YOUR BUSINESS CANNOT BE FORCED BY ERIE COUNTY TO HAVE YOUR EMPLOYEES OR CUSTMERS WEAR MASKS

Erie County Department of Health officials cannot force you or your business to enforce wearing masks for your employees or customers.

We have several leaders in our business community who have contacted the Erie County Department of Health that have confirmed this verbally and in writing. Erie County Department of Health officials have also confirmed that they have no authority to fine your business if you people are not wearing masks inside your establishment.

Additionally, Department of Health officials have confirmed they have no right at all to enter into your establishment if you do not have a certificate from the health department.

Local law enforcement is no longer accompanying Department of Health Officials because they no there are no laws on the books they can enforce. This further illustrates the fact that the County DOH has no authority over your business.

If a Department of Health official enters onto your premises, they are Criminally Trespassing on your property and should be told to leave right away. Get their names and report them to local law enforcement right away. Next time they enter into your facility, contact local authorities and have these officials arrested.

Local law enforcement knows that with recent law changes, they are all personally responsible and liable for the job of enforcement they do. If they do something wrong, they can lose their job, be fined, sued and have criminal charges filed against them. The same exact rules apply to all public officials.

If you are fined, record everything. And do not pay the fine. It is not enforceable, and every fine the county did issue that was challenged in court, was reversed.
