Backstory:
A landmark ruling has been made in the case of Sitzer/Burnett v. National Association of REALTORS (NAR). Through settlement, NAR has agreed to enforce two new rules on brokers/agents, changing the normal course of business.
RULE 1: Brokers/Agents may no longer advertise commissions in the MLS.
RULE 2: Before touring any MLS-listed property, buyers must sign a document outlining the agent's duties to buyer, as well how agent will be compensated for performing those duties.
Problem:
Until now, most agents told buyers that representation was free, and rarely signed any documents with buyers pre-offer to purchase. Rule 2 will now force agents into conversations with buyers about agent compensation -- upfront. This rule is a major hurdle for most, leaving agents scrambling.
Solution:
Secure agency and guaranteed compensation from buyers with an overwhelming demonstration of value.
