Courts of Record
In this short I discuss the requirements of a Court of Record . There are 4 criteria for a Court of Record and a 5th might be in use. The 5th is that it can have a seal. Most do, but it's a non-issue for the most part. The first two are not unusual to most folks and benign: 1) can fine or imprison for contempt and 2) keeps a record. Not shocking. The other two requirements though, they are material. 3) The magistrate and tribunal are independent from one another and 4) proceeds according to common law. Wanna know more? Democracy or Republic? In which do we live...
One of the best ways to define a republic in "layman's terms" is that a democracy and republic are the same in all respects but one. In a democracy the sovereignty is in the whole group; once the decision is made, it's binding on all. However, in a republic, the sovereignty is in the individual. The definition of sovereignty requires that anything enacted by the group be merely advisory upon the member of the republic.
