DA Steve Crump fumbles prosecution, 27 charges of child neglet dropped

Due to a flaw in the prosecution, a judge was forced to dismiss charges against a daycare worker who left 27 children alone in a fire.

On February 10th 2022 the Little Lambs Day Care in Cleveland, TN caught fire. When emergency responders arrived they found that the day care workers neglected to evacuate the children due to it being their "Nap Time".

Upon questioning, Day Care worker, James Carpenter admitted to having drank multiple shots of liquor and cans of beer that morning. Carpenter was arrested on 27 charges of child neglect and intoxication.

The state's prosecution attempt to argue that Carpenter was guilty under the Title 39 Child Abuse and Child Neglect or Endangerment statute:

"A parent or custodian of a child eight (8) years of age or less commits child endangerment who knowingly exposes such child to or knowingly fails to protect such child from abuse or neglect resulting in physical injury or imminent danger to the child. "

However, that statute also clearly states that:

" 'Parent or custodian' means the biological or adoptive parent or any person who has legal custody of the child. "

Judge Randolph was forced to dismiss the 27 charges of child neglect. Now, the prosecution must turn to the grand jury in an attempt to clean up the mess our District Attorney office has left us.
