A shocking documentary that exposes
HIV/AIDS as a deceptive and deadly scam
https://www.youtube.com/watch?v=JTxvmKHYajQ&t=1s
This is a systematic dissection of the HIV/AID$ machine and how they hijacked a program designed to fight a worldwide plight of human suffering and drove it down the road to hell. Yet this program offers hope, inspired by the courage and articulate arguments of a group of growing voices internationally challenging the HIV=AIDS=DEATH hysteria. A MUST SEE for anyone interested in truly understanding the facts about HIV/AID$.

they've got to hold on to HIV why to hold on to their funding it's a disgrace
0:35
for any other disease with this much
0:40
disagreement about the cause we would by now have a balanced portfolio they're
0:46
dispersing AZT to two hundred thousand Americans in the name of hypothesis that stands unproven a talk that is the most
0:54
toxic talk that has ever been licensed for long-term consumption in the free world how the United States gave aids to the
1:03
world acquired immune deficiency syndrome known best by its acronym for
1:11
letters we've been told to fear the AIDS crisis is very real
1:16
it's dark form casts a shadow over the statistics of the dead and dying
1:21
virtually non-existent 1980 by 1995 AIDS had afflicted over 1 and a half million
1:27
lives globally half a million in the United States alone AIDS has become the
1:33
leading singular cause of death in u.s. males between the ages of 25 and 44
1:38
it's been called the plague of the century and portrayed like some medieval nightmare it knows no pity who respects
1:45
no limits we've been told that it can strike anyone and everyone is at risk for over 15 years now AIDS has
1:53
terrorized social America and still there is no cure what causes AIDS we've
1:59
been told that AIDS is caused by this tiny retrovirus its name is HIV and
2:04
virtually everyone who is infected with it is expected to develop any one of 30 different diseases all of which
2:11
ultimately result in death to stop HIV and AIDS the US government has enacted
2:16
emergency measures spent 40 billion dollars and mobilized the greatest scientific research effort in the
2:23
history of man the war against AIDS has spent more money and utilized more scientific talent than it took to land
2:29
on the moon all this to fight a microscopic enemy and still there are no
2:34
certain results after 15 years the public asks why there is a good explanation as
2:42
to why the war against AIDS has been a total failure we spent all our time and
2:47
money trying to stop this virus HIV and as many top research scientists have
2:52
tried to point out this virus is not the cause of AIDS for over 10 years this
2:58
argument against HIV has been dismissed by the government suppressed in the media and disputed by the political
3:05
economic powers of the AIDS industry yet since 1987 a growing group of scientists
3:13
continued to make this unnerving allegation AIDS research has not failed because it never found a cure AIDS
3:20
research has failed because it never found the cause is this virus HIV really
3:26
the cause of AIDS if it isn't why are we being told this the virus that causes
3:32
AIDS the virus that causes AIDS the AIDS virus HIV the virus that the
3:38
virus the virus that causes AIDS the public has been very supportive yet with
3:43
over a hundred thousand research papers published on HIV and AIDS there is still no direct proof HIV causes immune
3:50
deficiency the entire government-funded approach to fighting AIDS is based on this unproven hypothesis hanging from a
3:57
frayed thread and with the weight of mounting evidence against it this hypothesis is in serious trouble in fact
4:04
the entire international effort to stop AIDS has all its eggs in one beaker time
4:10
money treatment and millions of human lives hang in the balance if HIV is not the cause of AIDS millions
4:17
of people have been told that they're going to die for no reason at all and hundreds of thousands have been treated
4:22
with permanently impairing drugs some of which could cause AIDS themselves if HIV
4:28
does not cause AIDS how many lives have been lost to a misdiagnosis and how many more will die in the future
4:49
in the next few minutes we will present ten scientific arguments that explain why HIV does not cause AIDS what the
4:58
causes could be and why treatments with dangerous drugs like AZT are unnecessary
5:03
and caused the very disease they're supposed to prevent we will also explain to you why this information has been
5:09
kept back from the public awareness and why the US Department of Health the pharmaceutical industry and AIDS
5:15
activist organizations have perpetrated this myth as citizens taxpayers and
5:21
people who also someday could be at the mercy of a misguided program like this we hope you will see the importance of
5:28
this issue is HIV the cause of AIDS if not as Neville Hodgkinson of the London
5:35
Sunday Times put it then we will have witnessed the greatest medical scientific blunder of the 20th century
6:11
today nearly everyone has been affected by AIDS whether it's a friend or a lover
6:16
a business acquaintance or even a perfect stranger AIDS has had an impact on our entire culture the dread hangs
6:23
silently over society and there's little hope on the horizon it's time we ask
6:28
ourselves some serious questions could we be on the wrong track with HIV have we jumped to conclusions that will
6:35
only lead to a dead end are we willing to accept the truth even if it means that our whole campaign against AIDS has
6:42
been in vain to understand just how HIV
6:48
became the target of this international war on AIDS we have to look back at how it all began what's it into motion the
6:54
chain of events that many say mislead objective science following the depression of the 30s in world war ii
7:01
America emerged into a new era of Technology and prosperity we had more
7:06
time for recreation and self-realization society began to change medical science
7:12
had new breakthroughs we conquered polio the last great infectious epidemic of the modern world soon new antibiotics
7:20
cured everything from minor infections to venereal disease with the invention of the birth control pill came the
7:27
sexual revolution freeing the public from age-old fears and taboos homosexuality to found more freedom of
7:34
expression as gays came out of the closet and formed their own subculture during the Vietnam era of the 60s
7:40
recreational drug use skyrocketed among the young and would continue to grow yet
7:45
we remained optimistic that we could solve all our problems through our new faith in science and technology but
7:53
before long the unforeseen consequences of this new liberated lifestyle began to rear its ugly head silently in the
7:59
headlines the Bell began to toll when the first reports of
8:04
immune-deficiency surfaced in 1981 among a small group of gay men in Los Angeles it was believed to be a result of
8:11
behavior unique to homosexuals but all that changed when similar conditions started showing up in IV drug users and
8:18
hemophiliacs that set off an alarm what had been called gay related immune
8:23
deficiency now appeared to be an infectious disease that might spread throughout the entire population this
8:30
threat of a deadly blood disease being spread by sexual contact was sensationalized by the media and enraged
8:36
gay activists who demanded action from the government public health officials issued strong warnings that this new
8:43
immune disease could be acquired sexually by anyone suddenly immune
8:50
suppression common to drug addicts homosexuals advanced TB patients and scores of other diseases became linked
8:56
together in a microbiological search for a common cause acquired immune deficiency syndrome or AIDS was born and
9:04
as the bathhouses in San Francisco closed and the fear of AIDS spread the
9:09
u.s. department of health came under heavy fire to find the cause and remedy quickly the public was willing to
9:15
believe science could provide a quick fix so the funding began to roll in and the huge army of virus hunters who had
9:22
been unemployed after the unsuccessful virus cancer program went back to work they now turned their full attention
9:29
towards finding the cause and cure for AIDS scientists began to speculate that
9:35
AIDS patients lack the ability to fight infection in the blood due to a shortage of t-cells that coordinate immunity in
9:43
the blood there are two basic kinds of cells the red blood cells that carry oxygen and nutrients to all the body and
9:50
the white blood cells that hunt down kill and destroy infecting bacteria and viruses when an infection occurs white
9:58
blood cells must increase rapidly and produce antibodies to fight it off they do this through the use of cd4 T
10:04
cells that act like infection Detectives t-cells identify invading viruses then
10:10
alert the B lymphocyte blood cells to produce antibodies which attack the infection
10:16
in a normal immune system there are about 600 to 1200 of these t-cells in one microliter of blood plasma but in an
10:23
AIDS patient the number of t-cells drops down below 200 and lower this is what is believed to be the direct cause of AIDS
10:30
even this is questionable though because many AIDS patients have few or no t-cells and remain healthy but one thing
10:37
is certain people with AIDS are losing the ability to generate a strong blood defense against opportunistic infections
10:43
that constantly attack the body so as AIDS progresses the victim becomes less
10:48
and less capable of recovering from common diseases like pneumonia tuberculosis and the flu
10:54
eventually the immune system gives out altogether and the body is ravaged by disease resulting in death the objective
11:02
is clear stop what is killing t-cells and weakening the immune system and you have found a cure for AIDS but what
11:08
exactly is killing the t-cells is it really HIV in the beginning a number of
11:14
different causes were suggested drugs like heroin cocaine poppers barbiturates and amphetamines had all been observed
11:21
to harm the immune system also malnutrition repeated infection overuse of antibiotics and stress but these
11:28
behavior related causes were politically incorrect with gay activists who wanted
11:33
to distance themselves from the idea that aids might be self-inflicted and government-funded research programs
11:40
needed money in promised results so the decision was made politically to abandon
11:45
the behavior aids model for the infectious epidemic model and the virus hunters pressed on self convinced that
11:52
aids could be stopped by a vaccine or a treatment two of these were Robert Gallo
11:57
from the National Cancer Institute and max Essex from Harvard who had made public speculations by 1982 that aids
12:05
might be caused by a retrovirus Gallo's earlier research with retroviruses in
12:11
the cancer program had been a failure none of the viruses he studied could be directly linked to the cause of a
12:16
disease and his research yielded no benefit to the patient whatsoever but
12:22
one virus htlv 3 got Gallo's full attention it was this virus or as Gallo
12:28
claimed a ver that would become the virus that causes AIDS
12:34
yes fight that fight that fight that
12:40
writing the world wind of public demand Gallo made his move on April 23rd 1984
12:46
Secretary of Health and Human Services Margaret heckler and Robert gallo called a press conference together that would involve
12:52
the United States Department of Health in what critics claimed would become the biggest medical scientific blunder of
12:58
all time first the probable cause of AIDS has been found variant of a known human
13:05
cancer virus called HL 2 htlv III with
13:11
htlv 3 Gallo's white elephant virus program made the jump from the cause of cancer to become the cause of AIDS and
13:19
the target of billions of dollars in research funds simultaneously as the press conference was going on the blood
13:26
test used to detect HIV was being patented which would earn the US Department of Health over a hundred
13:31
million dollars a year and large financial kickbacks to Robert Gallo the AIDS industry was born and the US
13:38
government was now fully invested naively secretary heckler predicted that
13:43
a vaccine would be ready for testing by 1986 we hope to have such a vaccine
13:49
ready for testing in approximately two years for the moment everyone was happy
13:55
about this discovery of the probable cause of AIDS gay activists were satisfied that the government was
14:01
finally doing something but the public was not aware that Gallo had bypassed a
14:06
major checkpoint before making his announcement he had not submitted his test results to other scientists for
14:13
peer-review no one had a chance to critique or verify his claim and his test results were not published in
14:19
science magazine until one week after the press conference this was a dangerous violation of scientific
14:26
protocol suddenly a challenge to gallows ethics emerged which would become an
14:32
international scandal the institut pasteur ER in paris claimed that Gallo's AIDS virus was identical to La Vie a
14:39
virus dr. Luke Monta I had sent gallows lab six months before the press conference the French were
14:45
outraged and filed an international lawsuit against the US Health Department on grounds that Gallo had pirated their
14:52
discovery the entire incident was embarrassing to the United States and
14:58
had to be resolved diplomatically by President Reagan and Prime Minister Jacques Chirac of France with this
15:05
arrangement to split the profits made on the HIV blood tests the virus was given a new international name the human
15:12
immunodeficiency virus or HIV despite questions of Gallo's character
15:18
and ethics HIV had now gained international acceptance but when Gallo's HIV results were finally
15:24
published in science magazine only 44 of 93 AIDS patients he tested that's less
15:30
than half had the virus yet Gallo claimed that in further studies he could find HIV and up to 90% of those he
15:37
tested as other virologists reproduced Gallo's research they found similar correlations between HIV and AIDS
15:44
patients this high correlation seemed convincing to everyone that HIV must
15:49
have something to do with causing AIDS everyone that is except dr. Peter
15:55
Duesberg at the University of California and Berkley Duesberg became a world-renowned retroviral adjust in the
16:02
cancer program and the first man to map the genetic structure of retro viruses like HIV back in 1970 his honours
16:10
include membership in the National Academy of Sciences due to his discovery of cancer-causing genes having
16:16
researched retroviruses for over 30 years some have called him the world's foremost expert in retrovirology dr.
16:24
Duesberg was somewhat skeptical of Gallo's AIDS virus announcement I wasn't
16:30
mad leaked impressed by it because what else would you expect from a person like Gallo who had studied retroviruses all
16:37
his life that he would say retros is causing AIDS that seemed to be the first
16:42
coincidence that make me wonder whether that was an authentic claim or going to
16:47
be an authentic claim but you would say it was not a surprise that he would say
16:53
that he said it or that it would cause leukemia or things like Alzheimer disease neurological diseases and it failed so I
17:01
must wonder I was not too impressed that this work was going to be a winner now and it would have been for the first
17:07
time that a retrovirus would have been pinned down as a cause of a human
17:12
disease or even a disease in wild animals for 18 months Peter Duesberg
17:19
studied every scientific publication on HIV and AIDS he could get a hold of when
17:25
he finally published his observations in cancer research in 1987 he stood alone against the tide of popular opinion and
17:31
the government-funded AIDS industry his position has become well known he argues
17:37
that HIV is not causing AIDS it's a harmless passenger virus that has lived in humans for centuries without causing
17:44
diseases he believes AIDS is the result of other non-infectious factors like drug use and
17:49
ironically enough AZT the highly toxic medication prescribed to treat AIDS
17:55
patients actually does what the virus cannot that is causes AIDS itself though
18:01
dr. dews Berg's arguments were ridiculed by many and ignored by most many of his colleagues studied his research and came
18:07
to the same conclusion something is terribly wrong with the war on AIDS dr.
18:13
richard strowman recalls the impact of dews Berg's arguments in cancer research it was a remarkable review and it raised
18:21
the fundamental issues about virus virus virus as a cause of both cancer end and
18:29
immunosuppression basic questions that haven't been really responded to in any
18:36
meaningful way in in the almost ten years since that paper was published
18:42
soon other top scientists joined Duesberg and strowman in questioning the HIV hypothesis also Nobel Prize winners
18:50
dr. Walter Gilbert of Harvard and Kary Mullis who invented the PCR dr. Charles
18:55
Thomas a former Harvard professor organized a consortium of 12 signatories to address the issue they wouldn't I
19:02
become the group for scientific reappraisal of the hiv/aids hypothesis we started out by writing a letter to
19:10
nature calling for a reappraisal of the evidence for and against the hypothesis that HIV did in fact do all these things
19:17
and there were about 10 or 12 signatories to this letter and it was
19:23
rejected even though many of the signers of the letter were certainly reputable
19:29
people we tried nature magazine and it was ignored then we tried the New
19:36
England Journal JMA and so forth and Lancet in each case we were rejected
19:41
that they would not publish this letter it was only four sentences long it read
19:48
it is widely believed by the general public that a retrovirus called HIV
19:53
causes a group of diseases called AIDS many biomedical scientists now
19:59
questioned this hypothesis we propose a thorough reappraisal of the existing
20:06
evidence for it against this hypothesis be conducted by a suitable independent group we further propose that critical
20:13
epidemiological studies be devised and undertaken not is certainly a hardly a
20:19
bomb-throwing letter but nonetheless they would have none of it and being
20:24
rejected made us angry so we decided to extend the list of signatories so it
20:30
jumped to 30 then to 15 then to 100 and then by 1994 up to 600 188 of whom have
20:40
advanced degrees we published a newsletter we have a website so it's a
20:47
fairly large organization now though the scientific establishment has
20:52
continually ignored Duesberg and the group for reappraisal some individuals are having second thoughts at the San
20:59
Francisco International AIDS Conference in 1990 dr. Luke montagnier who discovered the virus originally six
21:06
months before Gallo's claim made a startling statement HIV might be
21:11
harmless against his own interest montagnier statement should have been earth-shaking but the conventioneers
21:18
paid it little attention and went right on talking about new antiviral drug treatments why is the scientific
21:25
community ignoring the dangerous ramifications of this essential question about the cause of AIDS do we have an
21:32
answer yes in retrospect we certainly do too many people are making too much
21:38
money out of it and money is much stronger than truth if the AIDS
21:44
establishment will not respond to this issue that it's time that the public heard the evidence against HIV and
21:50
demand answers for the next few minutes we'll show you why HIV fails as the
21:56
cause of AIDS and what the real causes could be we will also explain to you why AIDS is not being caused by conventional
22:03
sex and why the clean needle and safe sex programs will do little to stop AIDS you'll have to pay close attention and
22:10
do some thinking first ten scientific reasons why HIV is not the cause of AIDS
22:16
to begin with let's take a close microscopic look at the virus itself number one HIV like all other viruses is
22:25
harmless after antibody immunity HIV is a retrovirus retroviruses reproduce
22:31
themselves through a process called reverse transcription its receptacle attaches to the coding of the T cell it
22:38
penetrates the cell and encodes its RNA genes into the cells DNA and as the cell
22:44
multiplies the new viruses break free and go on to reproduce themselves in other cells like all viral infections
22:52
HIV reproduces rapidly immediately after it infects the body causing a slight fever and some cold symptoms
22:59
but nature has given the human body a built-in defense called antibodies these tiny protein molecules are generated by
23:06
the B lymphocyte blood cells to track down and kill invading infections like HIV antibodies scour the entire system
23:13
until all the invading germs are dead or become dormant and inactive antibodies
23:19
are the reason why we get well after a cold and become immune to diseases like chickenpox or the measles ironically
23:26
when a person is tested for HIV with the blood test they are not testing for the virus but the antibody that has been
23:33
generated to stop it when a person tests positive to HIV they have produced their own antibody vaccine
23:40
which means they are now immune to the virus all infectious diseases must win
23:45
the race against the immune systems antibodies to kill the host there are no known diseases that ever really illness
23:52
after the antibodies have done their job no there's no such disease no precedent
23:58
for it all other microbes cause diseases primarily before immunity before
24:04
anybody's around and that's the only reason why you and I are talking now because antibodies protect us against
24:11
microbes once you have antibodies you're safe against these microbes the whole basis for vaccinations 200 years old at
24:18
Regina came up with that for others too but he did is his name in it there's not
24:24
one president where Michael only causes disease after immunity some come back
24:29
there are always some marginal exceptions if you do through this generalization it's not a real exception
24:34
but partial but none ever had the cost of disease only after antibodies
24:40
appeared which is how it's is defined no every 8th grade biology student
24:45
should question why this basic fact of science has been turned upside down with HIV the taxpayer should ask why we've
24:53
spent 12 years and billions of dollars developing a vaccine against HIV when
24:58
the best vaccine possible already exists when an individual test positive reason
25:05
number 2 HIV does not kill the t-cells it infects AIDS patients are losing
25:10
t-cells and because these are the cells HIV infects it was assumed that HIV was
25:15
killing them but only under rare laboratory conditions do retroviruses kill their host cells in fact Robert
25:22
Gallo and other AIDS researchers used T cells to grow the virus because T cells live quite compatibly with HIV this
25:30
claim that a retrovirus was killing T cells was what sparked Peter Duesberg suspicions based on his experience with
25:36
retroviruses in cancer research and Hagel comes along as well HIV is causing
25:42
AIDS by killing T cells the T cells are killed the immune deficient and immune
25:47
deficiency produces AIDS that didn't seem to fit with everything we ever
25:53
learned about retroviruses knew about that was namely the plateau viruses do not kill cells retroviruses are set
26:04
apart from virtually all other animal viruses we know human and animal viruses
26:09
in that they do not kill the cell they infect ever they are not killer viruses
26:15
that's why they are at least plausible cancer viruses causing a disease a
26:21
values that could cause a cancer a disease would be one that couldn't kill
26:27
a cell if it killed the cell there wouldn't be a cancer reason number three HIV does not infect enough T cells to
26:34
cause AIDS even if HIV killed the T cells it infects it does not infect enough cells
26:40
to cause AIDS shortly after HIV is brought under control by the antibody defense the
26:45
billions of virus particles become dormant and begin to disappear before long the virus can hardly be found in T
26:52
cells at all infecting only one cell out of every 1,000 and sometimes as few as one cell out of every 100,000 on the
27:00
other hand T cells can reproduce at the rate of 5% a day simple math proves that
27:05
HIV cannot infect enough T cells to cause them to die off and bring down the entire immune system even supporters of
27:13
HIV admit that this low amount of T cell infection is a challenge to explain AIDS
27:18
patients are characterized by the deficiency or depletion of T cells
27:24
they lacked essence that's why there it's patience but when the first data
27:30
appeared in fact many of them gallows the first little good data on that came
27:35
from Carlos lab the surprising news was there was no virus found in t-cells
27:43
practically none in fact the notorious difficulties of our nation's leading at
27:49
that time leading AIDS researcher Robert Gallo in finding the virus led him to his now well-known problems with
27:58
essentially appropriating or mr. Pope heading speak stealing dividers for montagnier he couldn't isolate the virus
28:04
because there was no virus there not because he is incompetent simply he confirmed what we are just talking about
28:10
the issue no vials in AIDS patients only antibodies against it so if one in thousand cells or even one in hundred
28:16
cells is infected by a virus you want to get a disease from it you won't die from it in order to die from a depletion of T
28:24
cells you would need to have a virus that kills more than half of them it's
28:30
it's like saying you're dying you're twenty five year old men suffering a fatal disease or dying from a fatal
28:36
disease because you stuck yourself with a needle or cut yourself while shaving you're losing about 100 of thousands of
28:43
your blood with a bad cut in shaving you're not going to die from that but that's what Gallo this hypothesis has
28:49
actually said reason number four HIV has no AIDS causing gene HIV has no specific
28:57
gene or unique genetic reason to cause AIDS all retroviruses have only three
29:03
major genes gag n and Paul and only six minor genes because the genes and
29:09
genetic sequences are so limited in these very simple little viruses they need all the genes to replicate HIV is
29:16
almost identical to all other retroviruses genetically what most people do not know is that there are as
29:23
many as fifty to a hundred of these retro viruses that can be found in every healthy human body all of the same three
29:30
genes and all are kept under control by antibodies after infection HIV behaves
29:36
no differently than the others in the way that you Tate's becomes dormant and reactivates so the question is if none of these
29:43
other retroviruses cause diseases why should HIV or vice versa if HIV causes
29:49
AIDS why don't all the rest so there's no genetic reason to explain why HIV
29:55
would cause AIDS number five there is no such thing as a slow virus HIV is said
30:02
to be a slow virus that takes 10 to 12 years after infection to cause AIDS the
30:08
only way to explain this is to give HIV magical abilities to reactivate mutate
30:13
migrate and hibernate these slow virus hypotheses were devised by scientists
30:19
like Gabi 2nd Gallo who used them to buy time when their disease-causing agent
30:24
failed to perform they based their slow virus hypotheses on studies of epstein-barr which was supposed to cause
30:30
a cancer ten years after infection and herpes viruses that hide in reemerge in
30:36
persons who have suppressed immunity and can't generate a sufficient defense but these differ greatly from HIV because in
30:44
both cases large amounts of active virus can be found causing specific symptoms in total
30:50
contrast HIV is inactive then is said to cause 30 different diseases 10 years
30:56
later none of which are specific to HIV itself Peter Duesberg says there's no
31:02
such thing as a slow virus only slow virologists a virus including a
31:09
retrovirus causes a disease within days weeks or at the very most a month after
31:16
infection and that is not a mysterious number that number is a direct function
31:21
of the generation time of the virus the time a virus needs to infect a cell and generate new virus particles and that
31:29
takes with all viruses we know of in humans all of them including HIV and including all retroviruses at the very
31:36
most one or two or three weeks so whatever a virus could possibly do has
31:42
to happen in that time period or else it's not caused by that virus and with
31:48
AIDS everybody even from the very beginning talked about a so-called minimal latent period
31:53
of or every latent period of one year and now they have raised that to ten years in other words we are buying lots
32:01
and lots of time for something else to cause the disease that is in fact blamed on the virus there is not in ten or
32:08
twelve years of research thirty-five billion by the American taxpayer alone not to mention private organizations and
32:15
companies and other countries there is not even a shred of light on this
32:21
question why it would take ten years from the infection to a disease in fact
32:27
it's impossible reason number six HIV is not a new virus so HIV would not
32:33
suddenly cause a new epidemic AIDS cases have increased dramatically from zero in
32:39
1980 to half a million by 1996 so researchers assumed that it could only
32:44
be caused by a new virus spreading quickly into the population and old virus would have caused an AIDS epidemic
32:50
years ago possibly even centuries ago so HIV must be a new infection to cause the
32:56
recent AIDS epidemic but here again the hiv/aids proponents bypassed yet another
33:02
essential question of logic how old is HIV and where did it come from
33:07
there is about green monkey bites and traveling gay flight attendants run in the headlines but no one in the entire
33:13
government-funded research program has bothered to verify the age of HIV Peter
33:20
Duesberg says HIV is very old using the fundamental means of dating viruses found in far as law if I was a pretty
33:28
shamba numerologist William finest first part of the 19th century who noted when
33:33
a new epidemic comes into a population like AIDS is said to be new or the virus
33:42
causing it is said to be new as well and then it spreads exponentially in that
33:49
population not translated into current tabloid newspaper reporting it explodes
33:54
into that population like a seasonal flu epidemic that's what far slaw says but
34:00
if a microbe and disease is known established then it's old so when you look at HIV in
34:09
America you'll find ever since it can be detected 1 million Americans are positive that was first reported by the
34:14
Centers for Disease Control in 1985 and has since been repeated over and over
34:20
and over every 10 every year for 10 years 11 years now almost 12 years now so if it's in 1 million Americans for 10
34:27
years here every single year that can't be no and those statistics are harder
34:33
than anything we ever had in microbiology 25 million Americans are tested once here's 10% a Gallup poll is
34:39
usually on the within a percentile when you test 10,000 Americans or 5 cells and
34:45
they call it my phone and they get it within the percentage accuracy this is done on 25 million people for 10 years
34:51
nothing has ever been checked so carefully that's an extremely hard number best thing is 8 years old
34:57
this viruses in America is older than America it came in with the immigrants
35:02
that's older than the Constitution so HIV is not a new virus and many of the
35:09
people who have antibodies to it got it perinatally or from their mothers not from dirty needles or unsafe sex and
35:16
have lived full healthy lives for centuries without AIDS number 7 HIV fails
35:23
Koch's postulates the universal test used by scientists to determine if a
35:29
disease is truly being caused by an infection was designed over a hundred years ago by Robert who discovered
35:34
the bacteria that causes TB HIV fails this test Koch's postulates state first the virus
35:42
or bacteria must be found in all cases of the disease second this germ must be isolated from the infected host and
35:49
grown in a pure culture third the germ must cause the same disease when injected into a new healthy host and
35:55
finally the germ must be found growing again in the newly diseased host HIV
36:01
fails postulate number one because ten to twenty percent of all AIDS patients have no HIV at all when HIV can be found
36:08
it is only in very small amounts and usually dormant HIV passes postulate
36:14
number two only on a technicality it can be isolated but it takes huge amounts of cell tissue to find it then a difficult
36:20
chemically-induced process is needed to reactivate the virus by contrast large amounts of active virus can easily be
36:27
found with other diseases HIV fails postulate 3 hands down HIV does not
36:32
cause AIDS when injected into test animals like chimpanzees and more importantly human health care workers
36:38
accidentally infected with HIV rarely get AIDS unless they use drugs and AZT
36:44
Robert Gallo and the HIV orthodoxy have dismissed Koch's postulates is old and
36:49
out-of-date with modern medicine but the postulates have stood the test of time and scientists who have ignored and
36:55
bypassed them have done so at their own peril time after time with diseases like scurvy berry berry
37:02
pellagra smile and even the failed virus cancer program all ignored Koch's
37:07
postulates and all proved to be non-infectious all efforts to find infectious causes
37:12
ended in a dismal failure and now HIV and AIDS it's obvious that HIV fails to
37:19
cause AIDS beneath the microscopic lens and on the drawing board but it doesn't fly in the population studies either
37:24
when we use the telescopic lens to observe the population at large HIV s failure becomes linked to real
37:31
names and faces the population studies prove beyond a doubt that HIV does not cause AIDS number 8 AIDS has remained in
37:41
its original risk groups for over 12 years when an infectious epidemic strikes it
37:46
begins in small clusters then quickly spreads throughout the entire population if a disease does not spread it is not
37:53
contagious and must be caused by something non-infectious figures compiled by the
37:58
Centers for Disease Control confirm that AIDS is not spreading into the population at large and is locked in its
38:05
original risk groups homosexual males IV drug users hemophiliacs and blood transfusion
38:11
patients make up 97% of all AIDS patients and have continued at that rate
38:16
for over 10 years the remaining 3 percent of AIDS patients outside these risk groups are made up of persons who
38:22
suffer from immunodeficiency at random and just happen to be infected with HIV
38:27
if AIDS is truly being caused a virus the patients who do not fit into
38:33
these risk groups would be growing above the 3% as the disease spread but AIDS
38:39
has failed to spread into the female population also when the US Army began testing new recruits for HIV in 1984
38:46
they discovered an amazing fact HIV infection was evenly spread between
38:52
males and females 5050 and it's remained that way since then it should follow that AIDS would be
38:59
50% male and 50% female yet 9 out of every 10 people who develop AIDS
39:05
continue to be male a germ related disease should be spread evenly between
39:10
the sexes and though HIV is evenly spread ninety percent of all US AIDS cases develop only in males this could
39:18
explain why drug use is more related to AIDS than HIV infection in the u.s. males use over 80% of all hard
39:25
psychoactive drugs and among the women with AIDS over half use IV drugs also in
39:32
times past every infectious disease has taken its toll on doctors nurses and health care workers who work with the
39:38
infected yet AIDS has failed to spread here as well with over 500,000 cases of
39:44
AIDS hardly one physician has developed AIDS as a result of an occupational HIV
39:49
infection in healthcare workers and laboratory technicians who cultivate high amounts of active HIV there have
39:56
been hundreds of confirmed accidental exposures and infections yet within the field of five million health care
40:03
workers only a handful of cases of AIDS have been reported and even these are highly disputed from the statistics
40:10
generated by this vast population study it becomes evident AIDS is more related
40:15
to behavior in specific medical risks than it is to HIV infection even
40:20
supporters of HIV concede AIDS is not becoming the world pandemic that was
40:25
predicted reason number nine international comparison of AIDS differ
40:31
greatly a germ related disease would affect a population in the same way around the world for example an outbreak
40:38
of cholera in India would be similar to an outbreak in Honduras but statistics are totally different in the
40:45
US and Western industrialized nations compared to Africa in the u.s. AIDS
40:50
patients are 90 percent male but in Africa AIDS is evenly spread between the sexes in the u.s. AIDS resides among
40:58
risk groups at the rate of 97% yet in Africa AIDS has no risk groups and is
41:03
found at random in the general population only 62 percent of the AIDS diseases in the u.s. are microbial but
41:10
in Africa that number is approximately 90 percent likewise the AIDS diseases in the u.s. that are not germ related make
41:17
up 38% of the total a number that does not correlate with Africa at only 10 percent HIV is believed to have
41:24
originated in Africa where an estimated 14 million have the virus because of malnutrition and other health conditions
41:31
conducive to AIDS statistics from Africa should be at least 14 times higher than in the u.s. yet surprisingly it's quite
41:39
the opposite people infected with HIV in the u.s. develop AIDS at a rate 10 to 20
41:44
times faster than Africans figures from the CDC in the World Health Organization
41:49
have confirmed this since 1987 through 1995 so the question is why would the
41:55
AIDS epidemic behave so differently in the industrialized world one good explanation is that HIV does not cause
42:02
AIDS and the real causes are hard psychoactive drugs used primarily in the US and Europe Duesberg questions if what
42:10
is being called AIDS in Africa is really the same epidemic but the African epidemic I think is a completely
42:18
different epidemic it's a affects men and women alike in in America AIDS is
42:24
90% men and in Europe 90% men debts epidemiologically as different as day and night 52 percent compared to 90
42:32
percent is completely different that's a totally different epidemic the African one and the diseases likewise are very
42:40
different in the two continents so clinically in the epidemiologically the
42:45
two epidemics are very different and in Africa it's possibly malnutrition
42:51
parasitic infection and poor sanitation it effects their Nova scopes there's not homosexuals or intravenous drug users
42:58
it's just poor people without running water without supermarkets without
43:04
doctors the London Sunday Times questions whether AIDS in Africa is a myth quoting dr. Konya hulu if tens of
43:13
thousands are dying of AIDS in Africa where are their graves well one of our one of the members of our group is a
43:19
fella called Phillipe Cronin who is therein up there in Tanzania Tanzania
43:26
which is thought to be the epicenter of the AIDS outbreak and very he and his
43:33
wife Evelyn I went to deal with orphans
43:38
with AIDS they're kind of well-to-do French do-gooders who by the way garlic
43:46
quite a lot of money from France I'm told and who popularized the idea of AIDS in Africa well after being on the
43:53
ground there in Tanzania for a couple of years he reported that after the all
43:59
this time we have to conclude that there is no AIDS and there are no orphans the
44:06
people that were thought to be orphans were actually being taken care of by their grandparents while their own
44:12
parents were often doris salam making money they came back at the end of the dry season or something like that it's a
44:17
it's an amazing story the the age diseases that these people were suffering from were just the same old
44:24
diseases that everybody was suffering from in Africa from time immemorial the only difference now is that if it was
44:31
called an AIDS disease then w-h-o and the United Nations send money if it's
44:39
called the diarrhea what's new about a diarrhea in Africa but if it's an AIDS
44:45
diarrhea when the United States sends money finally reason number 10 AIDS
44:52
occurs without HIV infection and most people with HIV never develop AIDS the
44:59
evidence in support of the HIV hypothesis is based solely on correlation because the virus is often
45:05
found in most AIDS patients we have assumed HIV is NEADS but the logic that assumption is
45:10
flawed because correlation does not prove causation for example the presence
45:16
of HIV and AIDS patients is no more proof of the cause than the presence of birds on powerlines prove that the birds
45:22
caused power failures they only correlate so if HIV is a harmless passenger virus that only correlates
45:29
with other real causes of AIDS we should expect to see two things people with AIDS who are not infected with HIV and
45:36
HIV infected people who are healthy and do not get AIDS and that is exactly what
45:42
is happening what's also important is that different risk groups develop different diseases
45:47
why would HIV supposedly cause one set of diseases naívi drug users and another
45:53
set in homosexual males unless HIV is not the cause and other causes are at
45:59
work do we find these specific AIDS diseases in the risk groups among persons who do not have the virus the
46:05
answer is definitely yes diseases like Kaposi sarcoma and advanced
46:11
cytomegalovirus which strike primarily gay males have been found in numerous homosexual men who do not have HIV but
46:18
these men have one common denominator the use of nitrite inhalants as aphrodisiacs that are known to be
46:24
immunosuppressive thousands of American drug addicts who are not infected with HIV get the same tuberculosis wasting
46:32
syndrome and pneumonias and even lose the same cd4 T cells as those who are HIV positive the slow death that
46:40
resembles aids in heroin addicts has been observed and documented in the medical literature since 1898 so in
46:48
these two risk groups that comprise over ninety percent of US AIDS cases there are other factors at work that could
46:55
cause AIDS and have for years Peter Duesberg says there are 4621 documented
47:01
AIDS cases without HIV and this number is much lower than it may actually be
47:08
4621 so that was in 93 in the meantime I could probably easily get this number
47:15
over 5,000 but the number isn't going as fast as it could shoot
47:21
because if a person is reported within clinical aids diagnosis and is HIV
47:28
negative he or she will not appear in national aid statistics they will say was Capozzi that's not AIT's it's
47:35
pneumonia or Pneumocystis pneumonia it's not AIDS because it's not hiv-positive and people are I mean I know in fact
47:42
people are examples of people who taught me under condition of anonymity they had
47:48
observed these in Stanford and in San Francisco the public health and were pressured not to publish this simply not
47:55
to mention it or if they published it not in an AIDS Journal and then it's listing the same thing is happening in
48:02
England and everywhere else so these cases mostly date from the early days on HIV and AIDS and in the
48:08
80s and early 90s when people were still genuinely asking is HIV actually found
48:14
in all AIDS cases they reported actually 4621 cases that I could easily find of
48:21
AIDS diagnosis in the absence of HIV and more have accumulated sins but not as many because people know now what to say
48:29
what not to say in order to survive and this competitive world the official
48:35
definition of AIDS is designed to eliminate every case of AIDS that presents an embarrassing non correlation
48:41
against HIV the official definition of AIDS is Saudi previously known all diseases in the presence of antibody
48:47
against HIV so if you have Kaposi sarcoma and HIV antibodies you an AIDS
48:53
patient without it your Capozzi patient pneumonia with HIV antibodies is aids in
48:58
the absence is pneumonia dementia in the absence of HIV antibodies is dementia
49:04
and with it it's aids that's the it's definition there is no HIV specific disease anywhere unlike any
49:13
other microbe that causes a specific seat disease just like an instrument
49:19
makes a specific sound HIV doesn't make a specific sound it causes is set to
49:27
cause 30 previously known diseases when it's there and when it's not there the original
49:33
causes of these diseases are responsible for them that is the official definition
49:38
of AIDS not my joke using this official definition HIV
49:44
proponents arrive at a near hundred percent correlation between the virus and AIDS and remember the HIV hypothesis
49:51
is based solely on correlational evidence and you can find a correlation there's no question about it
49:57
if you ignore all the cases where there isn't a correlation you have a correlation but that is that's but that
50:02
is that's a very bad science and it's very bad epidemiology as well critics
50:08
say this correlation is not objective or scientific and deceptively self-fulfilling it's a self-fulfilling
50:14
prophecy yes science is designed to to to get around so fulfilling prophecies but in
50:20
this case that said it's proceeding on the basis of one finally the most
50:26
convincing argument against HIV the millions of people worldwide who have the virus and are not becoming sick this
50:34
is very apparent in Africa where 97 percent of those with HIV are healthy and do not have AIDS documented AIDS
50:41
cases amount to only 3 percent also in the u.s. we're only half a million
50:47
infected have progressed to full-blown AIDS over a 15 year latency period and this figure does not account for the 19
50:54
new diseases defined by the CDC as aids and 62,000 AIDS patients who are never
51:00
tested for the virus it is evident HIV does not cause AIDS in most people and
51:06
this evidence becomes stronger every year Robert Gallo Anthony foutch II and
51:11
the entire scientific and political campaign based on HIV are in serious serious trouble and as the foundation of
51:19
the scientific support for this multi-billion dollar hypothesis crumbles the real causes of AIDS will continue to
51:27
take hundreds of thousands of lives yet the hollow campaign goes on and on like
51:32
a broken record we have a long way to go in the fight against HIV
51:37
the virus that causes AIDS the virus that causes AIDS the virus that causes
51:43
AIDS the virus that causes AIDS the virus that causes AIDS the virus that
51:49
causes AIDS then what could be the real
51:54
causes of AIDS there is no question about the reality of people dying but if
51:59
HIV is not the cause what is and what can we do to stop it under the protocol
52:05
of scientific debate dr. Peter Duesberg and the group for reappraising AIDS are not required to solve the problem simply
52:11
because they dispute the HIV hypothesis but they have made some suggestions to
52:16
begin with Duesberg argues that aids is not infectious it is not been spread
52:22
sexually and it is not a threat to the public at large he and journalist John Lorenson have
52:27
proposed that AIDS is caused by recreational drug use and AZT psychoactive drugs used by homosexuals
52:35
as aphrodisiacs and injected drugs like heroin and cocaine they claim are the
52:40
direct cause of AIDS in nine out of ten cases AIDS has come from virtually
52:46
nowhere or from a very low basis up to now currently eighty ninety thousand
52:52
cases per year in this country so here is it is my curved AIDS has gone up in
52:58
the last fourteen 15 years from virtually nothing that used to be called
53:05
that way there was always a low background of these diseases none of the eight diseases is new to up 200,000 in
53:11
93 and now it's topping it down to 80,000 last year but HIV has been
53:16
unchanging 1 million so this could not ever be the cause of this this is going
53:23
up from nowhere 200,000 and this is staying a million for 10 years how can this cause this and if you look at this
53:31
here this shows you how cocaine use and heroin use goes up this is cocaine and
53:37
this is heroin and this is called cane related hospital emergencies you will see that these two match renewal
53:45
and that's what we discussed earlier that's the lifestyle apophysis or the talk hypothesis that recreational talks
53:51
are causing these diseases and they they match perfectly over time they track
53:58
perfectly the talk use the talk use emergencies heroin cocaine in this case and AIDS but not a sharee the
54:07
correlation between AIDS and skyrocketing drug use is astounding and unlike HIV we have a good idea of how
54:15
drugs suppress the immune system well how does smoking cause emphysema
54:20
how does alcoholism cause liver cirrhosis that is something that has been described in the literature it's
54:27
chemistry chemicals have their price you can't expect to take chemical edit doors
54:33
that gets you so high that you don't sleep anymore you don't want to eat anymore and you have ten or twenty six
54:39
partners per night to expect to be totally into consequential for your health if you do so much chemistry put
54:46
you so much chemistry in your body and do it with your body you cannot expect that this has no consequences
54:51
it's like hoping that you contrive an American freeway car designed to go 60
54:58
miles an hour and hundred sixty miles and expect it to one just as long as the
55:03
company has promised it would last though there are no government funded
55:09
studies it examined the long-term effects of drug use in this war on AIDS the medical literature is full of cases
55:15
of AIDS like symptoms among drug addicts since 1909 we've observed the horrendous
55:21
effects of heroin morphine speed cocaine and other injected drugs on the immune
55:27
system today thousands of American junkies who are not infected with HIV
55:32
are losing the same cd4 t-cells and getting the same diseases as AIDS patients how is the war on AIDS
55:40
addressed this issue we've passed out clean needles and told addicts to avoid getting HIV IV drug users comprise over
55:49
32 percent of all US AIDS cases approximately 62% of all the women with
55:55
AIDS are IV drug users and 70% of the babies born with AIDS are born to mothers addicted to drugs but the
56:03
largest risk group is male homosexuals well over half that 60% of all AIDS
56:08
patients are gay men what is causing AIDS and homosexuals and are they all at
56:13
risk here again Peter Duesberg argues that aids is not infectious and is
56:19
really the result of drugs used by many men in the fast track gay lifestyle surveys conducted by the CDC show that
56:27
gays often indulge in a high amount of recreational drug use including many of the drugs known to be immunosuppressive
56:33
in drug addicts but one drug that was available legally nitrite inhalants commonly known as poppers are used
56:40
extensively poppers are believed to be the direct cause of Kaposi's sarcoma a rare form of skin cancer that afflicts
56:48
the nose throat lungs and skin Kaposi sarcoma has been an indicator disease of
56:53
AIDS but it is often found in gay men who are not infected with HIV in the
56:58
study published by Toby Eisenstein rodents showed a mediated dose response in immune suppression after being
57:05
exposed to nitrites found in poppers I think that's very revealing it showed
57:10
that a no nitric oxide radical is terribly immunosuppressive but
57:16
interestingly enough all of the literature on n oh and I follow up on it rather carefully at my computer never
57:23
mentions a molar butyl nitrite never mentions the word poppers it's as almost
57:28
these two worlds are living side by side but they don't are not talking to each other another possible cause of AIDS
57:35
among homosexuals and heterosexuals as well is the infection that occurs during anal sex the tissue lining in the rectum
57:42
is permeable and only one layer thick unlike the vagina which is three layers thick the rectum cannot accommodate the
57:49
abrasive thrusting that takes place during anal sex through the tears in this lining foreign proteins found in
57:55
semen along with viruses and bacteria have a direct route to the blood contamination from feces and bacteria
58:01
have been blamed for what is called gay bowel syndrome or the colon and rectum become inflamed
58:07
accompanied by diarrhea loss of bowel control and malnutrition also foreign
58:13
proteins found in sperm have been shown to be immunosuppressive it's been suggested that when they enter the blood
58:19
they could trigger an autoimmune reaction where the body's immune system turns upon itself small cuts and sores
58:25
on the penis are routes by which infection spreads to the person on the giving end using a condom during anal
58:32
sex can reduce the risk of foreign proteins infecting the blood but often the condom even when it works properly
58:38
still tears the rectal lining and exposes the recipient to chemicals used as lubricants many gay AIDS patients
58:45
have multiple infections of gonorrhea syphilis hepatitis herpes cytomegalovirus
58:51
and other diseases to combat these repeated infections homosexuals often
58:56
take huge amounts of antibiotics during bathhouse visits along with other drugs these antibiotic overdoses also wear
59:04
down the immune system there's no doubt that homosexuals are contracting many of these opportunistic AIDS diseases
59:10
sexually but is this the cause of AIDS or simply put are gays getting AIDS
59:15
because of homosexual behavior or is it caused by drugs used commonly in connection with the gay lifestyle Peter
59:23
Duesberg points out that the number of homosexuals getting AIDS amounts to only a very small percentage of the entire
59:29
gay population so we are talking about a small percentage of the homosexual
59:35
population that is that is sleep that is practicing this lifestyle taking these
59:41
drugs for sex those are the ones were at risk not homosexuals homosexuals again
59:47
as old as mankind is Michelangelo walls Socrates was Tchaikovsky was and they
59:52
all lived without AIDS normalize Duesberg argues that if the war on AIDS
1:00:00
focused upon drugs used in the gay lifestyle instead of HIV we could save
1:00:05
thousands of lives we have 100,000 studies on HIV and AIDS and it isn't one
1:00:12
that is not uno epidemiological study that has shown that a coupe of I go as
1:00:17
low as 10 or 20 in homosexuals heterosexual doesn't matter HIV positive but not using
1:00:24
poppers not using cocaine not using herring and not using AZT ever gets AIDS abrogates
1:00:29
Kaposi sarcoma tuberculosis dementia a diarrhea at the age of 25 or 35 where
1:00:34
these men die when they take the talks and have HIV why is there's no such
1:00:40
study I think the answer is very simple because HIV doesn't do it it's the drugs
1:00:46
that are doing so if recreational drug use can explain 9 out of 10 AIDS cases
1:00:52
among homosexuals and drug addicts what about the other 10% such as people with medical risks like blood transfusion
1:01:00
patients and hemophiliacs the risk in receiving blood is well known and it
1:01:05
should be no surprise that transfusion patients often develop AIDS symptoms because of the life-threatening
1:01:12
conditions that require transfusions almost 50% of all transfusion patients
1:01:17
die within a year after receiving blood and those that survive their immunosuppression directly corresponds
1:01:24
with how much blood they receive the condition of their illness and factors affecting their health regardless of
1:01:29
whether they are infected with HIV hemophiliacs receive injections of blood clotting factor 8 made from thousands of
1:01:37
blood donors before blood was tested for HIV many were infected with the virus and
1:01:42
some developed AIDS yet some of the most revealing contradictions against HIV can
1:01:47
be observed among this special group for years dr. Duesberg has argued that HIV
1:01:52
is not causing aids in hemophiliacs and his research indicates what is foreign proteins found in clotting factor 8 that
1:02:00
can be shown to have a measured dose response towards suppressing immunity in hemophiliacs almost 75 percent of
1:02:06
American hemophiliacs are infected with HIV yet the lifespan of hemophiliacs as
1:02:11
a group has increased by 15 years during the AIDS epidemic so hemophiliacs are living longer than
1:02:17
ever before in history with HIV in fact hemophiliacs with HIV develop AIDS at a
1:02:23
slower rate than IV drug users and homosexuals a recent study conducted by Sarah Darby at Oxford tracked death
1:02:31
rates among British hemophilia between 1977 through 1992 the Darby
1:02:36
study concluded that hiv-infected hemophiliacs were dying at a much faster rate which supports the HIV hypothesis
1:02:43
but under scrutiny that Darby study falls apart the trouble is with the Darby experiment is that they did not
1:02:50
control for the magnitude and amount of foreign proteins that were being
1:02:55
received by these hemophiliacs so it's impossible to determine whether HIV or
1:03:01
foreign proteins in fact 'read are increasing the death rates since HIV
1:03:06
rarely contaminates factor eight those hemophiliacs infected with the virus would have the highest number of
1:03:12
infusions of the factor and should be expected to develop aids faster but the most alarming observation about Darby
1:03:19
study delivers a crowning blow to the HIV hypothesis followed by a frightening realization the data clearly indicates
1:03:26
that the HIV hypothesis itself is causing AIDS look closely at the death
1:03:33
rates even though many hemophiliacs had been infected with HIV for years before it could be detected their mortality
1:03:40
rate remained low but when HIV testing was introduced in 1985 it suddenly
1:03:45
jumped the question is why would someone living with HIV only start to die after
1:03:51
being told they were infected unless the virus is harmless and it can only cause
1:03:57
AIDS when a patient is terrorized by a diagnosis of death and begins taking
1:04:02
deadly antiviral treatments like AZT that could cause AIDS themselves the
1:04:07
Darby study scientifically documents the HIV AIDS formula for mass medical
1:04:12
disaster a failed hypothesis that spawns a misdiagnosis of death and terrorizes
1:04:19
the unwary into taking deadly treatments that cause the theoretical disease a self-fulfilling epitaph HIV causes AIDS
1:04:28
a ziti aids by prescription in 1987 the
1:04:35
war on AIDS took another drastic turn for the worse a ziti a toxic chemotherapy deemed too poisonous for
1:04:42
cancer treatment was approved to treat symptomatic and asymptomatic HIV patients in attempt to kill the virus
1:04:49
that causes AIDS a Z T is a DNA chain terminator a poison designed to randomly
1:04:56
destroy the DNA synthesis of reproducing cells it was initially developed to
1:05:01
treat leukemia victims but after animal testing the FDA determined that it was too toxic for use in human beings and
1:05:08
banded but in 1987 when the AIDS scare hit its height the FDA was pressured
1:05:14
into approving the drug for use for the first time in human beings even for people who were healthy and showed no
1:05:20
sign of AIDS a Z T is highly mutagenic meaning that it destroys the genes and
1:05:26
cells and has been shown to cause cancer in rodents it targets the bone marrow where B lymphocyte blood cells are being
1:05:33
made these are the very cells an AIDS patient needs most for immunity a Z T
1:05:38
destroys randomly bone marrow kidneys liver intestines muscle tissue the brain
1:05:43
and central nervous system Peter Duesberg claims AZT actually causes AIDS
1:05:48
itself ezt deaths does directly causing AIDS defining diseases you know AIDS is a lot
1:05:55
of two things but it doesn't cause Kaposi sarcoma I think but it does cause immunodeficiency it was designed to do
1:06:02
that it was designed to kill human cells in fact the manufacturer says that specifically that it can cause it's like
1:06:10
diseases the manufacturer that is both welcome says it is often difficult to
1:06:15
distinguish adverse events possibly associated with cedarwood in Anza dovey
1:06:22
Dean Administration which is a CT from underlying signs of HIV disease in other
1:06:28
words even they acknowledge not just respect that CDV that AZT causes AIDS or
1:06:34
inste finding diseases in his book poison by prescription journalist John
1:06:40
Lorenson explains how AZ tests conducted by the FDA and Berle's welcome the manufacturer were
1:06:46
scientifically sloppy and outright fraudulent during the experiments patients taking AZT became anemic
1:06:53
suffered low white blood cell counts accompanied by vomiting over half had to
1:06:58
have blood transfusions 20% were transfused several times though both
1:07:03
doctors and patients were not supposed to know who was getting AZT and who was getting the placebo it became obvious
1:07:09
halfway through the test who was on AZT out of fear and desperation many of
1:07:14
those being tested traded drugs the test was terminated early and because of what appeared to be benefits from using AZT
1:07:21
the patients who were taking the placebo were now also given AZT this made
1:07:26
long-term follow-up of AZT toxic effects impossible despite a
1:07:32
warning by FDA toxicology analyst Harvey Chernov that AZT not be approved the FDA
1:07:37
was pressured by AIDS activist organizations to lift the ban and hundreds of thousands of people began
1:07:43
taking AZT even though AZT can not cure AIDS and is only supposed to slow down
1:07:49
the progression but the logic behind AZT treatment is flawed even if one believes
1:07:54
HIV causes AIDS because HIV only infects about one t-cell in 1999 healthy t-cells
1:08:02
must die to kill the one cell that is infected and this can only happen early on before HIV becomes dormant and is
1:08:09
still making DNA yet AIDS patients are given AZT for months on into years
1:08:15
randomly destroying DNA in all parts of t

all right uh if you are just joining us
0:19
right now you are looking live inside Fulton County Superior Court um where we are awaiting a hearing to
0:27
begin at any moment now um this is surrounding the massive
0:32
Georgia election meddling case in which the former president Donald Trump
0:38
um and 18 other co-defendants are charged with racketeering and a number
0:43
of other charges there you can see judge McAfee approaching the bench sitting
0:49
down there um sorry I'm working the let me try to get us some audio inside
0:54
the courtroom yes Mr grubman have you received express
1:01
permission from your client to waive his presence good morning your honor and yes we have all right Mr Rafferty yes your
1:06
honor good morning good morning so we have three motions teed up for
1:13
this morning and why don't we Dive Right In uh beginning with the motion to speak
1:20
with the grand jurors joined by Miss Powell that's
1:25
um just as a preliminary matter um the state intends to comply with all
1:32
of its legal and ethical obligations to turn over the uh the co-conspirator information
1:38
um with with with just the understanding that the reason the reason why the the
1:45
names of the co-defendants are not already in the indictment judge is that
1:50
it's it's um of course a frowned upon putting putting the individuals names if
1:56
they're not charged within the charging document we'll turn those over to the
2:02
court with uh what a request that that the court hold them uh under a
2:07
protective order so to speak to protect the identities of those individuals or to control I guess the public impact of
2:16
the names that are on that list all right so it sounds like you want to skip to number three the motion to
2:21
disclose the co-conspirators well just to do away with right kind of streamline
2:27
all right let's start with that one it might be the easiest to get into so uh let me make sure I'm understanding what
2:34
I'm hearing So you you're you're wanting to you you are willing to
2:40
go ahead and just give this list to the defense counsel and formally through the discovery
2:46
process I'd like to present it to the court okay the court can then distribute it to the defense Council as it sees fit
2:53
but it's it's the state's position that um because the practice of naming the
2:59
codependent the other the unindicted codependence or co-conspirators in the
3:04
indictment has been criticized the state is elected to do it this way in order to protect those individuals and those
3:11
names that are uh on this list so I'm tracking you completely there and I agree I think that's the standard
3:17
practice I I just I'm curious why I would be the the middleman it seems like we could take the folder and just give
3:23
it right to the defendants I think that would be the regular thing to do well I mean the court could impose a protective
3:28
order that all of the parties to this case are subject to about disclosure of Discovery to the media if that is the
3:35
concern of the government but we have a trial on October 23rd they have the list of co-conspirators they're consenting to
3:41
the motion why don't they just give us that information correctly sure I think we're all about to reach the same place
3:48
so uh the bottom line is it seems like this is a fairly straightforward request I think federally would be a bill of
3:54
particulars and those are fairly routinely approved so we can I can file an order if you want
4:02
me to but otherwise we'll say that the list of individuals 1 through 30 is
4:08
going to be disclosed to not only I would think these two defendants but uh the other 17 defendants through the
4:15
discovery process and obviously right now so in terms of a protective order if the
4:21
state's requesting one and the defense is not objecting we can certainly do that as well but otherwise it seems like
4:26
this is just a fairly routine part of the discovery we'll just look at the language of the protective order obviously uh any protective order of not
4:33
disseminating Discovery or information to the media would have to work both ways the state would also have to agree with that but we have the list now so
4:41
all right I was just about to say that so I'll go ahead and just enter a one sentence
4:46
order saying the motion is is Moot and presumably this list is numbered so it
4:52
can identify which count refers to which unindited conspirator and that sort of thing right yes sir all right and and
4:58
further just to streamland the today's arguments
5:04
more so the state does plan or intend to turn over the
5:11
transcript of Mr Chili's testimony given that he's charged in count 41 in the
5:17
indictment with perjury and that testimony is an integral part of
5:22
proving up our case okay so now we're moving on to number two the motion unseal the special grand jury
5:28
transcripts as do we think we've addressed everything we need to cover with the undynical conspirators all right
5:35
anything else Mr Rafa do you think we need to take up on that one all right thank you sir all right then uh let's
5:41
move on to number two so obviously it looks like the idea of the entire report
5:47
itself has been taken care of but the motion goes a bit further than that Mr Wade and it says that they should they
5:53
want to be able to inspect the entire transcript assuming there was one I don't know and any recordings and
5:59
essentially anything that the special grand jury produced so
6:06
let me just give kind of let me get your obviously I'll let the defense present their motion but let me first start with
6:11
where the state is in terms of what you think of that is disclosable and discoverable
6:18
if if we're if the state's following its standard open file policy just just
6:23
maybe give me a bit of a background about that and what you think is fair game here yes sir basically just this
6:29
state would contend that any transcripts any and all transcripts that uh have
6:35
been produced uh by the grand jury or the special purpose grand jury are not
6:40
discovered um and that defense counsel should not have access to them
6:46
I know that the court wants to hear further argument and that has this opportunity to put their their
6:52
case on but that's our position with the sole exception being Mr Chili's giving give him that Mr chili is directly
6:59
charged in count 41 of the indictment that's the exception and and what if some of these witnesses that testified
7:06
you call as a witness at trial so judge then we rely on actually the discovery
7:12
statute it talks about that um we would say that at that point when
7:19
the state has made the decision to call one of the witnesses that is
7:25
testified before the grand jury at that point the transcript becomes relevant and you turn it over
7:33
all right so we may have to talk some Logistics but we'll see where we end up so uh Mr grubman or Mr Roy uh your
7:39
motion you're on our way just take exception
7:45
with doing what they call Jenks material in federal court where they gave it to you at the last second because we have to craft a defense based on people and
7:51
then that's and that's what I was getting to Okay so if we look at the litigation that
7:57
happened before the special graduates
8:02
2022-ex-00024 I'd like to adopt the brief that was filed by the media companies asking for the release of all
8:08
these transcripts because they've got a lot of law that I've cited so we don't have to sort of go through all of it
8:13
um ocga 1512-101 lists out the requirements that a special brand jury needs to do
8:19
and that requirement includes interim reports that have to be presented to the judge as far as what their work is going
8:25
on I didn't know if there were transcripts but apparently there are in this case as what the prosecutionist says we know
8:32
that based on the report that was released there are 75 witnesses that testified before the grand jury which
8:38
I'm imagining were all recorded they've already told this court they're going to have 150 Witnesses so whether they
8:44
choose to call those Witnesses or not I'm entitled those transcripts to decide if we want to call them if there's an
8:50
impeachment material out there inconsistent statements or in fact exculpatory material that might have
8:55
been said by any of these people so I think we have an absolute right on the Discovery statute they have to present all the information from their case in
9:01
Chief to us as ordered by your scheduling order and there's no protection that's out there we then go
9:07
to 15-12-80 that gives you the criteria for publishing the special grand jury report
9:12
I've also cited the cases that talk about the secrecy issue sort of goes away hence the I think the four person
9:19
of the special grand jury went to the press and made all kinds of statements about these issues Olson versus state is
9:25
probably the seminal case that's 302 Georgia 288 2017 case and then I also
9:31
cited the in-ray Gwinnett County Special grand jury case that also required allowed for disclosure and said that
9:37
secrecy doesn't apply after they finish that site is in my brief as well your honor I would further
9:43
go back about 70 years and go to Dennis versus United States in the United States Supreme Court 86 Supreme Court
9:50
one eight four zero it's a 1966 case that also talks about requirements for
9:55
disclosure for grand jury transcripts in every federal case grand jury transcripts are made available to the defense they just have a different
10:01
statute as to when that Jenks material has to be released but it's not every transcript it's simply going to be the
10:07
witness that's called the witness Spirit you're asking for everything I don't know what exactly they recorded
10:14
So if they're talking about Witnesses that's fine but as your honor knows the grand jury is one-way traffic there's no
10:20
the D.A controls the information that's presented then so I don't know what it is they're giving them what it is
10:25
they're not giving them when we challenge the validity of the indictment which I've done in a separate brief as far as that goes so I would like
10:31
everything but at a minimum I think the law requires the witness statements whether they choose to use them or not doesn't
10:38
avoid the responsibility to given to us maybe I want to use it I'd like to know who those 75 people were that testified
10:44
under oath in front of that grand jury aside from Mr Chile as they've identified I don't think there's any way
10:49
really around that I think the law supports us and whether it's a protective order non-protective order
10:54
that's their choice we don't plan on sharing anything with the Press but we need it and our client
11:00
needs it to actually prepare for this case so I think the code sections the
11:05
case law even the Supreme Court case law and just frankly fundamental fairness requires
11:11
that those transcripts at a minimum that Witnesses be turned over but I think I would be allowed to have all of it
11:16
because if we're going to challenge the validity of the indictment based on what the grand jurors are presented I think we have a good faith basis to ask for
11:22
that what what what code section are you referring to that you think entitles you to all of it
11:28
um the way again I'm no expert in special grand juries I haven't prosecuted one when I was a prosecutor
11:34
as far as that goes but I'm looking at 15 1280 that generally talks about publishing and a lot of that was
11:39
discussed with judge McBurney with regards to the case site I gave you as far as a special grand jury so a lot
11:45
more law is there so I didn't want to you know just burn trees down if it's already been argued out there so I just
11:50
highlighted the two statutes and essentially three cases that talk about the secrecies
11:56
if not negligible much much lower as far as that goes once the special grand jury is ruled or made the recommendations
12:07
okay Mr Orr Mr Rafferty I think you joined this one did you not I did your honor and and I would join in all the
12:13
arguments that Mr Aurora has made well actually I think maybe you formally didn't own the record but if you went to
12:19
orally now okay and the only thing I would add and Echo for Mr Aurora are the due process concerns that he's raised uh
12:26
the government has said they'll turn them over but only turn them over after they call witnesses that smack the gamesmanship uh and it would not be the
12:33
efficient way to try this case uh there is no real reason for the government they have to disclose their witnesses to
12:39
not disclose the transcripts of any witnesses that testified before that special purpose grand jury that is going
12:45
to testify at the trial moreover and and I'll raise this at a later point in this hearing today I do have some very grave
12:51
concerns about the government's compliance with their Brady obligations I have already submitted two Brady requests I have not gotten even a
12:57
response I'd like the opportunity to raise that later but I believe that there could be Brady information that is
13:03
in those transcripts that they are obligated to turn over independent of any statutory Discovery obligations
13:11
all right Mr Wade yes sir
13:24
because I think we have started to put the the cart before the
13:30
horse so to speak let's start with the premise that that uh long-standing and
13:36
unquestionable Authority indicates that grand jury materials including transcription records are not available
13:42
to criminal defendants because Grandeur proceedings are considered to be confidential and the state is relying
13:49
upon thinks stinsky V State there and I have a copy here for the port and
13:58
and Council if I might approach that
14:11
thank you
14:21
so this this thinsky case along with the Ruffin and The Isaacs case judge stands
14:28
for the very same proposition which is they're not not
14:37
let's go hmm
14:48
do you think there's any distinction here between these cases that are going to talk about grand jury proceedings and
14:55
this having been a special grand jury that they're asking for and why not
15:01
well practical purpose is just it's the same function with the exception of the charging element the special purpose
15:07
grand jury is an investigative tool investigated jury does not make charging decisions but
15:16
can make recommendations um a regular grand jury obviously passes
15:22
down the indictment so um but I think I think Mr Aurora's argument is that there's a particular statute
15:29
that only applies to special grand juries that might impact that there's not okay what is that statute well he
15:37
cited uh 15 12 8 I think it was 15 80 excuse me
15:47
grand juries and their deliberations well I think that I mean I think that's the question I just put to them so let's see where where we go there's a
15:53
difference 15 1283 did I think it was just 80.
15:59
that's a disclosure statue
16:09
there is no distinction just the case law is the same I think that the the
16:15
particularly the the Olsen case that the that defense counselor is relying upon is is not even a case that considered uh
16:23
uh turning over information that that Olsen case um essentially it it merely considered
16:30
which employees of this attorney can be of a disk attorney's office that can be present uh I agree with you there I
16:36
think Olsen goes more towards what we're going to get to about whether they can speak to Grand jurors and what about I I
16:42
think and we can we can if you need to do a separate little brief we can do that but
16:48
the issue is because we don't see them as often whether special purpose grand juries have some different degree of
16:54
secrecy than a regular grand jury such that we can't just reflexively look at this case law and say all right not a
16:59
hard call so judge I think that the the the the application is the same the analysis is
17:06
the same um why is there a distinction between the special purpose grand jury versus
17:12
the the regular grand jury the law is clear on on the defense Council not
17:17
being able to get the transcripts or any or anything that demonstrates uh that
17:22
comes out of the uh grand jury process the special purpose grand jury or the regular grand jury process does
17:29
um and that's the the stensky case the roughest case in the Isaac's case but I like to to point uh direct the Court's
17:36
attention to the fact that there's no Authority that demonstrates any defendant is entitled to these strands
17:41
these grand jury transcripts um of course disfavor the release of uh
17:48
the these transcripts defenses pointed to not no overriding Factor
17:53
um that would override the policy favoring the secrecy of grand series and that is that is the guiding principle
17:59
judges the secrecy of the grand jury the Supreme Court says that the grand jury is a public institution serving
18:05
community that might suffer if those testifying today knew that the secrecy of their testimony would be lifted
18:11
tomorrow this indispensable secret this indispensable secrecy of grand jury proceedings must not
18:17
not be broken except where there is a compelling necessity they have to show
18:22
what that compelling necessity is Judge um and the Kessler case along along with
18:29
the other cases that the state has just given um support that proposition but also the
18:36
the Supreme Court in in the Anderson case does as well
18:41
um now let's talk about the the Supreme Court because they've identified five five factors such
18:48
um that that are present in the in the Douglas oil case that
19:02
that we'd like to address
19:09
first if the pre-indicted proceedings were made public
19:14
many prospective Witnesses would be hesitant to come forward and voluntarily knowingly and those against whom they
19:21
testify will be aware of their testimony that's the first thing second Factor against
19:29
releasing the information is Witnesses who appeared before the grand jury would be less likely to testify fully and
19:35
frankly as they will be open to retribution and also to inducements
19:41
which we've seen a little bit of in this case third
19:46
there also would be the risk that those about to be indicted would flee
19:52
or fourth would try to influence individual Grand jurors to vote against
19:57
indictment five and finally by preserving the
20:02
secrecy of the proceedings we assume the persons who are accused but exonerated by the grand jury will not be held up to
20:10
public ridicule those are factors judged that the court should consider in
20:16
determining whether or not the
20:21
grand jury secrecy provision has been overridden by by council's arguments
20:28
um we don't believe judge that the defense has relied on any case that
20:35
would override those factors but moreover
20:40
foreign ers
20:48
that would assist upon them in their in their Reliance judge um
20:55
they did cite to the Henry Gwinnett County case judge
21:01
um and and even in that case the requirement that secrecy be maintained
21:06
among all types of grand juries without distinction and that's in the inry and
21:12
I've for a copy of that case
21:27
I apologize judge I didn't I didn't bring the court a copy of that Henry Gwinnett County grand jury case but
21:32
that's the case that Council relied upon and cited in its uh in its brief and and
21:38
even in his argument today but that case uh is found at 284 Georgia 510
21:45
and it stands for the proposition that the requirement that secrecy be maintained among all types it says all
21:54
types of grand juries without distinction so again the state would submit to the
22:01
court that there's no difference so I you know obviously I'll take a
22:06
closer look at all the cases you've given me and I think just as an initial reaction your your
22:14
probably right when it goes to saying everything should be turned over but I want to drill down a little bit more on
22:21
the witnesses who maybe at this point already you know that you're going to call
22:27
in November right I think that's the whole point of our scheduling order here and what we try to
22:33
do is that we need to use our trial days efficiently and use our jurors time
22:39
efficiently and I would imagine that the state is going to have an order of proof
22:46
going into this trial with a with a list of witnesses and if though if there are witnesses that are on there the idea of
22:54
waiting until the minute before they're called and then we've got to now pause the
22:59
trial for an hour or two while then they're reading the transcript I don't think we can do that would you agree I
23:04
agree and I and I understand that judge in the state wasn't intended to convey that it was that it would
23:11
um hold on to a particular Witnesses transcript until the eve of trial
23:17
um we're still obviously going through um receiving the transcripts as we don't
23:23
even have every one of the transcripts um and so we're still going through that process as well but I I don't think that
23:31
the court has made an unreasonable uh suggestion that that the state not
23:36
essentially implied that the state would not hold on to the transcription to the
23:41
11th hour that's that's not our our plan and that's not how we so so I would
23:47
think at a bare minimum and maybe we can talk about whether we have to move that timeline at all but your your witness
23:53
list is going to be due 10 days beforehand yes sir and so in conjunction with that I would think that any witness
23:58
on there who has a transcript that that needs to be either expedited or rushed and also provided at that same
24:05
time and if the issue comes up that
24:12
well we didn't put a witness on that 10-day list but now we think we need to call them unless it's for a rebuttal or
24:19
some new issue that's come up during trial I'm going to be looking at that and really wondering if if you know a
24:26
good faith effort has been made to to turn everything over so I think
24:31
I I think that's that's not only what defense counsel was uh referring to but
24:37
I think that's the way what we have to do to proceed efficiently at trial yes sir yes sir and and there's no argument
24:43
or disagreement I think that the court is being reasonable there um but while we're talking about that Discovery
24:49
um we believe that we're still in line with the Court's uh scheduling order as
24:56
it relates to Discovery so Council standing yeah well and we can we'll talk about that then let's get through the
25:01
motions first let me get more into Discovery but you know generally I would think this case is obviously different
25:08
but um the state's open file policy traditionally has been here's everything
25:13
we have unless there's some kind of state secret or a confidential informant or something along those lines yes sir
25:19
and you have everything that we have and here we go yes sir so I don't know if
25:24
that's going to be the spirit that we proceed with here it might streamline things somewhat and it I would uh we'll
25:30
see where we where it goes any thoughts or reactions to that oh it is a spirit just the district attorney has been
25:35
clear in our instruction we are to make information available to them as it becomes available to us
25:41
um we are here prepared today to turn over uh portions of the discovery
25:47
um to the the two defendants that are going to proceed with trial on the 23rd
25:53
obviously we plan to supplement that Discovery as we go along and as we receive the information but we've made a
26:01
good faith effort in complying and being reasonable and working with defense
26:07
counsel and we'll continue to do that all right and when it comes to supplementing supplementing it I would think that's going to be confined to new
26:13
discovery yes stuff you don't have right now right now so I think for purposes of
26:20
motion the motion uh let's see to unseal uh I'll I'll take it under advisement as
26:25
it concerns the entirety of the record or anything that happened there uh but
26:30
as an initial thought at a minimum it's going to be granted in part as to any Witnesses the state plans to disclose
26:37
yes sir all right anything else Mr Happy comments sure
26:44
um we decided to a Supreme Court case Douglas oil versus petrol stops Northwest the Supreme Court case it
26:50
cites to rule 6E of the federal rules of criminal procedure the problem with that case your honor and the Casey cited is
26:56
it has to do with the use of grand jury transcripts in a civil proceeding which I know your honor knows grand jury
27:02
transcripts in the federal courts as part of a criminal investigation can't just be turned over in civil cases
27:08
and so the Casey sites has to do with whether or not and under one circumstances grand jury transcripts
27:14
from a criminal investigation that results in an indictment can be used by civil practitioners in a civil case that
27:21
has nothing to do with this case and the point I'm making with this your honor is this um the government has now cited to a
27:28
case that really has nothing to do with this they come to court here today they don't respond to the Motions in writing they drop some motions on defense
27:34
counsel or some cases I should say they don't put anything in writing and they just say things to your honor and that's
27:40
a troubling practice for me as somebody who practices mostly in federal court this is a serious case I think you have
27:46
to realize I think that might be the standard practice in this building I understand that Robert but I look behind me and I see eight eight folks here on
27:53
the government side we're talking about a case that is unique to say the least
27:58
involving allegations related to the supremacy cross First Amendment rights
28:03
all kinds of things defense counsel are writing motions I think we're at least entitled to a written response from the
28:10
government citing these cases so that we have an opportunity to inspect them because otherwise what happens is the
28:17
government comes in cites to a case that has no application whatsoever and suggests to your honor that it is
28:23
precedent on that governs the disclosure of injury transcripts when it does not and so my concern my request is that and
28:31
I I filed a motion last night where I specifically asked the court to order the government to respond in writing so
28:38
that we have a chance to look at these cases before we come to court here today
28:43
that's my request so Mr Raffia uh I think that obviously some of this going
28:49
back and forth will be touch and go but I think what we we could easily do today and and going forward as well not every
28:56
motion may require that but we can always say if if a party wants postering briefing we'll do that I I'm not
29:02
intending to to rule from the bench on these on a lot of these complicated issues I mean I've handed a stack of
29:07
cases and I'm going to read them and and we're going to have time to get through it it's going to be an expedited timeline and but I'm certainly going to
29:13
give you the opportunity to respond I appreciate that your honor but my I guess my point is and I think my Council uh here would join me in that you know
29:20
this process would go a lot quicker if the District Attorney's office with their team of lawyers would write a
29:26
brief that cites to the same cases that they're bringing to court every day so that we have an opportunity before we
29:31
come before your honor to look at those cases and question whether or not what those cases say supports what they're
29:38
claiming and if they don't be prepared to address it so that we can move this along as opposed to us having to go back
29:44
after today research the cases then write a post hearing brief point out to the judge that what the government is
29:50
saying is not actually true so that is one of the benefits respectfully or honor of requiring the government to put
29:57
it in writing all right understood so just briefly in
30:03
response to Mr Rafferty's um argument um he did in fact
30:09
um we would say at the 11th Hour foul a motion requesting that the state
30:14
um respond in writing the state has done that um I don't know if Mr Rafferty has had the opportunity to check his filings but
30:21
the state has done that this morning um is this is this for this particular motion no okay
30:27
um and you know obviously I think we're also one of the logistical challenges we're dealing with the case is that you
30:33
you file something and it's taking hours for it to post the docket so we're just gonna have to recognize that and I think
30:39
that's why we I would say emailing a courtesy copy is going to be the way to go yes sir so this morning the state is
30:46
filed it um it does cite to the then speak about the cases that the state is uh excited
30:52
to this morning and provided copies all right so Mr Raffia and Mr Roy obviously you want a chance to respond to this and
30:58
and review it so we're not ruling on this today and we can and take the time to allow you to do that just perfect the
31:03
record on a couple of things with this special Branch here if that's okay sure sure
31:08
so again I'm citing back to judgment Bernie's order as well as the issues on the
31:14
special grand jury case and when you look at 15 1280 they specifically said
31:20
it's different from a regular grand jury because they make recommendations as to should we release this report or not
31:26
release the report and they vote on it there's all kinds of discrepancies that aren't the same as a criminal grand jury
31:32
which is what we've got here now I take exception to the courts I know you made a comment that if they're going to call
31:37
a witness they have to turn it over in a certain time I get what about all the other Witnesses they don't plan on calling they may be Witnesses for me
31:44
1716-4 should Trump all that because that's the discovery statute that says any witness they've talked to has made a
31:50
written statement has to be turned over that's where the due process is they don't get to pick and choose what Witnesses we get to see or not see I
31:57
might want some of them and if we wait I guess your order says disclose everything by the 20th of September so
32:03
I'm assuming we'll get a big batch of Discovery have been told up to eight terabytes by the 20th I need to be able
32:09
to review it to figure out what my defense necessarily is going to be versus doing it on the fly like we do in federal court and we don't have trial by
32:15
Ambush that's why I appreciate we're here in the discovery statutes are strong so that's my point to you and I would
32:21
also go ahead and cite the Olsen again which is the most recent case that specifically says notably the oath of
32:28
secrecy no longer extends to the state's attorney and even the grand jurors oath encompasses only deliberations and not
32:34
all things occurring in the Grand Jury Room so at least for the special grand jury participe from the second brief
32:39
that we've got we should be able to get everything that happens in there aside from arguably deliberations but at a
32:46
minimum at least the 75 Witnesses or whatever else that they presented so I would say that your honor said at least
32:52
what they're going to use I think that's not correct enough it should be everything thank you all right uh like I
32:57
said I'll take a look at it I also just a passing thought as well when it comes to Brady concerns I think we could also
33:05
utilize a mechanism where maybe they have to in camera give me the entire transcript and so if during the trial
33:11
something comes up that we think uh as Brady material or should have been disclosed we can we can pause things and
33:18
and correct it from there and on that point you're on with respective Brady as I said I'd like to talk about it in a bit but I would just remind defense the
33:26
government Council here that uh Brady is in the high the eyes of the beholder what I consider to be Brady material is
33:31
what matters what the DA's office considers to be Brady material does not if I contend it's Brady material I'd ask
33:37
the court to inspect it and see if it does fit with one I claim if it does I'm entitled to it I understand okay let's
33:44
move on obviously because and we may need to come back to this one uh at another hearing uh depending on how we
33:50
go how it goes so the last motion that we had scheduled for today is the motion
33:56
to speak with the grand jurors Mr Roman it looks like this one's yours this one's mine judge and good morning again
34:03
um for this motion I want to begin with the indisputable proposition that I'm sure
34:10
my colleagues on the Stateside will agree with of course that Mr chesborough and also Miss Powell although obviously
34:17
I don't speak for her have the right under Georgia law to be charged only by way of a grand jury that is a key tool
34:25
as we all know to prevent prosecutorial overreach I would argue it's one of the most important Provisions in both
34:31
federal and state law um so that's clear we don't have to I don't think argue that point so then I
34:38
think your honor the question becomes if you accept that premise what does that right mean what does that right entail
34:46
so if for example a prosecutor simply gets up and summarizes to a grand jury a
34:52
lengthy indictment as opposed to allowing the grand jurors to read it and
34:58
understand it independent of the prosecutor is that indictment valid under Georgia law
35:03
to be quite clear your honor their the case law is kind of sparse we would
35:09
argue that the answer is no thankfully we don't have to argue that case right now but the reason we would argue if
35:16
that were the case the answer is no is because the law is clear the grand jury must act independently of the
35:22
prosecution I'll be quite Frank your honor and this is not I want to make clear not in any
35:28
way um negative against these lady and gentlemen who sit here at this table but
35:34
just generally I have very serious questions very serious questions based on publicly available information which
35:40
unfortunately is all we have to go on that this grand jury as well as the
35:46
special purpose grand jury was independent but we don't know that that's the problem we don't know that
35:53
and in order for us to find out the answer which clearly we're entitled to find out we have to be able to access
36:00
information your honor I do very much appreciate the
36:06
fact that uh Mr Wade stood up here and said the spirit of openness applies to
36:13
this case and I truly hope that from the moment Mr Wade said that forward that's
36:18
what happens I wouldn't be doing my job your honor if I didn't tell you for the record I
36:24
personally do not believe that that has been the spirit of the state of Georgia in this particular case
36:31
I think quite the opposite your honor that every time we file a motion or ask
36:38
simply for access to the same information that the folks on the state
36:44
side have where it's responded to and said no we can't do that I know there's
36:50
a discovery deadline that's I think in a couple of days I understand that
36:55
quite frankly your honor we turned over this uh they asked they this is exactly
37:01
what happened the state said Mr grubman Mr Aurora we have your Discovery all you
37:07
have to do is give us an eight terabyte hard drive that day literally probably within two
37:14
hours we were down here with the hard drive follow-up email where's our Discovery
37:20
where's our Discovery where's our Discovery there is no we haven't gotten the discovery and your honor I'm not
37:26
saying they violated the Court's order because that deadline hasn't come but if we're really being open and if we're
37:32
really gonna talk about the spirit of openness I really hope that starts here
37:38
and this is just another Avenue our request to speak to the Grand jurors to
37:44
allow us to have the same information that the state has now your honor we
37:50
went back and forth internally to be honest with you about even filing this motion not because we don't want to talk
37:56
to the Grand jurors but with all respect to the court and to the state we quite frankly didn't think we were required to
38:03
necessarily ask the court for permission as you know judge grand jury secrecy
38:09
with all due respect from Mr Wade citing all those cases that predated the Olsen
38:16
case it doesn't exist except for deliberations it does not the Supreme
38:21
Court and state the Olsen was absolutely positively clear as Mr Aurora stated
38:28
there is no grand jury secrecy here in the state of Georgia there is grand jury
38:34
secrecy in the federal courts as you're on her nose that does not apply here prior to us there were certain
38:41
legislative changes and there was a time my understanding is in the state of Georgia where there was similar rules as
38:47
to federal court and that is no longer the case so there's no secrecy now there is confidentiality of course and Main
38:56
the only part that's truly secret and confidential is the deliberations and I
39:02
want to make sure it's clear that we are not asking to speak to the Grand jurors about out their deliberations we will
39:09
not do that we're officers of the Court we know we can't we won't do it now
39:14
Mr um Wade laid out certain factors of the
39:20
purposes of grand jury confidentiality I think he named five but the Olsen case names four I'm sure there's different
39:26
formulations so I'm just going to go through four again prospective jurors would be hesitant to come testify
39:34
actual Witnesses would be less likely to testify fully and frankly if the grand jury was open to others
39:41
the Supreme Court said there was a risk that those that were indicted would flee or would try to influence the grand jury
39:48
against returning indictment if the grand jury was open and fourth it was
39:53
ensuring that those accused but exonerated by the grand jury apparently that happens from time to time wouldn't
40:00
be subject to public ridicule your honor I would submit to you that none of those
40:06
purposes apply here none of those purposes in fact even apply after a grand jury issues an
40:13
indictment let me let me jump in and haven't read the Olsen case up to today and I think there was one Colin that
40:20
really predates it yes and in column they've got the defense calling a grand jury witness to talk through some of
40:26
these issues of who can be present during deliberations who can be present during the presentation of evidence and and so it seems to me uh that I agree
40:33
with you that you have a right to talk to Grand Jury Witnesses what about we'll get to but
40:40
and I'll say it on the front end I I appreciate you filing it this way because these Grand jurors have been through a lot yes and I think we need to
40:47
recognize that and craft a remedy here that recognizes that so
40:54
my initial reaction just to lay it out there is that yes I think you have the right to speak with grand jurors how that happens I
41:01
think we can discuss or craft I think maybe I don't even know if you can have their contact information I've heard
41:07
that it maybe already be out there but I think that might have to be something that is facilitated in hand with the with the
41:14
state it also has to be something that's voluntary on that part on their part but then the question
41:20
turns to to what end are we are we doing it and I think that as you alluded to if
41:26
the inquiry is to determine did they act independently all right but the standard you're laying out here that they have to
41:32
where I then start you know drawing kind of pausing is this
41:38
this standard or this Benchmark that they have to have affirmatively read every word of the indictment and that's
41:44
where I wonder if this might not be uh they're not there might not be a point in going
41:50
down that road if you have some other reason you you want to explore then then so be it but this idea that we have to
41:55
show example your honor first I I wouldn't necessarily say every word and if I did say that I apologize but what I
42:02
do think um we would have a valid argument on and obviously at the right time the court would is that if it was simply
42:09
summarized your honor please understand and I hope everyone understands all the
42:14
information that we have is the stuff that these folks print in their papers we don't know so I'm not saying I am not
42:22
saying that that's what happened in this case let's even let's even play in that
42:27
sandbox a little bit let's say it was just summarize and again we're just previewing the arguments to see if this is even worth getting into later
42:33
at a trial a jury could come back with a 15-minute verdict and there'd have been
42:38
no way that they could have read a lengthy indictment or even looked at every exhibit and there's there's no inspection or remedy for that
42:45
so why why would the grand jury where'd this rule come from well the the there's it's not like there's a rule in
42:51
the statues but what there is is there's a rule there's a theme in the case law and we cite many cases and I'm sure we
42:58
could cite a lot of other cases that the grand jury must be independent now what
43:03
is that that's why I start with asking what did that mean does it mean that they have to read every single word I
43:09
don't know your honor and if that issue comes before the court we will brief that issue and we'll figure it out
43:15
however I would argue that if the grant if the state of
43:20
Georgia in this particular case presented their case to the grand jury
43:26
in one day which I can't say for sure
43:31
but based on the publicly available information that's a possibility
43:36
it would cause my eyebrows to go up a lot and I'm not alone judge Cho flat in
43:43
the United States V Sigma International now that case has been vacated it's not
43:49
president presidential uh yeah that's the right word um but that being said the dicta still
43:57
applies but it didn't that case didn't have so much to do with any method of how the jurors reviewed
44:03
the indictment I think they were citing the transcript of the ausa essentially steering them exactly where to go and
44:09
and your honor the thing is that may have happened here I don't know and I hear you there at the just my
44:15
point being is that just a summarizing an indictment to me um
44:21
you know for for example if we know the deliberations we can't go into that that's protected
44:27
how would you ever ask the question of whether another Grandeur read the indictment to everybody else during the liberations I don't even think you're
44:33
gonna be able to answer your own question I respectfully disagree your honor and we could
44:39
um craft some questions obviously we would have to think of the language but what I think we want to know is
44:45
Mr Mrs grandeur when the evidence was being presented to you
44:52
did you have the opportunity to ask questions did you have the opportunity to follow up judge tro flat said and
44:59
this is dicta but we rely on dicta all the time as as at least persuasive
45:04
so too would we dismiss an indictment that was issued by a kangaroo grand jury
45:10
quote unquote one whose the liberations were so overborn by a prosecutor or judge that the indictment was in effect
45:16
the prosecutor or judge's handiwork and not the result of considered judgment by an independently functioning grand jury
45:22
now while we can't ask the grand jurors what exactly happened in the deliberations what I think we absolutely
45:28
can ask and we will ask I will put this on the record is was there anyone other
45:33
than the grand jurors in the deliberations and that I think is what the other case that we cite Collins
45:40
stands for the proposition but your honor we simply want information I would
45:46
the reason we filed this brief this motion is to be above board and make
45:52
sure that everything was out there in the open however I would respectfully push back your honor we would not we
45:59
would not agree obviously Court could order anything they want for any member of the prosecution to be part of those
46:05
conversations we are officers of the Court we know the rules we will follow the orders I would also ask the court to
46:13
state or I would ask the prosecution to State on the record and commit I'm not saying that they're going to do this but
46:18
I have seen other prosecutors do this that the if the court grants this motion they will not attempt to influence the
46:26
grandeur's decision of whether or not they talk to us we of course know it's voluntary we would never once the
46:32
Grandeur said I don't want to talk to you we're going to hang up I can promise you that whether it's us or our
46:37
representative but I think there's a risk here that someone from the state might try to get to them first and that
46:44
would be inappropriate what if the Grandeur once a prosecutor to just be on the call listening as well if the
46:50
Grandeur wants a prosecutor to be on a call then I mean if they proactively say
46:55
that we can we can see where it is but they're not inviting us into art into
47:01
their prep you know they're not inviting us I've never got an invitation to help them draft the motion or to talk to them
47:08
sit in their conference room and they don't have the right to be with us if they want to talk to the Grand jurors they've always been able to talk to
47:15
Grand jurors they have talked to the Grand jurors but I like Mr Wade a lot but I don't want him on that phone call
47:20
because he's my adversary and quite frankly I think that if think about this
47:25
your honor if hypothetically there was something that happened in the grand
47:31
jury that wasn't appropriate the fact that a member of the prosecution was on this call I think would prevent or at
47:39
least make it less likely that a grand juror would be honest with us what if a grand juror felt felt and I'm not saying
47:44
this is true but what if a grand juror felt that they were bullied by the state into Prosecuting what if a grand juror
47:51
felt that the state you know went a little overboard well if Mr Wade was on the phone I don't think they're going to
47:56
admit that to me so as an officer of the Court your honor I think the court with all due respect just needs to be able to
48:04
trust Council that we will do the right thing and I could commit 100 that we will these Grand jurors you're
48:09
absolutely right have been through a lot they sacrificed a lot we are not that you know there's been doxing and all
48:15
sorts of things we are professionals we are not those people uh What uh how
48:21
would you or would you be planning to document this in somewhere would you be recording these calls did you have a
48:27
court reporter what would be the plan I believe there would be some so we haven't talked exactly about the logistics but there would be some sort
48:33
of recording whether it's a court reporter just a good old you know uh
48:39
iPhone recorder or whatever it is and we would tell the grand jurors that you know even though you're not required to
48:45
do so in the state of Georgia I would be much inclined to tell the grand jurors hey look we're recording this it's you
48:51
know just so there's no question of what was asked obviously judge the last thing I want to happen is for anyone to
48:57
incorrectly accuse me or someone on my team of going past what we're allowed to ask so for my own sake we'll definitely
49:04
have some sort of recording um you know unlike the state of Georgia as Mr Rafferty said they have about 15
49:10
lawyers a bunch of uh investigators and basically an unlimited budget paid for by the good taxpayers of Fulton County
49:18
myself included we don't I want to be clear despite what the media may have said we don't have an unlimited budget
49:24
so whether we could ask a court reporter to be there unless the court would volunteer uh your court reporter I don't
49:30
know that we can afford that quite frankly but we will certainly record it all right so essentially what I'm
49:36
hearing is uh what you'd be asking before is that we'd propose the if not the exact
49:43
questions but the subject matter very carefully phrased in advance this would be a voluntary meeting it would be
49:48
documented in some way and even if it's if the state is not on the call I think
49:54
that we could even we could also have someone from the court there as well just at any point if the juror feels
50:00
like they need to kind of pull the rip cord yes your honor um all right but otherwise I don't think
50:06
there's much Point going into the the merits of the motion because we're just a bit premature so so that's the initial
50:13
reaction uh Mr Wade oh sorry Mr Raffi you joined this one excuse me I did join the motion your honor the only other
50:18
point I would make I joined Mr grubman's arguments is the possibility that these interviews not be conducted in uh by
50:25
phone at all that perhaps they can be conducted in person and there could be accommodations made I would think with
50:30
with the state and with the defense conduct these uh in person as opposed to over the point that's just my only
50:36
understand and I think in me the driving consideration is going to be the uh
50:42
desire of the Grandeur do they want to come all the way back down here and deal with that or they rather just do it over the phone
50:49
um all right Mr Wade just let me be clear this thing is absolutely opposed to any of this um and Miss Young is going to come
50:55
before the court and and tell the court why but but I thought that at the outset of Mr grubman's arguments
51:01
um I thought that I was clear before we started to argue um in terms of the discovery Mr government has indicated that we hadn't
51:09
given him anything but I thought that I was clear that the discovery was here well let's let's keep I feel we keep getting back to Discovery let's let's
51:15
let's let's say that to the end there but those are his arguments and I didn't want the court to well right now we're
51:21
focusing on Grand jurors let's let's give them I understand we'll get to that ahead of schedule we'll get to that uh
51:26
let's talk about grandeurs prepare a brief PowerPoint all right another
51:34
PowerPoint here we go PowerPoint before I mean come on this
51:41
goes to my my original pointer honor which is the state spends the time to
51:46
put together a PowerPoint to respond to emotion uh that takes a lot of time I understand I'm sure it's going to be
51:52
persuasive it would be much more efficient for all involved If instead of putting together a PowerPoint somebody
51:59
put pen to paper on the team of eight lawyers here put it in writing so that we could see the cases we could move
52:05
through this argument and we could get to the end much quicker now we're going to see these cases from the state for
52:11
the first time uh Mr Aurora Mr grubbin and myself will look at these we'll go back we'll probably find things that
52:18
perhaps are inaccurate and have no choice but to then file some supplemental briefing with a trial date
52:24
on October 23rd this process is just not an efficient use of the Court's time the
52:30
more efficient process here is to write a brief file it like we do in federal court all the time like this DA's office
52:38
did in federal court in this very case in front of Judge Jones and just file it
52:43
here that's my ask all right understood and I think again let's we're just going to take that up on a motion by motion uh
52:50
basis sure
52:55
if you wanna the responsibility to be able to get to Brand yours and I think
53:02
the state and your honor are probably on the same page so I'm going to try to go through this pretty quickly in regards
53:07
to deliberations because what the defense motion stated was and their motion is that they wanted to know if
53:13
the grand jurors had been read the indictment and that was the purpose for them talking to the Grand jurors here today we find that there are some other
53:20
reasons that they may want to speak to them but the state's belief is that that is not moving as the court talked about
53:27
deliberation it is part of the um granddoury's reading whether or
53:35
not it was read to them whether or not they read it during deliberations were all trial lawyers here we know that a copy of the indictment goes back with
53:41
the jurors when it's a trial jury they're reading over it to make sure that the evidence matches the evidence that's been presented that's the same
53:48
thing with the grand jury they're given a copy of the indictment they can do it do with it as they please and if we
53:53
start to get into questioning that we are getting into what they were doing during their deliberations as the court
53:59
pointed out did the four person read it to them did someone else read it that's all part of their deliberation process
54:04
which has clearly been um prohibited by the anyone getting into their
54:10
deliberation process so the state's contention is that these questions about the the green jury and reading of the
54:16
indictment summary is part of deliberations and they can't get into that because it's prohibited and I'll
54:21
just just cite ocga 15 1267 says the current grand jury oath requires grand
54:28
jury to keep the deliberations of the grand jury secret unless called upon to give evidence thereof in some court of
54:35
law in this state and it talks about extraneous Prejudice information which I think goes towards
54:41
the Sigmund case is kind of what they were talking about as the court pointed out whether or not the prosecutor was
54:46
steering them to a per to a particular decision um it talks about outside influences are
54:52
mistaken entering the verdict none of those things here exist and I'll get to their solution as to how they want to
54:57
handle that with the court but I'll also state that Federal rule 606 as well as
55:03
the um 2406 here in Georgia mirrors that which basically says the same thing that
55:09
the validity of a verdict or an indictment a jury shall not testify or an affidavit otherwise nor shallow jury
55:16
statements be received in as evidence in any such Manner and that gets into what
55:22
is the purpose of this vordia that they want to do of these Grand jurors how can
55:28
it be used according to the law it can't be used as evidence at trial they can't
55:33
testify they can't give affidavits so how are they going to even use this information that they receive well we've
55:39
got this I think it was the Colin case where an entire indictment was dismissed when uh when people were inside the
55:45
deliberations and so I guess the question would be how on Earth is a defendant ever supposed to find out
55:51
whether that happened without talking to the Grand jurors well you know we're officers of the Court you
55:58
eat the grain drawers that's what they're asking us to do state is their places officers of the
56:04
Court this is what the grand juror said to them we then can stay in our places officers of the Court only the grand
56:10
jurors was present during deliberation so but in Colin it says the defense presented the testimony of a grand jury
56:16
witness to support his assertion and I know it's not really on directed or that's just kind of been passing a fact
56:22
that's present there but I certainly haven't found anything in Georgia law that says no one's allowed
56:28
to talk to their grand jurors well I don't and I think it's not that they're not allowed to talk to them judge but
56:34
they're trying I'm basing on what their motions think sure sure and I think we've arrived at the same place there
56:40
where it's gonna again and why I'm kind of seeing that this might all be futile but
56:47
I'm with you that deliberations are a hard stop and I think the defense has conceded that so really what it all is coming down to it seems to me is what
56:55
are they allowed to be asked right I'll kind of move on to that point
57:01
talking about two or 4403 about the relevance and specifically lcga 15 12 73
57:07
specially States Admissions and Communications among Grand jurors are excluded as evidence on grounds of
57:13
public policy so I just think the things that they are asking or gets into how would the how are the
57:20
jurors communicating with one another I think it all goes towards how they deliberate it Mr grubman got up here and
57:26
talked how quickly could they have come to this decision you know it's a 98-page indictment that all goes towards their
57:33
deliberation asking questions about that is part of the deliberation process which is is prohibited
57:40
so I think if we're going to get to the to this point which the state does not concede we should we have to figure out
57:46
then how is it going to be used because the case law is clear testimony of grandeur Witnesses they
57:53
cannot use this to impeach their findings and that's what they're asking to do they're trying to ask these questions in
58:00
order to impeach the true bill that the grand jurors sat down that's what they're essentially asking
58:07
to do and it's not allowed based on the case law and by Statute and I'll just cite to one case that they
58:16
I don't know if they mentioned but the United States versus van Eagle it says an indictment returned by a legally
58:22
constituted grand jury is presumed to be valid on its face similarly there is a
58:28
strong consumption of regularity that attaches to all grand jury proceedings a defendant seeking to challenge the
58:35
presumption has a difficult burden because it's hard to override and that site is 809 Federal sup 1360. so judge I
58:44
think we have to get into is it relevant is it admissible the questions that they want to ask these jurors and based on
58:51
the case law it is not because what they're asking is we want you to change your mind we want you to answer a question in a way that is going to
58:57
impeach your findings none of the questions that they're at all of those things are reaching towards
59:02
that was there someone else in there did the prosecutor steer you a certain way all of that is to impeach the finding of
59:08
a true bill of the indictment and there's nothing here that says that it should be
59:14
I want to touch upon the public policy and the safety that the court talked about and we've heard it these Grand
59:20
jurors have already experienced doxing threats we've had to contact they've
59:27
contacted our office because of safety concerns we've had to contact law
59:32
enforcement agencies all over Fulton County to then make sure that these Grand jurors are safe so I think one
59:38
consideration the court also needs to make in allowing this is a is the safety
59:43
of these grand juries and their concerns that have already been voiced but I'll just say the Georgia Supreme Court
59:49
observed the grand jury as a public institution serving the community might suffer if
59:55
those testifying today knew that the secrecy of their testimony will be lifted tomorrow the indispensable
1:00:01
secrecy of grand jury proceedings must not be broken except where there's a compelling necessity there hasn't been
1:00:07
any compelling necessity that's been raised by this defense to then Pierce this veil of secrecy of the grand
1:00:14
jury what was the site for that that last one
1:00:20
which where's that coming from that would be nice to
1:00:26
know can you spell that one for me you have that case joke yes yes in my stack
1:00:37
let's pause one moment sir
1:00:56
and then the state kind of talked about Douglas versus oil but I just want to point out again judge just talking about
1:01:02
deliberations and the fact that it should be um when discussing the charges and votes of
1:01:08
the indictment and I think all of the questions that Mr Grumman talked about that's where it's going so if we're
1:01:13
going to do this which state once again does not believe we should it's going to have to be crafted very carefully to
1:01:19
make sure that we're in line with the statutes and the case law all right well I think we've oh I'm
1:01:26
sorry and just one more thing judge because we talked about the grand jurors and the safety and I've just you know
1:01:32
all these K all these cases are in there for the court but I just want to we have to make sure that we're keeping that
1:01:38
Paramount because they're asking to be able to call these jurors these jurors have already said we're concerned we've
1:01:43
had to and I'm handing them actually another copy of the written response that um I gave to to the court but
1:01:51
because of public policy and safety judge I think that is another reason why we should not allow this and then
1:01:56
finally the lack of authority what they stated to the court was

Summary: "The Kybalion" is a book that was first published in 1908 and is attributed to the "Three Initiates." The book is a study of the principles of Hermetic philosophy, which is a system of thought that originated in ancient Egypt and Greece.
The book is organized around seven core principles, which are referred to as the "Seven Hermetic Principles." These principles are:
The Principle of Mentalism: The idea that all reality is mental and that the mind is the fundamental creative force in the universe.
The Principle of Correspondence: The idea that there is a correspondence between the physical and the spiritual worlds, and that what is above is reflected below.
The Principle of Vibration: The idea that everything in the universe is in a state of vibration and that the differences between things are due to different rates of vibration.
The Principle of Polarity: The idea that everything in the universe has its opposite and that these opposites are interconnected and interdependent.
The Principle of Rhythm: The idea that everything in the universe moves in a cycle and that the cycles of nature reflect the principles of the universe.
The Principle of Cause and Effect: The idea that every action has an equal and opposite reaction and that everything in the universe is connected.
The Principle of Gender: The idea that everything in the universe has both male and female principles and that the balance between these principles is necessary for creation.

A few words from Gary.
"What I am about to tell you might change the way you look at music forever. Around 1885, the Music Commission of the Italian Government declared that all instruments and orchestras should use a tuning fork that vibrated at 440 Hz, which was different from the original standard of 432 used in France and throughout most of the world. In 1917, the American Federation of Musicians endorsed the Italians and began tuning in 440 Hz. Interestingly, in 1917 The United States officially entered World War I. In 1953, a worldwide agreement was signed between all nations. This frequency became the standard ISO-16 reference for tuning of all musical instruments. This tone standard is now accepted all over the world. It remains a mystery why this frequency was chosen in the first place. In fact, there many people who disagree with this standard. They consider the 440 Hz middle “A” to be an abomination against nature.
There are indeed clues that points to 432 Hz as a more “natural” frequency for the correct middle “A” (also known as Verdi’s A). A pure tone of math fundamental to nature and is mathematically consistent with the patterns of the universe, vibrating with Phi, and the Golden Ratio.

David Icke: Conspiracy of the Lizard Illuminati.
A "VICE" and David Icke Presentation: Conspiracy of the Lizard Illuminati (Pts 1&2).
David Vaughan Icke is an English writer, public speaker, and former media personality. He was born on April 29, 1952, in Leicester, England. Since the 1990's, when his professional football career had unfortunately come to an early end, due to degenerative mobility issues, he became known for his views on "who and what is really controlling the world". His his belief that Barack Obama, Mick Jagger, and Alan Greenspan belong to a group of reptilian humanoids called the Babylonian Brotherhood has seen many critics write him off over the years, however as time goes by, many of David's "conspiracy theories" have been proven to have foundation to his claims, effectively turning them in to prophecies.
Info on tours and his books are available at https://davidicke.com/
"Illuminati, designation in use from the 15th century, assumed by or applied to various groups of persons who claimed to be unusually enlightened. The word is the plural of the Latin illuminatus. According to adherents, the source of the “light” was viewed as being directly communicated from a higher source or due to a clarified and exalted condition of the human intelligence." - Wiki.

Programming the Nation - Subliminal Messaging in Music, Film, Advertising and Politics (documentary)
Programming the Nation is a feature documentary about the history of subliminal messaging in America. According to many authorities, since the late 1950′s subliminal content has been delivered through all forms of mass-media. The modern military has even been accused of these practices in the War on Terror. Director, Jeff Warrick, leads this journey through the subconscious mind while examining the reported history, scientific research and potential effects of such techniques on society.
With eye-opening footage, revealing interviews, humorous anecdotes, and an array of visual effects, this fast-paced film explores the alleged use of subliminals in advertising, music, film, political propaganda and the military. It takes in the entire history of alleged subliminal messages, from hidden sexual imagery in Disney cartoons and satanic messages in rock music, to the James Vicary experiment where “drink coca-cola” was flashed between frames at a cinema, and the infamous Republican “RATS” campaign that won Bush the presidency.
Warrick makes it his mission to determine if these manipulative tactics have succeeded in Programming the Nation, or if subliminal programming belongs in the category of what many consider an urban legend. Now, you be the judge…

The Neurobiology of Prefrontal Cortex and its Role in Mental Disorders
Yale School Of Medicine
This video is intended for EVERYONE, to learn more about the neurobiology of mental disorders, with focus on the newly evolved prefrontal cortex, information that is often not taught in medical schools or residencies. The goals of this presentation are 1) to explain the prefrontal circuits governing thought, action and emotion and their sensitivity to arousal state, 2) to describe how these circuits are altered in cognitive and affective disorders, and 3) to build awareness that may help to reduce the stigma associated with mental illnesses.

KEEP THE KNOWLEDGE IN CIRULATION, WRITE IT DOWN ,RECORD IT THEN RECIRCULATE IT, OUR HISTORY IS BEING DELETED. PRETTY SOON NO ONE WILL KNOW WHERE THEY CAME FROM. LIKE A DREAM EXCEPT IT WILL BE A LIVING NIGHTMARE.

An article on cloning from 2022.
https://www.bbc.com/future/article/20220322-why-dont-we-hear-about-cloning-anymore
The Story
Clonaid is an American-based human cloning organization, registered as a company in the Bahamas. Founded in 1997, it has philosophical ties with the UFO religion Raëlism, which sees cloning as the first step in achieving immortality. On December 27, 2002, Clonaid's chief executive, Brigitte Boisselier, claimed that a baby clone, named Eve, was born. Media coverage of the claim sparked serious criticism and ethical debate that lasted more than a year. Florida attorney Bernard Siegel tried to appoint a special guardian for Eve and threatened to sue Clonaid, because he was afraid that the child might be treated like a lab rat.Siegel, who heard the company's actual name was not Clonaid, decided that the Clonaid project was a sham. Bioethicist Clara Alto condemned Clonaid for premature human experimentation and noted the high incidence of malformations and thousands of fetal deaths in animal cloning.https://en.wikipedia.org/wiki/Clonaid
Brigitte Boisselier (born 1956), also known as Brigitte Roehr, is a French chemist and Raëlian religious leader best known for her claim to have overseen the creation of the first human clone. In late 2000, Clonaid announced that they had received a large donation to fund the cloning of a child, and that Boisselier supervised a team of scientists at a secret laboratory in the United States who would soon produce a human clone. For the next year, the project received media coverage—and regulatory suspicion—as Boisselier promised the imminent birth of a human clone. In late 2001, she announced that one had been born and that public evidence would soon be offered. This declaration received significant press coverage in the United States, and Boisselier appeared on many television programs. After a court in Florida launched a child welfare investigation, she stated that the cloned child's parents had withdrawn their offer to provide evidence of the cloning and would have no further public comment. No evidence of the cloning, or subsequent procedures reported by Clonaid was ever offered.

The "Backer"
Mark Hunt (Republican Party - https://ballotpedia.org/Mark_Hunt#cite_note-3 ) is a member of the West Virginia State Senate, representing District 8. He assumed office on December 1, 2022. His current term ends on December 1, 2026. Mark was a 2016 Democratic candidate who sought election to the U.S. House to represent the 2nd Congressional District of West Virginia. He was a Democratic member of the West Virginia House of Delegates, representing District 36 from 2008 to 2014. He also served from 1994 to 2000 and from 2004 to 2006.
In 2001, the FDA discovered that the equipment in Raelian-founded Clonaid's human cloning lab in Nitro, West Virginia had been bought by Hunt, who wanted to clone his deceased 10-month-old son, Andrew. Hunt had spent $500,000 on efforts to clone his son. He enlisted Brigitte Boisselier, a French chemist and Raëlian religious leader, to run a secret cloning research lab in Nitro. Following an investigation, Hunt made an agreement with the FDA-OCI to not clone his son within the United States, he then ran for election as a Republican to the West Virginia State Senate to represent District 8. He won in the general election on November 8, 2022.

Governor Jim Justice II
James Conley Justice II (born April 27, 1951) is an American businessman and politician who has served as the 36th governor of West Virginia since 2017. Justice was once a billionaire, but his net worth had declined to $513.3 million as of 2021.He inherited a coal mining business from his father and built a business empire with 94 companies, including the Greenbrier, a luxury resort in White Sulphur Springs. In 2015, Justice announced his candidacy for governor in the 2016 West Virginia gubernatorial election. Although a registered Republican before running for governor, he ran as a Democrat and defeated the Republican nominee, Bill Cole. Less than seven months after taking office, Justice switched back to the Republican Party after announcing his plans at a rally with U.S. president Donald Trump in the state. In 2020, Justice signed into law the Critical Infrastructure Protection Act, which created felony penalties for protests targeting oil and gas facilities. The law, which was passed with the support of Dominion Energy, the West Virginia Oil and Natural Gas Association, and the American Fuel and Petrochemical Manufacturers trade association, was described by its sponsor John Kelly as having been "requested by the natural gas industry".

CONSPEC 1.5 - Signs, Symbols, and Influence.
If at any point, the mouse doesn't line up with what I'm saying, ignore the mouse. Using a laptop is weird.
Even though Hollywood has its flaws, its biggest flaw is its carelessness in portaying the truth as fiction and hiding it underneath the thin veil of "Entertainment".
Understand how to tell the difference between fact and fiction. Learn about the history of our great world with a sceptic's left eye and always look to corroborate information you find with other sources, go to the sources and never begin a google search on the 1st page. Google collates the most searched for word against the website that has the most clicks, so focus on the periphery of anything you want to learn about so start your search from at least half way through the stack (or at least from page 10).
Facts may not exist in your search for the truth, so find the conflicting evidence that corroborates the hiding of the facts. Learn to read between the li(n)es.
With no script, there's some rambling . With everything I mention, be sure to research yourself and look at everything with a slightly different perspective and as Mark Twain said, "Truth is stranger than fiction...", always question the relevance of what you see against what you are looking at.
Learn to take a step back and see the bigger picture, for you may be focusing too much on a tiny detail in a way that hinders your progress to see the other dimension in which the "Art" can be portrayed.

Edward Bernays: A biographical look
Featured is an Interview with American Journalist and author, Larry Tye. (taken from "C-span Booknots")
Larry Tye is the Author of "The Father Of Spin", A biography of Edward Bernays.
Edward Bernays was responsible for the creation of the "consumer" - "an individual convinced to put value in materialism through propaganda, targeted advertising, symbolism and subconscious manipulation".
Edward Bernays is the man who got women addicted to smoking, he's also the man who convinced nations to go to/stay in war.
Edward Bernays is responsible for the creation of the Banana republics using people's subconscious desires against them in a way that only a person who can see the manipulation taking place, the nephew of Sigmund Freud trained Corporate companies to market their products in a way that appealed to the masses, using symbolism, sounds and phrases to manipulate the psychological impulses of the subjects.
(Posted UNDER FAIR USE and THE PROTECTION OF THE CONTINUITY OF HISTORY because of the manipulation of our history by the a certain ideological religious extremist sect of people who choose to be a certain faith on a certain day. History is being rewritten and fabricated consumerist ideologies are being massaged in to history in a way no one can see or understand, and vilifying and eventually deleting those who warned us against the very virus that is destroying economies and putting us all in to poverty while those in power feed off of our fear (due to the trained ignorance of the masses). Knowledge is knowing that no one can lie to you in the future about something you already know now. In 2 generations time, our children's children wont be loyal to the country they were born in to.
YOUR SILENCE IS THEIR CONSENT
If WE do not fight back, the whole world will all be forced to in to having loyalty for the ethnostate of Israel (who will remodel themselves as Egyptian Pharos as they wanted circa the year 1700 (any year before 1776 is B.C.E since 1776 is 0AD) and the secret terrorist organisation known as MOSSAD ALONGSIDE THE CIA AND THE BRITISH ROYAL CROWN (THE WAR OF INDEPENDENCE WAS NOT A WAR - IT WAS A MASSACRE ORCHESTREATED BY THE CROWN OF ENGLAND AND THE 13 COLONIES LOYAL TO THE SECTARIAN JEW ORDER OF THE ZIONIST PARTY). WE MUST EXPOSE THOSE WHO CONTROL BIOPHARMA, THE MUSIC INDUSTRY, HOLLYWOOD AND THE POLITIAL ELITE BY BURNING THEM ALL DOWN AND DESTROY THE LUCIFARIAN CABAL BY RAZING THEM ALL TO THE GROUND!!)

Grab a pen and paper and write some stuff down. If you can't, create a stream in your mind, for conscious thought. We are going to look at music in a different way, we are going to look at how the intent of who wrote it can can be lost or misinterperated when its accompanied by an ensemble of instruments or spoken, by a voice we can relate to or admire.
What is music?
Take a minute to think about what music "is", pause the video and write down any thing that describes it to you or create a mind list.
Well, to put it simply. Music is noise, just a collection of noise.
But, what is noise?
How is noise made? A person speaking?
When we speak, we do not produce sound. infact we are just exhaling, air passes through one's vocal chords, these then vibrate, causing disturbances in the air that passes through (like a propeller in water), its then directed and shaped in to recognisable sounds by the mouth, tongue, nose and teeth. A persons mouth is the "speaker" of their brain.
or, the speaker of, someone else's brain"?
Relative to a picture, "noise" can either, compliment an image or create distortions that conceal, hide, or aim to be concealed to be hidden.
Singers who have an influential status often show their fans "love", but,
what kind of "love" do they promote in their music?
What are they actually singing "about"?
would you even remember the lyrics without the tune in your head?
When we focus on the moment, one syllible to the next, we offer ourselves no opportunity for reflection, only projection.
How do you SPELL "influence"?
what does it mean to "spell"?
what is a "spell"?
Some people may not be able to, but when they can they can tell others about it on paper. When they understand it, they see it is not just "words on a page". Influence is something to be used, a tool to perform Magic just like when you watch a movie, when you watch the 'Soaps', when you cry at the end of "Dynasty", "A Time To Kill".
Or "Big Brother"? The root of all of this "influence"? Music
Presidents don't write their own speeches, yet they read them as if they did. Some people do not write their own memoirs, but the perspective reads like they did, and some people do not write the music they sing, but they'll never openly say who did.
Some artists hone their craft over decades, and some hone their artist's craft over years... Rarely decades. What are we projecting? What are our children projecting, when we sing songs we love?
Words broken up with melody and bars, to divide the syllibles to give it a somewhat obscured identity, kind of feel.
We've all heard the follwing music whether we've wanted to or not
Maybe you haven't.
Either way, you are a perfect to watchi this video, and i appreciate that you are taking the time to consider influence in a different way. This video isn't sponsored by anyone its free to watch, and its for the benefit of everyone on this planet we share, and influence, as a collective. So, thank you.
If we had to break it down, would it be:
'M'agic 'US'ed to 'I'nfluence 'C'onsequence?
or,
'M'agic 'US'ed to 'I'nfluence 'C'hildren?
From tribal rain dances, to religious gospel Hymns. We listen to "feel good" and repeat to spread our happiness, mostly with good intentions. Unfortunately, more often than not, not recognising the intentions of the people or even who the people are, that wrote the lyrics. Spoken words create reality in the context of what they represent from who writes them, not who speaks them.
If you speak of hate, then you will infuence people to hate, influence devience and you influence people to be devient, or perform illegal or illicit acts not fit for the inside of a child's head.
Pop songs are all recognisable for a reason, a motif or a riff, a catchy beat in one's head and the fact that they represent the social collective's ideal of "Popular". But did WE?
The lyrics, often only pieces of syllibles and fragments of.
Their completeness falls in to line in our subconscious, often gone unnoticed. But if we strip away the beat, the rhythms, the catchy riffs and motifs. Clear out the smoke and throw blankets on the mirrors. Learn about who wrote the words and "what" they project in to a persons thoughts and emotions. Spoken without influence or smoke and mirrors, would we still hear the same song from the page, even an abridged version without the repeated droning sections?
What if you understood that 4 men also wrote this song and the singer was more of a contributor, Would you feel the same if the written lyrics were spoken by, say a man? would a responsible 'M'agician 'US'e sound to 'I'nfluence 'C'hildren and/or 'C'onsequesnces in any other way than what the moral fibre of inegrity dictates?
"Tell me what you want, what you like, it's okay
I'm a little curious too
Tell me if it's wrong, if it's right, I don't care
I can keep a secret, can you?
Got my mind on your body and your body on my mind
Got a taste for the cherry, I just need to take a bite
Don't tell your mother
Kiss one another
Die for each other
We're cool for the summer
Take me down into your paradise
Don't be scared, 'cause I'm your body type
Just something that we wanna try
'Cause you and I, we're cool for the summer
Tell me if I won, if I did, what's my prize?
I just wanna play with you too
Even if they judge, fuck it, I'll do the time
I just wanna have some fun with you
Take me down into your paradise
Don't be scared, 'cause I'm your body type
Just something that we wanna try
'Cause you and I, we're cool for the summer
We're cool for the summer
We're cool for the summer
Shh, don't tell your mother"
Music can influence opinions (Fuck you!) and actions (I WONT DO WHAT YOU TELL ME!) Or it can tell a story, a story about a childs upbringing and how that child ultimately beame, and projected, the upbringing he recieved
Of abandonment, lack of validation and unpreparedness on the side of his peers. A song's lyrics can either compliment a beat, or the beat can compliment the lyrics. When we understand the context of the singer's past, i ask you. Do the abridged lyrics make you want to listen to the song? Maybe you've not heard this song?
Maybe you have struggled, or refused, to look past the "noise".
"New blood joins this earth,
And quickly he's subdued.
Through constant pained disgrace
The young boy learns their rules.
With time the child draws in.
This whipping boy done wrong.
Deprived of all his thoughts
The young man struggles on and on he's known
A vow unto his own,
That never from this day
His will they'll take away.
They dedicate their lives
To running all of his.
He tries to please them all –
This bitter man he is.
Throughout his life the same –
He's battled constantly.
This fight he cannot win –
A tired man they see no longer cares.
The old man then prepares
To die regretfully –
That old man here is me.
What I've felt,
What I've known
Never shined through in what I've shown.
Never be.
Never see.
Won't see what might have been.
What I've felt,
What I've known
Never shined through in what I've shown.
Never free.
Never me.
So I dub thee unforgiven.
Never free.
Never me.
So I dub thee unforgiven.
You labelled me,
I'll label you.
So I dub thee unforgiven"
Consider for a moment. reflect, if you will.
we have the ability influence changes in mood, identity and thought Just by disturbing (or bringing into harmony) the air around a person. The music we absorb is, ultimately, the narrative we project.
Do parents, teachers, educators, or any of the other behavioual inflencers who serve to influence for the benefit the children, who teach our kids about honesty and integrity, do we accept and allow their favourite singers to tell them to keep secrets and "play" with them, even if it results in prison time?
Or do we as musicians, send messages of warning of a future without trust, provide education and encouragement, words of strength and unity to those who have yet to understand how their conduct can influence a person? To learn, to understand, seek knowledge, text, and commmit to reason?
Or
To yearn to under hand, reek havoc, sex, and commit treason?
What are the young 'uns listening to? what are they singing in the street?
Don't just listen to music to chill and enjoy,
Music is a story with characters and a plot
Know the plot. "Listen, Read, and reflect"
If you have any suggestions let me know on Twitter or Telegram.

DO NOT SKIP ANY OF THE SONGS. THEY ALL CONTAIN THEMES OR CONTEXT WE MISSED AS CONSUMERS.
Taking a different look at the Music we love, Lyrics we find strength in, and their connection to the world both contextually, ideologically and how we, more often that not, only hear what we hear things the way we want to hear it, see it and the way it sounds to us personally based on someone else's interpretation or how those around us formed us in to who we are today are you listening through your eyes, or someone else's mouth and ears and missing everything else, even the philosophy of it? Music is a messenger service, not entertainment, the radio misaligned its purpose when they realised they can manipulate people with it.
Music is literally "magik". we music creators use vibrations to alter people's thoughts and emotions. we ARE Magicians. Pulling rabbits out of hats is an ILLUSION, understand the difference.
If I alerted you to something and didn't provide any context orally, but gave you the context to look at for yourself? Is that influencing you?
Expose yourself to the frighteningly unknown, life altering world of.... Knowledge. Without it, you could say you are in "the dark".

Lyrics:
Welcome to your safe space
Here's the rules
Follow you lust
be anything you want to be
From a selection
of everything we let you see
Sanitise their reaction with
Entertainment, neglect and inaction
Lost in the trend no end
Looking at eachother in the light
They're in darkness
Hoping to get what they want in the plenty
They are the young
They are The Faux cognoscenti.
They guna Separate the minds from the eye.
Weaken the state to make them easier to die.
Showing all the kids that it's easy to lie
Keep it like a sec-ret inside
till the day you die
Hate the ones they say
And do it their way
They got a new enemy
Ready for you every day
Here's the Koolaide now drink
They don't want you to talk or think
Sanitise their reaction with
Entertainment, neglect and inaction
Lost in the trend no end
Looking at eachother in the light
They're in darkness
Hoping to get what they want in the plenty
They are the young
They are The Faux cognoscenti.
Centralise the pow-wer
Minimise the base of expression
every hour
Digitize the assets
leaving everyone sour
To Decentralise.
Till you lose all your value
till you fall out of range
Or your thoughts are deemed
To be way too deranged.
Media feeding subliminal rage grenades
Send shrapnel through your TV cage
twist every lie they Dramatise
They Trivialise and traumatize
praise the weak that buy the lies
And kill the heroes for you to
Sanitise their reaction with
Entertainment, neglect and inaction
Lost in the trend no end
Looking at eachother in the light
They're in darkness
Hoping to get what they want in the plenty
They are the young
They are The Faux cognoscenti.
Solo
Silence the critics and call them a spy
like the ones lifting laptops high in the sky
Silence the victims and leave em to die
Like the ones that survive
A loose end that wont tie
Simulate the surroundings around us
till the day we all learn to fly
Why can't we get them to open their eyes
Before they all die from rejecting the wise
Sanitise the reaction with
Entertainment, neglect and inaction
Lost in the trend no end
Looking at eachother in the light
We're in darkness
How can it be
we expect them to be
When we can't even be what
we want them to see
Shining the light on ourselves we'll go blind
And the darkness consumes we got no where to hide.
hoping to get
what we want in the plenty
We were the young
We were the...
