A white police officer shoots a fleeing black suspect—Malachi Williams--in the back, at a moment where the suspect presents no immediate threat to the officer. Worse, the officer’s body worn camera footage shows no apparent indication that the suspect was armed. Today's show is in response to the video posted on August 25 by the channel "Washington Gun Law" (Attorney William Kirk) regarding the shooting death of Roger Fortson by a Florida deputy back in May. The deputy was responding to reports of an apparently violent domestic violence complaint when Fortson responded to the door knock with a gun in hand--at which point the deputy shot Fortson. Kirk had previously concluded that the shooting of Fortson was an outright execution for Fortson having merely exercised his Second Amendment rights. I critiqued Kirk's conclusion that the Fortson shooting was an outright execution on the basis that (despite claiming to be a criminal defense attorney providing legal analysis) he never made a single reference to any relevant Florida use-of-force law whatever, nor entertained any legal argument that might favor the deputy who shot Fortson. It is frankly unimaginable to me that a criminal defense attorney can offer a legal analysis to the public on a use-of-event of high public interest and controversy without even once considering the likely defendant's legal defenses. In my own critique I made actual use of the relevant Florida law that, combined with the facts available, provides a sound foundation for the legal conclusion that the deputy's shooting of Fortson was lawful, if awful. The Kirk video we'll be taking a look at today is apparently in part a response to my critique. Two days ago the Minnesota Supreme Court filed its ruling in the case of State v. Blevins, a case in which the defendant pulled out a machete on a train platform and brandished it at several people. Today brings us the closing arguments in the murder trial of Ashley Benefield, one-time aspiring ballerina, charged with murder in the death of her estranged husband, Doug Benefield, whom she shot dead in Tampa FL on September 27, 2020. Ashley is claiming she shot Doug in self-defense. It is perhaps noteworthy that the couple married 13 days after first meeting each other, and Doug was a full 30 years older than the then 24-year-old Ashley. Ashley quickly became pregnant, and just as quickly decided she no longer had any use for Doug as a husband, and left to live in a different part of Florida. When Ashley had her birth induced, she hid that fact from Doug. The pair soon were involved in a heated divorce and custody battle, up to the September day on which Ashley shot and killed him. The murder trial began last Tuesday, and ran for five days of witness testimony, with jury instruction and closing arguments taking place today, after which the jury will be sent into deliberations to arrive at a verdict. On Wednesday I published the video of my legal analysis of the Sonya Massey shooting, who was shot and killed by Deputy Sean Grayson inside her own apartment earlier this month. Grayson has since been fired and charged with murder and other crimes. In my legal analysis I concluded that the available evidence--in the form of the body worn camera video of Grayson and a second deputy with him at the time--made clear that the shooting of Massey, while tragic, was almost certainly lawful self-defense. This, of course, has led to a tsunami of protesting comments, as my analysis runs counter to the consensus view of this police use-of-force event. An Indianapolis driver got very angry with another vehicle, and approached that other in a rage with a gun in hand.
