Sam: Let's turn to KBJ just for a moment. This is Joe Biden's nominee. not the one that was chosen to placate Lindsey Graham and Clyburn for that matter. I suspect that is a function of unions feeling like we know a big the unions must have had a big part of that. I suspect labor in terms of Childs. and also just KBJ is just a much easier pick it seems to me. She's already been approved by the senate. but what's your perspective on this pick and the implications of it.
Guest: So I think she was always the pick. and in some ways that she was like 85 of the way there. Clyburn sort of what we do. Clyburn is our guy. I think there was a little confusion that he caused. but I don't think that I think it was always trying to move them from their preferred pick. so I think that is where they landed. and I think she's got the right. I think the labor staff did the American prospect reporting and did sort of weaken Childs further. but I still think Jackson had the resume and was the person they were sort of always starting on. in some ways they could have in the same way Barrett was picked and everybody knew it. they could have announced Jackson in a week is my guess and I'm not sure I think climber may have drawn up the process would actually probably happen. and my view on the pick is I wrote a piece that was you know it was a little mean probably but basically saying Breyer had a great a pretty good record in my view. but the last year where he spent basically saying the court is nonpartisan. How dare you see that saying the court is partisan was sort of shameful and like what was the point. and sort of really disappointing. and seemed he sounded you know Biden's worst days when he's doing the mitch McConnell's my friend I love the republicans and look how bipartisan I am. it was like but Breyer spent like a year doing that. you know whatever you like I support adding judges to the supreme court or court-packing whatever you call it very reluctantly. I think it's a good idea. I just think a court with Amy Coney Barrett Kavanaugh Alito and others is anti-democratic anti-voting rights and so on. and if Breyer can't understand that or is so focused on pleasing his colleagues. that he can't like he spent a year attacking progressives for honestly discussing how the court works. I found it outrageous.
