Corrupt Election Ballot Case at Supreme Court
Justice Elena Kagan directed the Nevada Democrat Party to file a response brief to the emergency application we filed last week. Ironically, the Democrat Party claims to be the party of choices and freedom, but it has unconstitutionally denied Nevada voters the right to vote for their preferred candidate. It also waited until the last day possible to initially file its lawsuit, strategically giving less time for the Green Party to defend itself.
In its response brief, the Nevada Democrat Party claims that it’s too late to put the Green Party back on the ballot because there’s not enough time to reprint the ballots. This is 2024 – if the state needs to print new ballots, it can do so. It’s a ridiculous argument.

SHOCKING: Secret Service Funding For Donald Trump Stalled
After the foiled second assassination attempt on President Donald Trump’s life at a golf course in West Palm Beach, Florida, the Biden-Harris Administration is finally taking action by seeking additional congressional funding for the U.S. Secret Service. President Biden said yesterday, “The service needs more help. . . . Congress should respond to their needs.” However, the White House Office of Management and Budget initially requested more protection, labeled an “anomaly request,” in August.
Amid the initial request was the shocking admission that if the Secret Service didn’t increase protection quickly, “the Secret Service would have insufficient resources to sustain and enhance protective operations.” Well, we saw what happened when President Trump didn’t have sufficient protection around the perimeter of the golf course in Florida.
So last month the White House had admitted that the Secret Service protection wasn’t ramped up enough in the days leading up to the second assassination attempt. This raises all sorts of questions as to why not. Even far-Left Members of Congress are raising concerns, such as Representative Ro Khanna (CA-17), who wrote an op-ed in the Washington Post demanding that Congress provide adequate protection for Trump, “whatever the cost.”
Why is only money preventing proper Secret Service protection? Knowing the danger that Trump faced first in Butler, Pennsylvania, and just recently in West Palm Beach, Florida, why can’t Congress allocate resources to shore up protection for the leading GOP presidential candidate? Unfortunately, I don’t think dollars alone will fix the issues within the Secret Service.
Unlike the mass security failures in Butler, the Secret Service did its job protecting President Trump on the golf course. The agents identified the gun barrel before it fired. At the same time, if Trump had the proper protection, no one would have been able to get in his vicinity.
Supposedly, Congress is mired in passing a spending bill for an October 1 deadline to avoid a government shutdown. But that’s no excuse for why Congress can’t get a standalone bill to fund the Secret Service. In recent days we’ve seen Congress move quickly to pass emergency funding for Ukraine and Israel. The government loves to spend money, so priority should be given to protecting President Trump.
Back in July, the ACLJ filed a Freedom of Information Act (FOIA) request into the Secret Service’s failures on the day President Trump was shot at the Butler rally. After what happened at the Florida golf course, Americans deserve answers. Sign our petition to demand answers for the Secret Service failures and for President Trump to receive the needed protection.
Speaking of addressing other government agency failures, the ACLJ filed a FOIA request back in January over Deep State targeting of conservatives. House Judiciary Committee Chair Jim Jordan had exposed the FBI for targeting conservatives’ bank statements that had purchases labeled “MAGA” or “Trump” or came from stores like the Bass Pro Shop. The FBI even went so far as to screen Bible purchases. All of these actions were unconstitutional attacks on liberty.
We just received a partial victory yesterday regarding this FOIA. ACLJ Senior Counsel CeCe Heil elaborated:
"When we sent out our FOIA, it was because the House of Representatives Judiciary Committee had come across an actual report . . . titled “Domestic Violent Extremists Emboldened in Aftermath of Capitol Breach.” And that report was shared with these financial institutions for the purpose of alerting private sector partners of the January 6 violent breach by suspected domestic violent extremists in the U.S. Capitol building. And it would serve as a driver for a diverse set of what they call “the domestic violence extremists.” . . . We wanted to see that report, and we got denied. Now you have to go through an administrative appeal. . . . [We] did get a response back from the Administrative Appeals Department, saying that they have looked at our appeal, and they’re actually remanding our request to the FBI for a further search for responsive records to that specific report."
Effectively, the FBI tried to stonewall the ACLJ over our FOIA. In similar instances, we usually have to go to court to procure the requested documents. But here we were able to get this pivotal document that exposed the Deep State’s targeting of conservatives without fighting in court.

Trump Shooter Is NOT a Stranger - “Well Known”
We were very close to discussing a national tragedy yet again. The U.S. Secret Service spotted a gun and opened fire at a golf course in West Palm Beach, Florida, preventing an apparent second assassination attempt on President Donald Trump’s life. The suspected gunman, Ryan Wesley Routh, fled before being eventually apprehended almost 50 miles away.
The alleged assassin had chosen a place on the edge of the golf course. He placed body armor plates on the fence, had an “AK-47 style rifle with a scope” attached, and a GoPro filming the entire operation. Secret Service agents noticed the gun barrel sticking out of the fence and opened fire, scaring the gunman off.
Routh has been arraigned and charged with possession of a firearm by a convicted felon and a firearm with an obliterated serial number. So far, no charges for an assassination attempt have been filed, but charges can be amended later as more information comes out.

MASSIVE UPDATE in Trump’s Fani Willis Case in Georgia
Two important events just took place in Georgia regarding the Deep State DOJ’s political prosecution of President Donald Trump. First, Fulton County District Attorney Fani Willis just defied the subpoena to appear before the state Senate committee regarding her alleged affair with former Special Prosecutor Nathan Wade. Such a refusal to appear in court shows that Willis believes she is above the law.
Second, Georgia judge Scott McAfee dismissed two counts against Trump in DA Willis’ Georgia election interference case. Remember that DA Willis’ indictment against Trump is a state case, so it has different ramifications than Special Counsel Jack Smith’s federal election interference case against Trump.
Let’s recap how we got here. After a wild few days in court, Judge Scott McAfee ruled that Willis’ standing as DA was tainted, citing an “odor of mendacity” – lying – permeated her disqualification hearing. However, the judge gave Willis the option to step down as DA or remove Special Prosecutor Wade. Unsurprisingly, she decided to remain on the case against Trump.
Following this, President Trump appealed to the Georgia Court of Appeals to have DA Willis removed based on her illicit conduct. The ACLJ became involved at this point, filing an amicus brief to disqualify Willis from her tainted political prosecution of Trump. The Georgia Court of Appeals delayed Willis’ election interference case until a ruling was made in Trump’s appeal, which will take place after the election.
So the Georgia judge’s actions today mean that Willis’ case against Trump got weaker, as two charges were dropped based on false documents allegedly being filed in federal court. We’ll see how it affects Willis’ case going forward.
In other election news, the ACLJ has a brand-new case headed to the U.S. Supreme Court, where we just made an emergency filing on behalf of the Green Party. The Democrat Party unconstitutionally had the Green Party removed from the 2024 presidential election ballot in Nevada to ensure that more votes are cast for Vice President Kamala Harris. We’re urging the high Court to intervene and prevent Nevada from printing more ballots without all the qualified candidates’ names until the Court has the opportunity to fully hear and ultimately decide the case.
As you remember, the ACLJ secured a 9-0 victory at the U.S. Supreme Court after the Colorado Supreme Court banned President Trump from the state ballot. We represented the Colorado Republican Party to ensure that all Americans have the right to vote for the candidate of their choice. And we will now be fighting to ensure that all voters in Nevada can vote for the candidate of their choice despite the blatant attempts at election interference.
My dad, ACLJ Chief Counsel Jay Sekulow, joined the broadcast to expound on our new client. Some might be surprised that we are representing the Green Party. However, the ACLJ has a history of representing the constitutional rights of clients on both sides of the aisle.

Uproar Following Trump Fact-Checked Debate
Everyone witnessed a very unfair fight last night on the presidential debate stage. President Donald Trump debated not only Vice President Kamala Harris but also ABC News moderators David Muir and Linsey Davis. The moderators fact-checked Trump multiple times and failed to fact-check VP Harris once, which rightly outraged many conservatives.
President Trump fired back after the debate, calling it “rigged” and “three-to-one.” He also asserted it was his “best debate ever.” On the other hand, the mainstream media largely praised Harris’ performance.
I’ll be honest: I knew President Trump had no chance of winning the debate last night after I saw how the moderators were asking loaded questions that started with negative statements. For instance, one ridiculous exchange included Muir arguing with Trump about whether or not the former President was being sarcastic when he said he lost the 2020 presidential election “by a whisker.”
But then the moderators asked Harris simple questions – which she often didn’t answer – without any pushback. Instead of challenging the Vice President on the clear flip-flopping she’s guilty of on topics like banning fracking and supporting Trump’s border wall, the moderators were silent. Because of this, Harris emerged with one of her best debate performances.
VP Harris wants another debate in October. It’s odd because if you believe you destroyed your opponent right out of the gate, you aren’t typically the first to push for a second debate. However, since she learned how to get under Trump’s skin easily and have moderators backing her, another debate would be worthwhile for her campaign.
Now I don’t think Trump did as bad as the media is saying. Yes, he had some difficult moments, especially regarding health care. Obamacare has been a weak spot for Republicans for years now, and the party has failed to come up with a proper replacement. And I have to say I felt he was way too vague in his response. But I don’t think that this debate actually changed the race that much.
The economy was an important topic last night – if not the top issue of the debate. VP Harris promised to give small business owners a $50,000 tax credit. ACLJ Senior Counsel and Director of Policy Harry Hutchison reacted to Harris’ economic proposal:
"Kamala Harris knows virtually nothing about economics or the economy. And last night, she proved that by focusing on tax credits. . . . So 50% of all small businesses in the United States fail in the first five years – none of those businesses would be eligible for Kamala Harris’ tax credit. [And] 20% of small businesses fail in the first year alone. So I think if you really drill down, you will find that most small businesses would not be eligible for the Kamala Harris tax credit. . . . Her proposal will do virtually nothing to jump-start the economy."
Unfortunately, Harris offered mostly platitudes about the economy, which do nothing to expand small businesses. And if her economic policies will reduce inflation and create jobs, why hasn’t she worked with President Biden to implement economic policies for the last 3.5 years?
Another key discussion last night involved abortion. Trump pointed out how the far Left is in favor of aborting babies up through the ninth month and that some like the former Governor of Virginia have even condoned infanticide. The moderators and VP Harris claimed that Trump was lying.
However, seven states have zero restrictions on the gestational age of a baby to be aborted, meaning abortion is legal up until the moment a child is born. Minnesota, from which Harris’ running mate Gov. Tim Walz hails, is one such state, and he signed legislation saying the state can’t interfere with abortion. The ACLJ has fought against legalizing infanticide in the perinatal stage, which is up to 28 days after birth.
Unfortunately, the ABC News moderators didn’t do their homework when it came to the topic of abortion. They allowed Harris to lie about the far Left’s radical positions on killing the unborn.
At the end of the day, I don’t think the debate will affect the outcome of the election. Trump was his typical self, and he had a strong closing argument asking why Harris hadn’t done anything for the last 3.5 years to improve the country. We didn’t really learn anything new from VP Harris. Almost every word she spoke last night was memorized, and she didn’t receive any pushback from the moderators, so she didn’t have to expound on her policies or record.
