The Fourth Amendment STILL Prohibits Unreasonable Searches and Seizures
You answer a knock at your door to find a government agent standing outside. Do you know what your rights are? When does the agent need a warrant? What makes a search reasonable? What should you do if the agent attempts to illegally enter your home? Whether or not you end up in jail may very well depend on how well you know your rights, and how prepared you are to defend and assert them.
So, where does that leave you if and when you find a government agent at your door? First, unless they have a warrant, you are not required to grant them entry. If they threaten to have you arrested for refusing them, remind them of the Fourth Amendment and the fact that the Supreme Court has confirmed that you cannot be prosecuted for refusing to allow an inspection without a warrant...

The Least Dangerous Branch of Government
Associate Justice Kagan made a statement that many probably took in stride, but for me, was jaw-dropping.
"I’m not talking about any particular decision or even any particular series of decisions, but if, over time, the court loses all connection with the public and with public sentiment, that’s a dangerous thing for a democracy," Elena Kagan.
I expect most people to read this sentence and not give it a second thought, but when I read this, I see the failure of the republic. Let me explain.
Justice Kagan is concerned that the court may lose its connection with the public and public sentiment, but the court is not elected by the public, and for a very good reason. The court’s job is not to court public opinion, but to decide controversies and criminal prosecutions based on the law.

Double Jeopardy vs. Dual Sovereignty Doctrine
The idea of the Double Jeopardy Clause is simple: Government only gets one chance to convict you of a crime. In the United States, we have multiple governments. We have the federal government, one for each of the fifty states, and I don’t know how many county and city governments. Does the Fifth Amendment apply to all of these governments? Yes.
There is nothing in the language of the Fifth Amendment to limit it to just one government. So what happens when a state tries someone, yet doesn’t get a conviction? Is it possible to get another chance once “jeopardy has attached,” as the legal eagles would say?

Congress, Democrats, Working Overtime to Pack, Limit, or Steal the Supreme Court
Democrats have been trying to pack the Supreme Court since they stopped getting their way in justice nominations. While those attempts have not borne fruit, some think they have found another way to gain control of the third branch of government.
How will the rest of Congress, and the American people, react to this latest attempt to politicize the federal judiciary?
While the official title of this legislation is “Supreme Court Term Limits and Regular Appointments Act of 2021”, it should be called “The Reinvent the Federal Judiciary Act.”
Not only is Congress claiming the authority to change the duration of a justice’s service, but also how and when they are appointed, by creating a “post court” position they may fill.

Religious Freedom in America: Supreme Court Ruling School Choice in Maine
When a state offers parents a choice in schools, what limits can they put on the money? Most people cannot afford private schools, and others cannot dedicate time to homeschooling. Since the people pay for these government schools through their taxes, shouldn’t they be able to use that money for better options?
David and Amy Carson sought tuition assistance to send their daughter to Bangor Christian Academy, while Troy and Angela Nelson sent their son to Temple Academy, but could not afford to also send their daughter. There was one problem for these two families, though; since 1981, Maine has limited tuition assistance to “nonsectarian” schools. While both schools met the state’s requirement of being accredited by the New England Association of Schools and Colleges (NEASC), the schools did not qualify as “non-sectarian.”
Since the First Amendment specifically prohibits Congress from passing laws abridging the free exercise of religion, it appears once again the court got to the right answer, but for the wrong reasons. What Maine’s “nonsectarian” clause did by singling out religious schools for discrimination, was violate the Equal Protection Clause of the Fourteenth Amendment.

Did the department of justice FBI raid on the former president signal a threat to the constitution?
Police, Power, and Politics.
Lt. Dave Smith, a law enforcement expert, and trainer, holds nothing back in his assessment of the overreach by the United States Department of Justice and the federal bureau of investigation as he analyzes the moves made by the Biden administration and their utilization of America’s premiere law enforcement agency against a political opponent.
In a jaw-dropping interview with show host, Randy Sutton, the historical context of this move plus the militarization of the Internal Revenue Service reveal a very dark and a power-play by one political party even as the national media ignores the Biden administration’s unprecedented attack on who they view as political opponents.

Can You Be Prosecuted for Encouraging People to Cross the Border?
Do you have the right to tell people they should break the law? That is the basis of the case United State v. Hernandez- Calvillo & Papalotzi. Both Hernandez-Calvillo and Papalotzi were charged with encouraging people to enter the country illegally. But what about their Freedom of Speech?
If we were to apply subsection (iv) equally, then many politicians, pundits, and everyday Americans would be guilty. Just think of how many people, from the President of the United States to state and local officials, have encouraged or induced aliens to enter or reside in the United States, knowing that doing so would be in violation of the law...

Restraining the Powers of Federal Agencies - EPA Overreach
What does a case involving the Clean Air Act have to do with restraining federal agencies? In the Supreme Court’s opinion in West Virginia v. Environmental Protection Agency, the court found that the agency had exceeded its statutory powers. But that was not all. What started as a question of whether or not the EPA’s plan to reduce carbon-dioxide emissions from the electric grid was constitutional ⏤ turned into a statement about the limits of discretion granted to executive agencies.
The EPA claimed the authority to transform electrical generation throughout the country. Was this a power Congress had delegated to the EPA under the Clean Air Act? According to the majority of the court ⏤ NO.
Executive agencies cannot enact rules beyond the powers specifically delegated to them by legislation. It appears the EPA, along with most if not all of the executive agencies, believe they have the power to run the country.

What Limits Can a State Put on a Person’s Right to Keep and Bear Arms?
Does any state have the legal authority to arbitrarily decide whether or not you get to exercise your right to keep and bear arms? That is the question in the case New York State Rifle and Pistol Association (NYSRPA) v. Bruen. New York State is one of six “may issue” states, meaning that you may not get your carry license even if you’ve met all of the legal requirements to do so.
In New York State, you had to show you had a special need for self-defense, greater than the general public. Does that sound like an infringement on your right to keep and bear arms to you?
The State of New York makes it a crime to possess a firearm without a license, whether inside or outside the home. An individual who wants to carry a firearm outside his home may obtain an unrestricted license to “have and carry” a concealed “pistol or revolver” if he can prove that “proper cause exists” for doing so.
Let’s start with the obvious. The Constitution, as the supreme law of the land, makes this New York State law invalid and void.

The Battle Against Prosecution for Shootings Has a New Tool for Police
New ammunition for the “War on Cops.” A retired major crime investigator develops a new app to assist law enforcement officers in the battle against prosecution for shootings and other major uses of force.
As the “War on Cops” has progressed and “activist “district attorneys and prosecutors have moved against law-enforcement officers even for justified shootings, the need for a defense mechanism has never been greater.
This new technology and product can save the careers and perhaps even the lives of law enforcement officers across the nation. ‘Thin Blue Defend’ is now in use and is a major protective tool for our police.

Can We Have Independence in 2022?
The evidence seems pretty straightforward, the government in Washington, D.C. is just as corrupt and despotic as the government we declared independence from in 1776. Sadly, the American people are rushing toward their own servitude. My hope is that if we take a closer look at how far we have fallen, We the People will once again show that tyrants are unfit to govern a free people.
I wonder if, when those 56 men pledged their lives, fortunes, and sacred honor in support of the Declaration of Independence, they ever conceived that not only would the American people return to a life of dependence, but that we would do so willingly. Thankfully, this does not have to be our fate.
If We the People will pick up the Constitution, read it, and study it, we’ll find that our subjection to Washington, D.C., is not the law, but a result of our own actions. Washington, D.C.’s power is as fake as the emperor’s clothes in the Hans Christian Anderson story. Isn’t it time others join me in pointing out just how naked the government in Washington, D.C. really is?

How to Bring Washington DC Back Under Control
There are plenty of problems in America today, too many to number most likely. I’m frequently asked what we can do. Too often, it seems everyone is looking to Washington, D.C. for answers. By studying the Constitution, and a couple of Supreme Court opinions, I think we can find some answers a lot closer to home.
First, the states need to remember that they are separate and independent sovereigns, not vassals of Washington, D.C. The states created the federal government to serve them, not the other way around. The states delegated to the federal government certain limited and enumerated powers, which means only the states have the legal authority to amend the Constitution to give them more.
Second, the states need to defend themselves against government overreach. Today it seems when government goes too far, all most states will do is sue in federal court. That’s like asking the bully’s sister to protect you. Sure, we may want the courts' opinion, but that’s all it is: An opinion. We need states to learn to stand their ground against Washington, D.C. Yes, they’ve made it harder when they ratified the 16th and 17th Amendments, but that doesn’t excuse those in our state governments who roll over every time a new edict comes out of Washington, D.C.
And lastly, our Sheriffs, the chief law enforcement officers, are bound by oath or affirmation to the Constitution of our states and the United States. They need to take up their responsibility to protect the rights of the people of their county.

George Soros Activist District Attorneys Create Havoc in America's Cities
A Radical District Attorney in San Francisco Is Recalled. Chesa Boudin, the son of convicted weather underground murderers, has been tossed out of office by the people of San Francisco. His extreme policies of failing to prosecute for “social justice” reasons have led to the incredible decay of what was once a beautiful city.
The violence, crime, and filth increase are directly related to the soft-on-crime agenda that many cities around the country are facing as more and more “activist” District Attorneys are put into office by George Soros funding.
The recall of Boudin might be just the first in a stack of dominos as efforts begin in other crime-plagued Democratic-controlled cities to oust their District Attorneys.
Retired Los Angeles police detective Moses Castillo joins show host Randy Sutton to explain the efforts in Los Angeles to recall George Gascon. Another Radical district attorney’s policies have made Los Angeles another violent crime-plagued city.

The "Presidential Emergency Action Documents" Threaten America's Future
Have you heard of “Presidential Emergency Action Documents” (PEADs)? More likely, you’ve heard of a President’s “Emergency Powers.” These documents are plans created by various presidential administrations to prepare for various emergencies. Taking the form of executive orders, proclamations, and messages to Congress, the idea is that these PEADs can be put into effect at a moment’s notice.
As with so many things in government, PEADs started as a good idea that has morphed into the Sword of Damocles hanging over the rights so many of us cherish.
America stands on the precipice. Multiple presidential administrations have set in place rules and orders to effectively take over and rule this country. They did this behind closed doors, not even letting Congress know what their plans are.
All it would take is the right person and the right conditions, for someone in the office of President to declare a national emergency and activate these despotic powers.

Too Young for Rights?
At what age are your rights protected? As children, we receive protection of our rights through our parents. But have you ever considered at what age you receive protections for your rights directly? Are all rights treated the same?
The case Jones v. Bonta asked the question, when do you receive protection for your right to keep and bear arms? The answer of the Ninth Circuit Court of Appeals may surprise you.
Several young adults, gun shops, and advocacy groups filed suit in federal district court, claiming California’s regulations violated both the Second and Fourteenth Amendments to the Constitution of the United States.

Freedom of Speech in a Flag... What about a Christian Flag?
Is flying a flag government speech? That was the question before the Supreme Court in the case of Shurtleff, et al. V. City Of Boston et al. When the City of Boston refused to fly a Christian flag did they infringe on the rights of Mr. Shurtlef? Did Harold Shurtleff have the right to fly the flag of his choice on public property? What does this mean for other Freedom of Speech cases around the country?
Harold Shurtleff, the director of an organization called Camp Constitution, asked to hold an event on the plaza to celebrate the civic and social contributions of the Christian community; as part of that ceremony, he wished to raise what he described as the “Christian flag.”
Sure enough, once someone asked to raise that scary Christian flag, the problems started.

Policing and Race in America, A Country Divided
Violent crime in cities across America is surging to levels almost unimaginable just a few short years ago.
Police Officers are turning in their badges in droves, leaving a void of experience and knowledge that is impossible to fill. And as the body count continues to rise, we continue to see the political “leaders” of our cities still embracing “social Justice” and “police reform” ideologies.
Why is America becoming lawless, and why are communities of color bearing the brunt of the violence?
