Epis. 17.2 - 2022. Mini Series: Social Security Disability Function Report Q No 6 - Do's and Don't-Do-So-Much's
The famous or infamous Social Security Disability Function Report (FR) (SSA-3373), can be the vehicle that sinks your claim due to inadvertent omission, mischaracterized narrative, and pure non-responsiveness. Here Social Security Attorney Stephanie Joy provide a brief share on her thoughts about Question #6 of the FR, "Describe what you do from the time you wake up until going to bed." (You can find SSA's provided copy of a blank report here: https://www.ssa.gov/forms/ssa-3373-bk.pdf.)

Epis. 1 - 2022 A short explanation of what SSD stands for in the world of Social Security Disability
With acronyms gone wild in the Social Security world, most people call Social Security Disability "SSI". Yet, it isn't. They are two different programs, and one is not part of Social Security at all. Knowing the difference can be the difference between filing for something you can win if you are disabled, vs. not win - it is that important.

Epis. 14 - 2022. Patients' Use of HiTech HIPAA for low cost records
Patients are often being excessively charged for copies of their own medical records. Often it is a hardship to pay, other times they simply can't. I have seen many a patient be unable to avail himself of insurance coverage, disability benefits, health treatment. I have seen a patient/disability client remain homeless far longer than necessary because he couldn't get the records needed to prove his disability case. I am Disability Attorney Stephanie Joy and here I share what ALL patients, nationwide, can do to ensure their right to very low cost records, and it has to do with asking for them in the manner prescribed by HIPAA's HiTech/Access provisions - an apparently little used right provided them under HIPAA, which will supercede any higher charges sought by your provider under his State fee laws which may be less favorable than the federal HIPAA protections. Take a listen!

Epis. 7.1- 2022 SSD-Why NOT To Snooze Instead of Filing ASAP
As discussed in Episode 7, it is not unusual for best practice, based on the facts of a particular situation, to tell us that we should not file for SSD or SSI the day after we stop working due to our medical impairment, that a stronger case can be built with some patience and discipline and evidence development - HOWEVER, it can be claim-fatal to snooze and not file your case for 2-3-4 years after you became unable to work, and here is WHY... and what other havoc such delay, if worse comes to worse, can wreak on your Retirement benefits. Epis. 12 - 2022 Do I have to cancel my case if I try to go back to work - A Real Life Case Study
I am Stephanie Joy, Attorney/Proprietor of Joy Disability, and here is another off-the-cuff, informal quickie of a video share, a case study involving going back to work while you have a pending Social Security Disability claim. You filed for disability because your medical impairments worsened to the point where working was torture. You have an opportunity for a job that you think may totally work with your limitations and provide you the concessions you need. You want to try it. Can you do that and still keep your claim going just in case the job / work doesn't work out? Yes, often you can. Here are some considerations. SUBSCRIBE for updates and related content.

Windfall Elimination Provision - The Simple Reason
Learning for the first time that the Social Security you expected is going to be reduced by the Windfall Elimination Provision, can be a shock to many. While it is noted in our annual Social Security Earnings Statements, many of us don't read through it, so remain unaware. OK, here is the simple version of what it is, ans why. Remember, I am just the messenger.
Of note: "Congress passed the WEP to prevent workers who receive non-covered pensions from receiving higher Social Security benefits as if they were long-time, low-wage earners. b In2020, the WEP applied to 3.0percent of all beneficiaries..." https://www.ssa.gov/policy/docs/program-explainers/windfall-elimination-provision.html

Epis. 24 - 2022 What Your SSD Lawyer Can Do For You, What She Does NOT Do, and WHY
Your SSD lawyer is UNLIKE any other lawyer you have ever had - if she/he exclusively practice SSD/SSI and works properly in that government/legal arena. It is very important to know what is and is not offered by your attorney, what expenses and practices she will pay for and expend on your behalf, and what is not possible or appropriate in this area of law. It is VERY important to also know why, so if someone tries to steer you wrong in order to profit from you while trying to appear something other than, you will know what is up.
This video touches on your medical records responsibilities and in particular, why your SSD lawyer will not be paying your doctor for you, if he chooses to charge you for clarifying his medical record verbiage if it was less than clear or articulate.
