Will an employee be at fault if his spouse receives gifts from an employer’s service provider?

The duty to abide by the rules set out in an employers Code of Ethics is no trivial matter. Mr Schwartz, an engineering manager, in the employ of Sasol, learned this lesson the hard way. Will an employee be at fault if his spouse receives gifts from an employer’s service provider? Will the answer to this question be any different if the employee is estranged from his spouse? These questions were answered by the Labour Appeal Court in the 2015 judgement of Schwartz v Sasol Polymers and Others.
