There is no mention in the video about the 'mere utterance' by the claimed magistrate, being the granting of the notice of liability = the fraud is the claim that a liability order has been granted/made. However there seems to be little in most videos that point to the root cause of the issue; lgfa s1 ss3 chargeable dwellings, ss4 hereditaments and composite hereditaments, domestic dwellings; the composite hereditament is interesting as it shows that the part used for business is assessed for rates, the domestic dwellings (from recent memorandum by m gove show second homes and lettings as domestic property used wholly for living accommodation as subject to council tax) nothing I have read shows that a principle, only home is subject to council tax, but more so halsburys confirms the lgfa 1988 s66 ss 1 a 'domestic property wholly used for [the purposes of] living accommodation is not rateable' martin & ors v hewitt confirms this,

The local government finance act 1992 created a new tax, council tax. Council tax applies to chargeable dwellings; hereditaments and composite hereditaments. To aid definition the legislation retained points from the local government finance act 1988 (poll tax) and the general rates act 1966 section 115 which refers to schedule 13 and domestic dwellings. Halsbury's law shows that The local government finance act 1988 section 66 (1)(a) removed domestic property from rating and the GRA provides that domestic dwelling is such as letting rooms. A recent memorandum shows that second homes are assessed for council tax as they are domestic property, but also seems to disapply principle/primary homes!

Thank you Sheena and Laura, God bless you both. I am constructing a brief defence letter in relation to the summons itself. There is nothing in the legislation and regulations that the billing authority has powers to issue a councils summons only the court can issue a summons - Council Tax Collection Second Report of Session 2023–24 provides a single sentence for this. But more so the same report shows that there is considerations to change the CT - and make it a property tax! Therefore council tax is not a property tax, it is not applicable to peoples homes but is only applicable to chargeable dwellings.

Council tax time bomb
A transcription of this has been provided in telegram groups. The named Barrister has authored the council tax manuals freely available on various sites. He seems to over look sec 35(3) of CTAE regs 1992 and the depth of dwellings is not quite there!

Are councils using the electoral register for council tax purposes?
My notion that the billing authorities lift peoples signatures from voting ballots and dropped into credit agreements has no supporting evidence, it is just a theory... however the use of the electoral register for council tax purposes seems to be gaining evidence to support it!
'It does not matter much whether local authorities are or are not required by statute to keep something called a register. The practical needs of the situation will require them to have a point of reference and a database. If they do not keep a register themselves, they will no doubt make use of the one register that does exist—the electoral register, thereby prolonging and exacerbating that threat to civil rights already posed by the poll tax, which has induced hundreds of thousands of people to trade away their votes.'

Case Law; though this matter concerns boathouses it confirms that domestic accommodation, wholly used for living purposes is unrateable!
There is no confusion about chargeable dwellings however the goonies in government stand to loose your money to fund their wars if this was pushed - just an opinion, what do you think?

Was it legal in the first place? The European Communities Act 1972 seemed to have prevented such taxation as council tax...
