Senate Confirmation Vote for Nominee "Dale E. Ho"

On Thursday, January 20, 2022, three prominent U.S. Senators on the Senate Judiciary Committee urged Democrats to vote against confirming one of Joe Biden's nominees to a federal circuit court named Dale Ho.

During Mr. Ho's hearing, Senator Mike Lee questioned Mr. Ho regarding a term that Mr. Ho had used in some online activity on social media. Mr. Ho had used the term "Senate Malapportionment" implying that he doesn't agree with how the US Senate is structured or how it operates, but it also happens to be the one thing in the Constitution that is expressly forbidden from being changed without the consent of the states. As Senator Lee points out, no states are going to opt to change it, or at least it is very unlikely at best.

The roll call vote for confirming Mr. Ho to the federal court ends up 11-11 tie. He is therefore not confirmed after this vote. It proceeds to the Secretary of the Senate where I believe it will end up being a "No" on confirmation, but I could be mistaken on that part.
