The Supreme Court of South Carolina affirmed on Wednesday the criminal conviction of former Greenville County Sheriff Will Lewis, therefore denying his appeal.

Lewis had appealed his conviction after he was found guilty of one count of misconduct of a public officer in October 2019. He was found not guilty of common law misconduct in office. He was indicted on a dozen other charges alleging additional aspects of misconduct in office, obstruction of justice, perjury and misconduct of a public officer but those charges were later dismissed.

After his conviction, Lewis' attorney, Rauch Wise, argued that the criminal charge of misconduct in office in Lewis' case was "overly broad" and vague. He argued that the state failed to explicitly show how Lewis violated this statute.

Lewis' former assistant, Savanah Nabors, claimed he sexually harassed and assaulted her during a business trip to Charlotte, North Carolina, in March 2017. She sued and was ultimately awarded a settlement of nearly $200,000. Lewis had admitted to a consensual sexual encounter, but denied all allegations of an assault.

In the Supreme Court opinion published Wednesday, the allegations were detailed in a typed summary, first describing the treatment and perks of Nabors while working at the Sheriff's Office and later outlining the alleged incidents in Charlotte.

"While the exact details of the events were disputed at trial, both Lewis and Nabors stated a sexual encounter occurred once the two arrived back at the hotel later that first night," the Supreme Court opinion states. "According to Nabors, Lewis sat next to her on a couch, placed his arm around her, and tried to kiss her. The next thing she remembered was waking up in bed with Lewis on top of her engaging in sexual intercourse."

Lewis was initially criminally charged with misconduct in office and obstruction of justice in February 2019. He was suspended from office during a state investigation into Nabors' allegations.
