Update:
Talked with John, a ranger for the Gunnison national Forrest out there. He said that is a disputed spot. So yes we would be legal if the gate was open but he said the guy keeps it locked. They are weighing the cost of a legal battle with him or making a go around that would run NEXT to his property. Obviously various issues cost money. It is the Rangers belief that this is a guy that moved here so not an original homesteader that is 5th generation or something it's a yahoo that bought land and then up went the gate across a public access point.

Sadly people know it's a battle and thus it's how it happens. So for now it's on the MVUM so if the gate is open the guy has no real recourse as you point to the MVUM is the the law of the USFS. The ranger also said there are various mining claims back there too...so can this guy keep people from their claims, NO. We all have the right to access our public lands and or property.

If you come across such issues don't just shrug it off, report it so it can be dealt with ASAP and the more people that report the USFS might feel a need to fight the issue.
