Former Campus Officer Johnathon Silva Appeals Excessive Force Against Philip Chong, Wins Job Back
@PoliceEncountersUS#SanJoseState #JohnathonSilva #PhilipChong #ExcessiveForce #California #SJSU #College
It was the morning of March 17, 2016, when Silva responded to reports from library security officers of a man looking at pornography and potentially masturbating on the eighth floor, records show. The Dr. Martin Luther King Jr. Library is open to the public and the man, Philip Chong, was not a student.
Silva asked Chong for his name and birthdate. The two went back and forth for a little bit, and Chong’s answers got progressively more bizarre.
“Satan for Earth,” he said at one point.
“The head of the Italian mobsters,” Chong said at another.
Chong also wouldn’t provide his date of birth.
“I need you to stop fucking around,” Silva said, his voice becoming agitated as he moved toward Chong.
It escalated from there. Silva grabbed Chong’s arm in a wrist lock and pulled him out of the chair to arrest him. They went into a wall and then Silva wrestled with Chong down an aisle of books, eventually going to the ground.
“Roll on your stomach,” Silva yelled at Chong, and then told the man he was going to use his Taser on him.
Silva used his Taser on Chong multiple times, kneed him and hit him with a baton. Chong moaned and screamed.
At that point, other officers arrived and gained control of Chong. He was taken to the hospital with broken ribs, collapsed lungs and cuts on his face and head. Records show Chong spent 10 days in the hospital.
Silva's wrist was also fractured in the incident, according to the records.
Police recommended prosecutors charge Chong with lewd acts, resisting arrest, battery on a peace officer and drug possession.
Police had been called to the library before in regard to Chong. He’d been found vaping one time and was arrested for being on drugs and talking to himself on another occasion.
Chong’s attorney, Stuart Kirchick, called him a “very intelligent young man, but suffering, unfortunately, from a mental illness that started unusually only a few years prior.”
Kirchick said that his client spent a few days in jail, but that Santa Clara County prosecutors dismissed all charges after they saw the body-cam footage from the library.
“He [Chong] was not willing to give his true name to the officer and that just completely set the officer off,” Kirchick said. “I mean he just completely lost his temper and used unreasonable force in the process of detaining him … to just find out his name.”
Chong filed a claim with the university in September 2016 and the school settled, paying him $950,000.
This wasn’t the first time Silva had been accused of excessive force. A 2017 lawsuit filed by then-student Alan Chen alleges that Silva and a fellow officer "flung" him to the concrete face-first, breaking his teeth and causing him to lose consciousness in 2015.
Records show, Silva was given a warning in 2015 on a performance evaluation to “not let his frustrations get the best when dealing with uncooperative subjects in the field.”
The school settled with Chen for an undisclosed amount last year. The university has not yet responded to questions about that incident.
In November of 2016, the university launched an internal investigation into the library incident, and Silva was placed on administrative leave.
The university fired Silva in August 2017. But he appealed with the backing of his department and his fellow officers.
Silva won his appeal and was reinstated in May 2018. The university contested that decision with a strongly worded filing from the school’s attorney, Katherine Winder, but the personnel board declined to reconsider.
Silva never returned to active duty with the school's police force, according to a university spokeswoman. He resigned on Oct. 1, 2018, the day he was scheduled to return to work.
Silva apparently still had the support of his former chief, Peter Decena. After about eight years, Decena had left the school in 2017 to head up the Los Gatos-Monte Sereno Police Department.
Decena hired Silva as a Los Gatos officer in September 2018.

Dashcam Footage & Bodycam Footage Show Fatal Shooting of Deshawn Whitaker by Virginia Beach Police
@PoliceEncountersUS #VirginiaBeach #DeshawnWhitaker #JacquelineOrtiz #OfficerInvolvedShooting
An unnamed Virginia Beach police officer fatally shot 28-year-old Deshawn Whitaker on 12/01/2022 after identifying the car Whitaker was driving as stolen, police said.
VBPD voluntarily released body camera footage of the interaction — an action police departments in Virginia always have the option to do, but often decline because the footage is part of active investigations. In this case, the department released the footage despite two ongoing investigations.
“We also have a lot of misinformation that’s bubbling up in our community and beginning to take on a life of its own,” Virginia Beach Police Chief Paul Neudigate said at a press conference on Monday, where he shared the video. “Therefore, the police department felt it was imperative to share these videos with the community.”
According to the department’s original press release about the incident, Whitaker ran as the officer tried to detain him.
The officer then tried to take a female passenger, 20-year-old Jacqueline Ortiz, who is Whitaker’s wife.
In the video, the officer and Ortiz struggled. As the officer pointed his weapon at her, she yelled to Whitaker: “Help me. Babe, help me.”
The department said she “repeatedly” reached for her own gun in the waistband of her pants.
At one point, the officer yelled at Ortiz, “Let go of the fucking gun.”
At that point, the department said Whitaker returned and pointed a gun at the officer.
The officer pulled his own weapon and fired four times, striking Whitaker.
In the video, the body camera footage of that interaction is distorted because of a glare from the sun, but once Whitaker falls to the ground, there is a weapon on the ground.
Whitaker was taken to a hospital and died a day later.
Neudigate said he’s waiting on autopsy results to determine where and how many times Whitaker was shot.
Neudigate said the commonwealth’s attorney will make the final call on whether the shooting was justified.
The department’s own homicide unit is conducting the criminal investigation. Once those two things are done, the department’s Internal Affairs unit will also do an administrative review.
According to a police spokesperson, the officer has worked on and off in the Virginia Beach police department for eight years and has a 14-year law enforcement career. He is on administrative assignment while the investigations are completed.

Doorbell & Bodycam Footage Show Texas Man Shot Dead By Police While Defending Home From Burglar
@PoliceEncountersUS #AustinPolice #RajanMoonesinghe #OfficerInvolvedShooting
'He did nothing wrong': Family of Texas entrepreneur fatally shot by police say he was defending his home
Austin police shot Rajan Moonesinghe on Nov. 15 as he held a rifle on his own porch. His family told media outlets he thought his home was burglarized and say police did not provide enough warning.
A tech entrepreneur in Texas wasn’t given ample time to drop a rifle he was carrying on his own front porch before he was fatally shot by police last month, his devastated family told media outlets.
Rajan “Raj” Moonesinghe, 33, had returned from a trip and suspected his home had been burglarized during the early-morning hours of Nov. 15. That’s when he held a rifle outside his front door and was encountered by an Austin police officer who quickly shot him while almost simultaneously ordering Moonesinghe to drop the gun, relatives said.
In an exclusive interview on Thursday, Moonesinghe’s mother, Ruth, and brother, Johann, said they were heartbroken and demanded answers from Austin police as to why their loved one was killed so quickly before being given a reasonable amount of time to drop the weapon.
“He did nothing wrong,” Johann Moonesinghe said. “He had a gun … he was defending his house and he didn’t point the gun. He was not menacing. He didn’t look like he was going to shoot anyone.”
Moonesinghe said his brother got a rifle to protect himself and there had been recent crimes in the area.
“He called his friend and he said I think something’s been moved around my house. Something strange is going on.”
'Thank you for being this amazing gift'
Ruth Moonesinghe described her son, the co-founder of a restaurant consulting business, as an "amazing gift" to her and many others.
"I just wanted to hold him … and say, ‘I love him. Thank you for being this amazing gift that I had,''' she said. "I’m just sad. I wasn’t there because … that shouldn’t have happened to him."
Austin police said in a statement the deadly shooting occurred about 12:30 a.m.
They said a 911 caller told a dispatcher that a man in a gray robe and dark pants was pointing a rifle down the street.
The caller also said the man was pointing his rifle at the interior of his home, police said. The caller then stated the man just fired into his own home. The caller said the police were on scene and the man fired again, police said.
Police identified the officer who fired at Moonesinghe as Daniel Sanchez, who is now on administrative leave.
“Officer Sanchez was the first to observe Mr. Moonesinghe and gave him a verbal command to drop the gun. Immediately after telling Mr. Moonesinghe to drop the gun, Officer Sanchez fired his Department approved firearm at Mr. Moonesinghe. Mr. Moonesinghe was struck and fell to the ground,” police said.
Two other officers initially responded to the call. One of those officers ordered Moonesinghe to show his hands after he was shot.
“The officers immediately began life-saving measures,” police said. Moonesinghe died at a local hospital, police said.
Sanchez has been with the department for two years and nine months, police said. They said two investigations into the shooting are ongoing.

@PoliceEncountersUS #AtlantaPolice #OfficerInvolvedShooting #DearianBell
A woman called 911 and reported she had been involved in a fight with her husband, identified by authorities as 28-year-old Dearian Bell. “For approximately 12 minutes, Bell held the firearm and walked around the area ignoring verbal commands to put the gun down,” GBI spokeswoman Nelly Miles said. Officers rendered aid to Bell at the scene. He was taken to Grady Hospital, where he was pronounced dead.

Suspect Armed With A Knife Stabs Daytona Officer In The Face Before Being Shot Dead At A Gas Station
@PoliceEncountersUS #BenjaminRemley @daytonabeachpd @VolusiaSheriffsOffice
According to authorities, a Daytona police officer was stabbed in the face during a physical altercation at a Sunoco gas station on the morning of December 1st.
The officer fatally shot the man after being stabbed in the face. Daytona Beach Police Chief Jakari Young said that the owner of the Sunoco gas station called police after the suspect was trespassing for a second time.
A Volusia County Sheriff’s deputy who was already at the scene approached the man first before the Daytona Beach officers arrived just moments later. Young said:
“As they approach the suspect, they attempt to detain him, and the fight is on.”
During the struggle, Young said that the suspect had a light in one of his hands and at some point, the man pulled out a knife from his pocket and proceeded to stab the Daytona Beach officer in the face. The officer then shot the suspect twice, killing him.
The officer was transported to a nearby hospital and is expected to make a full recovery, thankfully. Young said:
“My officer sustained a laceration to the face as a result of being stabbed by the suspect. He fired two shots and the suspect has passed away as a result of those gunshots.”
“It goes to show you how fast, when you see the body camera footage, an encounter over a trespasser turned deadly. Thank God the Daytona officer is going to recover. I think we should be really proud of the way these guys acted. It’s what they were told to do. They did their job.”
The suspect has been identified as 36-year-old Benjamin Remley, a local to Volusia County. He has previous criminal history, which includes two felony convictions and two misdemeanor convictions.
The officer that fired the two shots is on paid administrative leave, which follows policy and procedure after an officer involved shooting.

Raleigh Police Bodycam Compilation Footage From Hedingham Mass Shooting
@PoliceEncountersUS #Raleigh #HedinhamShooting #MassShooting
The first body camera video from the Oct. 13 massacre in Raleigh’s Hedingham neighborhood was released seven weeks after a shooter opened fire, killing five people and wounding two others.
The volume and quantity of firepower is apparent during the intense footage. The content of the video may be disturbing to some.
Three videos were released by the department with along with a compilation video composed of all three clips.
The clip contains multiple angles of a roughly 5-minute period about 90 minutes after five people were killed.
The summary video begins with footage of officers on a K-9 track trying to find the suspect described as a white male wearing camouflage. Officers were huddled in a fenced-in plot of land in a wooded area with several sheds.
"We're on a track," one person could be heard saying.
Around three minutes into the compilation video, shots are fired. Raleigh officers fired more than 20 shots in total. Two officers and four Wake County deputies fired shots in the clip.
During the search, someone fires several rounds at officers from a building he was hiding in. One Raleigh officer, Casey Clark, appears to go down at the first shot. Clark was shot in the knee and gunfire is exchanged between officers and Austin Thompson. The officers then took cover and began to assess where Thompson was hiding.
"I am nauseous but I'm good," said Clark, who was eventually released from the hospital.
Another clip contains Clark's body cam, capturing the moments he falls to the ground from the inital shot.
The seven victims ranged in age from 16 to 60. Those who lost their lives included an off-duty Raleigh police officer, Gabriel Torres, 29; James Thompson, 16, the suspected gunman’s older brother; Mary Marshall, 24; Nicole Connors, 52; and Susan Karnatz, 49.
Clark, 33, was treated and released from the hospital, and Marcille "Lynn" Gardner, a special education teacher who just turned 60, is walking again after a weeks-long hospital stay.
The medical condition of Austin Thompson, 15, the suspected gunman, continues to improve, sources tell WRAL News. The suspect was taken into police custody 4 hours and 27 minutes after the first 911 call was received, and sources told WRAL News he suffered multiple injuries, including a serious wound to the head, during a standoff with police.
Police have yet to say where Austin Thompson got the guns he allegedly used in the mass shooting.
Timeline of mass shooting
The first 911 call on Oct. 13 was received at 5:09 p.m. Raleigh police officers responded to the east Raleigh neighborhood and golf community off New Bern Avenue in about 10 minutes.
More than an hour later, the suspect was spotted running into woods near Tarheel Club Road. At 6:42 p.m., officers located suspect near a barn on McConnell Oliver Drive.
According to Raleigh Police Department report released five days after the shooting, “As officers were attempting to search the area, the suspect fired multiple shots at the officers from one of the buildings.”
Police reported using drones and robots to get a visual of the suspect inside a barn.
At 7:28 p.m., police said the suspect was “holding the shotgun up,” but it’s unclear where the gun was pointed.
Two Raleigh police officers and four Wake County sheriff’s deputies exchanged fire with the suspect. All six remain on administrative leave per department protocol.

Reno Police BodyCam Show Officers Pull 2 Persons Out of An Upside Down SUV In Water-Filled Ravine
@PoliceEncountersUS @renopolicedepartment7133 #RenoPD #Carcrash #PoliceBodycam
While working the scene of a previous crash, Reno police officers witnessed an SUV flipping over and plunging into a water-filled ravine.
Body camera footage captured a dramatic rescue by Nevada police officers when they pulled two people from a SUV that had overturned and crashed into a ravine last week.
The incident happened Nov. 26 while Reno police were working the scene of a crash involving a vehicle and a pedestrian, KRNV-TV reports. Another SUV didn't notice the road closing and did not slow down at a stop sign.
The SUV missed the police officer and plunged down an embankment, ending upside down in a water-filled ravine. Police body cameras show the officers racing down the ravine to check on the condition of the vehicle's occupants.
The officers entered the frigid water and begin calming and reassuring the driver and a passenger, who were both alert. Then, the officers pulled the two people to safety.
The driver and passenger were taken to the hospital and treated for minor injuries. The driver faces multiple traffic violations.
"Chief (Jason) Soto would like to commend the officers, and emphasize that this is an example of the selfless action Reno Police Officers are willing to take for their community," the department stated in a social media post.

White Settlement Police Vs. Motorcylist
@PoliceEncountersUS #WhiteSettlementPolice #TexasStatePolice
White Settlement police are looking for a suspect who fled when an officer tried to stop him for a traffic violation, officials said.
Shortly after noon on Friday, a police officer attempted to stop a man who was operating a motorcycle without a license plate, according to a news release from the White Settlement Police Department.
Instead of stopping, the suspect led police on a chase that eventually had to be terminated due to the danger to other motorists, according to the release.
Chief of police Christopher Cook called the incident “another blatant disregard for public safety,” in a tweet and asked for the public’s help in identifying the suspect.

You Couldn't Hit The Broad Side Of A Barn! | Muskogee, Oklahoma Police Officer Involved Shooting
@PoliceEncountersUS #Muskogee #MuskogeePoliceShooting #DannyBrogdon
At about 3:30 p.m. on 03/05/2019, Muskogee police officers responded to reports of two women being stabbed in the 1500 block of North 18th. When they arrived, they evacuated victims in an attempt to de-escalate the situation while Danny Brogdon reportedly was armed with a knife.
Dash cameras and body cameras captured officers arriving to the home until after Brogdon was fatally shot. In all, the confrontation with police lasted more than 18 minutes, with one officer asking 122 times for Brogdon to drop his knife. (You can view the final 2 minutes above)
Officers tried various methods of nonlethal force on Brogdon inside and outside the house, but they didn't appear to have much effect on him, according to the video.
Toward the end of the incident, body cam footage shows Brogdon standing in the front yard of the home as officers shouted commands. Officers continued to tell Brogdon to stop walking toward them, which he was doing slowly. They deployed flashbang toward the yard, but it did not deter him from inching forward either, the video shows.
Muskogee Police say Brogdon was suicidal and they believe he was provoking them to commit "suicide by cop."
At one point, with officers pleading with him to stop and "don't do this," Brogdon told officers, "I am ready to die."
Just a few seconds later, he stepped off the curb while holding a knife and seemingly lunged in the direction of officers, who were backed up against vehicles in the street with nowhere else to go.
Multiple shots rang out at once, and Brogdon fell to the street, the video shows.

Whatcha Gonna Do When They Crash Into You? | Cop Admits To DWI After Car Crash
@@PoliceEncountersUS #UnionCity #Hoboken #KevinRoldan
A Union City police officer charged with driving while intoxicated and assault by auto last month after a two-car crash in Hoboken last month admitted to drinking three beers, police body camera footage shows.
“ … Don’t let that change your judgement: if he passes, he passes, if he fails, he fails – you understand?”, Hoboken Police Lt. David Olivera said to Officer Anthony Rutkowski on October 16th while showing him the police ID of Kevin Roldan, 24, of Union City.
“Gotcha,” Rutkowski, who is certified in the Standardized Field Sobriety Tests (SFSTs), before approaching Roldan and asking what happened during the roughly 3 a.m. crash.
“The light was turning yellow, I kept driving, it turned red, and I got clipped,” Roldan said to Rutkowski, clarifying that the light was yellow when he drove through Paterson Avenue near Harrison Street.
Roldan said he was hanging out with a friend when asked what he was doing that evening, admitting that he drank “a little bit,” going on to say that he consumed three beers.
Both cars had their airbags deployed and the other driver, a 23-year-old woman from Jersey City, complained of neck and shoulder pain afterwards. She told police that Roldan had struck her vehicle after running a red light.
The police body camera footage shows Roldan performing the Horizontal Gaze Nystagmus (HGN) test, a walk and turn test, and a one leg stand.
“Based on my observations and Roldan’s performance of the tests, I determined that Roldan was too impaired to safely operate a motor vehicle and was placed under arrest for driving while intoxicated,” Rutkowski wrote in his report.
He also indicated that Roldan was unable to complete the one leg stand, putting his foot down and restarting the count several times.
Roldan was cooperative throughout the incident, was unarmed, and off-duty when the crash occurred, the body camera videos show.
Additionally, the police report states he was also charged with reckless driving, as well as that the breathalyzer at the Hoboken Police Department came back with an inconclusive result, prompting Roldan to be transported to the Port Authority Police Department.
While that yielded a result, it was not stated outright in the report. Rutkowski also pointed out that he searched Roldan’s car for intoxicants and did not find any before both vehicles were towed.

Bodycam Footage Shows Suspect Pull Out Gun & Open Fire On OKC Police Officer During Patdown
@@PoliceEncountersUS @Oklahoma Highway Patrol #OklahomaCityPolice #OKCPolice #BryceSheehan #CrastevenWilson #OklahomaCityPoliceDepartment #OfficerInvolvedShooting #PatDown
On March 2, 2022 around 5:50 p.m., officers were called to 21st Street and Emco Drive in the city about a disturbance and a suspicious person. The caller claimed a man was “scoping out: the house of another man he had been in an argument with.
The caller reported:
“They got in an argument and my brother left and the guy keeps like walking, the guy he was out there still like scoping the house. He has all red on.”
A neighbor’s security camera captured the suspect walking along the street armed with a firearm, but the officer was not aware of the gun when he responded to the scene.
Police said Officer Bryce Sheehan found a man who matched the description from the disturbance call. Sheehan’s body camera video shows the officer asking the suspect, 23-year-old Crasteven Wilson, if he had any weapons.
The video shows Officer Sheehan ask Wilson if he could pat him down for weapons:
“You got any weapons? Can I pat you down real quick, make sure you don’t have any weapons?”
When Sheehan placed his hand on Wilson’s arm, Wilson mumbled “yeah,” but instead quickly turned around and shot Sheehan, striking the officer in the right leg and narrowly missing his head before running to the officer’s patrol car and trying to drive off.
An official with the Oklahoma City Police Department told news media outlets the bullets were so close to the officer’s face that they left gunpowder burns.
Sheehan ran for cover while returning fire and radioed for backup:
“Shots fired, shots fired!” Sheehan yelled. “I’m hit!”
For unknown reasons, Wilson placed the officer’s vehicle in gear, but then ran from the scene on foot.
Officer Sheehan can be seen on the video placing a tourniquet on his own leg to try and stop the bleeding from the gunshot wound.
Officer Sheehan managed to continue returning fire and struck the fleeing suspect several times. With the aid of a police drone, Wilson was found a short time later lying in the backyard of a home. Officers rendered aid, but he later succumbed to his injuries.
Officer Sheehan was treated and released from the hospital and was placed on administrative leave pending investigation of the shooting, a normal procedure in officer-involved shootings. The department will turn their investigation over to the Oklahoma County District Attorney’s Office.
