Today we'll be doing a LIVE verdict watch on the Aaron Dean Trial. After closing arguments yesterday morning, the jury deliberated for some 8 hours before calling it a night. The jury is sequestered, and deliberations continue today. On November 30 a civil lawsuit was filed against the Sig Sauer firearms company in Federal court in New Hampshire. The suit is brought by no fewer than 20 plaintiffs, all with similar claims--that the company's P320 pistol was defectively designed, that this defect caused them serious injury, and that Sig Sauer should be held liable for those injuries. This past Sunday a man decided to commit an armed robbery of clerk working in a California convenience store. When the robber fled with the stolen goods, the clerk retrieved his own gun and pursued, firing at the fleeing robber. The robber then used his own gun to shoot and kill the clerk. Many were surprised when Contra Costa County District Attorney Diana Becton then decided that she would not press a murder charge against the armed robber, on the grounds that the robber was acting in lawful self-defense when he killed the clerk. In the afternoon of February 23, 2020 then-District Attorney Jackie Johnson was informed that "jogger" Ahmaud Arbery had earlier that afternoon been shot and killed by the son of her former lead investigator. This former work relationship raising a potential conflict of interest, Johnson immediately referred the case over to a DA from a different county. Those few hours, in which Johnson made no substantive decisions related to the Arbery shooting other than the conflict referral, was the entirety of her official involvement in the handling of this matter. The Georgia Attorney General was duly advised of this conflict referral on February 27th, 2020, three days after the shooting. Despite her conduct being cleared of wrongdoing following an investigation by the Georgia Bureau of Investigation, Ms. Johnson lost her next election for DA, and worse was indicted by the Georgia Attorney General on charges of violation of her oath of office (a 5-year felony) and hindering law enforcement (a misdemeanor). The evidence for either of these charges appears to be non-existent, and this suggests that this prosecution is little more than a furtherance of the political witch-hunt maelstrom that surrounded the Arbery killing from the moment the video of the death was released on May 5, 2020, about 10 weeks after the shooting. Cummings Trial Verdict!

Today the defense begins to present its case in chief to the jury in the murder trial of NM v. Cummings, the State having rested on Friday afternoon. This means that finally the defense will be calling its own witnesses, and the State will be limited to cross-examination of those witnesses. We'll be live streaming today's proceedings in real-time, rather than playing catch-up as we were doing in our coverage of the trial last week. (That means no fast-forwarding through breaks, unfortunately--but we'll fill that time with other content.) NOTE: We will read comments and answer questions FIRST from the Law of Self Defense Members chat, and SECOND from SuperChats on YouTube that are a minimum of $5. The State's narrative of guilt of famous skier Dean Cummings in the shooting death of Guillermo Alliora presented in last week's case in chief proved shockingly weak. This was especially true of the State's final witness, the lead investigator on this case, who because of a 9-day coma has lost virtually all recollection of the matter, not even recalling if he testified before the grand jury (he did). The State's other witnesses, especially their law enforcement witnesses, were also just awful. While no one can ever know what really happened in that cabin the day Cummings shot and killed Arriola, the State's burden to achieve conviction of Cummings is to disprove his legal defense of self-defense beyond any reasonable doubt. So far any objective view of the evidence and testimony must conclude that it is entirely consistent with self-defense, rather than inconsistent--and certainly does not disprove self-defense beyond a reasonable doubt. I'd like to take a moment to particularly note the excellent legal defense being provided Cummings by Attorney Kari Morrisey. Were I charged with murder in New Mexico, Attorney Morrisey would likely be my first choice for representation. Also very sound has been the performance of defense co-counsel Attorney Nicole Moss. This is our FINAL day of CATCH-UP live-streaming the Dean Cummings self-defense trial taking place this week in New Mexico--with our next show on this trial we'll be doing our commentary and analysis in real time, as the trial takes place. Yesterday a MI trial judge ruled that probable cause existed to bring Police Officer Christopher Schurr to trial on a charge of second-degree murder in the shooting death of violently non-compliant suspect Patrick Lyoya. Lyoya was shot and killed by Officer Schurr while the two men fought over control of the officer's Taser following Lyoya's lawful traffic stop. We'll cover that entire probable cause finding by the judge during the public portion of today's show, in particular discussing what I consider to be America's broken probable cause standard for dragging citizens into criminal trials. Alec Baldwin certainly seems to have an open-and-shut conviction waiting for him on the charge of involuntary manslaughter. I've also discussed how there's a legal path to a conviction for felony murder. Today we explore the legal path for Baldwin to be found guilty of MURDER murder. SECOND: We will cover how fellow actor on the "RUST" movie set, #JensenAckles, made sure his own gun safety practices would NEVER have allowed him to unintentionally shoot someone dead on a movie set, as he discussed with law enforcement during a police interview shortly after the tragic shooting of Halyna Hutchins by #AlecBaldwin. THIRD: We will cover the shooting by an off-duty Alabama officer of a Jeep-driving maniac at the end of his home driveway.
