When the OTHER Guy Is Armed, TOO!
An Indianapolis driver got very angry with another vehicle, and approached that other in a rage with a gun in hand.
Turns out the other vehicle also had a gun, and the day ended poorly for Indianapolis man.
Was this shooting an unnecessary murder? Manslaughter? Or could this have been an entirely lawful killing of another human being in the middle of a public roadway?

Premiere in progress. Started less than 1 minute ago #donaldtrump #AlecBaldwin
This past Tuesday Dana Loesch was gracious enough to invite me on as a guest on "The Dana Show." We talked both the Trump shooting and the Baldwin dismissal.
It was great fun! Join us for this playback of that interview!

REAL LAWYER: How to STOP an Assassination INSTANTLY
This past Saturday a rifle-armed assassin came within millimeters of killing President Donald Trump. Fortunately, the President survived with a flesh wound to his ear.
Perhaps even worse, the more we learn about this assassination attempt, and especially the US Secret Service preparations for and response to this threat, the more inexcusable the whole scenario becomes.
Join me to discuss how the law of self-defense provides MORE than sufficient perfectly legal options for the US Secrete Service, local law enforcement, and even mere bystanders to have STOPPED this assassin in his tracks, before he was ever able to to fire his first murderous shot.
Join me LIVE at Noon ET!

ERROR! Alec Baldwin Trial Dismissal Was Legally WRONG
Just a quick show today, folks, to set out a framework for the proposal that the dismissal with prejudice of Alec Baldwin's manslaughter trial was legally incorrect.
And, yes, I'm aware that I appear the be the only internet lawyer taking that position--it's OK, I'm used to it. :-)
On that note, I WELCOME any LAW-BASED argument against my proposition--comments will be completely open for that purpose on all social media platforms.

LIVE! Alec Baldwin Trial: Jury Selection (Court NOT broadcast!)
FYI: Turns out the jury selection was NOT live broadcast from court today. At about 58 minutes of today's show I realize that's the case, and I switch to a quick summary of the outcomes of the 22 motions argued in yesterday's pre-trial hearing. _____________________________________________
It begins! Finally! Today the jury will be selected for the manslaughter trial of actor Alec Baldwin, who shot and killed Halyna Hutchins on the movie set of low-budget western "Rust" on October 21, 2021.
Baldwin is charged with manslaughter based on the facts that he pointed what he knew to be a real gun directly at Halyna Hutchins, without ensuring it had no live ammo in it, cocked the hammer, and pulled the trigger.
In fact, the gun did contain a live round, which fired and killed Hutchins. Trial Judge Sommers has ordered the parties to take no longer than 50 minutes each to arrive at a jury of 12--a very rapid jury selection process for a high-profile trial, so I expect this will be a morning show only, today.

REAL LAWYER: A Brooklyn Pew: Lawful?
On Saturday July 6th an event called "Freaknik Picnic" held in Brooklyn NYC's Prospect Park (nearly?) almost had a bit of fisticuffs turn into a fatal shooting--and a rather unusual shooting, at that, as it appears to have involved a derringer!
With only a very short (~7 second) video clip of the confrontation available, and little news reporting that I was able to find, it's not easy to arrive at any definitively RIGHT ANSWERS about who might have been acting lawfully--or not.
What we can do, however, is identify the RIGHT QUESTIONS as a foundation for any legal analysis of this event, and that's what we'll do in today's show.
After all, you can hardly expect to ever arrive at right answers if you don't even know the right questions.

Alec Baldwin FINAL Pre-Trial Hearing: EXCLUDING EVIDENCE!
Today the Alec Baldwin trial court is holding its FINAL pre-trial hearing of this case, mostly covering requests by the State to exclude various forms of evidence they expect the defense to offer, and which the state believes is irrelevant.
It appears that Judge Sommer is allowing only 10 minutes per side on each of these many motions, so things should proceed quickly.
Join me LIVE as I play catch-up on these arguments.

Good Pew: Bad Pew
The body worn camera for two police shootings were just brought to my attention, and I thought they provided good examples of how police shootings can be straightforward GOOD shoots, as well as how they can be straightforward BAD shoots.
In today's show we break down the legal elements that make each of these shooting lawful and unlawful, respectively.
Unfortunately, of the two, it was the unlawful shooting that resulted in an unnecessary death.

Baldwin Judge is ON FIRE!
Yesterday's ~5 hour pre-trial hearing for upcoming #AlecBaldwin manslaughter trial was largely a snooze-fest--but the last ~35 minutes was ABSOLUTE FIRE.
So I've carved out that last bit so you can enjoy it without first having to slog through 4.5 hours of defense bloviating.
Enjoy!

Will Judge DISMISS the Baldwin Manslaughter Indictment?
On October 21, 2021, actor Alec Baldwin, on the set of low-budget Western movie "Rust," pointed what he knew to be a real gun directly at cinematographer Halyna Hutchins, cocked the hammer, depressed the trigger, and fired a fatal bullet into her body.
Baldwin is now approaching trial on a charge of involuntary manslaughter.
Last week the Baldwin defense team began arguing to the court that the manslaughter indictment should be dismissed WITH PREJUDICE--so that it could never be brought again--on the grounds that the prosecution "destroyed" evidence.
The "destroyed" evidence consists of the revolver used by Baldwin to kill Hutchins, which had some small internal parts broken during function testing by the FBI.
In today's live stream we complete this argument to the court, hear the State's response, and hopefully get an immediate real-time decision by the judge.
Join me LIVE at 4PM ET, with court proceedings on this matter scheduled to begin at 4:30PM ET.

Frying Pan Home Defense!
A Chicago man walks into his home and finds a burglar already present. The homeowner grabs a frying pan, and chases the burglar from the home, whacking away at the burglar's noggin. The chase continues outside of the home, into the yard, and ultimately down the sidewalk--at this point accompanied by Chicago PD.
Join me to discuss the legal boundaries for the use of a frying pan in self-defense, defense of home, and defense of property!

State to Expose Baldwin's Reckless Conduct!
New Mexico has charged actor Alec Baldwin with reckless manslaughter over his shooting dead cinematographer Halyna Hutchins on the set of the low-budget western movie "Rust."
Baldwin's immediate conduct that results in the firing of the bullet that killed Hutchins ought to be enough, on the legal merits, to support his conviction beyond any reasonable doubt--he (obviously) never checked to ensure there was no live ammo in the gun, he pointed what he knew to be a real gun directly at Halyna Hutchins, he manipulated the hammer of the gun while doing so, and he arguably manipulated the trigger at the same time. BLAM!
Prosecutors, however, want to introduce evidence of Baldwin's firearm recklessness beyond this conduct immediately proximate to the gun in his hand discharging into Hutchins. They also want to introduce evidence of Baldwin's reckless firearms conduct--and misconduct--in the days immediately proceeding the shooting.
Normally, evidence of "prior bad acts" for which the defendant is not charged is presumptively inadmissible in court--but Prosecutor Kari Morrissey is arguing that THESE prior bad acts are an exception, and in the motion we'll cover today she explains to the court exactly why.

In California Shooting a Burglar = Murder?
A 77-year-old Oakland CA homeowner is confronted by multiple burglars in a stolen vehicle, armed with a crowbar, a fake gun, and disparity of numbers. He manages to fatally shoot one burglar, and holds another at gunpoint for police.
Result? The HOMEOWNER is arrested on charges of murder.
Can this REALLY be the use-of-force law of California?
Join me LIVE at 11AM ET to discuss!
Car thieves wave an apparently full-auto Glock with a drum magazine at the door camera of the victim's home, obviously threatening overwhelming deadly force if the victim attempts to thwart their theft of his vehicle.
Would the owner have been legally justified in simply shooting THROUGH his door at the thieves in defense of himself? In defense of his home? In defense of his vehicle?
Join me LIVE at 11AM ET today to discuss the various use-of-force legal dynamics!
