
On the agenda:
.
› Norm updates on the conditions of confinement for J6 detainees in DC detention facilities.
.
› Mark Rutte, the former Netherlands Prime Minister, has resigned, after the Dutch government failed to reach an agreement that would have tightened immigration policy in a country that has seen a dramatic rise in migrant arrivals over the last several years. Is the Netherlands the canary in the metaphorical coal mine for the whole of the West?
.
› The Fourth Circuit Court of Appeals in a split 2-1 decision sided with North Carolina State University in a lawsuit brought forth by a former tenured doctoral professor in the institution's education department which claimed violations of his first and fourteenth amendment rights and unlawful retaliation. The opinion cites Professor Stephen Porter's lack of collegiality as the lawful basis for his termination. What is going on in higher education?

LAL — Mike Takes (Solo) Flight! Screwtape on Staying 'Safe' & Voter I.D. in NC (July 10, 2023)
Good Morning and Happy Monday #LALiens! Law and Legitimacy is back on its normal schedule this week. Streams begin at 8:00am eastern for the foreseeable future. Again, a word of gratitude for those of you who adjusted your schedules and joined us over the lunch hour last week. Mike's tan also sends its regards.
.
Speaking of Mike, he is flying solo today. Norm is deep in the heart of trial prep and while LAL is his first love, every self-respecting attorney knows the rules: the client is the main event.
.
Let's see what happens! Mike offers a couple of items to listeners and viewers before indulging a brief #AMA:
.
› C.S. Lewis's "The Screwtape Letters" is something that Mike comes back to time and time again. This morning, Chapter 28 is resonating loudly. What does Uncle Screwtape say about keeping the human patient 'safe'? And what insight does that excerpt offer us under current social conditions?
.
› North Carolina's citizens affirmatively voted to implement voter identification in 2018. The NAACP sued to bar enforcement, citing discriminatory animus by the legislature and North Carolina's sordid history with racism. With many of the procedural hurdles for the law now cleared, the case appears ready to resume later this month and the North Carolina Board of Elections is preparing for voter identification implementation in all statewide municipal elections later this year. What is it that Mike always says about North Carolina?

LAL — L. Lin Wood Retires from the Bar & Biden v. State of Missouri v. Biden (July 7, 2023)
Good afternoon and Happy Friday, #LALiens! Norm and Mike are back today for the final 12:30pm livestream of the week and for the foreseeable future. Law and Legitimacy will return to the normal 8:00 am eastern time slot beginning Monday, July 10, 2023. We extend our gratitude for all of you who have adjusted your schedules to be with us this week. We take nothing for granted.
.
If you are not following LAL on Twitter (@PattisPodcast), you should! We just published the first installments in a series of LAL Hot Takes—short-form bursts of written content giving what we hope to be unique perspectives on topical events at the intersection of law and legitimacy. Check it out.
.
On today's stream:
.
› The New York Times Reports: L. Lin Wood, Lawyer Who Tried to Overturn Trump’s 2020 Loss, Gives Up License — Norm and Mike review LAL's past coverage of high profile attorneys taking advantage of the populist sentiment regarding the illegitimacy of the 2020 presidential election. What does this revelation say about the broader narrative assigned to the 2020 election?
.
› JUDGE TERRY A. DOUGHTY has issued a preliminary injunction in State of Missouri v. Biden — the case alleges that the Biden administration by and through the various named defendants engaged in public pressure campaigns, private meetings, and other forms of communication regarding what the Biden administration defines as "disinformation," "misinformation," and "malinformation" to collude with and coerce social media platforms to disfavor certain speakers, viewpoints, and content across those same social media platforms.

LAL — Renewed Calls for Packing the Supreme Court & A.I. Scraping Human Data (July 5, 2023)
Welcome back to the best half-hour in the world of law podcasts. We hope you had a blast over the Fourth of July. Thank you to those #LALiens that joined us yesterday for our holiday-themed stream! If you missed it, go back and watch.
.
Today, Norm and Mike convene for some weightier topics:
.
› Tyler Pager writes for the Washington Post: "Biden faces renewed pressure to embrace Supreme Court overhaul" — Of course he does. It was a campaign promise, after all. But what is the realistic outlook for the future of the Supreme Court's construction? And haven't we been here before?
.
› Bloomberg reports: "ChatGPT Creator OpenAI Sued for Theft of Private Data in ‘AI Arms Race’" and Natasha Tiku writes for the Washington Post: "How elite schools like Stanford became fixated on the AI apocalypse" — After a week in which Elon Musk came under fire for the significant slowdown and seemingly arbitrary rate limitations placed on Twitter users, the question is being re-asked, "what is going on with artificial intelligence?" Norm and Mike discuss the softness of higher ed's inquiries into A.I.'s threats to mankind while also threading the theme of whether the humans in charge of sector innovation are really to blame for the unmoored development of A.I. over the last several years.

LAL — SCOTUS Decisions in Harvard/UNC & Groff + Friday #AMA! (June 30, 2023)
Good Morning #LALiens and Happy Friday! What a week it has been. Let's finish strong. If this is your first time with Law and Legitimacy, Welcome! We appreciate very much your time and attention. You could be anywhere in the world, but you're here with us. All we ask? Share Law and Legitimacy with one person when we earn it.
.
The Supreme Court of the United States. What's there to say? The end of the October 2022 Term is taking a drive through the old neighborhood. It didn't used to be like this, don't you know? In all seriousness, June 29th's published opinions are historic. Norm and Mike convene to discuss:
.
› Students for Fair Admissions, Inc. v. President and Fellows of Harvard College/Students for Fair Admissions, Inc. v. University of North Carolina, et al. — Chief Justice John Roberts delivered the 6-3 majority opinion of the Court, which struck down the institutions' respective race-based admissions procedures as unconstitutional violations of equal protection. The reactions on the internet—especially those from supposed lawyers—have been dreadful (dredful?).
.
› Groff v. DeJoy, while overshadowed in large measure by the landmark equal protection decision in Harvard, delivered a major win for Title VII and the protection of the individual from discrimination based on one's religion. Norm and Mike set the stage for this opinion a little while back.
.
› #AMA! Norm and Mike devote a few more minutes to accommodate a Q&A session with the #LALiens in the live chat. Send your questions!

LAL — NC Attorney General, NCAA's NIL Memo, SCOTUS in Harper v. Moore (June 29, 2023)
Good morning and Happy Thursday, #LALiens! Thank you for being with us. If you are new to Law and Legitimacy, greet us in the chat and enjoy the warm company. All we ask? Share the stream with one person.
.
Today, Norm and Mike tackle:
.
› North Carolina State Attorney General Josh Stein is the named defendant in Planned Parenthood v. Stein, the lawsuit brought to overturn North Carolina's new law banning abortion after 12 weeks. Stein is also running for Governor of North Carolina in the 2024 election. His recent public announcement as to his decision not to defend the duly enacted law passed by the North Carolina legislature presents an important question about the duties of the office of the State Attorney General, Stein's loyalties to the profession and obligations to his client, and whether his political ambitions have reached an inflection point in the simmering potential for a conflict of interest between the two roles.
.
› As first reported by Sports Illustrated, the NCAA released a memo yesterday advising member institutions through a series of FAQ's of member obligations under the NIL rules. Of particular note is the NCAA's clear position that state law is inferior to NCAA policy. Norm and Mike discuss.
.
› The question presented to the Supreme Court of the United States in Harper v. Moore was whether a state's judicial branch may nullify federal elections regulations through judicially created rules of its own. SCOTUS says 'nope.' Norm and Mike discuss.

.
› The First Amendment in the Workplace — Norm shares some dark humor through a real story as it developed within his law office this week.
.
